we do have the fog there but it will burn off. we'll have sunshine today. a little breezy not as bad as yesterday. it was rather windy at times yesterday. inland temps coming up a few degrees low to mid 80s. now an update on your traffic with sal. >> right now we are looking at highway 4 bay point. you can see traffic is moving along okay coming up to the willow pass grade. if you are in the san jose area 237 coming this from milpitas not bad. let's go back to the desk. we are continuing to follow breaking news out of alameda six people all under the age of 18 are in the hospital after their car crashed in a tree. here are some live pictures from the scene which is quite active. an accident investigation team arrived there. they are trying to figure out what led up to the crash you can see the car still there at the scene. firefighters had to rescue the driver of who was trapped in

that white vehicle. i want to show you video during that rescue of firefighters trying to get that driver out. the firefighters peeled back the cars roof eventually freeing that driver but we don't know the victims condition. coming up at 6:30 we will go back live to the scene with how long the investigation could effect traffic in that area. we are follows a tragedy in santa clara county. the three-year-old son of a san jose police officer was shot and killed in gilroy. alex savidge tells us about the questions that surround this deadly accident. >> reporter: i did a short time ago talk with a family friend out here that told me the participants of this three -- parents of this three-year-old boy are devastated this morning. the child's father is a san jose police officer. the deadly shooting happened inside the officers home. it was around 5:00 last night. family members were home at the time. police are calling this now a tragic accident. this morning we watch as the

crime scene cleanup crew was here doing their work. gilroy police are investigating whether this three-year-old boy shot himself or was shot by someone else. police are look at the possibility one of the boy's friends accidentally fired the handgun. paramedics found that boy with one gunshot wound. they tried to receive strive the -- revive the child but he died on the way to the hospital. the newspaper is identifying the boy's father as san jose police officer brandon orlon day -- orlando. the child death protocol has been activated in this case. they will move in to see how the gun was stored inside the home. gilroy police and san jose police offering support to the family. for now we are live in gilroy this morning alex savidge ktvu channel 2 news. >> the bay area horse racing community is in shock over the

death of a popular jockey. he died during a race at the alameda county fair. tara moriarty live this morning in pleasanton where a news conference is scheduled for later this morning. tara. >> reporter: the horse racing community here grieving and a spokesperson from the alameda county fairgrounds saying their heartfelt sentiments go out to the family of jorge herrera. it happened just before 5:00. last race of the day. the crowd in shock when a jockey on a gray horse number eight fell from the horse and died. a witness says that he started strong but fell back and got too close to another horse and thrown off on the track. >> it seemed like he might have over corrected and he came across the nine horses. clipped heels with the nine horse and stumbled badly and the jockey flew over the horses head. >> reporter: officials say it appears herrera was

centrallabled trampled. he was in mexico and finished first 55 times in his career. he raced in california, oregon, and washington starting in more than 1,000 races. no word yet on how the community here at the fairgrounds plans to honor him this weekend. live from pleasanton i'm tara moriarty. in overnight news the fbi is now leading the investigation into two dangerous laser incidents involving commercial jets heading into sfo. the trouble began shortly after 10:30 last night. someone with the laser in the palo alto area pointed the light into the cockpit of a united airlines jet flying over the san mateo bridge. the same thing happened on a virgin airlines flight a short time later. both jets landed safely. two people died during violent storms in tennessee's great smoky mountains national park. hundreds of trees came crashing down and more than a dozen people were injured in the

storm. many people were visiting the park for the 4th of july holiday. emergency crews are still trying to assess all of the injuries and damage but they're having a tough time accessing roads because of the down trees. meanwhile people in chicago are bracing for another day of intense heat. temperatures have been in the triple digits over the past few days. the heat wave contributed to two deaths and led to summer school cancellations. even the roadways can't handle the heat. one street buckled yes and ha to be repaired. new unplace of employment figures for june just released a half hour ago show -- that indicates the economy is still struggling. we will hear what president obama has to say about the latest job numbers later on this morning as we continues his campaign bus tour in ohio and pennsylvania. coming up at 6:15 the high level republicans following president on the campaign drill slamming his handling of the economy. the friday morning commute

up and running and sal is joining us with an update in san francisco. >> that is right mike and pam. they've had a little trouble getting it out of the way. they took the injure people away but for some reason they're having a little trouble here on northbound 280. the crash has been here for an hour. they just issued a sig alert two minutes ago. so we are lucky that this is so early and this is a lighter day. the friday after the july 4th holiday. some people have the day off but still you may see some slow traffic approaching northbound 280, 101 interchange coming in from daly city to san francisco. they are running traffic breaks getting traffic slowed down coming up toward that interchange. we'll let you know when it clears. we thought it would be cleared by now but it has not. let's go to 880 north and southbound that looks good. barring any major crashes we've had pretty good times in the last few days when it comes to

welcome back to the ktvu channel 2 morning news. a man that told jurors he beat a los gatos priest is found not guilty. defendant will lynch was cleared as he walked out of court. jurors said they couldn't ignore that he was raped as a child. lynch was acquitted on felony assault and elder abuse. >> i wanted to take responsibility and be accountable unlike the church and father jerry. >> lynch plans to create a nonprofit organization with support for sexually abused victims. jurors did dead lock on a misdemeanor assault charge and prosecutors have a week to disease if they will retry him on that account.

a marin county judge will rule on an evidence request me by accused serial killer joseph naso. he wants permission to examine dna evidence collected from panty hose of one of his alleged victims. he is charged with killing four northern california women between 1977 and 1994. jury selection is expected to bin november 7th. new this morning opposition activist in syria say government forces have killed at least 25 people and arrested dozens more while seizing a northern city from rebel fighters. this comes as the u.s. and international partners are meeting in paris to discuss further sanctions against the regime of president bashar assad in syria. and diplomats from around the world including secretary of state hillary clinton are looking to step up the pressure on syria. the u.s. is urging countries around the world to pressure russian and china in forcing

president assad to leave power. they have arrested seven men on acts of terrorism after finding weapons hidden in their car. they impounded a car for not having insurance. it was only later that they discovered the weapons hidden in that vehicle. that prompted police to trace and arrest the driver, the passenger, and other suspects earlier this week. as we have been reporting the june jobs report just released about 45 minutes ago shows the economy added 80,000 jobs in june. that is less than what most economists predicted. as scott mcfarland reports we expect to see some political spin on those numbers. scott. >> reporter: the spin has already begun. 80,000 jobs added in june. that is just a slight improvement from what we had in may. the unemployment rate in the country remains unchanged fixed at 8.2%. there were some gains in the health care sector. some about 14,000 jobs.

the manufacturing industries faired a little better than others. about 10,000 jobs gained. but four months before election day, such anemic growth as potential political rip tonight for the president. >> here in ohio we are 40,000 fewer jobs then when he took office. average income down $3,000. the list goes on and on but the bottom line is this, we've had enough of broken promises. >> reporter: just got a statement from the republican house speaker john boehner say this is prove that the u.s. economy is not doing just fine. the nations unemployment rate fixed again this month at 8.2%. live in washington scott mcfarland. >> we just got word more hr. will re-- mitt romney will respond to that jobs report. president obama has a clear advantage in california over his republican challenger mitt romney. the poll shows 55% of voters

support the president compared to 37% for romney. more independent voters also favor president obama over his republican challenger. oakland police are offering a $10,000 reward in the search for the hit and run driver that killed a bicyclist. it's a story we first reported during the ktvu 10:00 news 4th of july night. the driver may have intentionally hit the bicyclist near international boulevard and 81st avenue. police only have a vague description of the car. it's a dark colored oler model american sedan with a possible windshield damage. over the next few months san carlos fire station could be closed from time to time because of a staffing shortage. only 17 of the positions are filled. the daily news reports the department salaries are among the lowest making hiring tough. san carlos deputy fire chief says neighboring stations and cities would help response to calls until staffing is increase. the city council will discuss

the plan on monday. >> firefighters were put to the test just days after three of the districts six fire houses closed. crews battled three brush fires within a 24 hour period. neighbors say this fire may have been started by fire works. some antique canoes burn and flying embers sparked a small fire on the rooftops of two homes. no one was hurt. crews also battled a grass fire in brentwood. no one was hurt there. some yards were damaged. no official word on the cause of that fire one neighbor says it may have been spark by one cutting wood. response time took about ten minutes the fire chief says the new reality knew with fewer fire houses. that is just the way it will be. 6:18 is the time right now. back over to sal that is starting in san francisco. what is going on? >> are still looking at that

sig alert they have issued on northbound 280. they are doing numerous traffic breaks to slow the traffic down. it has been there for more than an hour. we have been lucky because the traffic is light on 280 compared to what it normally would be. let's move over to contra costa county. i want to look at highway 4. it's not quite as bad as it normally is. there is a little slowing through the two lane construction start. but not bad. between vallejo and pinole and richmond it's a very nice drive. we are going to the mccarthur maze now traffic there looks good to a relatively empty bay bridge toll plaza. it's obvious on this friday a lot of people have been taking the long weekend surrounding the 4th of july holiday. 237 the same thing goes. usually by now we have slow traffic here but today it's better than normal. 237 looks good all the way to 101. let's go to steve.

we are following developing news right now out of millbrae. firefighters just finished putting out a house fire on alto street. one of the photographers just arrive on scene and providing you the live pictures here. fire crews and trucks still on the scene. flames responded just after 3:30 this morning. the fire quickly grew to two alarms. we are gathering information on the scene as firefighters gathering there by the garage door what was once a garage door. we will bring you more

information as soon as it becomes available. >> a massachusetts family says they are relieved they were away from home when a neighbors home made cannon ball funned. the mishap sent pieces of shrapnel flying. it all happened after it exploded in the backyard. police say no charges have been filed yet but they are investigating this explosive device. right now there is an unprecedented number of blue whales gathering in the monterey bay. marine biologist says there may be more than 100 in the area. the whales are there in such large numbers because of the krill they feed on. there is a lot of krill in the bay because of the mixture of the win, current, and earths rotation. >> i love it when it's like this. the people are just going crazy. and you know they can't even believe they are going to see a whale and let alone to see the biggest whale on earth.

here on 2. claudine. >> reporter: we expect investigators to be out here for quite awhile. take a look at the scene behind us you can see what they are dealing with. that was the one car involved in this accident. you can see the debris surrounding this area. this was a car verses tree. six people inside this car when the crash happened. all under the age of 18. i want to show you i have owe from earlier this morning. you get an idea of what they face when they came out here. there was one person that had to be extra dated from the vehicle. that was the driver of the car. this all happened just after 1:30 this morning. we are on island drive or island way just near the mccartney intersection. apparently this crash was so loud people heard it. at this point they don't have any witnesses that saw it, but they herd the impact of -- but they heard the impact of this car into this tree and they called 911. all six people were taken to the hospital. we do not know their condition. we know the officer spent the

morning at the hospital. we hope to get an undate very soon. in the meantime these investigators are out here trying to figure out how this accident happened. obviously this is a five seat car. six people inside. we don't know if any of them were able to put on their seat belts. we don't know where they were going or how fast they were going. that is the job of the investigators that will piece this together. how long will this be shut down? they are expecting right now 9:00 to 10:00 this morning before they are wrapped up here as the investigation moves forward. live here in alameda claudine wong. we have new video this morning of a police pursuit in san leandro last night. the suspects car eventually ranked into the side of a home on fargo avenue. the incident started when officers checked the license plate of the vehicle and it came back and the plate was lost or stolen. police then tried to pull the car over but the pursuit ended when the suspect hit a dip on the road and lost control.

>> into the house. right around the tree. and the police were right there immediately and they had guns drawn and then told us to put our hands up. >> police have not released the suspects name but they have identified her as a 33-year-old hayward resident. she suffered minor injuries and transported to the hospital. she faces charges including possession of a stolen vehicle and evading police. the investigation is under way into the tragic shooting death of a toddler at a gilroy home. ktvu alex savidge tells us that the three-year-old was the son of a san jose police officer. alex. >> reporter: and this little boy the son of that police officer shot top death in what investigators are calling a tragic accident. it all happened inside the officers home behind us here on kentwood court. it was around 5:00 last night. family members were home at the time. the family friend came out an told me the parents here are

simply devastated. the crime scene cleanup crew has been here all morning long. they are investigating whether the three-year-old boy shot himself or he may have been shot by someone else. police are looking at the possibility one of the boys friends accidentally fired that handgun. paramedics town the boy with -- found the boy with one gunshot wound. he died on the way to the hospital. they identify the boy's father as brandon orlando. the investigation we are tole will be focusing on how firearms were stored inside this home. we are live this morning in gilroy alex savidge ktvu channel 2 news. scott peterson has filed the automatic appeal of his death sentence to the california supreme court. he was convicted in 2004 of killing his wife lacy and his unborn son. he has always maintained his

innocence. the appeal is expected to take months or possibly years to be resolved. the state assembly will vote on a bill that will allow the temporary release of convicted serial killer wesley shermantine. it's to help them search for the remains of dozensover victims. sore man tine and -- shermantine and loren herzog were known as the speed freak killers. ross mirkarimi's wife now plans to fly back to san francisco to testify in person at her husband's misconduct hearing. earlier eliana lopez asked the city to pay for her round trip ticket from venezuela but mayor ed lee rejected that request. but now a spanish language radio station has raised the $1500 needed to pay for lopez's plane ticket.

meantime a second person has come forward to suggest san francisco's mayor may have commit perjury and the investigation into the cities suspensed sheriff. the elses stem from e lee's testimony before the ethics commission last week. >> i don't recall offering mirkarimi any job. >> however former board of supervisors president is telling a different story to ktvu news. he says he was asked to tell mirkarimi that he could have a new job if he resigned as sheriff. last week billing inspection commissioner debra walker claimed the mayor perjured himself in separate testimony. doubts are being raised about pg&e account of toasting. a finalling last week a retired employee remembers high pressure water tee being done

on the pipeline more than 50 years ago. and the procedure may have weakened the pipeline and could have contributed to the deadly blast. pg&e also says it has a defected weld. we are learning more about the man being blamed for yesterday's morning commute nightmare on the bay bridge. the chp has identified him as 29-year-old antonio roberson. roberson is facing felony drunk driving and gun charges after a chase, crash and shootout on the bay bridge early yesterday. no one was hurt but that incident did create quite a backup for drivers. they dropped off their cars and went on an evening stroll in antioch. they ended up waiting around for hours after the city locked up the park. coming up the plight of a stranded driver. >> a lot of people probably

here's a look at the top stories we are following. right now an accident scene is trying to investigate what caused a car to crash in a tree. there were six people in the vehicle all under the age of 18. the toddler son of a san jose police officer was shot and killed in gilroy in what investigators believe was a tragic accident. it happened at the family's home and it's not clear if the boy shot himself or was shot by someone else. >> and let's take you live right now to millbrae where firefighters are still on the scene of what was a house fire. flames were first spotted pouring out of the garage at around 3:30 this morning. you can see there the garage completely gone. the door at least. the cause of that fire is under investigation. the family of four that lived there di get out safely. the alameda county fair will hold a news conference this morning to discuss the death of a jockey killed during a horse race.

ktvu tara moriarty is out at the fairgrounds this morning with the tragic story. tara. >> well, we know that jorge herrera's horse had made it across the finish line but alone. let's take a look at video taken from that race yesterday. it was the last race of the day. right before 5:00. the 33-year-old from mexico fell from his horse and later died. he was on a gray horse number eight. it's believed he got too close to another horse and clipped him. his house stumbled. the horse falls over herrera's head. >> we are all very deeply saddened by this. this has not occurred at our racetrack since 1975 so we are all in a little bit of a shock but our thoughts and prayers go out to his family. >> reporter: officials say herrera died from massive head

storms that rolled across the atlantic sea board this week. hundreds of thousands are homes are without power in maryland these tree trimmers have been working nonstop to try to clear up the mess while temperatures hit triple digits yesterday. the heat index topped nearly 100. national park service ha a bigamies to clean up after the 4th of july celebrations. people who came do watch the fire works show brought alcohol, food, and even furniture. when the party was over they left it all behind. officials with the goalen gate recreational area said it took 55 employees to clean up that mess. it was a similar situation at dolores park. the chronicle says piles of trash was left behind by 4th of july revelers on wednesday. gardeners hauled away 60 big bags of garbage. a 50-year-old man is recovering this morning after a muni bus ran over his arm.

now the accident happened at 3:00 yesterday afternoon at the intersection of cabrera and l.a. praia street. the man trip and fell as he was getting off the bus. he landed under the bus. that is when the driver annoyingly hit him. emergency crews had to lift the bus to free the man. he is expected to survive. central california cyclist is recovering from serious injuries after he was mauled by a pack of dogs. the 49-year-old was riding his bike wednesday morning when he was attacked. six dogs were captured nearby and being held by animal control. he says he was on vacation when the attack happened but he's prepared for what could come next. >> if they did in fact attack, yes they should be euthanized. >> investigators say 20 minutes prior to the attack the same pack of dogs chased down another cyclist in the same area. the district attorneys office
