midnight. the chp says the hit and run driver swerve over the line and then smashed head on into the victims pickup truck. one witness said he walked up with the victims car with the hit and run driver. the chp says the hit and run driver left his pickup truck at the scene. at this point investigators only have a vague description of that hit and run driver. he's described as white in his 40s about six feet tall. >> homeless man is in jail accused of setting fire at a vacant apartment billing. that started shortly after noon yesterday. ktvu news got this exclusive video of the arrest of the arson suspect several hours later. 32-year-old michael moss is taken into custody steps away from the building he is accused of burning. neighbors say moss was one of many squatters that was living in the foreclosed apartments.

>> they are all on drugs. they all kept going over there. this is baa for them. >> investigators won't say why the arson suspect would burn himself out of his own temporary home. firefighters in san jose are searching far suspect that deliberately set fire at a san jose high school. that fire on independence high school started at 6:45 last night. firefighters say a side door on a feeder building at the school was set on fire. the fire melted a plexus glass window and damaged siding on the building. police in hayward are investigating a house fire that caused extensive damage last night. firefighters confirm the home on bay view avenue near kelly street was an active crime scene bawdy not say -- but did not say why. neighbors smelled smoke at 5:30

last night. no one was inside the house and no one was hurt. people in the mid atlantic are bracing for more severe weather as they continue to cleanup from violent storms on friday. the death toll has risen to 17 and nearly two million people are without power in sweltering conditions. it's expected to be a difficult morning commute with stoplights still not working. friday's storm took down trees and snapped power lines. >> the tree that was lying on the wires actually snapped under the tension and blew up a huge hole in my yard. pretty scary. my whole yard caught on fire. >> today severe thunderstorm watch is in effect for much of virginia, west virginia, and south eastern kentucky. this morning police are investigating after a person was found shot to death in a car near the oakland hills. police town the shooting victim after 6:00 last night on sunkist drive in oakland.

the victim had been shot at least once. the sonoma county sheriffs department is investigating a possible hate crime in guerneville. a 49-year-old man told deputies he was attacked after leaving a gay bar on third street. some unknown individuals attacked him and at least one of them used antigay threats and threats. the man suffered cuts and abrasions. closing arguments are scheduled today in the trial of william lynch. lynch is accused of beating the priest he says abused him as a child. he cried on friday while testifying about his 2010 confrontation with the now retired priest jerald litany. he did not intend to hit him but when he leered at him he recalls the alleged abuse and hit him. pg&e has a new plan it says

thing is moving well. it should be a drive without any major understand accidents. also this morning we are looking at the traffic here on the bay bridge approach. it is a very nice drive with no major problems coming into the city and no trouble on the bridge. northbound 101 on san antonio avenue off ramp on the peninsula there is a minor accident on the off ramp causing problems but on the freeway traffic is still moving well. southbound 101 traffic looks good. 4:36 let's go to steve. >> sal, thank you. we do have low clouds. not much of a pattern change. low clouds there cannot be i don't think as strong as yesterday. it made it well inland. west, southwest though 1 at -- 17 at fair feel. upper 50s for some. it's a mild air mass. san jose at mountain view.

>> the waldo canyon fire is 45% contained now but destroyed almost 350 homes. three east contra costa county fire stations are out of business. the fire stations one in brentwood, knightsen and bethel island closed because of budget cuts to the district. last ditch effort to save the fire department failed when voters rejected measure f. because it failed the district was forced to cut $3 million from its budget closing the stations and laying off 15 firefighters. fully voted yes for -- >> i voted yes for s. most of all everything else we can deal with. the district fire chief says these three closures will effect response times in emergency situations. the district is also considering hiring 50 volunteer

the cause of this house fire in martinez is under investigation this morning. two alarm fire started at is a home on trinity place at 11:00 saturday night. firefighters first thought there was someone inside the home but later discovered that person was able to get out. no one else was hurt. san jose police have identified a man found fatally stabbed in a parking lot saturday night. he was pronounced dead at the scene. police are still investigating but it doesn't appear to be gang related. the man convicted of

murdering a san francisco father and two of his sons in 2008 was accused of murder two years earlier. now according to the san francisco chronicle an informant told the fbi back in 2006 ramos killed a rival gang member. no one was arrested for that killing. ramos is serving three life terms for the killing of tony bologna and his two sons michael and matthew. 4:53 is the time right now. organization that focuses on keeping kids out of trouble is once again a burglar victim. they spent yesterday assessing the damage from the latest office break in. a widow was broken and brand new printer stolen. the executive director says there was a total of four break ins last month. after the first one fencing and surveillance cameras were stolen. >> for the crooks i would say there are surveillance cameras all over the property. please stay off of our property

a soldier that shot and killed his commander and turned the gun on himself has died. the 27-year-old soldier from kansas was recently charged with stealing a tool kit and awaiting court-martial at the time of the shooting. another soldier was wounded in that shooting but he has been released from the hospital. one man behind bars, an apartment severely damaged in concord, the role squatters may have played in starting that fire. >> plus a traffic disaster in the north bay after a fatal hit and run accident. what witnesses told our crews about the missing driver.
