et quakes are a -- earthquakes are a major concern. today, governor brown and interior secretary ken salazar announced a plan to address all those issues. >> the propose that we're unveiling today is a big idea. >> reporter: the idea is to build two huge tunnels to divert water underneath the delta to the controversial pump that will draw water from the delta. >> we're talking about the largest pump in the world. and we know and have known since the 60's that these largest pumps are fish-killing pumps. >> reporter: supporters pay the bay delta conservation plan will restore the ecosystem and ensure water supply. >> we've been here before. we were in 1982 when the first attempt was made to destroy the delta with a canal. >> reporter: he calls the tunnel idea a water grab and argues the tunnels could suck

half the water from the sacramento river even before it makes it to the delta. >> they have put the canal or the tunnel before the science. >> despite spending hundreds of millions of dollars studying this damn thing, people will say, well, you haven't studied it enough. >> reporter: supporters say this project could cost in the $20 billion range. opponents say it could be north of $50 billion. we have differing opinions on both sidings of this issue. at 6:00, we'll talk to those in the salmon industry who say this plan will not save their industry but could destroy it. and more details now on the delta water plan. those giant twin tunnels would run through the delta between sacramento and tracy. and the pumps would be at the northern end. now, it is estimated that the tunnels would divert 9,000 cubic feet of water per second. the governor's water plan is getting some swift push back

from washington. at a news conference on capitol hill, groups criticized the idea, saying that twin tunnels would reduce the sacramento river to a trickle. they also say the governor did not consult enough with northern californians before he unveiled the plan. >> i'm worried that what is now starting to build as momentum to get this facility constructed overwhelms the scientific considerations that are absolutely necessary for the protection of one of the great delta systems in the world. >> in the past, members of congress have argued over whether washington should even have a say in california's water war. go to our website and click on web links. there you will get a look at the current water delivery system. we are learning more about a fast-moving fire in san francisco today. alex is live on the scene with the story of one man who barely

made it out alive. >> reporter: one man i talked to today credits firefighters with saving his life today. one of his neighbors was not so lucky. this is a destructive fire that started on the second story of this complex this morning and neighbors tell me it trapped the elderly man who lived alone in that corner unit. home video shows huge flames pouring out of the complex. a cooperative on cleary court. >> it was really eerie and really threatening and we saw the middle center court was filling up with smoke. >> reporter: the fire was knocked down fairly quickly, but when crews did a search, they found one person dead in a second-floor unit. it was a man in his late 70's who was killed, a longtime resident. >> very quiet person and very nice man. he kept to himself. so sad.

>> reporter: 72-year-old bill sargis lives in one of the nearby units. he was sleeping this morning when firefighters came banging on his door. sargis says firefighters helped him escape as smoke filled up his face. >> two words. thank you. really wonderful. >> reporter: both sargis and another man suffered minor smoke inhalation. there was also one firefighter who was cut and had to be hospitalized. a dozen people were displaced here and the red cross set up an emergency shelter for them at st. mary's cathedral which is right next door. san francisco's arson investigation task force was called in today, which is something that's routine whenever someone dies in a fire. a fire department spokeswoman did tell me at this point there's nothing to suggest this fire was intentionally set. we're live this afternoon in san francisco, alex savage, ktvu channel 2 news. police in hercules need the

public's help to find the gunman who opened fire on a car full of adults and children. the victims were shot about 10:40 last night on highway 80 between pinole valley road and highway 4 and ended up at a gas station on willow avenue. someone in a car shot at a white pontiac carrying the three adult -- two adults and three children. the two adults were hit by the gunfire. the injured driver managed to get the car off the freeway and pulled into a gas station. police are still searching for the suspects. >> these people were very afraid, of course, and they got out of the area to try to get help and so because it was a very high emotional incident, they don't remember exactly where the accident occurred. >> the children were not hurt and both of the victims are recovering tonight. authorities have now identified one of two victims in a deadly east bay apartment fire that we first reported on

last night. 34-year-old samantha mone was killed at her apartment. she worked as a waitress in walnut creek. her friends say she was a passionate writer who loved the outdoors. the fire also killed her boyfriend, whose name has not been released, and their cat. authorities say there were no working smoke alarms in their apartment. rodents are being blamed for a natural gas leak today. the fire department was called to manila avenue in el cerrito just after midnight. neighbors reported seeing smoke but it was actually dust that the gas leak was pushing into the air. four homes were briefly evacuated. pg&e crews capped the leak and they found that tree roots had grown into a gas line and that rodents had chewed the pipe. there are calls tonight after a protest for police shootings in anaheim. you can see police in riot gear, face-to-face with some of

those protesters there. two dozen people were arrested, six injured, during a fourth night of rioting that left much of the city in shambles. here's a look at the protest and the deaths that sparked them. >> reporter: protests over two recent officer-involved shootings turned violent as large crowds clashed with police outside city hall. tuesday's gathering marked the fourth straight day of demonstrations since the shooting. a 25-year-old was killed by anaheim police saturday afternoon after he was approached by police officers and fled. he was not armed when he was shot. >> unarmed man, not engaged in any kind of criminal activity, run down by the police and shot in the back and shot in the back of the head and killed, once he calls to his knees. >> reporter: the shooting sparked a riot. police using pepper spray injured some in the crowd. >> they turned into this

commercial center and picking up the shopping carts and running with them and throwing them through the windows. >> reporter: the second incident happened on sunday when officers killed a man they say opened fire on them during a foot chase. he was the fifty person to die -- fifth person to die in an officer-involved shooting this year. >> i know the mother's feelings, because i know what i felt. i know what it did to me. >> reporter: the mayor is calling for local state and federal probes into the fatal shootings. >> i've called the u.s. attorney's office to conduct an independent investigation. when the investigations are concluded, we will have a clear and complete understanding of these incidents. >> reporter: diaz's family is filing a $50 million lawsuit against the city of anaheim and the police department. meantime, the police officers association say the officers felt threatened and acted appropriately. in los angeles, adam housely, fox news. the mother of one of the men shot and killed by the

officer spoke out against the violence. manuel diaz, who was not armed, was shot in the head from behind. >> please, please stop the violence. it's not going to bring my son back. it's not. and this is the worst thing any mother could go through. >> diaz's mother also said that no member of her family took part in last night's protest. the first of the colorado shooting victims was laid to rest today. 51-year-old gordon cowden. his two teenage kids who went to the movie with him both escaped unharmed. survivors of the 2011 tucson shooting that injured

congresswoman gabrielle giffords. people are upset that neither of the presidential candidates has addressed the gun issue. the petition asks for the presidential candidates to show how they would prevent the kind of bloodshed that occurred in tucson and aurora, colorado. dates are now set for three presidential debates. republican mitt romney and president obama will debate domestic policy in their first meeting and foreign policy in their third. their second will be a town hall meeting with audience members asking the questions there. the debates are scheduled for october 3 in denver, october 16 in new york, and october 22 in boca raton, florida. the u.n. secretary general is calling for international

support to try and stop the violence in syria. there are reports of attacks all over the city of aleppo in a fifth day of fierce fighting. as the fight escalates and the president refuses to step down, there are now fears that he may try to carve out a breakaway state. that could lead to mass genocide, similar to the bosnia war two decades ago. >> act now to stop it. >> the assault illustrates the, quote, depth of depravity, they say. the cool-down continues. coming up, the change in the

in sonoma county, there have been five drownings in just the past few weeks. one possible reason for this deadly spike? >> reporter: two of those drownings happened right here in steelhead beach. just three days ago, a 13-year- old was pulled from these very waters. one county official told me today, the russian river is safe. a wednesday on the russian river. >> the water is warm. >> reporter: canoes, paddles, rafts and swimmers swimming away. it's a relaxing spot suddenly

starting to turn some heads. officials say five people have drowned in this county in the past few weeks. >> this is for infants. >> reporter: today down at the airport, the rescue unit checked the ropes and bags, getting ready for the next call. in some of the recent drownings, this team has been called in for part. >> it could be shallow in one section and deep in another, so you never know what you'll find. >> reporter: it has been a busy season on the river. one possibility is swimmers who think the now lazy river is as calm as a pool. >> it is misleading, because you can look at the water and on its surface, it may appear still, but below, the water still carries a current and it could affect your ability to swim. >> they're capable of swimming. >> reporter: she's talking

about her two children. she says her eyes are always on family and friends. >> always, at all times, anywhere, especially anywhere near water. >> reporter: and it it is advice from a mother who knows this river. it is advice she hopes viewers take to heart. two helicopters joined the search today for a hiker missing in the saqoia national park. the hiker was last seen wearing a white shirt, long pants and a full-brimmed hat. he is known as an experienced outdoorsman. in vallejo, firefighters have their hands full. the first fire was at a home on

anador street. the other flared up on sonoma boulevard. the fire damaged the sign-a- rama store. fire officials belief both of those fires were accidental, but they continue to investigate. no one was hurt. in oakland, fire investigators are trying to figure out if a house fire was caused by squatters. the fire broke out at a vacant home about 3:15 this morning and we have some dramatic pictures. firefighters are standing right there on the roof as flames and smoke poured from the house. even though no one lives at the home, neighbors say they have seen people coming in and going. >> your mom woke you up, and what did she say? >> she said the house next door is on fire.

you need to get out now. it's next to your roof. >> firefighters believe the fire started in the back of the house, but no word yet on how it started. the concord, a house fire also broke out this morning in a home on san carlos avenue. everyone got out safely but we do hear that one cat ended up dying. nevada state tourism is considering kicking up money to help prop up the air races. insurance costs went up after last year's crash that killed 11 people and injured more than 70. they're considering a formal sponsorship tomorrow. the visitors association recently provided a $75,000 grant to help cover the increase in those insurance premiums. the drought that hits elsewhere in the united states could come home to us next year

in the form of higher food prices. the federal agricultural department estimates that the drought will drive up food prices 3 to 4%. it shows the price of beef, dairy and poultry will increase from 3% to 6%. with the cost of soy, corn and other commodities also soaring. judging by that picture behind you there, it looks like there's a lot of fog up the coast. >> that's a typical pattern you expect this time of year. the cooling trend right on track. temperatures are really dropping off. we had some 90's inland on sunday. today, just maxing out in the 80's. as you can see right now on live storm tracker 2, mostly clear skies inland but there's that fog hugging parts of the coastline from pacifica and san francisco. and we still have a bit of a breeze out there. some white caps out there. winds gusting currently right by the bay bridge, gusting to

20 miles an hour. current numbers, not too hot. no major heat out there for today. the warmest locations in the 80's, but lots of 60's and 70's. san jose, 73 degrees. typically we talk about the hot temperatures inland. what's happened, a deeper marine layer has transported some of that cooler air inland. that marine air is covering around 2500 feet. no major changes to the forecast over the next one to two days. here is our forecast showing an increase in some of the fog. this could also produce some drizzle out there as well first thing tomorrow morning, with the clouds hugging the coast, already into the bay as well. even a few patches well inland. that's all a part of your forecast for thursday morning. lots of low to mid 50's out there. san francisco, 52. san jose, 54 degrees. as far as the afternoon hours,

apple released its now operating system which is called mountain lion. it's designed to make mac computers more like iphones and ipads. microsoft has already indicated that its windows 8 operating system will be designed to work on tablet computers. mountain lion is available only by download. apple's stock tumbled more than 4% today. shares closed almost $26 lower

to finish it just under 575. a san jose family celebrated a hero's homecoming today after a long deployment overseas. how about that? sergeant first class jose morella, they just kept on hugging today at the airport. it's the first time since september that the two have been together. the army reservist has been deployed in iraq and afghanistan for almost three years. today he received a hero's welcome from the motorcycle group, the patriot guard riders. >> the first time i came home, i kept it low key. this time i knew she had something planned. i didn't know what. >> we got married right before he left, so this is really excited. there's been tough times but, you know, you just, like with anything, you just get used to it. you have to find ways to keep

motivated. >> he served back-to-back deployments. for his homecoming, his wife greet him with ribbons and welcome home science. they say they are just looking forward to staying put at home. well, investors were dumping stock after a huge miss on earnings in zinga. the stock tumbled nearly 40%. investors had expected the company would earn 5 cents a share because of a jump in sales. most of the revenue comes from the sale of virtual items. those zinga is due to have an impact on facebook. they make the five top games played on the facebook platform. facebook stock has been on a

helicopter to the hospital. four young people were also in that suv but were not hurt. a tow truck is now on the scene. now to the violence in oakland. it is up, according to new fbi statistics. the mayor quan has repeatedly said crime is one of her top priorities. today kara talked to the mayor. >> reporter: we caught up with them here at city hall a short time ago and asked them about the violence plaguing the city. after a press conference promoting next month's national night out and the fight against crime, we asked mayor quan why violent crimes in oakland have been going up. >> they've been going up. it's a much bigger question. we look at the trend and the last few months are on the way down. we're about three above last

year in murders and that's even including the oikos tragedy. that means street shootings are actually on the way down. >> reporter: but recent fbi statistics show violence in oakland is up, even as violent crime across the country dropped 4% last year. 14 more people were killed in oakland in 2011 compared to the year before. and just this weekend, a five- year-old girl on her way to get ice cream was shot near 50th and bankcroft. >> we have kids, 50% of the summer jobs are kids in the neighborhoods. the neighborhoods didn't change, no matter what the traffic was. the neighborhoods that we've had the most violent crime have

not changed in the last decade. >> reporter: the police chief had less to say about why violence is up. >> that's a question that requires a lot of time to answer and i don't have that time. sorry. >> reporter: the mayor also says there will be 25 new officers in those areas that have the most crime. hoping a big goose will return home. just a few months ago, staffers noticed the goose was gone. all that's left are pieces of its webbed feet. employees filed a police report. they say if someone decides to return it, they would gladly take it back, no questions back. the oakland zoo has removed a monument inscribed with the ten commandments. that comes ahead of a protest planned by a local athiest

group. san francisco -- the group california watch says there have been ten pedestrian deaths in san francisco so far this year. the city is taking steps to improve pedestrian safety. speed limits have been lowered in some areas in an effort to make them safer for pedestrians. if you plan to attend the garlic festival this weekend, officials have a warning for you. undercover police officers will be on duty at the festival. recently a thousand tickets were stolen. some are now being scalped online. >> it's very disappointing that people have stolen not just from the garlic festival but our mission as a nonprofit is to benefit so many community

organizations, so they're really taking funds in a way, away from those groups. >> the stolen tickets are lilac- colored. if anyone tries to use one to enter the festival, that ticket will be confiscated. a top deputy with the san francisco sheriff's department appeared in late on domestic violence charges. ktvu's rob roth was in the courtroom and tells us what the district attorney said about the allegations. >> reporter: vincent calvarese had been working inside the san francisco county jail on the top floors of the hall of justice, but this afternoon, a few floors down, vincent calvarese stood before a judge, facing charges of domestic violence. inside the court, lieutenant vincent calvarese pleaded not guilty to misdemeanor assault, battery and false imprisonment in connection with a fight he had with a man he used to date named elvis. >> what was this fight about? do you have anything to say? >> reporter: authorities say

the fight happened inside gold's gym last thursday. they approached vincent calvarese and accused him of lying about their relationship, and they say vincent calvarese, who appeared in the documentary the butch factor, said he was a captain who would have him arrested. >> we have zero tolerance for domestic violence. it does not matter who the defendant is or who the victim is. >> reporter: vincent calvarese's attorney said that the other man started the fight. >> did he hit you first? >> anytime we have someone using positional authority, it's very disturbing. >> reporter: these charges come just months after another officer pled guilty to domestic violence involving his wife. we're told he's performing desk duty until the case is resolved. there's a scenario where vincent calvarese could be convicted and still keep his job. >> he can work out a deal where

he gets just false imprisonment and not the domestic violence count. it's theoretically possible he could get his job back. >> reporter: the judge also issued vincent calvarese a stay- away order to have no contact with the alleged victim. he is due back in court in about three weeks. reporting live in san francisco, rob roth, ktvu channel 2 news. under the new state prison realignment report, it shows less than a 4% failure rate in reporting to parole officers. it may be due in part to a provision that allows release from probation at six months instead of a year if there are no violations. some counties are also helping inmates with jobs and housing before they are arrested. it's a tough choice and faces major sanctions, but with the option to play elsewhere, dozens of penn state football

into a car and drove her around the baltimore area. they found her this morning near her home unharmed. police say there are indications that someone used her credit cards in several locations but there was no demand for a ransom. the man didn't even mention her famous son. 1970's television star everett has died from lung cancer. he appeared in a number of movies, including mulholland drive. he is survived by his daughters and grandchildren. chad everett was 76 years old. is living in california bad for your child's well-being? we'll tell you why one study says it is. a little cooler today across the bay area. coming up, when our next warming trend could return.

there are a lot of great things about california, but when it comes to the well-being of children, it turns out that this state is among the worst in the country. ann ruben is here now with how california appears to be failing its kids. >> a study released today looked from everything from economics to education. it found that when it comes to kids, we're just not measuring up. >> reporter: whether their future is in music or medicine, this woman wants her kids to meet their full potential.

but right now, she's struggling with the basics. >> we need a lot of -- good education and good health care. that's the main important thing for our kids. >> reporter: but when it comes to those things, california may be falling short. a new study conducted by the casey foundation ranked california 41st out of 50 states in children's well- being. >> as a native californian, you don't want to think of us as a bottom ten state, and when you look at this report, when it comes to kids, we are. >> reporter: while california's overall rate was 41, we were even worst in economic well- being. 43rd in education. and 42nd in the area of family and community. the bright spot? health, where california ranks middle of the pack at 23rd. >> this report really sends a call that we need to better prioritize our funding and making sure kids come first.

>> unfortunately, the state coming to the rescue, they need to come to the rescue. >> reporter: she says she doesn't need a study to show her things are tough on kids. with families struggling to pay for child care, health care, even groceries, she sees it first hand. >> i just hope things turn around. >> reporter: it appears that california dropped from 16th last year to 41st now, but the foundation that does the study says they actually changed the factors they look at this year, so they believe we're getting a more accurate picture of where we stand. the state that fared best was new hampshire. the worst was mississippi. the late pioneering astronaut sally ride chose a discrete way to announce she was gay. at the end of an obituary, she disclosed to the world her relationship of 27 years. for many millions of people who

admired her, it was a revelation. some commenters say she could have been a role model for gay youth while she was alive. an orca whale attacked a sea world trainer. we're showing you the end of the attack. the orca dragged him to the bottom of the pool for about a minute. he suffered a broken foot and puncture wounds but kept his composure. this video was used during the trial for sea world orlando following the 2010 death of a trainer. the government is taking legal steps to stop the sale of high-powered buckie balls. they are sold as toys and

desktop accessories. the problem is, if children swallow them, they can pinch intestines and may require surgery to remove. so far the company that makes buckie balls has refused to recall their products. people who use tanning beds could have up to a 20% increase risk of skin cancer. but the number skyrockets if the tanning beds were used before the person turned 35 years old. researchers analyzed studies. the team notes that since the use of tanning beds is relatively new, more research needs to be done, but they do believe that the risk could be even greater. american idol may have its sights set on one of country music's biggest stars. brad paisley is apparently being courted by them. he has worked with past

players. both steven tyler and jennifer lopez are not returning as judges but randy jackson says he'll be back. our weather certainly was cooler today. looks like when that fog comes in, it's going to cool down even more. >> the key change tomorrow, we'll have a little bit more of the serving of fog. we'll have a big impact on temperatures. we do have mostly clear skies but fog regrouping near parts of the immediate coastline. here on our mapping system, you'll notice this as you zoom in. patchy overcast around pacifica and becoming a bit tighter around san francisco, closer to the golden gate bridge. we still have a bit of an on shore bridge. that will be the source, the mechanism, to transport some of that overcast back into the bay. as far as temperatures today, we had a little bit of cooling,

about one to five degrees on average from yesterday's highs. out toward fairfield and antioch. fog will continue to develop for tomorrow. no big changes here. the weekend, we're going to gradually warm up. you can see the two extremes we're watching. this area of high pressure is a source of heat. the low pressure is a source of the cool-down. this will continue to be a factor in our forecast for tomorrow and also into friday. but that high gradually expands back into california and we're going to warm things back up for both saturday into sunday. but once again, a familiar pattern with cool temperatures for the beaches and no major heat showing up on the forecast maps just yet. here is the model showing you some of the overcast tomorrow morning. clearing back to near the shoreline with partly cloudy

skies. this orange contour links up with the 80's. warmest locations tomorrow barely make it up into the lower 80's. oakland, 66. and livermore at 81 degrees. san jose, 76. these temperatures will check in right around 3 or 4:00 tomorrow afternoon. san francisco at 64. no major changes friday. the whole thing is steady. but then we bump up those numbers. these are all just minor changes. coming up at the 6:00 news, it is the last weekend of july, and that means that the garlic festival is in town. the street corner action that had some of them out there with their boot in hand.
