lawsuit against the killer and why. good afternoon, lorain. >> reporter: the civil suit is being filed on behalf of his children. inside the courtroom riser made several attempts to speak with reporters but the bailiff would not allow it. and a half during the few minutes we were allowed to shoot video inside, we weren't allowed to shoot or record any sound. potential jurors filed into a courtroom for jury selection in the wrongful death lawsuit. riser was convicted in 2008 for killing their mother nina 2 years before. inside riser placed pictures of the children on his table to represent himself for the trial. attorneys for the young risers say they'll fight the case without the children present. >> we'll do that by having other people who knew children talk about nina and her relationship with her children which everybody agrees was a wonderful loving relationship.

>> they seek $2.5 million in damages. riser claims he doesn't have the money but -- >> there are a number of people that think that mr. riser has money somewhere in russia and perhaps in the united states. if he does what we need is a judgment so that we can try to find those assets for the children. >> the plaintiff's attorneys will also argue for the authority to seize any assets riser may receive from future ideas the software developer may come up with while in prison. >> reporter: attorneys suspect that selection to continue tomorrow morning and then they'll start opening statements. ktvu has requested to speak with riser. right now we are waiting. reporting live in hayward. ktvu channel 2 news. >> thank you lorain. police are looking for a gunman in connection with a shooting that left 5 people injured outside a busy movie theater. it happened around 9:30 right in front of the regal theater

near washington street. one victim underwent surgery over night and is now listed in stable condition. the other four are also expected to survive. police suspect the shooter may have been in a car driving by. witnesses describe the scene a total chaos outside the movie theater. >> people were getting trampled. it was crazy. >> still not clear what led up to the shooting. police talked to a number of witnesses, but so far there is no suspect information. the identity of a critically ill patient at san francisco general hospital is no longer a mystery. they say the man's family came in last night and identified him. he was admitted to the hospital saturday after falling from an over pass on interstate 280 near evans avenue in san francisco. he's been unconscious suffering from multiple life threatening

injuries. debate about plans to build a new hospital is heating up again. we'll tell you what happened this morning as hospital officials try to assure people from one neighborhood they do not have to worry about having medical service. san francisco international airport is getting a new control tower, new at noon ktvu joins us live to explain why some heavy hitters were on hand for the ground breaking ceremony, good afternoon alex. >> good afternoon to you. this is the spot where local and federal officials grabbed their shovels a short time ago and they officially broke ground on this new state of the art air traffic control tower that will be going up here. it's going to be squeezed here where i'm standing between terminals one and two they're going to have to tear down this walkway in order to make room. this new 221-foot tall tower will have modern air traffic

control technology. along with transportation secure tear and the acting director of faa. the faa will be kicking in about 70 million of the $102 million price tag. here is animation of what this new tower will look like as it takes shape. the new taller thank you tower will give controllers a better view of runways and it will be equipped with next gen satellite technology designed to reduced delay. >> celebration today about this announcement is important because it really does take us to the next generation of technology. when this tower is open, it will have the next generation technology for guiding planes in and out of this airport and guiding people on those planes in the safest possible way. >> reporter: another reason this decision was made to build a new tower, well there were

seismic reasons involved, the current tower not seismically sound. the new tower will withstand a magnitude 8 earthquake once its built. it's expected to create hundreds of jobs construction and otherwise all of it supposed to completed by the fall of 2014. live this afternoon at sfo alex, ktvu channel 2 news. >> thank you alex. >> soon people who live there the oakland airport could be hearing more noise than usual. crews will be driving concrete pilings into the ground as part of the airport's $200 million terminal renovation project. work is supposed to continue for the next 2 weeks. shortly after the sfo appearance u.s. transportation secretary will cross the bay for a visit to the port of oakland this afternoon. coming about a month after the transportation department awarded the port a $15 million for the oakland army base redevelopment project. it will be used to improve rail access around the port. governor jerry brown and oakland mayor will also be on

hand for the visit to the port. president obama is calling on congress to expand bush tax cuts for the middle class. but these tax cuts would only be for people who make less than $250,000 a year. the president opposes extending those cuts for wealthier people. he says there's a bipartisan agreement to preserve the tax cuts for the middle class and letting them expire will be a big blow to working parents and serve as a drag on the economy. >> we need policies that grow and strengthen the middle class, policies that help create jobs, that make education and training more affordable, that encourage businesses to start up and create jobs right here in the united states. >> congressional republicans are expected to push for extension of all attacks including the cuts for wealthier americans. starting today cal tran is testing a new system that

predicts train arrivals and departures. the system uses gps technology to track trains. that information will be displayed on digital message signs at train stations and included in live audio announcements all week. the system is expected to launch by the end-of-the year. at that time riders will be able to sign up for e-mail and text message alerts with real time train data. a san francisco bike sharing program will not be up and running in time for the americus cup event in august. officials say the program will not be ready because negotiations with a vender is still on going. proposed creating a bike sharing network in san francisco after seeing the system at work this europe where cyclist can pick up and drop off bikes at select locations. >> we really do. i don't think -- >> computer users and security experts are nervously watching to see if an internet threat

several wile fires continue to rage north of sacramento. five fires have broken out in the last 5 days and two of them have merged into the site's complex fire. firefighters are dealing with high winds and high temperatures, so far the five fires combined have burned nearly 1600 acres and are 10% contained the site complex fire is burning west of the town of max well. no structures have burned. there's no word yet on what sparked the fires. >> environmentalist say they will turn in more than enough signatures today, possible november ballot fight. the ballot measure would go to voters in november and it would require san francisco to draw up a plan to draw up a valley to its natural state. if voters say yes in november and supporters will put another measure on the ballot in 2016 to require the draining of the reservoir. the system is water supply for more than 2 million people in

the bay area. the farm protesters say they will be at tonight's city council meeting no protest plans to develop a plot of land owned by uc berkeley. on saturday the protesters went back to the uc berkeley plot of land in albany to harvest crops they planted last spring. the protesters want the land to be used as an urban farm. the uc berkeley plans to build a whole foods grocery store and senior housing complex around that part of the land. we sent our ktvu camera out to plot of land to check on things and all quiet no one was around protesters do not seem to be occupying the site as they did back in april and may. because of the increased interest in the city council meeting tonight. city leaders move their regular council meeting location from albany city hall to the albany community center. the meeting starts at 7:30. student leaders at city college of san francisco have called an emergency meeting

tonight over threats the school might have to close. the organization that accredits community colleges have given ccsf eight months to figure out how to deal with its financial problems. the groups report also criticizes the school's leadership as being weak. the meeting is set for 6:00 tonight at the lgbt center at 1800 market street in san francisco. supporters of controversial plan to rebuild two san francisco hospitals fired back at city officials today reaffirming their commitment to the project. doctors and hospital administrators for the california specific medical center and saint luke's hospital sent a letter to mayor ed lee. the mayor recently said if the hospitals do not commit to operating saint luke's for 20 years, the entire deal is off. hospital officials say they are ready to spend 2 and a half billion dollars to build two seismically safe hospitals on cathedral hill. >> and we have committed to

operating that hospital after it opened for at least 20 years unless we have a substantial decline in our ability to do so because finances change. >> a committee of the board of supervisors will take up the hospital plan today beginning in about 45 minutes. a police pursuit in oakland ended with a crash outside of a church late last night. the suspect was arrested thanks to quick action by church members. witnesses say the suspect crashed into a fire hydrant and some parked cars outside the east oakland faith deliverance center. church services were going on when this all happened around 11:30. members say the suspect ran inside and some members tackled him. >> what was he saying. >> it wasn't him, it wasn't him. we know it was him. >> police say officers tried to pull the suspect over after a check on his car he was driving revealed it was stolen.

witnesses say it took about 30 minutes to turn off the water and church does have water damage everyone it's a trend that worries some people law enforcement agencies demand customer cell phone information. the new york times report that last year carriers received at least 1.3 million request for consumer information related to investigation. surveillance includes everything from text messages to customer's location. some were in privacy being compromised and some carriers reported what they call inappropriate request. more than $17 million is missing from trust funds in the south bay. according to the san jose americay news the money disappear fred 35 fund. the funds belong to mostly elderly clients an were all under the management of back house fiduciary services and campbell owner christine blames her exboyfriend and former business partner for embezzling the money. the fbi is involved but no arrests have been made.

computers security experts are nervously watching cyber space today ominous warning about a possible mal ware attack. it's called dns changer -- dns changer. it makes it impossible for people to log on to the internet. the fbi estimated 4 million computers were infected worldwide and set up a special web site to help. security experts estimate 47,000 americans computers might tim be infected. >> we desparately hope that the consumers that did the right thing over the course of the last week, they checked the machine, they cleaned them up and we hope today that it's nonissue. >> experts say if you cannot log on to the internet call your service provider for help. google is supporting gay rights and its campaign called legalized love. the internet and software giant based in the south bay said it

will focus on countries with antihome sexual laws. the campaign is to promote safer conditions for gay and lesbian people inside and outside the office. google is frequently named lgtb frequently workplace by gay rights organizations. organizers declaring avon walk for breast cancer a success success. about 2200 people including myself and some old friends walked from san francisco for a total of 39.3 miles and i got a few blisters to prove it. it was a great experience. the walk raised $4.8 million for local breast cancer charities and research. good afternoon to you. >> well that weather was great this past weekend and we're looking at another day very similar to sunday giving you a live look outside our doors.
