sheriff ross mirkarimi return to the witness stand. last night eliana lopez began her testimony about the alleged domestic violence abuse incident. allie rasmus tells us why eliana lopez was smiling as she entered the hearing room. she may have been smiling because it was the first time she had seen her husband suspended sheriff ross mirkarimi and a protective order kept the couple apart and since march she has been with her young son in venezuela. but in the room she made icon tact and they both smiled and she was polite and charming when a deputy city attorney started questioning her. >> reporter: at issue is whether sheriff ross mirkarimi can keep his job as sheriff. he pled guilty to a false imprisonment charge stemming from a bruise on his wife's arm.

he testified -- she testified despite the disagreements, neither of them considered divorce. >> you have in the past considered divorcing your husband? >> you have never considered divorcing your husband? >> no, really serious but we had been talking about it but we never make any decisions. >> now later in the hearing eliana lopez said she did go to her neighbor for legal advice. >> reporter: she wanted to know who would gain custody if she and her husband separated. she showed this bruise and her husband said he is a powerful man and can use his position to gain custody of their son if they had a divorce but she said some of her statements had been misinterpreted. ktvu channel 2 morning news. and here is a timeline of

the sheriff ross mirkarimi case, on new year's eve he had an an argument. he was sworn in on january 8th and five days later he was charged with three criminal counts. then he pled to false imprisonment and march 28th mayor ed lee suspended him. the ethics committee will make a critical decision directly tied to this case. they will decide whether sheriff ross mirkarimi's lawyers will be allowed to pursue perjury allegations against mayor ed lee. they want to subpoena four people they might be able to show the mayor lied under oath twice when he testified before the panel. mayor lee strongly denies those allegations. just go to www.ktvu.com and click on the sheriff ross

a crash that sent a couple to the hospital. they saw a vehicle driving erratically in the south of market neighborhood. the suspect sped away when a patrol car tried to pull him over. the man kept driving away and soon rammed into another car. you see it there, the two people who had to be taken out suffered serious injuries and officers tracked the suspect a block away. just until now a san jose neighborhood is clearing out and allie rasmus is telling us -- tara moriarty will tell us what will be done to help the people who are displaced. >> reporter: they are getting information for city containers homeless people can store their belongings in. they let the people know it was time to get out. some have left but police believe there are still a dozen

or so folks still lifing by coyote creek. police will be eaching an 0 eye out and they will have to see. for santa tare reasons, they didn't want them to do that and people living in nearby apartment complex say there is too much trash trash and they don't feel safe. one man said he has experienced fires, drug activity near his campsite although they don't see a lot of homeless crimes here. now back near the encampments, many residents feel relieved that the homeless will soon be gone. tara moriarty, ktvu channel 2 morning news.

sustained east bay and south bay. he is moving before it kicks out tomorrow and it is held in check and also some drizzle on the coast. lots of low clouds and fog. and i mean it was way up there and starting to come down, more in the way of low clouds but there is a pretty good push on it today. once it burns off, we will have muggy conditions and partly sunny, but that low cloud deck keeps the coast, 50s on the temperatures, almost 60s and san jose state both checking in at 90 degrees. and we are 60 degrees in tahoe as well. and modesto, freest know and it is right on the when edge of

of indecent exposure. he protested invasive airport security measures and a judge ruled it was a protest and therefore protected by free speech. he was planning on flying to san jose for a business trip. and the accountability office found a glaring loophole in national security. some people who are banned from flying were not banned from attending flight schools. they found some had already completed flight school without a full background check. new security procedures are underway because of this discovery. and because of that crisis in syria after yesterday's deadly bomb attack, there are big new questions about who is running the government. live in our washington d.c. newsroom, it looks like time is running out from bashar assad.

. early morning house fire in sonoma. it started early this morning in windsor. there were people inside the -- people inside the house but everyone made it out okay. one firefighter went to the hospital but we do not know his condition. the cause of the fire is still being investigated. progress is reported on finding several wildfires in california. they are in the mendocino and trinity counties are now fully surrounded. the robber's fire is now 70%

sources tell ktvu channel 2 morning news, the uncover -- undercover violence team had been involved in a murder in contra coster county. they tried to pull the driver over but the driver took off. police began a brief pursuit but quickly called it off for safety reasons. the man got out of the car and ran on foot and officers caught up with him a block away. police conducted an investigation saying crews cleaned up the mess and as you can see the roads are back open ktvu channel 2 morning news. three cars burned in a fire on belmont. it happened near sterling view avenue along the cal train tracks. they found two cars on fire and flames 20 feet high spread to a

van at a flooring business next door. we had some heavy overhead power lines and we were concerned the flames were contacting those power lines. >> they kept the fire from spreading to the buildings and they are trying to figure out just how that fire started. overnight a 23-year-old man was -- 23-year-old man was shot on fairfield. he was standing in front of an apartment building when somebody shot him last night. he was wounded in the torso and rushed to the hospital. we are told he is in stable condition. back in september three people were injured on that very same block. and the wife of suspended sheriff ross mirkarimi returned to the witness stand to return to her husband's conduct hearing. they are hearing how eliana lopez was trying to save her husband's political career.

. a few sprinkles out towards tracy, a lot of fog and drizzle and it will be 60s and 70s and lower 80s. here is a quick look at some of the top stories at 6:44. a couple is in the hospital after very serious injuries. early last night they were hit by a suspect trying to escape from san francisco police. police actually called off the chase, worried that chase could lead to a crash just like that. fire suddenly broke out in a car that was underneath an apartment in oakland. just hours ago, you can see the fire almost spread to the car port and the apartments above. investigators are still checking to see if this was an arson fire. also later on today, the wife of suspended sheriff ross mirkarimi goes on the witness stand at her husband misconduct

screen, the girl was walking with her brother when a man comes and picks her up off the ground. she started kicking and screaming and eventually the man drops her and runs away. the girl's father said she is still shaken up. police are looking for a suspect and they are offering a $10,000 reward in the case. he has been placed on administrative leave and the suspect stabbed a co-worker at the new american chocolate factory at pier 17. authorities say it was an unprovoked attack. he used a box cutter and police chased him to the financial district which is where a police officer confronted him and the suspect lunged at the police officer with the box cutter. the female police officer shot him twice in the chest.

>> it was gross leaking out to the street, i was shaken up for about a half hour. >> the police firsthand cuffed the suspect and then they released him after they performed cpr after he had been wounded. he died at the hospital and that suspect is eye didn't paid to as a 30-year-old man from cambodia and the victim of the stabbing had minor injuries. san bernardino is heading straight to bankruptcy court after the city council voted to declare a fiscal emergency. they are avoiding a long process and they will not be able to pay workers next month. and 50 miles east of los angeles airport, they are also close to running out of money. compton may not be able to pay its bills by the end of the summer but they have not voted on a bankruptcy proposal. they would be the 4th in the
