killed in gilroy. alex savidge tells us now about the questions that are surrounding this tragic accident. good morning, alex. >> reporter: good morning, to you, pam. the officers home is on kentwood court in gilroy. the shooting happened here around 5:00 last night. gilroy police investigators are trying to figure out if this three-year-old boy shot himself or accidentally shot by someone else. this investigation will focus on how the gun was stored in the home. paramedics last night tried to revive that boy. this morning gilroy dispatch newspapers identifying the boy's father as san jose police officer brandon orlando. the paper is also reporting that police are looking at a couple possibilities here. the boy shot himself or the boy was possibly shot by a play mate another child who was over at the home and playing with that young boy. because of the serious nature of this and the fact that it involves the death of a child, we understand the santa clara county child death protocol has

been act visited -- has been activated for a thorough investigation. alex savidge. we do have new video from alameda where four people were rescued just hours ago from a car crash. take a look at that. rescuers had to use the jaws of life to peel back the cars roof so they could free the last victim who was trapped inside. this all happened along island drive and mccartney shortly after 2:00 a.m.. all four victims are being treated at the hospital. coming up we'll take you back live to the scene where traffic is still effected this morning. also this morning the bay area's close knit horse rating community is mourning the death of a successful jockey. jorge herrera was thrown from his horse. he later died from his head

injuries. this is video from a horse racing website. you can see herrera riding a gray horse it's number eight. he started off strong but then fell back. herrera got too close to another horse and was thrown on to the track. >> it seem like he might have over corrected and he came across the nine horses field and stumbled badly and the jockey flew over the horses head to the racetrack. >> herrera won 55 races during his career. his death was the first at the alameda county fairground since 1975 when jockey juan gonzalez fell off his horse and died and that accident also took place on july 5th. a group of people furious that the city of antioch. they went to the park for evening stroll but their cars were locked inside the gate when the park close last night. fliers left on the cars instructed them to call police who would let them out.

however officers tole them they had -- told them they had other priorities. stranded visitors waited for hours until an officer arrived. >> i have an 80-year-old at home that is waiting rob me to do her me sin. i'm diabetic i didn't eat dinner before i came. >> we are waiting for a police comment on this incident. there is a park sign warning that the park closes at dusk. scott peterson has filed the automatic appeal of his death sentence to the california supreme court. he was convicted in 2004 of killing his wife lacy and his unborn son. he has always maintained his innocence. he blames publicity, incorrect ruling, and mistake deprived peter son o ever a -- peterson of a fail trial. the state assembly will vote on a bill that will allow

the temporary release of convicted serial killer wesley shermantine. it was to help insure he would look for the victims. shermantine and lauren herzog were known as the speed freak killers. herzog committed suicide after learning shermantine was giving investigators maps to lead them to victims remains. a man that admitted to beating a los gatos priest is found not guilty. defendant will lynch was cheered as he walked out of the court. jurors say he couldn't ignore that he was likely raped as a child. lynch was acquitted on felony assault and elder abuse charges. >> i wanted to bring this out and bring attention to the cause but also take responsibility and be accountable unlike the church and father jerry. >> reporter: lynch plans to create a nonprofit organization

for sexually abused victims. jurors did dead lock on a misdemeanor assault charge. prosecutors have a week to decide if they will retry him on that account. arraignment is set in two weeks for operators of a san jose home. they are accused of abusing the people they were supposed to be caring for. coming up in eight minutes some of the deplorable conditions the people were allegedly living in. doubts are being raised on pg&e testing on the san bruno testline. pg&e said a retired employee remembers being a pressure test being done on the line more than 50 years ago. and the procedure may have weakened the pipeline and could have contributed to the deadly blast. the pipeline had a defective welch. a defective line would not be able to withstand the hydro test the worker described.

4:35 is the time right now. an hour from now unemployment figures will be released for june. analysts predict that the economy gained 90,000 jobs last month which would make for third straight month of weak job growth. unemployment rate for june is expected to remain at 8.2%. president obama will be paying close attention to those job numbers as he continues his campaign bus tour in ohio and pennsylvania. it includes a stop at an elementary school. mitt romney is doing a practice run for the november election tomorrow. they are calling it super saturday. gop volunteers will call hundreds of homes of swing state voters just as they will before november 6th. the goal is to test the campaign's ability to turn out the votes which is something the republicans struggled with in 2008. right now 4:36 want to go

back to sal for a complete look at bay area traffic this morning. hi, sal. >> hello, pam. we do have word on that crash that we saw a video of a little while ago in alameda. that area still closed. this is new video. we showed it a few minutes ago. this is on mccartney road. and this area is closed. they had to rescue six people who were all under the age of 18 from this car just a few hours ago. our reporter claudine wong is on the scene trying to gather more information. she'll have more on the perhaps the status of the people that went to the hospital but a huge emergency response this morning here in alameda. let's move along and take a look at the live picture of the north shore freeway. there is flashing lights eastbound.

good morning. low clouds will give way to sunshine and a little bit warmer temps today. 80s inland. 60s and 70s coast and bay. >> san jose law enforcement believe there is is more mentally disabled adults that may have been abused at an unlicensed facility. the house in the evergreen neighborhood is guarded with mounted cameras and bashed wire -- and barbed wire. police discovered a dozen mentally disabled adults. they were malnourished, beaten, bathes, and forbidden to use toilet paper. >> we don't know how long this has been going on for. we don't know how many others have been involved. >> here are photos of four of the five suspects.

they are all related and face charges including felony abuse, negligent, and running an unlicensed care home. all of the suspects are out on bail. time now is 4:43. three east bay police departments are abonn donning -- abandoning plans to buy military style armored vehicles. they were looking to buy a linco bear cat similar to the one shown in the pictures. the three jurisdictions were going to share use of it. police said the vehicle would be used in hostage situations but there was concern it would also be used as an intimidation tactic during protests. it's 4:44. let's check back in with sal for a look at traffic. >> all right, pam. we are doing pretty well around the bay area. we look pretty good if you are driving on the east shore freeway westbound interstate 80. it's a nice looking drive. the morning commute looks good at the bay bridge toll plaza. not much to worry about it. has been a very nice drive and

over the next few months the san carlos fire station could be closed from time to time because of a staffing shortage. only 17 of the 24 positions are filled at fire station 16. the daily new reports the departments salaries are among the lowest on the peninsula making hiring tough. san carlos depping fire chief says the neighboring cities will help with calls. firefighters in eastern contra costa county were put to the tests just days after three of the district six fire houses closed there. crews battle three brush fires in a 24 hour period. this fire in oakley last night may have been started by fire works. some antique canoes burned and small embers sparked a small fire on the roof of two homes. crews also battled a cross fire

in neighboring brentwood. no one was hurt but some yards were damaged. no official word ons cause of that fire but it may have been started by one cutting wood. east contra costa fire officials say they had to call for help from other fire jurisdictions. >> we are definitely seeing the impact of having half the resources that we had four days ago. five days ago. >> three acres were burned in another grass fire late wednesday night. it took crews about ten minutes to respond and the fire chief says it's the new norm. voters rejected measure s that would have saved the fire houses. walnut creek police chief says he need more officers on the street. right now they have 76 sworn officers with plans to hire two more before the end of 2014. the chief plans to ask the city council for at least one more officer each year for the next five years. but critics of the idea say the city needs to upgrade city facilities and maintain its

roads more than it needs more police. the pensions of city workers in san jose and san diego are unlikely to be effected by state pension reform measures if the leader of the state senate has his way. darrell stein burg says any initiative that changes how pensions are set would probably be grandfathered in. now voters in san jose and san diego have their own pension plans and pass their own reform measures earlier this year. ross mirkarimi's wife now plans to fly back to san francisco to testify in person at her husband's misconduct hearing. earlier eliana lopez suicided that the city pay for her round trip ticket but she has backed off on that demand and a spanish radio station has raised that money needed to pay for lopez's plane ticket. meantime a second person has come forward to suggest san francisco's mayor may have committed perjury in the

investigation into the suspend sheriff. >> i don't recall offering mr. mirkarimi any job. >> however, former board of supervisors president aaron peskin is telling something different. last week building inspection commissioner debra walker claimed that the mayor perjured himself in separate testimony. the mayor denies both of these accusations. george zimmerman remains behind bond this morning. he has to post 10% or $100,000 in the $1 million bond the judge ruled. the real challenge is coming up with the $1 million in collateral. if he makes bail he will have to wear an ankle monitor.

welcome back to the ktvu channel 2 morning news. pilot error and equipment failure that's what aviation officials caused the deadly crash of an air france jet hyper three years ago. it sprunged into the atlantic ocean killing all 228 people on board. investigators say the planes air speed sensors froze and the pilot didn't know how to manually deal with the situation once the plane went off auto pilot. they now rem better training -- recommend better training to pilots. today is likely to be a make or break day for california's high speed rail program. the state senate is scheduled to vote on funding the first phase of the project. the plan is to have trains running at speeds as high as 220 miles an hour between the bay area and southern california. but right now even strong backers believe there may not be enough support. >> i want to think positively.

it will be a very close vote in the senate. >> some backers of high speed rail including mark plan to vote no because of the way this proposal is worded. we are learning more about the man being blamed for yesterday's morning commute nightmare on the bay bridge. the chp has identified him as antonio robberson of oakland. he is on patrol for how many trafficking conviction that involved a minor. he is facing felony drunk driving and gun charges after a chase, crash, and shootout on the bay bridge early yes. fortunately no one was hurt but it did create a monument fall backup. hopefully naprons this morning on this friday morning. sal. yeah this morning, pam, we are doing pretty well. we don't have a lot going on. we don't have anything going on in the lower deck of the bay bridge just in case you are wondering. let's take a look at the bay bridge westbound.

bike wednesday morning when he was attacked. six dogs were captured nearby they are being held by animal control. larry bird's family owns four of the dog being quarantined. he is prepared for what could come next. >> if they did in fact attack the gentleman. >> 20 minutes before the attack the same pack of dogs chased another cyclist in the same area. the district attorneys office will determine whether the dogs owners will face charges. warning signs are posted in san francisco in one neighborhood where birds have been attacking humans and dogs. the signs that read beware of attack birds are posted at the noe recreation center. >> the bird had dived down from a tree and slammed into my
