the principal we're talking about lives in san jose. because the first incident wasn't reported another child ended up getting sexually abused. >> reporter: frank, we were the first people to peak with prosecutors here at the district attorney's office. just minutes after charges were filed against a san jose elementary school principal. the elementary school was rocked by the arrest of craig chandler back in january. now the principal, is also charged. >> a child came forward in october of 2011, and gave

information to miss vijayendran. >> reporter: she instead went to the teacher after the claim was made against him. he denied the accusation, and prosecutors say no one reported anything until january when the mother of another alleged victim went directly to police. >> unfortunately, the results were tragedy. another child was molested after the initial child made the report. we believe that forensic evidence may have been lost. >> reporter: we went to vijayendran's house after the charges were filed. a statement said they had no way of knowing the conduct was sexual of nature. san jose attorney robert alard specializes in sexual abuse cases and feels people who don't do their job and report should face charges.

>> a misdemeanor is just a slap on the wrist. yes it makes the news, yes it increases awareness. but as far as her own personal accountable, what message does that send? that's why the law needs to be changed. >> reporter: principal vijayendran's attorney says she is still employeed by the evergreen school district and has not been suspended or fired. matt keller, ktvu, channel 2 news. in livermore, detectives tracked a suspected child predator to the city of lodi where he was arrested today. they took him into custody on three sexual assault charges involving a 6-year-old child. investigators say the crimes took place from 2003 to 2004 and munez is also investigated in other cities for similar crimes. at this hour in berkely, a protest is set to begin over a proposed ban on sitting and lying on city sidewalks. the city council is expected to

vote tonight on whether to put the measure before voters on the november ballot. berkely already bans lying on the sidewalk, and this measure would ban sitting on the sidewalks in commercial areas. supporters say the measure would improve the downtown district for merchants and customers. a sit in and boycott is set to begin right now on telegraph avenue. newly released statistics show violent crime is on the rise in oakland and what happened just today is an example of that troubling trend. paul chambers is live now in oakland where the chief is about to explain what's happening to the se council. >> reporter: that meeting will happen an hour and a half from now behind us at city hall. they will talk about the crime rate which is up in some major categories. and just within the last 24 hours, six people were shot and one person was killed. shootings had officers extremely busy. chopper 2 was on the scene of

this homicide. police say a 20-year-old man was found dead in the backseat of the car near the freeway offramp. however, it's believed he was shot somewhere else. in three situations, police say there were attempted robberies. rapes are up 31%. robberies 27%, and burglaries are up 42%. councilmember reed says part of the problem is the lack of officers on the force. >> we lose about five officers each month. we've got another 90 officers either on light duty, or not working at all. >> reporter: another issue some say is the lack of planning by the city. crime stats show the police department's 90 day crime suppression isn't working as expected. >> we're frustrated. all of us are part of the city.

all of us have equal responsibility. >> reporter: we attempted to talk to mayor kwan about the crime stats and all the overnight shootings. she declined our interview and asked that we talk to police chief jordan tonight. live in oakland, paul chambers, ktvu, channel 2 news. the bart police department has cleared the officer who shot and killed a homeless man in san francisco one year ago. security footage showed officer james crowle opening fire at the civic center bart station. the officer said he shot 45- year-old charles hill after hill threatened him with a knife. bart's decision comes five months after the district attorney determined that the officer had acted in self defense. investigators are looking for what sparked a fire that destroyed an already fire damaged home in martinez. calls about the fire came in about 3:30 this morning. the fire was fueled by a broken underground gas line. investigators say that today's

fire may have been started by either construction equipment or by trespassers on the property. another vacant house suffered damage from an early morning house fire in saratoga. the cause of this fire is under investigation. with california's fire season now in full swing, we wanted to take a look at how this year, compares with recent years and our consumer editor is live at sonoma airport at cal fair's attack base. >> reporter: here it has been very busy today. these huge tanks make and store the fire retardant that these tankers drop. these have been out several times and there's still plenty of daylight left. hundreds of firefighters are battling blazes in triple digit temperatures. near the colusa county farming

town of maxle, a 3700-acre blaze is 50% contained. the state's current megafire is in the mendocino national forest and has assumed more than 10,000 acres. 15 square miles so far with only 10% containment. cal fire tanker pilot, a veteran of 36 years of california fire fight says he's never seen it this dry and there's plenty of fire season left. >> it's not getting any wetter. it's getting drier. the fire activity is becoming much harsher. it's very rampant. we have been extremely busy this week. >> reporter: the fire season as of yesterday compared to the same period a year ago, cal fire has responded to 2864 fire missions. last year, it was only 1750. the five year average is 2451 missions. this year, 16,400 acres have burned compared to just 13,000 last year. all of this is well below the five year average of more than

62,000 acres consumed in really big early fires. but now, the fires seem to be really wining up. >> jimmy is going right now to join the people down at the altamont in santa clara. and i hear grass alley flying as we speak. ukiah flying. redding flying. they're keeping us moving right along. >> reporter: back live. you can see that the pilot of the spotter plane that tells the tankers where to drop their loads is walking out. they're likely to be on a call very soon. cal fire says it likes to keep 90% of the fires that it flies on 10 acres or less. 10acres or less, and they're pretty successful about that, which is why we never hear of most of them. a vandal made this morning's routine a little rougher for hundreds of people who live on treasure island. san francisco police tell us someone cut a padlock along with several small gate wires

on a transformer panel around 7:00 this morning. police say that knocked out power on the island for over and hour. service was finally restored by about 8:20. police say it doesn't appear that the vandal, or vandals stole any copper cable during the incident. we should also toll you yorba buena island was not affected. it's hot out there right now. there's still fog right at the coast, but inland, we've got triple digit heat. it's going to be hotter tomorrow. i'll show you how hot in your neighborhood.

in the case of hans rieser. he is serving 15 years to life for killing his wife. his children are seeking $15 million for emotional damage. two alleged members of a notoriously violent gang were in a san francisco courtroom today. charged with the killings that sent shock waves through the city. david steveson is live now in san francisco, where authorities say they're tightening the net on the ms-13 gang. >> reporter: yesterday's arrest is bringing new attention to another case at san francisco's hall of justice here. which allegedly also involves members of the same violent gang. our camera wasn't allowed in san francisco court today as attorneys and prosecutors took up the case of the alleged ms- 13 gang members accused of stabbing a 14-year-old to death

with a sword in july of 2008. today's hearing also heard discussions of disturbing conversations recorded by an informant. >> they are not invisible, and they are not invincible. >> reporter: the killing was one of four san francisco homicides blamed on the gang that year. >> responsible for killings of innocent people on the streets of san francisco. and have been responsible for terrorizing entire communities. >> reporter: state, local, and federal law enforcement agencies say they've since made significant progress in infiltrating and cracking down on ms-13. just yesterday, alleged ms-13 gang member, wilfredo reyes was arrested in the balogna family triple murder. >> edward told them from the beginning he wasn't the shooter. they had already interviewed

three witnesses that saw more than one person in the car. >> whether or not the gunman was a part of that in any way, you are equally guilty of murder. >> reporter: briefing the media on the reyes case, including when he may be extradited from north carolina to appear in san francisco court. we will bring you details coming up later on our 7:00 show and the 10:00 news on channel 2. david stevenson, ktvu, channel 2 news. santa rosa police made two arrests today in connection with an early morning shooting at a bar that's becoming known for trouble. it happened in the parking lot of el puente restaurant and bar right after it closed. jose chavez was wounded after shots to his chest and knee. other recent shootings there included one last december that killed a man. in vallejo, police are investigating the death of a

construction worker as a possible homicide. 62-year-old michael branson was found dead inside a home he was renovating. police say his truck turned up several blocks away with all of the tires missing. investigators are waiting for lab results and an autopsy to determine exactly how branson died. an east bay city is now home to an ultra green campus with the opening much a new sporting goods conglomerate. it covers 14 acres. it serves as headquarters for the north face, jansport and lucy brands. for employees, there's a gym, cafe, and vegetable garden. >> the people that work for these brands are very passionate about the environment and outdoors. they want to be able to not only see it, but they wanted to be able to work in it. we have outdoor meeting areas. wi-fi throughout the campus. >> it will be home to about 500

employees. a couple of megawalgreens drugstores are coming to san francisco. the chain is remodeling and expanding on powell street, and at the one in chinatown on stockton street. it will feature a bakery, a juice and coffee bar, and fine wines and alcohol. there are only two others like them in the country. one store is in new york. the other is in chicago. construction is set to begin in october. california's ban on foie gras just went into effect this month. it is made by force feeding ducks or geese to expand their livers. allie rasmus told us how some restaurants are already finding ways to get around the ban. >> reporter: at the presidio social club, the lunchtime club is used to cold drafts and comfort food. starting this weekend, the restaurant will serve something different. something technically illegal.

fatty goose, or duck liver banned in california since july 1, but the presidio social club sits on federal land, and restaurant owners say they're not subject to the ban. >> we don't want to break the law, or flaunt the law, we're just able to under this law, where we are able to serve it legally. >> reporter: under state law, anyone serving foie gras can be subject to a fine. >> people are crafty about getting it out there. >> reporter: a former restaurant manager is advertising a foie gras picnic for $100 a ticket. >> from what i gather, they're going to serve 10 courses of foie gras. >> you bring the foie gras, and

they'll cook it for you. >> the presidio social club says their reservations for this weekend are booked solid. a new ktvu field poll has found california voters are slightly less pessimistic about the economy compared to last year. 24% say it will get worse and 42% expect it to stay the same. last september, 26% said it would get better. 30% said it would get worse and 42% said it would stay about the same. the alameda county fair not only celebrated its 100th birthday this year, it set a record for attendance. today, fair offenses said a total of 534,577 people

attended the fair. that's up 18% from last year, and the largest attendance in the event's history. for the record here, visitors ate 7,882 deep fried oreos. so far, there are no leaks reported from a $3 million yacht that sunk at lake tahoe yesterday morning. there were about a dozen people onboard the sierra rose when it started to go down. everyone got out of the vessel safely. it's now sitting at the bottom of the lake, with just the top floor above water. officials are hoping to pull it out in a couple of days. we've got fog right along the coast. but it's hot inland. check out live stormtracker 2. you see the heat in the valleys. triple digit heat out in the eastern livermore valley and towards sacramento. a live camera shot.

you can see that fog. there's the golden gate bridge. those towers over 700 feet high. so the fog is right at about 700 feet. that's the inversion. so 700 feet, the coastal hills go to about 1,000 feet. so the fog can't really get through. here's what we have as we move through time. looking at that fog which has been compressed, cannot make it into your inland bay valley. that is why tomorrow will be hotter. this is what i'm tracking. the depth of the marine layer. shallow right now. it gets fat toward the end of the week, and we cool down, but not tomorrow. along the coast, dense fog throughout the area. low visibilities right along the coast toward half moon bay, and pacifica. the fog really dense. drizzle possible. it's stuck there. can't get inland. as you move around tomorrow morning, the hottest day of the week will be tomorrow. temperatures should trend down as we head into the next day. the extended forecast calls for that cool down. tomorrow morning, if you got business along the coast,

you're going to need the jackets. if the kids are going off to swim practice or whatever, it's going to be chilly along the coast. inland, as the high pressure shifted west, temperatures are on the rise. tomorrow looks to be the hottest date of the week. 101, maybe 102. but right along the coast, the fog persists. will the fire danger go up? yes, it will. is there a red flag warning, no? the humidity is low, but the winds aren't a part of this thing. if we had offshore winds right now, it would be a whole other deal with the fire danger. they'll be tracking that to make sure the fire danger stays where we think it is, which is not in a critical level. 91 out there towards the alameda area. 100 in antioch. 101 in brentwood. it is a spare the air day tomorrow. 62 in pacifica. the five-day forecast, this is one of our hottest periods. we haven't had that many triple

digit days. today triple digits. tomorrow probably triple digits. air quality gets better, fire danger goes away. >> so it's brief. >> it's brief,. >> thank you. a plan to improve the bike lains on a road in san mateo county where a biker was killed took a step forward today. the improvements would take effect on a stretch of alpine road. died there in a crash with a big rig. bike safety advocates asked the county to make the road safer for bike riders. today, the supervisors voted to ask the county transportation authority for $175,000 to repave, and restripe the lanes on that road. baseball big stars are about to take the field. a look at the strong bay area representation at the all-star game. also, the commissioner addresses the a's stadium issue. are they any closer to finding a new home?

well the waiting continues on a decision on whether the oakland a's can move to the south bay. bud selig said there's no timetable on when the team can decide to move to south bay. he says they still don't have all the answers. the giants have territorial rights to the south bay, and have insisted they will not give them to the oakland a's. the all-star game is just minutes away. we're going to recognize a lot of faces. >> oh, yeah, five total bay area representatives. of course matt cain is starting, and the festivities continue up until game time today.

they had what they called a red carpet parade through downtown kansas city. this is video from the 2010 world series. we bring it up to tell you, even though this is a fun exhibition game, there's something at stake. the league that wins will have home field advantage in the world series. to the big vote getters, josh hamilton and buster posey, know a little something about the impact this game can have. >> it definitely carries some weight. obviously, he's got to see it for the past two years now. it was big for us in 2010 to have those first two games in san francisco. >> it definitely makes it for for fans. those first two games, if you can be at home, and open up at home, there's a level of relaxing, and just being in your comfort zone. >> kansas city. kansas city here we come.
