sidewalk, it is very slow going to get into the fox theater. half block away. that is the facade right there. the folks who are waiting where their tickets, they are nose to nose with protesters who are unhappy with the president and many started at city hall and marched here to get as close as they could. you can take your pick on the issues. everything from medical marijuana, to immigrant policy, military intervention, the general opinion is the president betrayed them. a stronghold for president obama in his 2008 election and it still is but today we are hearing from the disenchanted. >> there is still deportation taking place every day. we are asking him to comply with his policy and stop deportation. >> we are opening up the oil

children slept. ktvu's matt keller is outside the home and tells us what one neighbor saw moments after the shots were fired. >> reporter: you can see police put up the piece of plywood there on the front window after it was broken. neighbors say their children were here at the home at the time of the shooting. >> reporter: the 911 calls came before 4:30 a.m. this morning. neighbors heard an argument and gun shots from inside this home in downtown san jose. >> 3-4 gun shots and 5 seconds later more gun shots. and that is when i thought somebody killed somebody over there. >> reporter: he was watching from across the street and saw a man dressed in black. >> ran to the corner. from that house to the corner, he ran. sprinted. >> reporter: police arrived to find a man and woman dead

court appearance today. james holmes appeared dazed wearing a jump suit, his hair died orange. he said nothing. the judge told him he would face first degree murder charges and will be held without bail. the district attorney expects to file charges next week. >> i would say there is no such thing as a slam dunk case. it is a case where we are still looking at the evidence and we would never presume it would be slam dunk. >> families and victims from the movie theater shooting attended today's hearing. 12 people died and 58 others injured. a lawyer for james holmes' family in california spoke out today and read a statement from the defendant's mother. >> he asked if my son was james holmes who lives in aurora,

this newscast and at 6:00 on ktvu channel 2 news. today fremont's police department became the 7th agency to receive a suspicious package. on friday a letter arrived that hayward police department. it contained a white powdery material and authorities said it was not anthrax. fremont police gave the letter to the fbi. five other police agencies received similar letters. a police officer has been released from the hospital after a accident. the officer was responding to a robbery when his car collided with another vehicle and crashed into a building at 1:00 a.m. this morning at 18th street. investigators haven't released information on what caused the crash. the car ended up inside a h&r block office. the officer's injuries were minor. san jose police chief says a decision could come this week

on a permit for a card club. that comes after a hearing this morning by the police department. at which no one spoke. it is a reworking of the old garden city casino. it was scheduled to open in april but delayed because the owner couldn't get a permit in time. >> we work with them regularly so working with those conditions shouldn't be difficult. and speaking with administrators, they think we can get open by july. >> he will now take a few days to study the recommendation to issue the permit. protesters took to the streets in spain over the weekend upset over budget cuts and unemployment. the protest comes as fear grows that spain might need a bail

special report. >> reporter: union scare, a fine july afternoon, hundreds of tourists enjoying san francisco on a summer day. like any city construction is a common site and this very busy corner is a perfect example. pedestrians and workers are everywhere, tourists on the street, office workers, all protected by these barriers around the construction site. except they are not. these barriers are supposed to be filled with water, 162 gallons to weigh them down, 1300 pounds each. not one of them is. most of them are filled with garbage from passing people and they are supposed to be locked or pinned together, which we found is not the case. which means, let's say a car hits a barrier, it is likely to

building. it broke out in theadic on 26 26th street -- attic on 26th street. everyone escaped without injury. they responded to another fire at this building yesterday. both fires were called by an electrical fire. a apartment fire here started in a unit but investigators are trying to determine the cause. last night's fire forced 60 people to evacuate. the red cross is helping a dozen residents who have been displaced. firefighters say the flames spread throughout the complex. five people were treated for minor injuries. 70 people died in gas pipeline explosions since 1968 across the country. an investigation shows many explosions could have been prevented by a vallive that cost $10 -- valve that cost

$10. industry resistance kept the companies from being equipped with the valves. in san francisco, muni is getting millions of dollars to buy mew new buses. ktvu's david stevenson is here and tells us the money will also be used for upgrades on one of their busiest lines. >> reporter: look. muni says it has the greenest and oldest buses in the nation. we learned today, 19% of the fleet is out on any given day for repair. today they got money to replace some of the buses. >> reporter: they are ready to retire. that is what transportation officials say about the fleet of 800 muni buses.

the newscast, the gunman in the shooting in colorado appeared in court today. james holmes was handcuffed and appeared dazed. the prosecution is expected to file first degree murder charges against him. he is accused of murdering 12 people and injuring others at the premier of dark knight rises. experts say it may help explain his mental state. ktvu's john fowler is here now with more. >> reporter: a key issue will be his campitance to stand trial. i -- competence to stand trial. >> reporter: seeming unresponsive. strange eye movements. dozing at times. >> i think it is unlikely he was medicated but that is what it looked like. looked like he was out of it.

university of colorado six weeks ago. john fowler ktvu channel 2 news. friends of colorado victim set up a website where they are asking for donations. he lost an eye and suffered brain damage. she went into labor today but hasn't given birth yet. they knew the baby would be a boy and named him hugo. the virus that causes aids does not increase a woman's risk of cervical cancer. scientists studied 400 women infected with hiv and 300 other women who do not have hiv. all of the subjected tested negative. doctors say results have remained the same in both groups after five years.
