tom is gathering reaction. his report at six. >> tonight there were still a lot of questions about how the 3-year-old son of a san jose police officer was killed with a gun. robert honda live in gilroy with what you have learned about the boy, his family and what happened. >> here at the police department officers have been meeting nearly all day discussing this tragic case. it's safe to say everybody has mixed feelings about what is happening now even as their heart go out to the family an investigation started in to the circumstances of the shooting. today family and friend's have been showing up on the house where the shooting happened yesterday evening. they have identified the 3-year- old preston orlando has the child shot. the father and homeowner was brandon orlando a 9 year veteran of the force. the parent's families prominent, well loved residents

mopping up a small grass fire on south of downtown. fire started about 2:00 near kelley historical park. it burned two and a half acres in the open field. there were houses nearby but the fire didn't reach any of them. nobody was hurt. >> the east bay refinery was evacuated because of leaking super heated oil. 200-gallons leaked from the two inch pipe at the refinery in newark just before nine. the alameda county team was called in about 80 workers were evacuated from the oil recycling plant. evergreen handles hazardous waste materials including used motor oil and other waste. the team eventually determined there was no health hazard posed by the leak. > dealing the oil based product and if there was anyo pension for health hazards its that's it the number one concern. the second is if it's flammable. >> one worker was treated at
