"mornings on 2" starts right now. well, good morning. welcome to "mornings on 2." i'm dave clark. >> i'm tori campbell. it's tuesday, july 24th. we're following developing news that killed two and displaced others. tara moriarty is there with new concerns from firefighters. good morning. >> reporter: good morning. the coroner has just arrived.

the fire was burning for at least a half-hour before anyone called 911, that's disturbing to firefighters. they are questioning if the smoke detectors were working. they are actually looking for them. a couple in their 30s was killed when flames shot 30 feet in the air. the couple next doran -- next doran outside -- door ran next door. >> we could see the heavy smoke. >> reporter: now. red cross is working with the five dozen neighbors not being allowed back in their apartments for at least a day

or two. neighbors say the victims had two cats and a dog. we know one of the cats died. we'll keep you updated on the investigation. back to you. an 8-year-old boy is in the hospital right now after he almost drowned at a san jose swimming pool. janine day la da -- janine de la vega has more. >> reporter: good morning, dave. the boy's mother said she was in the hot tub and he was in the big pool when it was discovered he was under water. we're told a teenager puttedle -- pulled the 8-year-old out of

the water. neighbors say this will make them more cautious about watching their kid. >> it's really scary. my kids and me go swimming every nuns a while. i'm just wondering if -- i'm concerned, actually -- it's -- every once in a while. i'm just wondered if -- i'm concerned, actually. it's sad. >> reporter: now there's no lifeguard on duty. there are signs all around the pool saying that. there's also signs saying that children under the age of 14 must be accompanied by an adult. but even in this case, the mother was present and this near drowning just still happened, so it just goes to show you that you can never take your eyes off your children, especially when you are near the water. reporting live from san jose, janine de la vega.

back to you. home burglaries are 0en the rise -- are on the rise. most of these center around parked vehicles. a car is parked in front of the house when the resident is away or a car driving around for no apparent reason, keep an eye on that. police say if you see anything suspicious, contact police. also this morning, police are investigating an unusual sight, a suspect was caught on camera taking laptop computers and shoes but leaving befind millions of dollars of electronics of equipment. no word on who the laptops or shoes belonged to. 7:05. we want to check in on the

roads to see what's going on. sal? >> we do have minor things going on. but for the most part, the commute is slowing down. this is a look at the peninsula freeways. highway 92. a little bit slow coming in off foggy hill, half moon bay. getting to highway 280. we do have air delays reported at san francisco international airport at 90 minutes later today expected because of the cloud cover. this is noes at loud as it was but today it's up to 90 minutes there as we go to san francisco that earlier crash at ocean and san jose avenue has been cleared and the j church line is now moving through without delay. let's move along to some pictures. northbound 880. this traffic is moving along pretty well past high street on the right there. we also look at the commute at the toll plaza. that commute is backed up for about a ten-minute wait.

home. james holmes made his first court appearance. we're going to go live to aurora, colorado. alisia? >> reporter: good morning. this was an advisement hearing where the judge read him his rights. holmes sat through the whole hearing that lased about ten minutes and he sat away from -- that lasted about ten minutes and he sat away from everybody, near the jury box, separate from his attorneys. no bond. we're told this would be likely a first-degree murder murder. family members were staring straight at him the whole time. holmes did not look at anyone in the courtroom that we were able to see. he kind of looked forward, looked down. sometimes he closed his eyes. we did hear from the district attorney, carol chambers,

before and afterwards. she said the death penalty is something that will be considered in this case. however, we won't make that decision for a couple of weeks or months. she says she wants to talk to the victims and the families before the decision is made and she really doesn't have to do that right away. the next step in the process will start on monday when formal charges will be -- will be brought against james holmes. tori? >> have there been any funerals planned? >> reporter: family members are starting to make arrangement. s. that's the news we got today, this on top of the company that released "the dark knight rises." they will be donating quite a bit of money. they are expecting to donate any charities to go to help the family members. >> all right. live for us in aurora,

"usa today" says his business background call filed, the majority of those who polled. only 29% say no. jerry brown has called for an audit of more than 500 special funds in the wake of the scandal. the most comes after officials learned the parks department sat on $54 million in surplus funds for years. even as start park closures were ordered. we were shocked. we worked with the state for a long time and clearly this money could have been used for the crisis facing the state park system. the legislature 0 will decide what happens with the funds. but most suspect it will pubessed to keep the parks

another bay area police department gets a suspicious envelope. the latest one arrived at the fremont police headquarters. an employee saw the envelope yesterday, it looked like ones with white envelope inside. it was immediately isolated and taken outside. six other local police departments received similar envelopes on friday and saturday. the powders inside were harmless. the fbi is now investigating. it is 7:24. new yorkers will have their way today on a proposed ban on large sugarie drinks on restaurants and movie theaters. a public hearing on the band is scheduled this afternoon. the ban only needs the approval to become law but opponents could still sue to block it. michael bloomberg says the man is -- says the ban is necessary

this morning's shooting makes two so far this year. this morning's shooting happened right outside this blue house. you can see the iron gate right there. that's 2111. the other shooting happened in january this year. there is a lot of markings on the ground. notes written to the person. his name was edmond e -- edmond. he died back in january. police say just before 4:00 this morning, a person was shot

and that person had to be airlifted to the hospital. we don't know of a motive or if anyone is in custody. we know that person is expected to survive. and this is where edward arnold martinez was shot and killed back in january. was sitting in a parked car with his sister when police say the gunman began to shoot as he ran along another car on nevin car. they say that the gunman opened fire on martinez and his sit ter, who was not -- sister, who was not hurt. here's some notes written by his sister. now, with this morning's shooting we're told that the spokesperson for richmond police is in the office. we'll held -- we will head over to the p.d. back to you. >> thank you, paul. 7:31. also in richmond, police are investigating a possible homicide after a richmond man

was shot and killed after an argument with miss son. it happened the 3090 sun court. police are not releasing the sun's age at this -- the son's age -- with his son. it happened at 3090 sun avenue. police are -- police are not releasing the son's name. we learned new information about the fatal apartment fire in pleasant hill a few minutes ago. we now know the bodies of a couple were found in the upstairs bedroom of the apartment. firefighters say day pierce they died in their sleep and did not have a chance to escape. the coroner is at the scene. we'll go live to the scene for more on these details. police say a santa cruz man accused of breaking into his neighbor's home and attacking a woman killed himself during a

stocks continuing their losing ways. slipping at the opening of trading following weak

earnings. united parcel service cut its forecast 4% due to global economic weakness. dupont posted an incline on slower business in european and asia. the dow is down 82. nasdaq is down 13. s&p, down 8. apple reports its quart terly earnings today. analysts are slightly downplaying expectations because they say buyers may be holding off until the new iphone 5 comes out. there's reports that it's already in production in chine flaw. it's rumored to have a larger 4- inch screen and a smaller dock connector. apple's profits could be higher if they didn't hide some of them in overseas accounts. the company is tucking away billions of dollars for tax bills it may never pay. experts say apple could easily eliminate -- easy eliminate the phantom tax obligations and that could boost profits by as

much as $10.5 billion. bay area prices are going up. at least that's according to zillow. prices went up by l 4% for the second quarter of the year. alameda county saw about a 3% increase. contra costa county saw about a 1.5% increase. the average price to buy a house in the bay area is now about $453,000. some of the experts say that is a sign of a housing market that's recovering. also, it appears, though, that a recovering real estate market may have a downside. tens of thousands of homeowners are seeing their tax bills go up. some by almost 10%. some own, are saying no way, they believe their taxes are limited to an increase of no more than 2% because of proposition 13 which was approved by voters in 1978. that affected taxes for

declining property values. however, another initiative allows those increases to happen when home values go back up. 7:47. president obama is wrapping up a successfulfording trip to the bay area -- successful fund- raising trip to the bay area. the president was greeted were a lot of enthusiasm last night. he shared their excitement. >> it's great to be in oakland, california! [ cheers ] >> president obama told the crowd he needs their support because he'll probably outspent by the republicans in this campaign e talks a lot about how he and first lady, michelle obama, can relate to the hard- working people of oakland because any come from a blue collar working family as well and he was raised by a single mother. he also offered hope and explanations for some of the problem the u.s. economy is facing.

two people were sadly killed in an apartment fire. firefighters found the victims upstairs in their apartment and tara moriarty is there at the complex with more details. >> reporter: we've learned that this couple never made it out of their bedroom. we're told they are smokers but there has not been a definitive cause of this fire as of yet. in you look behind me, you can see it's quite a big section roped off. the fact that this fire was burning for at least a half- hour before anyone called 911 leads firefighters to question whether the smoke detectors were working. we have some new pictures of the extensive damage. we're here at the -- we're here where the -- where at about 3:30, flames shot up in the air
