their family. cara liu, ktvu. in oakland firefighters told us this afternoon they still haven't determined what started the fire that destroyed a house overnight. the flames started at the back of the vacant house on 35th avenue around 2:00. firefighters had the fire out about an hour later but say the house is now a total loss. neighbors say they have seen squatters but there's no word on whether the squatters are responsible for the fire. a man was rescued from a cliff. he was trapped on 32nd avenue and el camino del mar. it's not clear how the man became stuck but fishes plucked him off the cliff without injurys in a second man charged in the death of his three daughters pled not guilty. wilfredo reyes was arrested in north carolina earlier this month. he was soft smoken today as he

entered the pleas and denied he is a member of a violent street gang. reyes is charged in the deaths of anthony bolognia and his son matthew and michael back in 2008. another man edwin ramos has already been convicted and sentenced to life in prison for their murders. it is estimated that in alameda county alone there are hundreds of tons of unused drugs that need to be disposed of. supervisors are trying something never done before to try to get rid of them. >> reporter: every day people walk into these prescriptions but getting rid of unused pill social security a problem, alameda county is demanding the drug companies solve. this pharmacy fills up to 300 prescriptions a day. but what do patients do with pills they don't use. >> i throw them away. >> where do you throw them? >> in the garbage can. you know sometimes i put them

down the garbage disposal. >> reporter: the alameda county board of supervisors adopted a new ordnance that for the first time would require drug companies to pay the cost of collecting and disposing of unwanted pills. operating dozens of drop boxes like this one cost more than $300,000 a year. and the county estimates registration debits have about 700-tons of unwanted pills at home. officials say quite often those pills can fall into the wrong hands. >> the youth are telling us how much pressure they have in the schools, primarily but to some extent middle schools to start taking some of these prescriptions drugs that are coming out of people's cabinets. >> reporter: or people flush them down the toilet that gets into our drinking water. >> they're showing up in our water, they're showing up in

animals that they shouldn't be. >> there's nothing that says children are not going to get expired pharmaceuticals. >> i think this is a good thing because people don't even think about what they're going to be doing with the drugs around the house. >> reporter: the drug companies have a year to come up with a plan to collect the unused pills and get rid of them. rob roth, ktvu channel 2 news. a fiery big rig accident in the east bay injured three people and created a huge traffic problem. the highway patrol says a big rig sideswiped a car in the highway 380. the truck scraped a wall and slid to a stop. it spilled diesel fuel and hydraulic. the truck driver and 17-year- old son was able to get out.

a woman driving the other car also was treated for minor injuries. all lanes have been reopened. in election 2012 news, tonight president obama is spending time in three states today. spectators outside san francisco airport watched air force one take off ending a three day whirlwind trip here in the bay area. he left here around 11:00, headed for portland oregon for a fundraiser there and he's scheduled to be in seattle tomorrow night. mitt romney addressed veterans in reno one day after the president did. speaking after the vfw convention, romney said america is the biggest country in the world but says obama's policies are hurting our country. >> in 70 years, exposed the military to cuts that no one can justify. compromised our national security secrets. >> reporter: romney will spend

the next two weeks over seas in israel and poland to outline his ideas on american foreign policy. voters in liver mother will -- livermore will be voting on changing the city's election cycle from an odd year format to an even voting format. many cities and agencies hold their voting on even years to livermore would be able to share their expenses with them. now to our continuing coverage of the movie theater massacre in colorado. a gag order is now in place in the case of a shooting suspect. a judge has banned police an lawyers from discussing the case of 24-year-old james holmes. this comes as a handmade memorial is growing for the

victims. several of the victims will be buried on saturday. and a 26-year-old navy veteran will receive a full military funeral next month. a nonprofit group has raised almost # -- $2 million for the victims. the police chief first asked for donations to the fund last friday. giving first.org allows people to donate to a variety of groups helping the victims. including mental health services, victim's assistance agencies and blood banks. a new report shows that the number of people trying to buy new guns has gone way up in colorado since the shootings. the colorado bureau of investigation says gun dealers submitted 2,800 requests for background checks in the three days after the shooting. that's up 43% compared to the week before. now to those who survived the movie theater massacre. they're giving new accounts of

to be you know a little emotional for me. >> reporter: michael white is also feeling emotional about the actions of his father. the younger white was shot in the back and his girlfriend farah sudani was badly injured. he says his father saved sudani's life by covering her. >> i could not let them get both of our lives. i thought if he is going to get both of us. so i put myself over her. >> it was the second time that he met her, so for him to do that to save her live, i love him. and the new gun debate

sparked by the colorado shooting. a special benefit dvd will be released at at&t park during the opening ceremony. that dvd was recorded by tim flannery and the grateful dead to help bryan stow. the two men charged with beating bryan stow appeared in a los angeles courtroom. stow is still recovering from very serious injuries. and is suing louis sanchez and norwood for $16 million. both sanchez and norwood pleaded not guilty to the charges last month. their trial is set to begin next saturday. j.p. morgan is set to settle a suit. customers had accused the bank of improperly raising the minimum payment on credit card

another swimmer finally pulled him to shore. an onlooker tried to revive corona before he was flown to children's hospital in oakland where he later died. >> reporter: coming up, the simple game in a pool in the south bay that almost killed an 8-year-old boy. how his life was saved with literally no time to spare. the man who played george jefferson in the tv sitcom the jeffersons has died. >> i am the cleaner who thought muhammad alli. >> reporter: sherman hemsley played george jefferson. hemsley later starred on amen. hemsley died today in his home in el paso texas, he was 74 years old. san jose has been clearing out homeless camps near ellis park. we'll tell you where some of them ended up and why the homeless are worried problems may follow them. additional cooling on the

it seems san jose's attempt to clear out homeless has created problems in other areas. we continue our coverage, the homeless were told to pack up their things from the quick site encampment and robert handa is live to tell us that they did but now another camp and another neighborhood have inherited the trouble. >> reporter: we're on key street about a half a mile away is where the homeless camps at kelly park were cleared away from the city. so where did the homeless go? many of them ended up here at this over homeless encampment and it's generating some familiar problems. a walk down trails and through brush brings you to the homeless encampment literally below k street. the trees and clearings have made this a popular place for

the homeless for years. after san jose cleared out homeless camps last thursday many who did not get housing vouchers headed to key street. raul hernandez is worried how the city will react. >> they might just over all kick us out because it's too many people to handle here, i don't know. >> reporter: hernandez says the influx of strangers is also causing tension. >> we have to just hope for the best. that nobody comes in and destroys our place. >> reporter: but minutes later hernandez confronted a man in his tent. >> hey, hey. you already looked in there okay. you already looked in there. there's nothing in there of yours, okay. i don't know where you kept your bag and your stuff whatever. >> reporter: that tension worries the manager of an apartment complex near the camp. >> a lot more desperate people living in the encampment. we've seen some upbeat in police activity. >> we've seen a little property theft in the neighborhood. >> reporter: one person who got assistance moved out of the camp today but says not many will be following.

>> i am so happy that catholic charities helped me get out of the hole here, out of the jungle. >> how come more people here are not applying for the aid you got? >> because they don't believe it's really going to happen. >> reporter: today a clean up group packed up 109 bags of garbage here. that situation bears watching since excess trash and environmental damage led to eviction at kelly park. robert handa. a 12 hour police stand off in oakland ended with the arrest of one suspect but a second suspect is still on the lose tonight. that stand off ended about 3:00 this morning. members of the s.w.a.t. team surrounded the home with two suspects inside. they say the men fired shots at a highway patrol car on saturday night. when the stand off finally ended authorities were only able to arrest one suspect. two other men were previously arrested in connection with the shooting of that chp car. the palo alto city council has approved a plan to keep the

city's animal city services open at least for the time being. the division has to cut its budget for $100,000. the city council approved a plan last night that will cut staff and raise fees. that move took away $479,000 a year in contributions. san francisco and china today entered a new agreement to boost business and trade between the two regions. city economic officials and china's minister took part. mayor ed lee says san francisco is a -- making it a good business partner for china. >> this is what happens here in san francisco. we don't just talk about the problems, we will try to discover ways to solve them. >> reporter: now under the new agreement, china and san francisco have pledged to work together to promote investment and opportunity and bio science

technology and other fields. the bay area real estate market is showing some signs of recovery with a promising jump in home prices last quarter. according to real estate site zilo, home prices rose in san francisco and santa clara county. those two areas are considered the top two markets in the u.s. for sellers. for all nine bay area counties, the average increase was 2.5% that could happen inventory levels as more homeowners decide to list their homes at higher prices. apple's copyright infriction may be worth $2.5 billion. that is how much the company is seeking. according to court papers filed last night, apple says that samsung copied their technology for smart phones and tablets.

this afternoon apple revealed its third quarter earnings the knew -- news is not good for investors. apple fell short of expectations. apple shares fell 5.8% in after hours trading. over all it wasn't a good day at wall street. the dow dropped 104 points closing at 12,617. the nasdaq was down 27. and the s & p500 lost 12 points closing at 1,338. yesterday rosemary mentioned that we were going to see temperatures drop just a little bit and indeed they did today. let's check in with rosemary about where conditions are right now. >> very pleasant out there. we're looking at another nice evening as we settle into your tuesday today. near replica for some areas and some spots did cool down a few degrees. additional cooling on the way for your wednesday. right now the wednesday any where from five to 15 miles per

today moody's said the that the university is about a billion dollars in debt. and sanctions could hurt student enrollment and fund raising efforts in the future. and on top of that state farm announced today that it plans to pull broadcast ads from penn state home games. general motors is also reconsidering their sponsorship. top school officials are also accused of a cover up. a new investigative report claims that president obama's new plan designed to shield young immigrants from deportation may cost the government hundreds of millions of the dollars. president obama announced that new policy just last month. it would grant temporary work permits to many young illegal immigrants. ap also says the government would have to hire hundreds of new workers to process an

no money for doctors visits or dental check ups and exclusive look tonight at the number of californians struggling to pay for health care. this exclusive ktvu poll shows the growing burden of paying medical bills and the cost of health insurance. our poll showed that 53% of californian voters reported some sort of difficult in

paying for health care. >> reporter: more latinos have difficult paying their health care costs than any other ethnic group. here at this oakland clinic many times dentists spend more time on emergencies than cleanings and cavities. at la clinica de la raza dentists see a lot of their patients when it's too late. >> it makes it very difficult for those of us who are providing the care because now you're dealing with a full blown energy situation. >> reporter: a good portion of patients are uninsured, unemployed or under employed. according to the field poll funded by the health care foundation exclusive to ktvu more than half of californians have difficult paying for health care. 39% say the high cost of premiums is the main problem. 46% delayed seeking services due to costs and 54% say they fear financial hardship due to the price of treatment.

the nonpartisan congressional office said that president obama's health care overhaul will shrink the deficit. the budget projection is the first since the u.s. supreme upheld most of that law last month. scientists at the international aids conference reported that the majority of sexual active teenagers are using condoms. researchers and political leaders are meeting in washington discussing ways to try to eliminate hiv and aids. today the centers for disease control said 60% of sexually active high school students say that they use condoms. that is a drop when condom use peaked at 63%. but a big improve from 1991 when only 46% said they used condoms. the cdc says more work is needed to spread the message. the cdc says more than a

third of the births are from unintended pregnancies. this number has remained steady since 1982. women with unintented pregnancies are now more likely to be hispanic as opposed to white. cdc researchers say in 1992 white women accounted for most unplanned births. the man is in his late 20s and he was wounded multiple times in the leg around 3:00 this morning. now we're told the injuries are not life threatening. you may remember back in january officers say 22-year- old college student martinez was shot. but right now they do not believe the two incidents are related. several hikers have reported seeing a mother and

mother at the pool performed cpr. emergency crews say the boy was lifeless when they arrived but they were able to resuscitate him. they say the good samaritan saved his life. he is recovering at lucielle packered. >> the mom is scared, very scared. lots of prayers for her because she is very, very scared. >> reporter: fire officials say this is the second near drowning this year. last year there were six near drownings in a one week period during the summer. that's why this mother is having her son take swimming lessons. >> that's why he's had swim lessons since he was a year old. every summer we have him either it's mommy and me classes or this year we finally decided to do one on one so he can learn more about holding his breath under water. >> fire officials say this near drowning serves as a reminder that it only takes a second of looking away for something to happen to your child. janine de la vega, ktvu news.

ktvu has learned that vincent calvary was taken into custody on july 15th. this video is part of a 2009 documentary that the openly gay lieutenant starred in. calvarez is charged with misdemeanor, and false imprisonment. the incident happened late thursday night at the gold's gym. calvarez was booked into jail then released. a spokesperson for the department says he is now on administrative duty and is expected to be arranged sometime tomorrow. second thoughts. the upcoming movie that is making a change in the wake of that movie theater shooting in colorado. >> and an honor given to a local airport and the airline that earned top honors.

symptom of troubled relationships not the cause. she does say face to face interactions use different types of the brain may atrophy. the los angeles council voted to ban medical marijuana clubs in the city at least for now. the city council has been struggling to control the hundreds of pot clubs that have opened up across los angeles. today they voted 13-1 to ban the shops outright until the state supreme court provide clearing guidelines. if the mayor upholds the decision, letters will go out to one dozen pot clubs. authorities say 27-year-old justin beldin had reached the summit and fell while descending the mountain with his two climbing partners.
