panel has decided not to decide. a majority saying they need more information, more time, and more community input. chief greg suhr came to the police meeting tonight, hoping to do what several of his predecessors couldn't. >> i'd just like to save a life or two. >> reporter: two weeks after officers shot and killed a mentally ill man in the city's financial district -- >> i really believe in that incident it could have made a difference. >> reporter: wanting those specially trained to deal with the mentally ill to have tasers. >> i know now i will never ever get to hear that voice again. >> reporter: the family told the commission tonight, it does not support the policy. >> i don't think it's right to

use my brother and to accept responsibility for what they did to him. i don't think a taser would have helped stop anything. >> reporter: some also cited taser caused deaths. they did agree to give chief sur 90 days for a taser study. >> both san francisco sheriff deputies and california highway patrol carry tasers. san francisco is the last big city to not allow them. at 10:30, a 13-year-old boy honored at that same police commissioners meeting. the board action he took. the bold action he took to help officers get a burglary suspect

off the streets. rescuers hit the chilly waters off the beach tonight to pull four people to safety. the san francisco fire department responded. witnesses said two children needed medical attention. one child was transported to the hospital, and a second was given oxygen at the scene. both are expected to recover. it's a secret hiding place for the president and military commanders, and it's the stuff of hollywood movies. matt keller is in san jose where some santa clara county officials have created their own security bunker. >> reporter: it's one upgrade in particular that has some wondering if it's overkill.

oftentimes what happens here is considered the mundane business of local government. but the room through that door is grabbing a lot of attention. jodie foster and kristin stewart made a manic room famous back in 2002. in the movie, it was the safest room in the home. security director says $220,000 is budgeted for security upgrades to the building with $77,000 going to what many are calling a panic room. >> if you just look on its face, it seems, you know, kind of strange to say panic room, it's actually a conference room reinforced. i'm not going to disclose anything else, because it's an issue of security. >> reporter: we were not allowed back into the conference room, but the director described the upgrades as a hardening of spaces, and a hardening of the room. >> there's other safety measures, some that are public, some that are not.

but it's all about protecting the employees that work here, the public, et cetera. >> we're not going to wait until after something happens. >> reporter: the sheriff's department did not comment on what sparked the need for the upgrade. the sheriff did tell san jose inside.com, the panic room is a good idea. reporting live in san jose, matt keller, ktvu, channel 2 news. san francisco police face questions today about whether they could have acted earlier to get an arsenal weapon off the street. police confiscated a shotgun and rifle from robert jones told police. it wasn't until three weeks later that authorities found the other guns, knives, and thousands of rounds of ammunition. >> the threshold between a person in crisis and criminal intent is at the discretion of

officers. >> johns told us, he kept a list of politicians names in his car, including the vice president, the president, and speaker of the house, because was interested in studying politics. the fbi is assisting the san francisco police department in the investigation. supporters of medical marijuana organized an unusual protest in san francisco. demonstrators staged a new orleans style funeral prosession to signify mourning for two dispensaries that shut down yesterday. organizers say hope net, and vapor room were forced to close after threats of prosecution by melinda hague. hague did not comment on the protests, but has said her office responds to public safety concerns. hundreds of firefighters in southern california are struggling to control a wildfire tonight that has already destroyed one home. cal fire officials say

motorized equipment sparked the fire. the volcano fire started about 11:30 this morning, west of the city of murietta. the fire has burned 350 acres and is about 50% contained. officials say three firefighters suffered minor injuries fighting the fire. the debate over gay marriage, free speech, and chick-fil-a reached a fever pitch today, as thousands answered a push to support the chain. a chick-fil-a actually ran out of food. >> reporter: they did, they had to shut down about 5:00. this place would normally be open until about now. any, they started handing out vouchers for a free sandwich another time. the real showdown over chick- fil-a and gay marriage in the bay area might be just getting started. >> give you guys some shrimp. >> reporter: it was the last bit of chicken left. >> that's it. >> reporter: the managers at

that chick-fil-a in fairfield estimate they served 5,000 before the food ran out. >> you just missed out. >> we just missed out. we were hungry too. ♪ [ music ] >> reporter: waiting hours in line was a religious experience for some customers after former arkansas governor mike huckabee declared it chick-fil-a appreciation day. the company's president has been at the center of controversy for taking a public stance against gay marriage. >> i think it sends a big message out there that everybody should have the freedom of speech. if this is how they feel, then they're respecting their opinion. ingly support gay marriage, and i have a lot of friends that are gay. >> this man made the 40-mile trip from oakland. >> i support gay marriage, but i also support free speech and i support capitalism. >> reporter: opposition is mounting. a handful of protesters showed up outside this location in san

jose. others plan a protest in walnut creek say the debate goes beyond freedom of speech. >> i think people part of the disenfranchised group, they might feel differently, if the ceo came out against, for example, gay marriage. >> reporter: we watched as people continued to show up long after the restaurant closed its doors. we've seen a few more people come by in the last few minutes. things could get interesting again on friday, when supporters of same-sex marriage are planning a national same- sex marriage kiss day at chick- fil-a. live here at fairfield, eric rasmussen, ktvu, channel 2 news. a technical glitch on the new york stock exchange today. it involved dozens of stocks moving up and down by wide margins for no reason. it was linked to the knight capitol group, which said it had a technology issue.

many bay area drivers count on traffic information sent to their smart phones, and on digital signs posted along the freeway to help speed up their commute. a ktvu investigation says some of the caltran sensors may not be accurate, and that cost all of us more than just time.

amber lee has tonight's special report. >> reporter: millions of bay area drivers depend on the information by caltrain. christina curry of danville is one of them, regularly driving interstate 680. the data is collected by caltran, using three principal methods. specialized loops of wire under roads, wireless sensors, and fast track responders in vehicle. but there are far few devices to measure traffic. the other two technologies have largely failed. the cost to taxpayers? 60 to $80 million. one top bay area transportation official who asked not to be named calls it quote, a scandal. cal transit has known they're

faulty at key locations. >> reporter: internal caltran documents show among the biggest failures are, every sensor on that freeway is dead. on the peninsula, the entire 43- mile stretch of 280 between king street and san francisco and magdelana avenue is dark. on the east bay, none of the sensors are working on 24. the entire 72-mile stretch of interstate 680, all the way from i-80 in the north to 101 in the south has no working sensors. not only do drivers depend on traffic times delivered to freeway signs, but all traffic

reports on the news as well. what's more, a law voted in by californians in 2006 requires it. and billions of dollars for california freeway construction and federal grant applications are heavily depend on the numbers the sensors deliver. >> right now, we have a fairly high failure rate. >> reporter: the caltran engineer in charge of collecting the data. >> we've identified as many as 50 to 100 things that could go wrong. >> there are probably holes in the system, but i can tell you, these are very, very useful information that we put out for our travelers. >> reliability rate is about

99%. >> reporter: he says caltrains may be doing simple as not flipping on a switch. >> you actually have to have the modem turned on. >> reporter: they have heard nothing from caltrans about any problems, even as the warranties tick away. >> our door is open. come tell us what you need help with. >> reporter: caltran counters it is working with census. state engineers say it will be 2 to 5 years before it can fix the problem. >> there's nothing that is more irritating to me, hearing about these things, first of all from you, from the press. we should hear about them from caltrain. i can't tell you how important this is. the application of this technology is the future of transportation for people. in california, we should be cutting edge. we shouldn't be doing things like this. our investigation also

found the sensor system operated by caltrans appears to work reasonably well on three bay area freeways. 101 on the peninsula. interstate 880, and 580 in the east bay. a bipartisan group of lawmakers is calling for an independent audit of california's specialty license plate program. an investigation earlier this year found the state had taken $3 million from a license plate that honored the victims of the september 11 terrorist attacks, and used it for general fund expansions, rather than scholarships and anti-terror programs. a legislative committee could authorize the audit next week. house republicans drew a familiar line in the sand today, calling for the renewal of all bush era tax cuts. president obama has promised to veto the measure.

in ten minutes, there's another tax cut, or tax rather that could be taking affect closer to home. we'll tell you where taxpayers are being asked to help fund county services. a new poll released today shows president obama is ahead of republican rival mitt romney in three critical swing states. we start with pennsylvania. right now, the president has an 11 point lead. 53% to 42%. we move over to the industrial state of ohio. this is of course where a lot of auto workers are. the president has a 6 point lead here. 50% to 44%. then we move down south to florida. which there's a lot of history there, going back to gore vs. bush. the president has a 6 point lead here, 51% to 45%. the bottom line in all of this, no candidate since 1960 has won the white house without winning at least two of these three states. right now, they're all trending

blue. the president told a crowd in ohio today, he's still focused on voters number 1 concern, the economy. >> our first order of business is to recover all the jobs and wealth that was lost in the crisis. and we've made strides the last three and a half years to get that done. >> after speaking to voters in mansfield ohio, he visited a chocolate shop. an estimated 47 million women now have access to free contraceptives. one part of the affordable care act went into effect today. this is one of eight health benefits that insurance companies are now required to provide to women free of charge. ♪ [ music ] a little bit of a warm up today for many. some places cooled down just a bit. but for the most part a warmer day throughout the area for your wednesday, as we head into tomorrow, temperatures are going to increase a few more

degrees. so we're going to see more mid- and upper 90s in the inland bay valleys. it's going to be a pretty warm to hot day inland. the fog is along the coast right now. pushing into san francisco. pushing across the bay, we're going to see a pretty good sized fog footprint tomorrow morning. you see it shooting across san bruno, over to oakland, to hayward. cooling in by the means of the fog. then it's right back to the coast by thursday afternoon, and the temperatures start to heat. because of that quick burn off, the numbers tomorrow are going to be pretty hot in them we could see upper 90s in our warmest, or hottest bay area locations. in the five-day forecast, there's changes that include skiing cooling. when i come back, we'll go right to that, and take a look at your five-day forecast with the bay area weekend in view. today was the last day for families to register a claim for remains of relatives who may be buried in a forgotten south bay cemetery. the cemetery is being excavated as part of a new construction project at the santa clara county medical center.

it's the potters field, where indig innocent, or unidentified patients were buried. about 100 people have come forward saying they may have a relative buried there. scientists say it may be impossible to ever learn the identities of all the remains. troubles in tahoe, as bears make their way to places where they are not wanted, why some fear the trouble will get worse. that story at 10:45. it is a spot for jimming and fishing -- swimming and fishing. the discovery that's prompted a warning about the water. >> also, an uptick in violence in san francisco. the police chief answers questions about a gang war.

an underground explosion in oakland, shut down a busy downtown street this afternoon. witnesses say flames shot several feet into the air through a manhole between 19th

and 20th on webster street. pg and e says an underground cable failed just after 5:00 p.m. a backup transformer is now carrying the power. webster street was closed for about an hour. san francisco police are blaming two ganging for a recent uptick in violence. the gangs are not targeting their rivals. >> reporter: every day this summer, more than 100 children come to the boys and girling club camp in visitation valley park. the counselors are being extra cautious. >> we don't utilize our large field as much. we do keep the kids a lot closer than we would normally keep them. >> reporter: counselors fear the children accept the violence as part of their landscape. >> it's our role to make sure that kids understand this is not okay. >> reporter: the most recent

shootings happened on san bruno avenue in this neighborhood not far from visitation valley. two members of the same family were shot. a 26-year-old was killed, his uncle was in critical condition. police are still looking into whether the shooting was related to recent gang violence. the police chief says the shootings are happening not between the gangs, but within the gangs. >> these guys are not guys that can't talk to each other. again, just a couple of weeks ago, they were friends. they were all within the same gang, if you will. and now all of a sudden, four of them have been killed since saturday. >> reporter: police say those involved in the violence need to bring an end to the bloodshed. >> in the meantime, we will be out there trying to save them from themselves. >> reporter: police are asking the visitation valley community to also step in and try to convince those involved in the violence to stop. in san francisco rod roth, ktvu, channel 2 news. the former head of the portola valley school district has pleaded no contest to

multiple felony charges as part of a plea deal. he's accused of embezzling about $100. he allegedly used the money to pay for work on his home. he's also accused of signing off a loan on an employer that was $2 million more than the district approved. he will be sentenced to no more than four years in prison. a warning for swimmers tonight at shadow cliff lake in pleasantton. the park remains open, but officials at the 80-acre former quarry site say the water has tested positive for high levels of chloroform bacteria. swimmers are advised not to swallow the water there, and to dry and shower off immediately after swimming. park officials say it's not unusual to have high bacteria readings. it's a place that's a sacred ground. you shouldn't be stealing from

happening now, san jose police are at the scene of a shooting this hour that sent two people to the hospital tonight. the issuing happened around 8:30 this evening. police say both the victims are males in their late teens. their injuries are not considered life-threatening. a cherished statue that stood in front of a south bay

church has been stolen. as robert honda reports, the brazen theft took place in front of a police station. >> reporter: father michael and his congregation have a routine at st. mary church in campbell. members pray outside, where stone statues depict st. bernadete. the statue was stolen from the church and its followers. >> mainly they're sad, and maybe angry, because they wonder why. >> reporter: police say the statue was stolen late thursday night or friday morning. the church on north third street faces the campbell police department. there is evidence thieves tried to take the virgin mary statue as well. >> the church wouldn't expect

someone to steal their property, especially being right across the street from the police department. >> reporter: it was bought tore $7,000 when the church was opened back in 1935. >> the psychological, and the emotional, and sentimentsal value is worth more. >> reporter: police say it took place after a music concert nearby, so the theft may have been a drunken prank, but now it's felony grand theft. santa clara county supervisors voted 4-1 to put a measure on the november ballot that would boost the county sales tax by 1/8 of a percent. the county sales tax would go to 8.5%. supporters say the tax hike would raise much needed money for health services.

>> we need an infusion of cash, and we know that a 1/8-cent sales tax isn't going to hurt people that much, but will have a big impact on county services. the city of berkely has decided to drop a propose for a plastic bag ban. councilmembers voted down the ban, saying it would cost the city about $175,000 for outreach and enforcement. the city will implement a ban on stores with $2 million or more. it's set to go into effect january 31 next year. another report is bad news for the oakland police department. a new adult suggests the department mishandled millions of dollars to upgrade

equipment. >> reporter: this new adult slams the oakland president on never used, or under used technology. >> we have $2 million that have gone down the drain. >> reporter: city auditor courtney ruby said she started the audit over a year ago. the underused half million dollars technology was the so- called shot spotter system. the deal had one person at one computer monitoring the shots so the department paid more to upgrade the system, and now each police officer has its own monitor. >> how do you explain that to the citizens? >> reporter: these cameras each officer now wears on its chest started with a $1.2 million system with cameras on police

cars now scrapped. >> the system is broken. >> reporter: the chiefs said the detectives have learned from the audit and have started making changes. >> the police officers aren't really that technical, so we've actually hired a consultant as part of our adviser. >> reporter: when i asked the chief about morale, he blamed the media for reporting only the bad, not the good. in oakland, rita williams, channel 2 news. the shootings of three federal agent. victor flores is accused of injurying three u.s. homeland security agents in an arrest warrant. flores has also been charged in the murder in the deaths of three rival gang members. a new call for information for richmond police after an elderly woman who was brutally beaten and sexually assaulted earlier this year died from her injuries. she died yesterday from the injuries she suffered during a

vicious attack in january. on january 28, a man found her unconscious, and badly injured behind the big old tire shop. she suffered major head injuries and never regain consciousness. police say they have no leads in the case. a san francisco police department gave a special honor today to a young man who helped catch a burglary suspect. the 13-year-old says he saw the man looking into windows at his home, so he yelled at him and called 911. police came and rescued the man. today, greg sur honored the team during the police commission meeting. >> deepest gratitude for your performance of outstanding bravery in service to others at great personal risk. such an example of bravery is worthy of the highest esteem by the san francisco police department. isaac, you're a hero. police have arrested a man they say was caught on camera stealing from a belmont home. investigators say the man in this video is john anthony bentley. they say that mercedes seen outside the home on 6th avenue is registered in bentley's name. investigators also say they found stolen items at his home in hayward. bentley was booked into san mateo county jail for burglary and possession of stolen property. two east bay women ran for their lives today to escape a burning home. one woman says she heard flames and an explosion.

she rushed to wake up her elderly aunt and helped her out of the house. several horses on the property also escaped the flames. no word on what started the fire. there's word tonight cal fire may lose more than 1,000 firefighters who are prison inmates. that's because the inmates are shifted from statprisons to county jails. the fran chronicle reports the issue is financial. centering on how much the state will pay counties to house the trained inmates at conservation camps. the federal trade comission has proposed updated online privacy rules in an effort to shield children from online marketers. the law was initially passed 14 years ago before smart phones and digital tablets exited. the ftc decided the law needed to be broadened to the 21st century to protect children. >> they truly are more vulnerable than adults. >> reporter: for children under

the age of 14, parental information would be required. the law also means tracking their browsing habits would be prohibited. the official death toll from the typhoon stands at 14. it forced 154,000 people from their holes. it has since moved onto taiwan, flooding farm lands, and turning taipei into a virtual ghost town. in india, the lights are back on after 670 million people lost power over the last two days, as a series of systems crashed. the grid failed because it was overloaded. but critics say the power outages are a result of negligence, and incompetence on the part of the government. in israel, u.s. secretary of defense, leon panetta stood

toyota is recalling almost 300,000 vehicles over safety concerns. the company says rav4 suvs, and

the lexus hs 258 sedan have suspension problems that could cause crashes. the lexus sedans are from 2010 only. the company said it will contact owners and tell them to take the vehicles into dealers for a free repair. the united states postal service today essentially declared it was broke. it failed to make a $5.5 billion payment to the u.s. treasury to prefund health benefits for retirees. officials say today's default won't effect mail deliveries or post office employee paychecks. so far congress hasn't agreed on a bailout plan for the ailing service. the fish and bear department calls it a bad year. why the problem could get worse.

>> reporter: not many tahoe bears have names, this one did. sunny, named for her golden coat. >> she would pass through our property pretty much every day to go to the lake and go swimming. >> reporter: sunny was found dead monday morning. she had been shot. >> she was a very special bear. very sweet, gentle. not a problem bear. >> reporter: the department of fish and game is looking for the person responsible, but this is just one incident of many this summer of tahoe human bear encounters. >> we get at least 20 calls a day. >> reporter: bears would normally find their food supply here in the forest. the problem this year is we had such a dry winter, many of the foods they normally would eat are in short supply. >> it's kind of like the perfect storm for human/bear

there was last night. along the coast, you've got to right now. maybe a little drizzle and low advise ability. livermore valley, 69 degrees. cool around the bay. oakland, san francisco, redwood city, you're in the 50s right now. overnight lows would be in the 50s. 52 in santa rosa. just like the last couple of nights, no big changes on the overnight lows. fog will make it probably to berkely, to the fremont area, but i don't think it's going to get to the livermore valley. fog tomorrow morning for a percentage of us. as we head into the long raged forecast kind of a cooling tremendous. tomorrow, saturday, and sunday, temperatures start to go down a few degrees. the high pressure is really doing its job, compressing the air masses. we're seeing fog right at the coast, but not much further inland than that. as you move through the microclimates, they will be

reflected. the temperatures reflected by where the fog is. out into the albany area, and the richmond area, you'll be in the mid-80s. mid-80s to the castro valley, and fremont. even upper 90s. your thursday looks like a pretty warm day. certainly warmer than today. and certainly the warmest day of the week. 81 in kentfield. air quality is fine. not great, but not spare the air worthy. fire danger out there, but the winds and the humidity are not cooperating. 94 in morgan hill, with a 93 in gilroy. 73 in santa cruz. along the coast there's fog and it stays there. it's there now and it's going to be there throughout the day tomorrow. 68 in san bruno. 77 in san mateo.

friday forecast highs are going to come down three or four degrees. the bay area weekend, temperatures start to trend cooler. subtle changes. it's been an interesting summer so far in that the temperatures, it's been sort of mild. last officer was similar to this too. we're getting some heat, but not crazy heat. not a lot of red flag warnings. >> looks nice in the meantime. >> a good five day. this year's west nile virus season is already the worst since 2004. almost 250 human cases have already been reported nationwide, including four deaths. health officials believe the weather has played a major part in breeding mosquitoes that spread the virus to people. most infections are reported in august and september. the removal process has begun on a big japanese dock that washed ashore in oregon. it is debris from the tsunami that devastated japan last
