complete bay area coverage starts now. this is the 10:00 news on ktvu. >> a shark attacks a kayaker. good evening. i'm ken wade. >> and i'm heather holmes. the 52-year-old man had a great scare when it tried to take a bite out of its kayak. it happened near santa cruz in an area that is popular for

surfers. eric rasmussen is there live. >> reporter: this happened behind a kilt bed about a quart mile from here. there happened to be a shark expert doing research and he rushed or here when he heard about the attack. in the middle of a surfing hot spot near santa cruz it was a kayak attacked by a shark. police pulled the boat out of evidence to show us the bite marks. >> he had started to paddle and go through the water will a shark grabbed the front end of it. >> reporter: wildlife experts spoke to the man. the 52-year-old fisherman from fremont was thrown from the kayak and unharmed when another boater rescued him. >> it was a white shark looking at the width of the tooth. >> reporter: police photographed a shark tooth they found lodged in the kayak.

despite warnings from the sheriff's office, surfers and boogie borders flocked there. >> it is scary but i will be out here tomorrow morning. i know that sharks are out here. >> experts say a larger than usual amount of wildlife in the bay may have brought the shark into shallow water but the risk of another attack remains low. >> sightings are common. >> the kayaker did not want to be identified. they be holding on to his kayak in case others want to examine it closer. there was a fatal shark attack more than 30 years ago in pacific grove. 25miles south of pleasure point in 1991, 25-year-old lewis moore was attacked by a great white shark.

he was estimated to be 21 feet long. prior to his death there was only 4 fatal shark attacks and none of victims were surfers. there was a body recovered in marin county. it came in on the peninsula north of elephant rock. fire officials say they received a report of a missing man, possibly a fisherman. about an hour later someone spot add body. swimmers covered the remains, there is no word on the victim's identity or how he came to be in the water. part of san jose's busy willow glen neighborhood was shut down because of a bomb scare. san jose police were called about 12:25 to investigate a suitcase found near a bench among the 1100 block. police evacuated shops while the bomb squad took over. the suitcase contained a type writer. investigators don suspect

anything criminal was going on. oakland police was alerted to a drive-by shooting. it happened at 3:00 p.m. on 73rd avenue. one man was shot. witnesses say he was able to make it to a nearby store when he told the merchant to call for an ambulance. the victim was sitting on the couch when someone opened fire. there was reports that a second person may have been hit but police were able to locate one victim. his injuries are not life threatening. police crisscrossed oakland responding to three different home sides in five hours. the latest killing was at 24th avenue around 11:00 last night. there were two more deadly shootings earlier. the victim's names have not been released and police say they made only one arrest. san francisco police are investigating a shooting that left a teenager injured.

the teen was standing with the a relative at san bruno and felton street when he was shot. it happened about 5:30. was taken to the hospital with a gunshot wound. the gunman fled on foot. occupy protesters returned to a five acre plot of land in albany, the same site kicked out of last may. we found out why they returned and what they are demanding now. >> reporter: they picked baskets full of crops. 80 protesters with the group occupied the farm that came back to the gil track. >> we got cucumbers and parsley and baseley. >> reporter: this is uc berkeley owned land within albany city limits. occupy the farm moved in with the goal of converting it to an urban farm. the group planted 70 rows of crops and camped out and tended to the crops until the protests came to an end on may 14th.

university forced the protesters out but kept the crops alive. >> we are creating a small work group and we are going to be harvesting and weeding. >> reporter: the protesters were not invited. >> they are harvesting the crops that we planted in early may. >> reporter: university officials and albany city leadings planned a par vessing party and canceled it when they learned that protesters planned to show. >> i think that dean felt the tensions were too high. >> reporter: they want all future volunteers to go through an application process. you have to be an albany resident and can't be supportive of occupy the farm. >> we wanted to be able to trust people to be respectful. >> reporter: occupy the farm still wants this land to become a community garden. >> you will be back. >> we are committed to weeding and harvesting because that is what the plants need. >> reporter: albany city council member joe ann while says the city wants an urban farm but at the root of this conflict is how and who would

be in charge of running it. more details now, the albany city council is considering approval of a new whole food store south of the gil track area. the grocery store and assisted living housing complex would be built on happened owned by uc berkeley. dozens will pack the city council meeting on monday. the regular city council meeting is set to move to the albany community center. an event aimed at helping families affected by police violence brought together dozens in oakland. >> the im oscar grant event was held this afternoon. nine other people have been kill by law enforcement. today's events focus on the families left behind. we will let them know that

we will do whatever we can to help them get through this. >> oscar grant was killed on january 1st, 2009 by barto officer messerly. he was convicted of involuntary manslaughter and served 11 months in prison before being paroled. new at ten tonight, a spirit airlines passenger who was apparently upset that his flight was delayed by more than three hours was taken off of the plane by al meda county sheriff deputies. the man was taken down the screen on the right side of the screen. the man was on a plane scheduled to leave oakland for las vegas at 8:45 this morning, around 12:30 this afternoon officials say he acted unruly and was asked to leave the plane. when he refused the plane was evacuated and sheriff deputies were call township remove the man. the avon walk for breast

cancer kicked off with thousands walking for a cause close to their hearts. the 39.3-mile two-day journey takes the participants through parts of san francisco and marin county and the money raised will go for research as well as preventive and diagnostic care. tonight the walkers are resting their feet at a camp site and that's where we are live with the emotional messages behind the march. >> heather, their tents on a sea of pink in this park. everyone is tucked in for the night. 2200 walkers raising almost five million dollars to fight breast cancer. there are rest stops on the route but this is the dance stop. >> we started this ten years ago. >> as long as the avon walk has been around. this cheering section has been keeping spirits up and feet moving. >> we want to give that you last bit of smile and energy to

participants through marin county and across the golden gate bridge to fort mason and the closing ceremony is scheduled at three p.m. for friends and family to welcome back all of the walkers after their 39-mile journey. another event today aimed at ending breast cancer took place under different circumstances. inmates at san quentin held their own anti cancer walk. it mirrors the aftervon walk. an inmate explains that it touches them and their families as well. >> it is to let people know that they are doing about rehabilitation and security and everything and rehabilitation and they allow us to do that. it brings us the human side that we lost a long time ago. >> 200 inmates made donations and their goal is to raise $10,000 for the avon program. people in the washington

firefighters in shasta counties contained a wildfire southwest of reading. the dale fire is started thursday and burned 1230-acres disturbing two buildings and damaging five homes. evacuation orders have been lifted for 100 people. there was no word on what started that fire. meantime the crippling heat wave across much of the united states could be coming top wind as melissa rainer reports that people are coping with the heat anyone they can. saturday brought another day of blistering heat in some places that means another day of triple digits. the record-breaking heat has been blamed for scores of deaths. people look for relief wherever they can find it. >> it feels great. it feels so wonderful. it beats the heat. that's for sure. >> in chicago, the heat buckled roadways and some residents gave up and fled the city. >> in chicago it was 105.

fire or flood. you can't control either one. portions of roads had to be closed yesterday as debris and water left it completely impassable. meteorologists say there's a 50% chance of thunderstorms through tomorrow afternoon. in election 2012 news, john boehner went to ohio for mitt romney. he went to headquarters outside of cleveland. romney is vacationing with his family in new hampshire. the latest poll shows president obama has a 9 point lead over romney in ohio with 40% supporting mr. obama and 38% supporting romney. no president since 1960 has been elected without winning ohio. meantime the man that could eventually become the republican vice-presidential candidate was in north carolina

this weekend. romney has said the campaign has mark rubio as a possible candidate. senator rubio was at a book is store signing his book. a job report shows 80,000 job bees were created in june. president obama used his weekly address to sign his measure of law offering 150 billion- dollars in highway and transportation standing. >> it will keep thousands on the job rebuilding our nation's infrastructure and keep interest rates on student loans from doubling which would have hit more than 7 million students. supporters say the transportation measure will save is 3 million jobs. the current unemployment rate is 8.2% nationwide and in california it is higher at more than 10%. the family of an elderly ohio restaurant owner that died hours after meeting president obama said they were very pleased that she could meet mr. obama and they recorded the

woman elizabeth emkin of danville, 51% to 32%. einstein is seeking her 4th term, 88% of people were able to give opinions of einstein and only 35% were familiar with emkin. massachusetts congressman barney frank got married to his long time partner jim reddy. he is the first gay member of the house of representatives when he came out in 1987, the first congressman to be in a same-sex marriage. nancy pelosi was on the guest list. frank is retiring after serving 30 years in congress. an apparent affair between two southern california councilmembers turns sour. what prompted them to take out dueling restraining orders against each other. talk about a wild ride, what caused a semi to crash into a person in restaurant two

returns to our forecast. some pretty amazing video to show you. take a look. a tractor-trailer lost its brakes and slammed into a gas station. the truck came barreling towards them. despite the danger as you see here, one woman actually then gets out of a minivan and runs to the truck and pulled off the windshield and helped a female passenger get to safety. police say the truck lost its brakes. no one was injured. secretary state hillary clinton made a surprise vis to it afghanistan to announce that country has a special designation as a major nonnato al lie of the united states. clinton made the announcement

as she stood with afghan president carzie. there is access to military training and excess mill supplies. afghanistan would also be able to obtain equipment loans from the u.s. and financing for leasing equipment. israel, japan, pakistan and other asian and middle eastern al lies have the same designation. following her visit to kabul hillary clinton is raising money for aid to afghanistan. the donors are working on a system to monitor where the money goes to make sure it is not wafted corruption or mismanagement. russia, at least 140 people

dead after there were flash floods. there was two months worth of rain. many of the survivors climbed on to trees to escape the water. rain will continue through monday. a celebratory feel on the streets of libya as the people voted in the first election in more than four decades. three million libyans registered for the national assembly. that group is charged in drafting a constitution and parliamentary elections. people were prevented from voting but some said it did go smoothly in more than 90%. gadhafi did away with the voting in 1969. a 7 3-year-old was injured as thousands raced ahead of bulls in spain.

that controversy the suicide barrier on the golden gate bridge could be one step closer to completion. president obama yesterday signed a transportation bill that provides federal funding for suicide prevention including safety rails and nets on bridges. the suicide barrier for the bridge will cost an estimated $50 million. critics of the barrier say it would mar the beauty of the bridge, supporters say it would save dozens of lives. today those buried in a cemetery recently discovered that they will be remembered. the ceremony comes as crews prepare to remove those coffins. an emotional service to honor the unknown. as a bishop blessed the site

more than one hundred pete gathered. community leaders from various faiths offered prayers for the hundreds of people buried here and most of them poor and many nameless when they died. we ask the lord to con to hold them close. >> gloria feels a strong connection to this century old cemetery. >> she believes her grandmother is buried her. danna that was buried in 1915 and her family couldn't afford a proper burial. >> they weren't john does. they came from families. they weren't just indigent. they didn't have the money and they were buried her. crews unearthed several coffins at this site and it became clear this was an old cemetery paved over and the hospital didn't know it. >> even though we don't know them, we feel they deserve

scuffle. officers were talking to two men on dickie lou street in the meadow view neighborhood on the south side of the city. the officers noticed the butt of an assault weapon sticking out from a man's shirt. that's when the officer and armed man reached for the gun and began to struggle. it was during the struggle that other officer drew his weapon and fired several shots killing the armed man. the other man was detained. police say he was not armed. volunteers set out to search for missing teenager sierra lamar. organizers are putting together volunteer searches hoping to find any sign of the girl. this morning another group of volunteers held a carwash to raise money for the continued search efforts. sierra was last seen on march 16th as she left for school. garcia torres has been arrested on suspicion of killing sierra. despite that, friends and family are holding out hopes she will be found alive.

result, dense fog and as a result matter of the coast only in the upper 50s to right around 60 degrees. overnight lows in the 50s, pretty chilly for santa rosa and right around the bay. there is a weather system out here to the north and west. this will coal us off a little bit. the warmest location in the lower 90s. here is the deal with high pressure returning. this is the system responsible for the warmup across parts of the country this past week. this edge is closer to the state and you can see the trend warming up a bit into monday. not too much but look what happens into tuesday. a big bound from the readings, tuesday, wednesday and thursday hot numbers and inland in the 90s. here is the microclimate, at least fog cosi and temperatures in the 60s to the lower 70s by midweek. we will have options. here is the forecast model showing you dense fog once

again tomorrow morning, a few patches could be sneaking into the bay right across the golden gate bridge and clouds in the shoreline into the afternoon and this red contour links up to the 90s. warmest locations around the 90- degree mark and most spots cooling off three to six degrees. oakland will go 72 and antioch and brentwood in the 80s. watch out for a drop off in visibility from pacifica and ocean beach first thing tomorrow morning with the fog. here is a look ahead. your five-day forecast with your weekend in view, temperatures a little bit warmer into monday and you will feel it inland for tuesday, wednesday and possibly thursday. mid to upper 90s and the coast mainly in the 70s. heather, and ken when i go
