oil recycling plant. what happened there, alec? >> reporter: there was a spill of an oil-based product inside the plant. it happened before 9:00 and news chopper 2 was overhead shortly. according to the fire chief, a two-inch pipe broke. the technical name is dow firm oil. it is potentially flammable. when it spilled, some of that oil vaporized. the 80 workers at the plant were evacuated. one worker was treated for breathing difficulty at the scene but he is released. the spill was not hazardous to the surrounding community. no nearby businesses were evacuated. a fire engine crew did remain at the scene for about two hours after the spill started to make sure there were no further problem. >> you are dealing with an oil- based product and if there was any potential for any health hazard, that's the number 1

concern. the number 2 is flamability. and if there is any ignition sources, we end up with a fire. that's why we kept all fire units on the scene as long as we did. >> reporter: ever green oil is an oil recycling plant and the alameda county hazmat crews have had to respond here, most recently for a minor spill. in march of last year, they responded to a fire at the facility which ended up breaking the arm of an employee. plant officials would not speak to us except to release a statement saying that the plant is in safe condition and the plant is working with alameda fire to determine the cause of this pipe break and subsequent leak. >> thank you, allie. the community of alameda is stunned after a car with six young teens crashed into a tree

this evening. claudine wong is live at the bay farm island where a 15-year- old suffered life threatening injuries. >> reporter: the roadway is back open but if you take a look, you can see the orange spray paint which gives you the path of this car. none of the 16 agers inside were old enough to drive. the 15-year-old behind the wheel is now fighting for his life. take a look at the mangled mess that remains of this car. >> i hear screeching of the tires and just a crash. >> reporter: jesse byrnes woke up the sound of the crash, looked out her window and heard the hysteria that followed. >> i heard a girl and a guy -- i didn't hear six. i heard two. and the guy was yelling, are you okay? >> reporter: they were not okay. five of the teens suffered

nonlife threatening injuries, the driver was trapped inside, fighting for his life. two of the girls are sisters and the car belonged to their father. >> all i know is that the parent that we talked to said he didn't give any permission for his vehicle to be used, obviously, by people who were unlicensed. i'm not sure where they were headed to. >> police say that parent also told them that beer found in the trunk of his car were his but it's unclear if the kids had been drinking. police do say that speed was a factor and it appears that only the kids at the front were buckled up. the road was reopened. the investigation continues. >> we hope they are okay >> reporter: it appears that most of the kids in that car are from alameda. at least one has now been released from the hospital. claudine wong, ktvu channel 2 news. >> thank you, claudine. some people left their cars

in a park and went on an evening stroll. they ended up waiting for hours before they could get it back after the city locked the park. we'll hear from one of the drivers who was furious and a shooting of the son of a soarnls police officer. the shooting happened yesterday at the officer's home. police believe that the shooting was accidental but won't say whether the boy shot himself or if someone he is shot him. they also would not say if the father's service weapon was involved. >> the boy was shot with a handgun. family members were home at the time of the incident. the county's death protocol has been initiated. >> the county's death protocol means that the district attorney's office and the medical examiner's office will be involved in the investigation. a horse racing jockey who was killed during a race in pleasanton is being remembered

today. there is also new information this noon time on a story we have been following since last night's 10:00 news. ktvu's tara moriarty joins us live. >> reporter: good afternoon. people who were here said they had no idea that a jockey was killed. that's because it happened here away from the stands, near the water tower. it's the first time a tragedy like this has struck in 37 years. the horses hit it the tracks just like they do every day during fair but today was no normal day. >> they feel it. they just feel for their brother, you know. they know what their families are going through. this kid was trying to get rolling. he was trying to do good like they all are. so something like this, for something like this to happen, it's the worst. >> yesterday, jockey jorge herrera died in the last race, riding the number 8 gray horse when he clipped another horse's

heels. he fell over his horse's head on to the track and was trampled. >> in this situation, there was nothing that was going to save him because he hilt the ground going 35, 40 miles per hour. the trauma was too great. >> reporter: former jockey darryl haire says that the mood is somber among his fellow athletes. >> just a wake-up call knowing that this could happen to them any time. >> i don't think there is a guy out there that does not know the risk involved when they get on the back of the horses. the weight of the horses is at least ten times weight of the jockey, at least. >> reporter: the horse was not injured and crossed the finish line alone. >> tough. riders always are getting hurt. you hit the side the gate sometimes. there is always little bruises that you get, all the time. you always kind of toughen it up, cowboy it. >> reporter: herrera was quiet, polite. he had only ridden ten races in

california but he had been a jockey for at least ten years competing in oregon and washington. >> he loves competing against these california riders. he totally enjoyed it. he died doing what he loved to do. >> reporter: herrera was from mexico but lives in southern california with his uncle. an autopsy is being done. and the california horse razeeing board had launched an investigation. in just a half hour, 45 minutes, there will be a moment of silence to honor herrera. despite what happened, jockeys say that the race must go on. >> thank you, tara. a new report finds there was no change in the number of unemployed people in the country. 80,000 jobs were created, 20,000 fewer than what

economists had forecast. as expected, both men in the presidential race had different takes. president obama says that while there are not enough jobs created, the reports show that things are moving in the right direction. >> it's still tough. we learned this morning that our businesses created 84,000 new jobs last months and that, overall, means that businesses created 4.4 million new jobs in the past 28 months including 500,000 new manufacturing jobs. that's a step in the right direction. [ applause ] >> the president also says that the numbers would be better if republicans in congress were not blocking his effort to boost economic growth. >> there's a lot of misery in america today. and these numbers understate what people are feeling and the amount of pain which is occurring in middle class america. >> presumptive republican nominee calls the report a kick in the gut to middle class

i'm moving back in... better call at&t. yep... ♪ a two-alarm fire badly damaged the garage of a home on milbrae. it erupted around 3:00 this morning. a family of four were sleeping inside at the time but they were woken up by the smoke alarm and made it out safely. the homeowner says he will remodel but will look for a temporary place for his family to live in the meantime. we have developing news outs of florida where george zimmerman has reportedly left jail. zimmerman is the neighborhood watch volunteer who shot and killed unarmed teenager trayvon martin. a judge revoked his earlier bail of $150,000 after prosecutors said that

zimmerman's wife lied about their finances. the judge reset the bail yesterday at a million dollars. zimmerman is charged with second degree murder. scott peterson has filed the automatic appeal of his death sentence to the california supreme court. peterson has always maintained his innocence. his attorney claims that publicity, incorrect evidentiary ruling and other mistakes deprived peterson of a fair trial. the appeal is expected to take months or possibly years to be resolved. the state assembly will vote on a bill that will allow the temporary release of convicted killer westley shermantime. the release is so he can help

for the sites of several victims. shermantime's accomplice killed himself after learning that sher machinetime had given names and lists of people they had killed. police applied for a grant from the homeland security didn't but university officials and berkeley city leaders reacted negatively to having the idea of a military style vehicle and the police department reconsidered. the suspect's car eventually rammed into the side of a home on fargo avenue and fleming street after a police pursuit in san leandro last night. the incident started when officers checked the license plate of the vehicle and came back to the plate with either lost or stolen. police then tried to pull the car over. the pursuit ended when the suspect hit a dip on the road and lost control. >> into the house, right around the tree and the police were right there immediately. they had guns drawn and then

told us to put our hand up. >> police have not released the suspect's name but they have identified her as a 33-year-old hayward resident. she suffered minor injuries and was taken to the hospital. she faces several charges including possession of a stolen vehicle and evading police. no one was inside the house at the time of the crash. >> a san jose church is asking for donations after being burke haraizeed not once, not twice but three times. in all three case, the burglars took instruments and musical instruments. the church says that the value is $25,000. people living in the oakland hills are busy buying surveillance cameras in an effort to combat crime. a few weeks ago, we showed you this video of a burglary captured by a homeowner's

surveillance camera. one salesman estimates he sold once of cameras to people in the oakland hills in recent months. one man who lives near redwood regional park has cameras that snap pictures of every license plate that enters his street. this is a critical day for high street rail in california the state senate is scheduled to vote on funding the first phase of the project. the plan toys have trains running as fast as 220 miles per hour between the bay area, sacramento and southern california when all the work is done. opponents say that the project wastes money but supporters say it creates jobs and is a critical part of california's future infrastructure. senators do agree the final vote will likely be very close. new at noon, some oakland airport workers are picketing and rallying in an effort to organize into a labor union. the food service workers are marching in front of terminal

2. they work at 121 eateries and shops at the airport, including jamba juice, and other sandwich shops. they want to alert the public that food workers have no benefit and are not salaried. >> we want to determine if we want a union or not. >> reporter: about 250 food service workers at the oakland airport are represented by unite here local 150. they say they are paid a living wage and receive affordable family health care fog caused delays up to 45 minutes at sfo. the f.a.a. website shows delays are down to 15 minutes or less. most of the delays this morning affected flights coming from less than a thousand miles away. a wildfire near reading
