some protesters are wearing these small plastic chairs on their clothing to express their opposition to the proposed sitting ban. i just came out of the meeting there are a lot of people waiting to give public comment before city council takes a vote. >> reporter: on busy telegraph boulevard, three sat on a sidewalk. they oppose a ban that would oppose sitting on the walkway. protesters targeted anna kurna. asking people to ban the shop. but the shop's manager says the owner hasn't taken a position. >> the voters can decide but it's not up to us. >> reporter: other merchants say a ban is necessary because some people sitting on the sidewalk are disruptive and intimidate customers. >> people tell us that they don't come to telegraph as much

anymore, telegraph avenue because they don't like the sidewalks here. >> reporter: opponents packed into tonight's meeting and some carried signs they said the proposed signs discriminate signs -- against the homeless. >> they are going to fine someone who seemed impoverished over a person that doesn't. if the council votes to put the proposed ban. it will go into effect july 2013. a citation will carry a $75 fine or community service. if there is a vote during our newscast we will of course bring it to you. reporting live here in berkeley, amber lee, ktvu channel 2 news. a motorists survived a very close call this evening after she lost control of her van and plunged about 100 yards down an enbankment. the officer happened shortly after 6:00 off skyline boulevard in the oakland hills.

firefighters were able to get the woman out of the van and pull her up the cliff using a pully system. a woman went to check on the woman before rescuers got there. he said he held her hand until help arrived. he said the wave of band landed a tree went down the shield. >> there was a tree that we believe the on her back. missed her by a foot -- tree that hit the back of the car, it missed her by a foot. if it would have hit her it would have killed her. new at 10:00, taxi drivers sounding off where the city council is meeting. robert handa is live in santa clara and tells us taxi drivers stopped work tonight so they

could attend the meeting and also to drive home their point. robert. >> reporter: well hailing a cab was difficult tonight in santa clara unless you were here at city hall. dozens of cab drivers held a work stoppage to deliver their complaints to council members. a caravan of about 40taxi cabs brought a loud message to the city council protesting a proposed ordnance that would allow more cab panes to operate in santa clara. until now the city had limited service to six companies. the noisy demonstration was quite a contrast than what we saw outside of the hyatt hotel. that's the point of their protest, there's not enough business in santa clara for more cabbies. >> there's too many drivers. sometimes we're here and

there's 18 drivers around the area. >> reporter: drivers from other bay area cab companies said it's unfair they are allowed to work around santa clara but not in it. >> we provide service in mountain view, we cannot pick up customers from santa clara because we don't have a permit. >> reporter: the mayor and other council members agreed the city would need more cabs when the stadium and new hotels are built and called the current system a monopoly. >> that's not the american way. we don't limit the number of tree trimmers or custodial people, any other services and we should not regulate the cabs as well. >> reporter: the protest did not work. the council approved the ordnance. but said the new companies would have to meet all the current standards the current companies follow. robert handa, ktvu news. we have developing news where there's a chaotic scene at an apartment complex after a young person was shot and

killed. the shooting happened about 8:15 tonight at the complex on leona creek drive near lion way. our photographer says the victim was shot twice in the chest and taken to a hospital. the alameda county coroner told us the person was pronounced dead at 8:35 tonight. the oakland tribune is reporting that the victim was a 15-year-old boy. new developments tonight involving a fatal accident in mountain view that we first told you about last month. police say they have arrested 21-year-old matthew pumar on charges of vehicle manslaughter with gross negligence. on june 21st. we showed you a car that jumped a curve striking william ware who was standing at the sidewalk. police say kumar was speeding and driving recklessly although no drugs or alcohol were involved. a gang member arrested in connection with a triple murder

case is now fighting extradition to california. wilfredo flaco was arrested in north carolina. district attorney george gascon says his department is doing all it can to get reyes back to san francisco to stand trial as soon as possible. gascon also says new information is what led to his arrest. >> we have an independent witness that surfaced earlier this year and that's how we were finally able to get enough information to be able to do an arrest warrant on him. >> in may, edwin ramos was convicted of murder for the killings. gascon denies that they waited until ramos trial was over to

arrest reyes. the arrest of reyes is bringing attention to of the members of that ms-13 gang. two are accused of stabbing a 13-year-old boy to death. now state, local and federal law enforcement agencies say they have made significant progress on infiltrating and cracking down on that gang's operations. an elementary school principal in san jose is facing a criminal charge tonight for allegedly failing to relay a report of child abuse to the proper authorities. ktvu's matt keller broke the store on our news at noon today and later went to the principal's home. >> reporter: o.b. walley elementary school was rocked with the arrest of a

teacher. now the principal is facing charges. >> the victim gave information that we believe would lead a reasonable person to entertain a reasonable suspicion that an act of child abuse had occurred. >> reporter: prosecutors say principal vijayendran was supposed to go to police instead she went to the teacher. nobody reported anything until january when the mother of another alleged victim went directly to police. >> unfortunately the results were tragic. another child was molested after the initial child made the report. we believe that forensic evidence may have been left. >> reporter: we went to the principal's house after charges were filed. >> would you want to talk to us? >> no, you can talk to my

lawyer. >> reporter: her attorney released this statement. san jose attorney specializes in sex abuse cases and feels anyone who doesn't do their job to report should face charges. >> a misdemeanor is a slap in the wrist. yes it makes the news and raises awareness but as for her accountability what message does that send? >> reporter: the principal' attorney says she's still employed by the school district and has not been suspended or fired. reporting in san jose, matt keller, ktvu news. b.a.r.t. services are back to normal tonight after a power outage caused major delays during the evening commute. news chopper 2 is over head at 7:00 tonight when the berkeley station was shut down. pg & e said the outage cut off power to more than 7,000 customers in the area. the utility tells us power was

>> new at 10:00, changes are coming to an intersection in el cerrito that neighbors have long complained is dangerous and was the scene of an accident last month. heather holmes is live where she attended a meeting to discuss the changes. >> reporter: we're standing at the corner and none of them used the stop sign. it is a curvy road that some say is used more like a freeway. >> you see speed, we see turning violations, we see stop sign violations. >> reporter: an alternate rout for those looking to avoid san pablo avenue.

>> a lot of people will come down here looking for a quicker way home. >> reporter: but the shortcut is challenging with drivers forced to navigate a tricky curve, pedestrians and bicycles. >> it's a very dynamic area, a lot going on. >> reporter: city officials discussed improvement to the roads. the improvements come after the death of gene smith last month. >> we have always said never to cross at that crosswalk because it's not safe. >> reporter: smith followed her children's advice that day and did what nearly every pedestrian does, crossed illegally where visibility is better. she made it across the road only to be struck by a bicycles. >> at that particular location there's a barrier of bushes between the roadway and a sidewalk and that prevented her from having a safe exit point. >> the roadway following this yellow stripe line. >> reporter: officials plan to clear vegetation, put up additional signage, add markers and -- >> we're contemplating moving the crosswalk around to here. >> i'm encouraged with the

number of people that came out and the fact that the city is standing up and addressing this problem. >> reporter: about 60 people attended tonight's meeting many of them had suggestions of their own. they'll be considered and frank and julie officials hope to implement those changes here as soon as possible. heather holmes, ktvu. in oakland police are investigateing the shooting death of a man who's body was found in a freeway onramp. officers found the victim's body just before noon inside a car parked at the end of the seminary avenue onramp from i80. news chopper 2 was over head. police say it appears the man was shot some where else then driven to that onramp and left there. oakland police chief howard jordan told city council members that the spike in violent crime is happening specifically during the daytime. and he says one of the keys to fixing the problem is working with federal authorities. >> part of is it a continued effort with atf to do more

operations with the u.s. marshal to remove guns from off the streets of oakland. >> the chief says a meeting will be held on friday to discuss ways to get more officers out on the street. it appears most californians think the state's economy is in bad shape. that's according to a new exclusive ktvu field poll. a whopping 88% said they believe it is bad times for california. 7% said it's mixed and only 5% consider this as good timeless. it's been 11 years since the majority of those surveyed said the state was in good economic shape. as for personal finances 42% in the ktvu field poll said they are worse off. 33% say there's been no change, and 25% said they are better off now. the university of california is looking at sharp tuition hikes if governor's tax

initiative failed in november. documents posted online show uc regents figure at the 10 campus system may have to be raised by as much as 20%. and that would happen in january. that means instate under grad tuition could go up by nearly $2,500 to more than $14,000. firefighters are working to contain a wildfire that's burning in the sierra foothill. the seven fire started around 11:45 near the lake san pedro. so far 800 acres have burned and the fire is only 50% contained. no word on a cause. the brush fire is a reminder that california's fire season is in full swing right now. coming up today at 10:45, where we stand to far this season when you compare it to last season. new developments tonight involving some racehorses that were found severely neglected a few months ago. ktvu's rita williams' reports may have saved those horses lives by exposing their

condition. tonight she shows us the progress they've made and the charges their former owner is making. >> reporter: just 4 years old, this horse now has a new lease in life. >> do you see a difference? >> reporter: decide for yourself. that's what that mare and others looked like. concerned citizens sent these photos to contra costa county animal services pleading with them to rescue the horses off private ranch land in el sebrante. three weeks passed with no action. i made calls that day animal services seized the horses and admitted mistakes. >> we made adjustments internally so we have to make sure this does not ever happen again. >> reporter: since then vets, volunteers and staff have fattened up the horses. >> reporter: put on 150 in 2- 1/2 months. >> reporter: but that carol ormen says each horse needs to gain another 100 pounds.

>> these are some of the sweetest horses i've ever gotten to work with. >> reporter: as for their former owner, guzman he's in jail. he pleaded not guilty. his attorneys didn't return our phone calls. we learned late today he's now in i.c.e. custody on an immigration hold. he was arrested here at golden gate fields thursday. a spokesman said guzman worked for veterinarians who provided services here but emphasized that he was not an employee of the track. rita williams, ktvu channel 2 news. bay area air quality officials have designated tomorrow as a spare the air day for a second day in a row. the air quality district urges people to cut back on activities that can cause pollution such as driving, using gas powered lawn mowers and other devices even using oil based paints. people who are sensitive to

a grass fire along highway 4 in pittsburgh disrupted the evening commute. contra costa county fire officials say about 12 acres burned not far from the

pittsburgh b.a.r.t. station. crews had their hands full but were able to put out the flames in about 30 minutes. with fire season heating up the central contra costa fire district is now placing a cap on how many crews it will send to help fight fires outside of its own territory. that move is designed to keep resources from being drained by the east contra costa fire district which closed three stations earlier this month after voters rejected a parcel tax. the central contra costa district says unless the call is for an emergency it will only dispatch up to three units to neighboring districts. the best advice, watch your step. california is seeing a spike in the number of rattlesnake bites. experts think the number of rattlers is on the rise. >> reporter: today people took advantage of the summer sun, heading out for hikes where morgan mckay says he's seen a rattlesnake on the trail. >> i've actually seen one, it

was a rattlesnake, yeah. >> reporter: what did you think? >> they scared my friend, they jumped out at him. >> it swelled up in a matter of 15 minutes, my hand looked like a baseball glove. and it was like probably one of the worse pains i've ever had. >> reporter: this year more californias are feeling that pain. the control system received 138 reports of rattlesnake bites april through june. >> you can see his rattle on the very far left there. >> reporter: expert devan trovouski showed us a rattlesnake. he says the wet winter two years ago provided a good habitat for snakes.

and this mild winter provided the opportunity for more snakes. stick to the trails and make sure you wear boots. at home keep that pet food inside so it doesn't attract rodents and if you do get a snakebite seek medical attention immediately. in lafayette, jana katsuyama. wall greens has announced plans to open two upscale stores in san francisco. the drugstore chain says it'll be unlike anything you've ever seen. walgreens is remodeling and expanding their stores. the new store will feature a bakery, fresh produce, a custom cosmetic department, a juice and refreshment bar and winery. according to the chronicle, san francisco as 68 walgreens stores. coming up here word tonight that a discovery of old baseball cards is said to be

the bay area has more apple users than any other part of the country but now one of the bay area's biggest cities says it's no longer going to buy apple computers. ken wayne live in san francisco to explain why, ken. >> reporter: frank apple is known as a forward thinking company but when it comes to the environment, it appears the pane is going back ward. the news broke today that the city of san francisco was

banning apple products because they're not environmentally friendly that's not exactly the case. >> we're not banning apple, we enjoy apple products. >> reporter: recently apple removed itself from a list knowned ep. it's a registry used to identify company that is make environmentally friendly technology products. many government agencies including the city of san francisco are required to only buy products on the ep's list. >> we remodeled the rule under president bush to acquire equipment that is 96% compliant. >> i think most people have some kind of apple product whether it be iphone, i pad, mac book whatever so i think it's quite irresponsibleover them. >> it doesn't keep me from

buying it obviously. >> one thing it observes and it's pretty hard to get out of it. apple is kind of like a drug. >> reporter: san francisco officials would like to hear from apple. >> we're hoping this dialogue will help apple to reach out to cities like us and find a solution to this problem. >> reporter: out of the $200 million the city spent on technology equipment last year, just $45,000 was spent on apple. live in san francisco, ken wayne, ktvu channel 2 news. city leaders in san francisco passed new legislation today designed to benefit small businesses. effective immediately companies with payroll less than $500,000 can expand by $250,000 and still be exempt from the city's 1.5% payroll tax on the new payroll. supporters say the new legislation will help provide jobs for thousands of people. google is reportedly close to a deal that will see it pay a record fine over a breach of privacy policies.

the federal trade commission investigation focused on whether google violated a settlement that planted tracking software on some iphones and i pads without users permission. the wall street journal says google could have to pay more than $22 million. opening statements are said to begin tomorrow in the trial of hanz riser. attorneys are now seeking $15 million in a wrongful death lawsuit on behalf of riser's two children. the anti doping agency featured lifetime dope bans on three of armstrong's team members. the tests all come as armstrong continues to fight to try to clear his name. the anti doping agency has

police in los angeles say a middle school pe teacher was behind the wheel of this truck leading officers through a wild

speed chase. the teacher was wanted for lewd acts with a former student. officers thought they had stopped him in torrence but he got away. his truck landed at the base of the tree and he remains in the hospital tonight. authorities are trying to figure out what caused a $3 million yacht to sink in lake tahoe. everyone made it out safely. the three level yacht now sits on the bottom of the lake with just the top floor over water. the luxury liner rented for $2,000 a night. officials are hoping to the pull it out of the water later in the week. stocks fell today for a second day in row. the nasdaq dropped 29. a slump in profits of technology companies developed the company down.

jcpenney is trying to reverse its sagging fortunes. to do that the company is laying off employees. pennys have layed off 600 workers they did that in april. the head of american airlines saying the company is doing so well it can now consider merger with another airline. the company has reached deals with unions to cut costs. the ceo says a merger would only make the airline stronger. american is the nation's third largest carrier. a house in martinez known as the christmas house because of elaborate decorations burned to the ground. contra costa county firefighters say they were called to the house on walnut street at about 4:00 this morning. when they arrived it was engulfed in flames. the house has been vacant since

new video tonight of a fire burning in the mendocino national forest. crews say they are making some progress and tonight we can report that that fire is now 30% contained. no determination yet as to how it started. about 30 miles away, firefighters were working to contain another wildfire that's burning in calusa county. the site's complex fire is now 60% contained and has burned nearly 3,200 acres. the two fires is a reminder that california's fire is in full swing. so far this year is worse than last year. >> reporter: hundreds of firefighters are battling blazes in triple digit temperatures. calfire tanker pilot bob valet a veteran of 35 years of

california firefighters says he's never seen it quite this dry and there's plenty of fire season left. >> it's not getting any wetter, it's getting drier. the fire season is becoming much harsher and it's very rampant. we've been extremely busy this past week. >> reporter: calfire has responded to 2,864 fire missions last year it was only 1,750. the year's average is 2,165. this year 16,400 acres have burned compared to 13,000 last year. all of this is well below the five year average of more than 62,000 acres consumed in really big early fires. but now the fire seem to be really winding up. >> jimmy is going right now to join the people down at the altamonte in santa clara and i hear grass valley flying as we speak.

police and the national guard. facebook is now alerting people to a checkpoint. the checkpoint sends users who are concerned that their computer might be infected to sign up at a variety of free anti virus sites. back in april facebook introduced the anti virus marketplace portal that offers users anti virus portals from other companies including microsoft. you know it's going to be hot tomorrow so take it slow. especially in the afternoon hours. especially inland. outside right now it's kind of cool. we have 55 in san francisco, 56 in oakland, the cool fog is right along the coast here and it's starting to fill in. you can see up toward concord and in the inland valleys we're still in the mid-70s. so there's still some cooling but that's going to get cut off tomorrow and it's going to get really hot. probably the hottest day of the season or the year so far.

with temperatures in the inland valleys, 101, 102. check that out because there's going to be dense fog along the the coast. this is one of those days where it's real cool coast side and real hot inland. you noticed the fog tonight maybe you did, maybe you didn't. but it was being compressed down from that high pressure center. when it gets compressed it can't get to the coastal hills. it's not making it up to livermore, to napa or the santa clara valley. we have higher fire danger and big heat that's because the air is compressing and that's going to be if story tomorrow. as the air compresses you're going to get dense fog along the coast from pacifica to bodega bay. maybe 58, 60 degrees. we're going to see a 40-degree spread tomorrow between the coast and inland, 40 degrees between coast and inland. that's just a few miles and a lot of temperature. it started this basic heat wave

for us started on monday. tuesday was warming still, as we get to wednesday probably the hottest day of the year. but right along the coast the fog exists. that high moves east and moves west. now it's west and now we're heating up. as we move into the weekend it moves east and we start to cool down. these are the forecast highs for a bunch of cities over 50 cities for where you live or near where you live. it is a spare the air day tomorrow. 100 in antioch. 100 in livermore. we haven't head that many 100- degree days this year. no warning because we don't have the wind, we have the heat, we have the high humidity and the bad air quality. we're watching it closely tomorrow. the five day forecast does cool it off for the bay area weekend. and that fog gets up over the coastal hills by thursday and starts to cool things off. but not until then so the tomorrow will be the hottest day. >> it's been a while since
