access in public libraries it joins other measures to keep minors from accessing explicit materials. two other states allows libraries the choice of installing software. a not guilty plea for wilfredo reyes. he's accused of the death of a san francisco father and two sons two years ago. reyes was arrested in north carolina and appeared in a san francisco courtroom this morning. prosecutors say he and another gang member mistook anthony bolognia for gang members when he shot at them. reyes will be back in court august 22nd. two people were killed in an early morning apartment fire that forced dozens of people from their homes. ktvu's cara liu joins us now where firefighters tell her the

tragedy could have easily been prevented. >> reporter: right now this apartment is blocked off. they are looking into reports this couple smokes and seeing if that played a role. we have also just learned from the fire department they do believe carbon monoxide poisoning contributed to their death. firefighters say working smoke detectors would have made a difference but they didn't find any in the apartment where a couple in their 20s lost their lives. >> it's really sad. it's really sad for me. unbelievable. you go to bed and you don't know if you're going to wake up the next day. >> reporter: anita jones lives near by, she says as soon as they found out what happened she called their renter to find out if their smoke detectors were works. >> kind of assume you know what's happening, but it was a wake up call for us. >> reporter: the early morning blaze forced people out their

runner just after 1:15 this afternoon. diesel fuel spilled and caught fire and the truck driver and his 7-year-old son had to jump out of the cab to escape. they suffered minor injuries as did the woman in the toyota. an 8-year-old girl from buehrleing game nearly drowned today at lake berryessa. it happened around noon near the south end of the lake. the girl was overcome by carbon monoxide from the exhaust of an idling boat motor. she became dizzy and fell into the lake. her father was able to rescue her. in san jose an 8-year-old boy remaineds in intensative care after almost -- remains in intensative care after almost drowning in a pool. a youngster pulled the boy out of the water and a woman started doing cpr. >> if it wasn't for that lady that was giving cpr, he wouldn't be here right now. >> reporter: we're told the boy

is in serious condition tonight at children's hospital in palo alto with his mother by his side. the city of walnut creek is taking steps to keep youngsters out of flood channels. the creeks can be tempting places to play especially on hot days. but since the drowning of two teenagers last february the city has taken steps to try and improve safety. a public meeting is about to get underway at the walnut creek and also get more input from the community. tonight we're learning that some people who were evicted from a park are moving into another makeshift camp. crews cleared out a homeless camp last thursday. the manager of a near by apartment complex told us he's now see an increase in police activity and thefts? -- thefts. alameda county is the first

jose voters will decide whether to raise the city's minimum wage. currently the same as the state's $8 minimum wage to $10. >> if it's passed on the voters it takes effect 90 days afterward. it just goes right into effect. >> reporter: also east bay congressman has proposed raising the federal minimum rage from $7.25 to $9.80 per hour over a three year period. >> reporter: today in sacramento a small group rallied in favor of the federal raise. >> everyone if the state of california where the minimum rage is $8 a total yearly income of 16,640 is not enough for one person. much less to sustain a family. >> reporter: back at the restaurant, earner jeff starback says he would love to pay his workers more but in doing so it would really hurt his business. >> we would have to look at the schedule tighter than what we look at it now and cut back everybody an hour or two here and there or completely

eliminate two or three positions. >> reporter: still server jose gallindo wants to see the increase. >> that would be like awesome you know, good. because more money for the people. >> the federal proposal and san jose's ballot initiative would be tied to inflation. live in san jose, i'm john sasaki. apple's third quarter earnings report fell short of expectations. slow growth and over all revenue everyone though profit rose. company stocks tumbled in after hours trading. netflix made $889 million in revenue in its second quarter. that's a 90% drop from last year but in line with analysts expectations. netflix warned it would lose money as it expands.

and stocks are down for a third straight day as economists. nasdaq dropped 27. uc berkeley is joining harvard and mit in offering free online courses this fall. the university of california will provide two classes in artificial intelligence and software engineering. a nonprofit group called ed x will host the classes on its website. ed x officials say 154,000 students registered for its first free classes that were offered by the massachusetts institute of technology this past spring. the u.s. secretary of labor was in san francisco today to hear what the city has done to help create jobs for young people. major ed lee says the city has reached its goal to provide summer jobs to 5,000 people ages 14 through 24. secretary hilda salas said it's an important of the importance

there's been a charge of domestic charges. we just received the mug shot of vincent calvarese. he was taken to the hospital after an altercation thursday night at gold's gym. calvarese is charged with assault and false imprisonment. he is now on administrative duty and is expected to be arraigned tomorrow. the case against suspended sheriff mirkarimi has raised perjury questions against mayor ed lee but tonight the mayor is

in the clear. tonight david stevenson is in san francisco with why both sides could be telling the truth. >> reporter: one veteran politician showed us what he says could be proof of perjury. >> i received a telephone call from mr. wong i've known him for many years. >> reporter: aaron peskin today showed us a text message he says helped prove that he was asked last march to encourage sheriff mirkarimi to step down. the text message says, our friend wants me to tell you no matter what outcome with your negotiations he is appreciate your help. >> he indicated to me that he was communicating on behalf of the mayor with an offer that if he would resign that they would find some sort of job for him.

>> reporter: so you never authorized say aaron peskin or walter wong to convey to sheriff mirkarimi if he would step down you would give him another job? >> absolutely not. >> reporter: this afternoon a san francisco district attorney's spokeswoman told us based on the available information there's no basis for commencing a criminal investigation. walter wong did not return our calls but political analysts says peskin could be telling the truth about wong. >> the mayor did not ask to be the intermediary he thought he was being hepful. there's an explanation for both sides. >> reporter: the ethics commission next month will recommend to the board of supervisors on whether sheriff mirkarimi should keep or lose his job but the supervisors are already preparing. the board will lay off a

process to vote on mirkarimi's fate. reporting live in san francisco, david steveson, ktvu news. lawmakers plan to discuss how to spend $59 million uncovered in the state's parks department budget. the state parks director you will recall has resigned. she did so last friday. after two hidden funds were found at the time when state parks are in danger of closing because of the state budget process. today the finance director found that there are limitations to how this money could be spent. >> that money can't be used for any other purpose than parks that's why it's a special fund. in terps of determining how those moneynies ny -- moneys are going to be used that will be discussed with the legislature. >> the department of finance have all begun separate investigations into that hidden money. >> mitt romney went on the offensive today slamming the
