>> reporter: it was very close. two democratic senators from the bay area voted against this bill but they still got the very minimum the fun the first leg of high speed rail. >> 21-16, measure passes. >> reporter: with just enough votes to get high speed rail moving, democrats celebrated with high-fives. bay area senator mark leno was among those pleading with votes today to begin spending as opposed to of the billions of the dollars voters approved in 2008. now construction of the initial 130-mile leg of high speed rail should begin in as little as six months but it comes at a time when critics say we can least afford it. >> they're going to see that you cut education, they're going to see that you cut healthy families but they're

also going to see that you found money for this collosal, spending money that we don't have. >> reporter: will you have the money to finish this project? >> it's the very nature of a large capital works project such as high speed rail. mayor of berkeley so many years ago denounced b.a.r.t. as a million dollars boondoggle. where would we be at as a bay area without. >> reporter: they put the cost some where around $80 million with express training making that trip in less than three hours. more detrails now on that portion of track that has now been founded.

it will run from mad era to bakersfield. planners say to secure funding they must start the project. $140million for new b.a.r.t. cars and $61 million for central muni project. two san francisco bound airliners hit by lasers. the investigation into the incident that can leave pilots temporarily blinded. we have new video tonight of two fatal shootings on the streets of oakland. one victim died on the streets in west oakland. a neighbor said she heard at least two gunshots. we found streets filled with emergency crews and onlookers. police will only say that the victim was male, they also say they're not really to release

suspects about suspects or a possible motive. about an hour earlier police responded to a shoots in oakland. police say two men got into an argument ending with one man shooting the other. the victim ended up dying at the hospital. a suspect was arrested at the scene, his name has not yet been release. it is believed that the two men did know each other. gilroy police are trying to determine how a gun was stored. that áf they consider the shooting of preston orlando inside a home yesterday an accident. they're trying to term how the child fired the gun. they say the firearm is not a police issued weapon. those who know the family say they are devastated. >> they give back in so many ways. it is just a tragedy and

everybody feels for them. it's really awful. >> reporter: the boy's father and the homeowner is brandon orlando a nine year veteran of the san jose police force. adults can be prosecuted for a felony when guns are lef accessible to children and teenagers. new at 10:00, matt keller is live in gilroy to learn what he's learned about the case and the law, matt. >> reporter: frank we spoke with officers here at the gilroy police department late today and they revealed new details about the accidental shooting death of a 3-year-old boy. investigators are calling the shooting death of preston orlando a tragic accident. they did not reveal how it happened but say the gun used was not the service weapon of preston's father and san jose police officer brandon orlando. >> we have determined that the firearm that was used was a personally owned firearm. at this time i'm not able to divulge who it belonged to. and i can also confirm that it

did not belong to any government agency. >> reporter: other children were at the house at the time of the shooting but determined they were not directly involved. now officers are looking into other circumstances. >> one of those things will be how firearms were stored at the time of the resident. >> reporter: accident prevention act allows for adults to be responsible for a shooting. >> to put a safety lock would probably be the best. to empty out the bullets. >> reporter: no arrests have been made but the law is clear. if the person a parent or guardian no arrest of the person for the alleged violation shall occur until at least seven days after the accidental shooting. defense attorney steve davidson has worked gun cases he expects the district attorney's office will not treat the situation differently just because the father of the victim is a

police officer. >> they're not going to draw this out. there'll be a decision relatively soon. if there's going to be criminal charges we'll know about it before the month i bet. >> reporter: a person convicted could face three years in prison and a fine. officials are on the look out for an escaped inmate tonight. richard norman sasse was cleaning the calf -- cafeteria. he blocked the door so it wouldn't locked then crawled through a food service opening. sasse was awaiting trial on robbery charges. the job numbers for june are out. and unfortunately the numbers are not good. the economy added only 80,000

the dow fell 124 points. nasdaq dropped 38 points. everybody is waiting to see what happens next. yahoo and facebook have reached a settlement in a long simmering dispute. the two silican valley companies had sued and counter sued. the settlement called for facebook to counter. tire car wash agreed to pay $500,000 in back wages and $75,000 in fees. the suit accuses the business of cheating employees out of a play. they were kept in a room and not allowed to clock in until cars arrived. tower car wash is in the city's south of market neighborhood.

landing at san francisco international airport last night. ktvu's amber lee is live at sfo and tells us it happened at a time when pilots are doing if most difficult part of their job, amber. >> reporter: pilots tell us having a laser pointed at them can be blinding. they say it's like having a light shined right into your eyes. the faa tells us someone pointed a laser light at a united express flight approaching sfo at 10:25 p.m. and just four minutes later the same thing happened to a virgin american air flight arriving from chicago. mike mccarren tells us most laser incidents happen while a plane is landing or taking off. >> people probably see a plane easier and are an easier target. >> reporter: that's when air traffic is heaviest. the faa tells us in both of last night's incidents the laser strike came from an area

near palo alto. >> keeping an outside visual reference. >> reporter: pilot calawati flies our news helicopter, he's been hit by a laser. >> we have instruments in there that we have to pay attention to. it's a safety factor of what the round is and what we high run into on the left, right side everybody in front of us. >> reporter: when someone points a laser at a chopper or plane it can light up the whole cockpit and this is what it looks like. and the consequences can be deadly when a pilot can't see. >> when we lose that visual field, it could turn into something very tragic. >> there's a lot of people at risk. it's a dangerous activity to partake in. >> reporter: in found flashing a light at planes could face a fine and jail time.

to the hospital. it happened on island drive. the teen more seriously injured is the driver. >> reporter: at 3:00 this afternoon, alameda accident investigators were back on scene measuring skid mark and trying to figure out how this morning's accident happened. witnesses began calling 911 at about 1:30 a.m. >> a couple of minutes later i heard the kids yelling, screaming, call 911. >> reporter: when emergency room crews arrived they found four 15-year-old girls, and two girls. in video you can only see here, you can see emergency crews using specialized equipment to cut the driver from the wreckage. >> after being extra -- extracated from the car, the driver was taken to the hospital. >> reporter: speed was a factor in this crash. the parents of one of the teens says the car is his and was taken without his knowledge. he also says the closed

containers of beer in the trunk of the car were his as well. >> the parents are very concerned about this, we're wondering how in the world did these kids get in this car, late at night with mom and dad maybe home, maybe not home. >> reporter: if you take a look at these direction, you can see the orange dots, they mark the spot where the car left the road and two out two trees. one of the teens has been released from the hospital. christien kafton, ktvu news. authoritys in contra costa county say they have seized dozens of illegal firearms. sheriff deputies say they confiscated 49 illegal weapons last night from a home in bay point. deputies say they went to a home after reports of a fight. once there they found the cash of weapons including a loaded

oozie. mike kesner was arrested. stockton is the largest city ever to file for chapter 9 bankruptcy protection. today's hearing was devoted to technical matters and will continue next month. stockton got into trouble during the housing boom. the federal government and private landowner has settled a lawsuit over a 2007 wildfire. the government claimed a spark from a bulldozer used by pacific industries caused a grass fire. both sides settled a lawsuit without disclosing the terms. the government was seeking $7 million. the clouds cleared out of the bay area today. we still have mostly clear skies. but over the next few hours,

a livermore teen bitten by a shark during a hawaii vacation has returned home with quite a story to tell. she shares her frightening ordeal with cara liu. >> it was the first day of a 10 day vacation. it was their fourth time back. 16-year-old sage was relaxing in shallow water. >> the reason i was in like two feet deep water is because i hate sharks and i was afraid to go deep. >> reporter: she never saw a thing but all of a sudden she felt the bite. >> it felt like something had bite me but all i could feel was all of the teeth. >> it was kind of surreal, i didn't know what was happening at first. >> reporter: sage was scared but says surprisingly it didn't

it's a verdict that has a lot of people asking themselves. jana katsuyama has the story. >> reporter: it brings up the issue which we asked a law professor today, how can a man that admits assault be found not guilty? for lynch supporters the verdict sent a clear message. >> today justice has been served. >> reporter: lynch was acquitted of felony elderly abuse and assault involved with his former priest lidner. lynch testified lidner abused him and his brother when lynch was four years old. lynch went to the priests los gatos home and confronted him. >> i can understand the

emotion, the anger that would come from that kind of horrific abuse. >> reporter: tim lennon with survivors network of those abused by priests says the case brings a spotlight. but some would say that justice was not served. >> i don't think there is a legal basis for it strictly speaking. >> reporter: evan lee says justice and the jury system is often up to the jurors interpretation. >> in some case the victim, the priest was on trial himself. not legally but her happens in the eyes of some of the jurors. >> so does the verdict send the message that people can take the law into their own hand and be set free. >> nothing that happens in a trial court is a precedent. whether it inspiring to go out and behave differently is not a question. >> reporter: prosecutors have until next week to decide

too many of our friend and family members and neighbors are still out of work. >> reporter: when he got back to the white house president obama signed legislation to keep jobs on transportation projects for two more years. it also keeps interest rates from going up on loans for mills of college students. it was a really sad ending to a story that started out so happily today. the owner of a restaurant in akron ohio where president obama had breakfast died of an apparent heart attack shortly after this meeting. josephine harris was all smiles as the president stopped. after the president's learned of harris death he called her family to express his condolences. thieves have targeted a church for a third time. >> and i look at this and it's

maddening. >> reporter: father john petigo gave us a glimpse of what's left in this closet that contained equipment used at guadalupe church. >> the people are so sad, they said what happened? this happened. somebody come in and take all and don't left nothing. >> reporter: the church has been burglarized three times in the last week and a half. the latest happened on the 4th of july. this home video of a mass shows how musical this congregation is. it took the congregation six years to get their equipment. >> this church is held together with benal floss and duct tape in some ways. there's no money available immediately to get these instruments replaced. >> reporter: father pedigo says there were no forced entry but the third time a side door was busted open. police are investigating. >> you have hundreds of these

things being sold at the flea market and so it's going to be impossible to figure out who did what and how they got there. >> reporter: but choir members say although their instruments were taken, the burglars did not take their voices. police have released a sketch of a man who attempted to sexually assault a jogger. he is described as a man in his 30s, and weighing about 250- pound. investigators say a 17-year-old girl was jogging in sea scape when the man exposed himself. he then tried to grab the girl but the girl ran away.

oakland police are investigating an officer involved shooting this weekend. the accident happened near the mexicali rose restaurant. police are only saying they made one arrest and no one was hit by the gunfire. our cameras did see a bronze sedan that had collided with a police car. we are told the driver of the car drove the wrong way down a unwithin way street and hit the police car head on. investigators from major crimes and internal affairs were on the scene. there's new evidence in the case of that san francisco

couple accused of killing a man who they say was their daughter's pimp. and prosecutors say that evidence proves there were others involved. district attorney george gascon says footage shot for the fbi just happens to show alfonso williams meeting shortly before the fatal shooting. >> what the camera shows is basically it shows the three individuals coming together. there's a weapon that was taken out of a vehicle. >> reporter: the girl's mother lupe macado also faces charges in the death of calvin sneed. the two blame sneed for luring their teenage daughter into a life of prostitution. george zimmerman walked out of jail free on jail. he is the neighborhood watchman facing charges in the shooting death of teenagers trayvon

martin. zimmerman's parents put up their home as collateral so he could make his bond. zimmerman must wear an electronic monitoring device now and stay within seminol county. a confidant of assad has defected. his defection is considered the first major crack in the inner circle. the news may give hope to those trying to topple assad. in romania the -- has voted to bring down the prime minister. a referendum will be held to

determine if he can return to office. in mexico a partial vote recount reaffirms the election of enrique pena nieto. he won the presidency with a margin of 7%. votes were recounted after allegations of fraud from another candidate. lopez abrador says he is still not satisfied and will file a formal challenge in electoral courts next week. the next ethics hearings are expected to raise questions about the testimony of san francisco mayor ed lee. mirkarimi's attorneys told ktvu they want to challenge lee's testimony when he said he would offer mirkarimi a deal if he resigned. all of this and another incident is raising questions of perjury. >> if the evidence surfaces after we have sworn testimony to indicate that perjury has

okay let the revelry begin. thousands of people joined at the city square in pamplona spain. they partied before the real excite -lt begins tomorrow. that's when six fighting bulls and six steers will charge down the street as the runners run ahead of the animals trying not to get hit by their horns. and this is anne canyon throws out the first pitch at municipal stadium and for the big event the grandmother of 15 brought along 50 of her closest friends and family. canyon was picked after she caught a foul ball with her bare hands at the saturday giant's game back in june. >> not bad. wow. mark is now back with sports.
