at 6:00, what we over heard mayor jean quan said when governor jerry brown joked about coming back. all 5 victims are expected to survive. they are in stable condition. noelle walker, ktvu channel 2 news. tonight a second arrest in the murder of anthony bologna who was shot and killed in san francisco with two of his sons in a case of mistaken identity. it is developing news. ktvu channel 2 news paul chambers tells us who is in custody and how he was found. >> reporter: within the hour i wrapped up an interview with edward ramos' attorney. his attorney said the time during the trial that edward ramos says he was not the gunman in the murders but this man was. 31-year-old wilfredo reyes. he was arrested this morning in north carolina. he is a known member of the ms-

13 gang and wanted for the murders of anthony bologna and his two sons. last month edward ramos was found guilty, however edward ramos' attorney feels that the timing of the arrest is suspicious and she is frustrated especially since she told them wilfredo reyes was in north carolina. >> they put off arresting this man because they knew there was a chance the truth would come out that edward ramos did not murdther bologna family. >> reporter: -- murder the bologna family. >> reporter: he said today i share this major development with the bologna family. we are one step closer to bringing this individual to justice. >> the suspect is in custody in north carolina and he will be transferred to san francisco.

murdering his wife. now attorneys for their children are seeking any assets he has or money he might earn in the future. he is affecting as his own attorney and asked that his children be returned from russia where they are living. >> i don't think it would do the children any good to come here and testify. i will say that the children are traumatized. and they probably will be for some time. >> jury selection will wrap up tomorrow. an emergency town hall meeting in an attempt to save ccsf. the school is one of the largest community colleges in the nation with 90,000 students. ccsf lost $17 million in funding from the state over the past year. at tonight's meeting, students,

request from cell phone companies. the marine county coroner identified a body of a man pulled from the ocean. the fire department was called about 2:30 p.m. saturday afternoon when a ranger saw the body in the water. a person told authorities the victim may have been fishing in the area. another apparent drowning victim also has been identified. he died saturday in a small lake. witnesses say he was on a raft, 20 feet from shore when he fell into the water. his friend jumped into the lake but wouldn't find him. crews are busy battling major fires in northern california, flames are fueled by dry conditions and high temperatures. ktvu's ken pritchett joins us

live north of the town. >> reporter: i want you to look behind me, that is not cloud cover. we have blue skies out here. that is all smoke. you can follow it over to where 30 minutes ago there were visible columns of smoke feeding that cloud. 1100 firefighters from cal fire in the foot hills there. they have the fire here at 40% containment. we were there this morning and this afternoon as firefighters held one flank of the fire. >> reporter: here this afternoon you can see one arm of the fire burning. cal fire used water drops to shape the fire's edge and crews cleared out a line ahead of the fire to stop it cold. three fires were contained yesterday, two burned together

now as one. this is video from last night hours after the fire started. cal fire made progress last night as winds calmed down but the fire roared back today. >> with the triple digits temperatures it is a major challenge. >> reporter: no homes are threatened here. the cause is unknown. so far cal fire fought twice as many fires at this time compared to last year but most have been small till now. >> because we didn't get a lot of rain, the grass, brush is already to burn and a little wind is all it needs to take off. >> reporter: as you look at the smoke, there is an optical allusion because the smoke is coming from two major fires. the one we talked about here today and there is another fire in the line of sight, in the national forecast, many miles

west of here. that fire started saturday. it is 2500 acres and 10% contained. cal fire says because there are two big fires in close proximity, they will bring in a dc10 converted airliner, they will bring it in to try to knock down the fires perhaps starting tonight. ken pritchett, ktvu channel 2 news. five 13-year-old boys are facing charges charges for starting a fire after starting off illegal fireworks. all five were sited for conspiracy and burning property and released to parents. firefighters from san jose and cal fire are mopping up

after a brush fire. news chopper 2 was over the scene an hour ago. no structure damage or injuries were reported. a oakland man escaped from a fire that damaged his home before 3:30 a.m. this morning. firefighters say the home was fully engulfed in flames when they arrived. a man tried to get out but the flames were too intense so he released the security bars on a window and jumped out. the cause is under investigation. a police chase in oakland last night ended with a crash outside a church. the suspect was arrested thanks to quick action from the church members inside. services were just ending last night when the car hit a fire

hydrant and parked cars outside the center. the suspect jumped outf the car and -- out of the car and ran inside the church. some heard the crash and tackled the man in the church lobby. >> big man came out, we seen a guy running in the church, he hit a couple of vehicles and we held him down till the police came. >> police say officers tried to pull the suspect over after a check on the car he was driving showed it was stolen. judge denied a injunction by an opponent. she was seeking an injunction. she would not appeal the ruling but another taxpayer association said it might. millions of people continue to receive a tax break from the

inland mountain community were surprised by what landed in their neighborhood. last night we told you about starving pelicans, but as ktvu's janine de la vega tells us, today's case is rare. >> reporter: we are used to seeing pelicans here at the beach. this afternoon we saw several but to find one in a residential neighborhood, while life experts say that is unusual. >> reporter: this pond is located in the center of a senior community center. it looks like he is enjoying the scenery but he is being a guardsman. at his feet is a pelican. >> never seen any here. kind of a mystery how he got here. >> reporter: they are 8 miles inland. a bird was barely moving and put up caution tape and waited.

>> i recognized right away it was a california brown pelican and that it was not behaving normally. >> reporter: first responders picked up the pelican. they say the past two weeks they have been getting called to pick up starving pelicans throughout the county. it is just what they call a natural die off. >> now that the population is big and strong, we are seeing more die offs. there could be 80% of die offs. they are not all supposed to make it. >> reporter: it was taken to a rehabilitation center. when we arrived, four more were brought in. three died and this is the loan survivor. >> where did you get this? >> by the peer. >> reporter: two more were brought in as we were leaving. both were found on the boardwalk. they will try to nurse them back to health.

built. john? >> reporter: this is the hotel, long vacant and the hope for the site of a new hospital. >> reporter: they want to turn this into this. a billion dollars 550 bed state of the art hospital. supervisors caught up in the conflict. the city's problem with the deal is what to do with this, the aging st. luke's campus. they plan to spend $300 million updating and down sizing. the city wants a guarantee they will stay open 20 years but the hospital said this: >> we have committed to operating this hospital for 20 years, unless we have a substantial decline in our ability to do so. >> reporter: that means two years in a row of 1% or lower

margin. we caught up with mayor ed lee who said a deal like that won't fly. >> i am getting closer to getting satisfied. i didn't like the news that occurred last week and so i wanted to put it in writing. i am feeling confident that will move forward. >> reporter: after 10 years, supervisors scheduled a vote in a week from tomorrow. there are other issues but they say if there is no construction agreement, st. luke's may be forced to close next year because it does not meet safety standards. john fowler, ktvu channel 2 news. officials gathered at the port of oakland to announce a grant to pay for rail development. it will be part of a larger redevelopment of the army base.

ktvu's allie rasmus reports on the debate over the hetch hetchy reservoir. >> reporter: in five san francisco homes and businesses, 85% of the water coming out out of the faucets comes from the hetch hetchy reservoir, 160 miles away from here. the hetch hetchy reservoir stores 117 billion gallons of water and all flows down hill and provides water to san francisco and 20 other bay area cities. today the campaign turned in 15,000 signatures for the ballot measure. if passed it would direct the public utilities commission to drain the reservoir. >> figure out, if there is a way for us to undue the damage we have done because no other city has done damage like this to a national park. >> reporter: the p.u.c. says without the reservoir -- >> we would have to find a new source of water, a place to

more details on ktvu's hetch hetchy reservoir. it delivers 260 million gallons of water every day. we live in a hurry up world and the chp is writing thousands of tickets every year for people caught speeding. tonight we crunched through numbers and have the top three freeways in the bay area where speeders are getting tickets. >> a lot of chp, underneath the over passes. >> reporter: he was getting a fill up along the number one place to get a violation in the bay area. we will tell you where that is in a moment, first how we found the top spots. we combed through databases, sorting out tickets. the majority are for speeding. the number three hot spot is in the north bay, on interstate 80, between american canyon road and red top road.
