next door as well. there seems to be heavy damage. and this is a four alarm fire. joining me live is lucia. she owns the bar across the street. you were here. it was around 4:45 this morning when folks started to notice smoke coming from the roof of the building. >> yes. actually, we woke up because of the noises of the sirens. we came over here and the fire was going. huge, huge flames. i'm so sorry about all the neighbors that we are losing these stores. it's been crazy.

really, really bad. >> i understand they were three stories high. >> yes, really high. it's horrible what is going on. because one of the stores over here they just remodel everything a few months ago. so they are losings everything. >> thank you for joining us. and luckily we have no injuries. you can see that crews are starting to pull out. they are starting to walk back to their engines. it appears they have the fire under control as of now. the flames periodically have shooting up out of the roof. what's important to note is behind this strip right here of businesses is a neighborhood and the homes are extremely close. san francisco the houses are pretty much on top of each other. westwood park is the neighborhood that's beyond. this those homes are threatened. so firefighters had to make sure they could contain the fire. it appears it ripped through the attic space all along the whole entire block. witnesses say it actually went down to the grocery store here. the fruit barn.

you can see quite a bit of damage here, almost an entire block. heavy smoke damage and flame damage as well. we are live in san francisco, ktvu channel 2 news. thank you. it's now 70:00. our coverage continues this morning on the chevron refinery fire in richmond. this morning we learned that the main fire is out. but that a small fire is being allowed to burn. ktvu is live from richmond where workers are reporting for shifts as an investigation continues. good morning. >> good morning. that small fire you mentioned is a controlled burn that chevron doing on purpose in order to release some of the pressure still at the refinery where this fire happened yesterday. the big question this morning is how did this fire happen and what triggered it and what's the question that investigators with cal osha, california epa and contra costa county investigators as well as chevron's internal team are trying to answer this morning. the fire started in refinery unit number four around 6:30

yesterday. residents in the area reported hearing a loud boom and then you can see flames shooting from two of the refinery stacks. and that released a huge black plume of smoke that drifted eastward and triggered a shelter in place warning. investigators are looking into reports that there was a leak in unit four immediately before the fire started. company representatives told us while the main fire here has been extinguished, they are still doing work. that control burn that we told you about, that's going on this morning. our unitis completely shut down and anything else going on is going on because it's safe to do so at our facility at this point. it's a normal day at work. we were expecting folks to be here on site and we will continue to operate. reporter: chevron spoke person say the other units at this refinery not affected by the fire are still operating and processing fuel as normal today. so production has not been entirely shut down by the fire. just the diesel unit, unit four is shut down and

representatives don't know when that unit will be back on-line again. as you heard the spokeswoman mention, we are seeing cars and employees walk and drive into the refinery ready to report to work. again, they don't know when that diesel unit, unit four where the refinery fire happened and don't know when it will be back online. other units are still processing fuel as normal today. live in richmond, ktvu channel 2 news. air quality officials are encouraging anyone experiencing symptoms or distress from the refinery fire to seek medical attention this morning. last night hospitals were flooded with hundreds of patients who complained about breathing problems stemming from the refinery fire. doctors medical group in sao paulo says it treated 200 patients and had a call in extra staff. kaiser in richmond said it treated three dozen people. chevron has apologized to the community for the refinery fire. the company will hold a town hall meeting tonight to answer any questions. it will be at the richmond

memorial auditorium on civic center plaza starting at 6:00 p.m. we will have continuing coverage on the refinery fire throughout the rest of mornings on 2. we have more pictures and video on our channel 2 website, ktvu.com. san jose police officers are gathering at their union hall to talk about a no confidence vote against the chief of police. ktvu is live in san jose to tell us why police officers are angry and what this vote could mean. alex? reporter: well, some of the rank and file members are concerned about a number of issues and they blame the chief and later on this morning the members of the san jose police officer association will take a critical vote. it will happen here at headquarters inside this meeting room where as you can see a number of officers arriving early this morning are all ready to weigh in on a job the chief is doing here in san jose. san jose police officer association members are going inside. the members will be polled and will decide whether to

authorize a vote of no confidence in chief chris moore. some members recently expressed concerned about issues of officer morale, pay cuts and lack of officers as well. now this is purely symbolic vote. this can affect the chief's job in the end. i did talk with the president of the union. he told me this vote was put on the agenda by certain members and he doesn't think this is the right time for this. >> we have a lot of issues that we need to be dealing with. crime is going through the roof. staffing is at an all time low. and the real adversary here is city hall in my mind. it's not the chief. >> and in fact the mayor of san jose says the issues that officers are concerned about here are not the chief's fault. this vote will happen here at headquarters at 7:30 this morning. actually the meeting will get started at 7:30 and then a couple of hours of discussion. the vote will happen here with the officers who show up at headquarters today and weigh in. and then eventually there will be a vote that will involve all

of the members of the san jose police officer association. that may happen in a month or so. we were live this morning in san jose, ktvu channel 2 news. time is now 7:08. lawyers for former kidnapping victim jaycee dugard is accused of the justice department of tampering with a key witness. lawyer says they spent weeks working with the parole expert to help their case and claim the justice department lawyers convinced the expert to quit the case. jaycee dugard is hoping to hold the government responsible. she claims federal agents could have put garrido back in prison before he kidnapped her but they did not. a search is on this morning for a missing pregnant woman from modesto. liza costello is considered at risk. police say she may have been taken against her will by her former boyfriend eric davis. she left a note saying she was going to meet with davis who came over during the night. now it's said to call the

playing in heavy metal bands. social media profile show page with banners that have swastikas. authorities say page killed six people and wounded four others in the sunday morning shooting rampage. he was then shot and killed by a police officer. one of the injuries is a 51-year-old police officer. he was the first officer on the scene and police say he was ambushed while trying to help a victim. >> he was shot between eight and nine times. during the shooting. they had him resting comfortably and we hope for him to make a full recovery. one of the six people killed was the president of the sikh temple. his son says he saved lives by trying to stop the gunman with a knife. three of the people killed had ties to the bay area. san jose sikhs gathered yesterday to pray and mourn. they plan to hold a candlelight vigil tomorrow. despite the violence, they will continue to keep an open door

avoid automatic defense cuts that are due to take effect in january if lawmakers don't come up with an agreement on a deficit reduction plan. two small planes violated airspace of president obama's plane were intercepted by air force fighter jets. norad says both of those planes entered the airspace that was temporarily restricted just for air force one. it happened yesterday evening in the new york area while the president was campaigning in connecticut. first plane was followed by the jets until it landed. the second plane was allowed to continue on to its destination. 7:17. the latest presidential campaign fundraising reports are in. allison burns is in our washington, d.c., newsroom to tell us which candidate is raising the most money here in california and around the nation. romney heads into the fall with money momentum. for the third month in a row he beats president obama in fundraising.

romney's campaign and the republican national committee announced they raised $101 million in july. president obama and the dnc raised about $75 million in july. although their total war chest is still larger than romney's. and president obama is raising more in california. our review of the fec's fundraising totals for each campaign in california shows obama raised $33.7 million so far in the state compared to $15.6 million raised so far in california for romney. the pressure to raise money means both candidates are spending more time these days at fundraisers than campaign rallies. reporting live from washington, d.c., allison burns, ktvu channel 2 news. time is 7:18. some republicans are now accusing senate majority leader harry reid of hipocracy. that's because reid has been calling on republican presidential candidate mitt romney to release more of his tax returns but reid refuses to

release his own tax returns. a spokesman for reid says majority leader is not running for president and that as a senator he is required to file financial disclosure forms every year. this morning the marin county board of supervisors are vote on a sales tax increase. the county sales tax will go up one quarter cent that's expected to raise $10 million a year. help pay for park maintenance, farm programs and buying new parkland. also today leaders in san jose and santa clara county are set to vote on a possible increase to sales tax. it involves two measures that would go before voters in november. the first is a county measure to raise sales tax by one-eighth of a cent the other is city measure that proposed a half cent increase. san jose mayor says he will not be voting to put the measure on the ballot since polls show it does not have much support from voters. our time is 7:19.

new report is out focusing on the big gap between the costs of for profit and regular colleges. according to the -- senate committee found that tuitions at career colleges is 20% higher than similar programs at public universities. associate degree programs at for profits average four times the price of community college programs. committee says career colleges are not fully explaining the costs to students. a group headed by a former owner of the la dodgers that includes golf star phil mickelson just reached a deal to buy the san diego padres. the deal is believed to be about 8,100,000,000. still has to be approved by major league baseball owners. they will be meeting later this month. some of the fans said they hope a change in ownership can turn the padres around. they regularly have one of baseball's lowest payrolls. is it 7:20. warming up in many parts of the bay area this morning.

pest control than you think. researchers at university of georgia attached little cameras to about 60 house cats and then let them roam around all day. found that the cats killed an average of two animals a week. they also brought a quarter of their prey home and ate about 30% and then left the rest behind. the cats were watched for seven to ten days. university said it didn't account for animals it ate or did not bring home. little cameras. >> i like the dog. >> all right. 7:00, we want to check on sal with a breaking news on the four alarm fire in san francisco and let us in on traffic issues in the area. first of all i want to mention the two firefighters are reportedly hurt in this -- fighting this fire in san francisco this morning. that started in the 5:00 hour. these are pictures taken just a little while ago by our crew on the scene. now our reporter is on the

ground gathering more details. we are learning that two firefighters were injured in this building fire that actually affected several buildings on ocean avenue near capital in san francisco's engelside district. the fire is still being fought. the engelside line is affected and there are bus shuttles in place to get people around. that let's go to live pictures now of the commute. bay bridge moderately heavy. no major problems once you make it on the bridge once you are in san francisco. in the south bay we had slow traffic on 101 north and 85 also slow. and we look at 880 it's pretty slow from hayward near a- street. 7:25, let's go back to steve. thank you. we do have some patchy low clouds around and hit and miss. nothing compared to yesterday. that fog burned off very soon yesterday. there are breaks in the low clouds and will burn off as well. temperatures starting off in the 40s and 50s and even some ground fog up to the north bay

fire crews are now saying injuries are being reported in the four alarm fire in the area of ocean avenue and capital. ktvu is live on the scene with more on who is injures and the damage done there so far. tara? reporter: yeah, we spoke to a deputy chief and he told us that two firefighters were hurt. one of them hurt, their shoulder and the other suffered heart palpitations and they are expected to be fine and no other injuries reported which is really quite miraculous considering how fierce this fire was going when we arrived on scene here. we are on the corner of ocean and capital. they have it under control now a lot of the crews have since left. there are about 50 firefighters here because this was a four alarm. the wind really, really blowing and it was ripping through this attic. take a look at video that we showed a bit earlier. the flames were leaping three stories into the air according to witnesses around here. and it appears the fire started in a business called kings

coffee and tea. it has an attic space above it and that's where some witnesses reported smoke coming out from that window around 5:45 this morning. and then this attic happens to be connected to a string of other businesses on the block. so it quickly spread all the way down to the end of the corner on ocean where the walgreens is. he sis 3wr5á7 they did get blown out. it wasn't very a good thing. >> all right, so when we were traveling here on 280, you could see and smell the smoke from the freeway. it was quite intense. things have definitely died

down and at the moment it appears that everything is under control. there is extensive damage here. we don't have an exact amount and we don't know the cause of this particular fire. is that under investigation. arson is on scene. it appears it started in the attic where some electrical wires run through. we will stay on top of this and let you know how to develops. live in san francisco, channel 2 news. 73:00, we continue our coverage of the chevron refinery fire in richmond chevron says it's investigating what caused the fire last night at one of the nation' largest refineries. a representative says the main fire is out but a controlled burn is being allowed to help reduce pressure fire started in crude unit 4 which processes diesel crude oil. >> the crude unit is completely shut down. i don't know about the status of all of our other units.

the oil refinery fire. chevron has publicly apologized to the community for that refinery fire. chevron will be holding a town hall meeting tonight to answer questions. it will be held at the richmond memorial auditorium on civic center plaza. it starts at 6:00 p.m. this morning all bart stations are open in the richmond area now that refinery fire is contained and the shelter in place order lifted. last night bart shut down at stations in richmond, elsaare theo and deller in they. no bus bridge were set up because of the shelter in place order so passengers had to find other ways to get home. again, all bart stailingses are -- stations are open now for the morning commute. and damage from the refinery fire has limited chevron's operations. it's not clear when production will be back to normal. coming up at 7:45. ktvu will have a look at how drivers all over california may be affected. we will have continuing coverage on the refinery fire throughout mornings on 2 and we

have more pictures and video on our channel 2 website, bayinsider.com. time now 7:34. the chp is busy trying to identify a body found burned in sarahing ita. saratoga. it was found 100 yards off the road. ktvu is there now with more on this discovery. it started with the report of a grass fire. officers say the stretch of highway 9 is dangerous. it's known for accidents and spin-outs and believe that's what happened last night when a car went off the road and over this embankment. this is video from the past hour. you can see firefighters still spraying water on the scene about 125 yards down the hill near heather heights road. that's where firefighters found a volkswagen beetle and a badly burned body lying next to it. >> coroner is trying to determine identification. we don't have any idea who this party is. we haven't gotten anything off the vehicle yet.

it's completely burned up. no vin numbers. so right now we don't know who the car belongs to or who next of kin might be at this point. we were told the victim appeared to have died from the fire or smoke inhalation. investigators don't believe foul play is involved. we had a fire truck pull up here and drop off a firefighter. three of them are down below checking on hot spots beyond this ledge. they are being extra careful with the dry brush and the hot weather conditions that they are expecting today here in saratoga. reporting live, ktvu channel 2 news. time is now 7:36. happening now, members of the san jose police union are considering a vote of no confidence against police chief chris moore. now not all of the police officers are blaming the chief for complaints that include lower pay and fewer benefits. ktvu alex savage is at the scene now in san jose with more on the controversial issue. he is going to bring us a live update on everything coming up in just about 30 minutes.

a search continues this morning for the san joaquin county man suspected of kidnapping his one-year-old daughter and that triggered an amber alert. the child was found safe right here in the bay area. but the authorities are still out there searching for 30-year-old jonathan martinez. here is his picture. he is about six feet tall and weighs 170 pounds. martinez was last seen wearing jeans, a white t-shirt and an as baseball cap. his suv was found yesterday evening. in a park lot near stoneridge mall in pleasanten. martinez's daughter was found unharmed at the home of a relative in san lorenso. investigators say she will be reunited with her mother. cap 37. police in richmond continue to look for a second suspect in a killing of a teenager. 16-year-old ulysses was shot and killed late sunday night as he walked down the street near mcdonald and first. he was a well liked student and football player at kennedy high

school. family members say they believe he was shot because of the red and yellow school sweatshirt he was wearing. one person has been arrested. police are looking for a second suspect and they say they know who he is. the drunk driving trial of a former state assembly man who was arrested in concord begins this morning. assemblyman roger hernandez was arrested for suspicion of dui at 2:00 in the morning. a blood test showed he had a blood alcohol level above the legal limit. hernandez has pleaded not guilt scheme challenging the analysis of the blood test. time now is 7:38. thousands of people who support same-sex marriage say they plan to head to starbucks today. starbucks is one of the dozens of companies that publicly supports same-sex marriage. the on-line lesbian and gay wedding magazine called equally wed is declared today national marriage equality day. more than 32,000 people have gone to the magazine's facebook

page to show their support for lgbt rights. 10:00 this morning a new casino opens in san jose. casino matrix with its eight story tower there overlooks san jose international airport. it's replacing the older smaller garden city casino which closed its doors at 2:00 this morning. all 440 employees from garden city will have jobs at casino matrix along with 300 new employees. time coming up on 7:39 a rail project will not make it easy too cross the railroad tracks in petaluma this morning. a long train will be delivering and unloading new rails at 8:00 a.m. it will back up traffic at lakeville street, east washington street, east d street and lane. a lot to talk about at 7:39. sal, you been busy all morning. what is going on now?

>> you know, one ever the things we are seeing is things are beginning to calm down a bit in these commutes. it's beginning to be the even part of the commute. let's go and take a look at these pictures northbound 280. a little bit slow in san jose. 280 and 101 are slow. it has been a rather slow commute. 101 is the worse followed by 280 as i look at the chp list. there is not too much going on when it comes to major crashes in the south bay. a couple of minor ones but nothing major right now. let's move along and take a look at the bay bridge toll plaza. is that backed up to about the overcrossing in many of the lanes. some a little shorter. that's a ten minute delay before you make it on to the bridge. highway 4 westbound from antioch to pittsburg and then the bay point and pleasant hill to walnut creek and so is 80 westbound heading to oakland and to the bay bridge toll plaza. 7:40, let's go to steve. thank you.

we do have some patchy low clouds around most locations are clear. a little haze in the air and smoke and a lot of that going on and even ground fog up toward sonoma county. we want to show you right now is show you that time lapse from yesterday from the chevron refinery near richmond. traffic camera footage captured thick black smoke yesterday. time lapse shows what it looks like in the first 30 minutes after the fire started. now the wind really wasn't that much yesterday. it's a little bit stronger this morning. i have seen about 20 near port chicago. about 15 to 20 through the delta. so there is a little bit of a breeze here this morning. there is also a weak system right there. kind of picking up. just heard from mike out at pittsburg and wind is picking up here and a few locations getting breezy. there is a little bit more of a westerly breeze, southwest 13, west, northwest 13 at sfo. the delta breeze in place and that system is providing that.

good morning. welcome back to mornings on two. >> i'm dave clark. it's tuesday august 7. we have new details for you. breaking news from san francisco. two firefighters were hurt this morning battling a major fire near ocean safe and capital. ktvu sarah moriarty there is no uwith more on the dangers the firefighters were facing. >> well, firefighters have been on the roof for quite sometime. several hours this morning trying to make sure that all of the hot spots are contained. they roup there between the two palm trees. they are starting to bring down the ladders and wrap this up. this fire actually destroyed businesses along an entire block. it raced through the attic of several businesses here off ocean avenue. the neighbors say they reported smoke seeping from the roof of kings coffee and tea shop here around 5:45 this morning. this fire spread quickly forcing this to a four alarm fire. witnesses reported flames shooting three stories high.

two firefighters receiverred minor injuries and they had to work fast to save the homes on the back side of the strip mall. butts up to the neighborhood known as westwood park. a huge explosion that they are calling a back draft forced them back. >> going in it was basically a smoke explosion that blew them out. i think they started to get in there. they said the attic was fully involved from the truck. when they made entrance it blew them out. reporter: so this fire is under investigation. arson is on scene here. the chief is also on scene. back here live you can see she is pointing up -- she just put her hand up in the air there. she is standing in the middle there talking about this back drft. a lot of guys said they never seen anything like. it it's quite powerful this rediscussing that. in speaking with a source they told me that usually and typically in these coffee houses there is a roaster for the beans. those can start fires easily. we don't know the official cause of the fire.

but that is something that happens quite frequently in coffee houses, we are told. live in san francisco. ktvu channel 2 news. our coverage continues this morning on the chevron refinery fire last night in richmond. this morning we found out the main fire there is out but a small fire is being allowed to burn. ktvu alley is in richmond now where the workers are reporting now for their shifts and i know an investigation is underway. reporter: that's right. that small fire you mentioned is a controlled burn that chevron doing on purpose. they say it's necessary in order to continue to release pressure from the refinery where this fire happened. the question this morning is how did this fire happen? what triggered it? and that's the answer that investigators -- a number of different investigators trying to find this morning. cal osha is here. california epa and contra costa county investigators along with chevron's inteshle team are trying to pinpoint the source of this fire and figure out how it

started. started around 6:30 yesterday and news chopper. was overhead and you can see flames coming from two of the refineries staff and those flames sent out a massive plume of thick black smoke across the east bay and that triggered a shelter in place warning for several communities around here. the fire started in refinery unit number four which refined diesel fuel. investigators are looking into reports that there was a leak in that unit immediately before the fire started. but again at this point company representatives told us they don't know yet what caused this fire. >> we apologize to our neighbors in this community for the fire and the concern that we have caused them. we are now working to determine the cause so that we can prevent such an incident from occurring in the future. >> now all the main fire here has been extinguished. again, as we mentioned there is still work going on with that controlled burn that's happening in unit four. and while that burn and controlled burn investigation are going on, unit four the

chief of police. ktvu channel 2 reporter is live in san jose to spell out what kind of weight their votes may carry. good morning. reporter: this is a symbolic vote. there are some san jose police officers who are not happy with the job the chief is doing and not happy that he is standing up for the average rank and file officers. this is a meeting that we are asked to not shoot while it's taking place. san jose police officers association members will be deciding later this morning whether to authorize a vote of no confidence in chief chris moore. couple hundred officers are taking part in this meeting right now. many of them angry about the direction of the department. some members concerned about officer morale. pay cuts and staffing issues and they blame the chief. but the president of the union told me this morning he actually have some reservations about this no confidence vote. >> we have a lot of issues that we need to be dealing with. crime is going through the roof.

staffing is at an all time low. and the real adversary here is city hall in my mind. it's not the chief. >> our leader who is chief moore he is held accountable for the low staffing issues we have the exodus of officers that are leaving. the closures of police functions that will affect the community. these -- we just want the chief to be aware of these issues. reporter: while this is all playing out, chief moore has the support of the mayor and city leadership here in san hose easm the police union members will meet here in a couple of hours. the meeting got started at 730:67:89 if they decide to dhoarks give the green light to this vote of no confidence and then what would happen is a couple of months from now the entire membership all of the union members here for the san jose police department will be able to weigh in as well on this issue and event yell -- eventually could decide to install a vote of no confidence

>> engine company officer about halfway into the building opened up a door to access the area where the fire was going to be and right when he opened up the door by adding that a oxygen a violent event took place. everything ignites at once and that energy has to go someplace. if you are in the path of that energy you will absorb it. reporter: luckily firefighters were on their knees as they are trained to do so the explosion blew over them. fire investigators are on scene. still too early to tell what sparked the fire but it was strong when crews arrived. it had time to burn. the damage is extensive to several businesses along this block of ocean near capital. luckily no homes were damaged on the back side. crews were able to spare those. right now it appears everybody is beginning to wrap up everything. they are controlling the hot spots and fire investigators will try to figure out what started this fire. live in san francisco, ktvu channel 2 news. this morning all bart stations are open now that the

chevron refinery fire from last night is contained and shelter in place order is lifted. last night bart shut down its stations in richmond, el cerrito and el cerrito deller in they. no bus bridges were set up because the shelter in place order was in effect and passengers had to find other ways to get home. but again all bart stations are opened nor for this morning's commute. the refinery fire will probably have a big impact on all of california. coming up at 8:47, pam cook will come back with more on why the state gas supplies are already tight and how this won't help prices at the pump. we will continue our coverage throughout the day at ktvu channel 2 news and will have more pictures and video at our channel 2 websites, ktvu.com. 8:32. overnight news the california highway patrol is investigating the discovery of a burned body in saratoga. it was found about 100 yards from the roadway near heather

heights and highway 9. ktvu channel 2 reporter matt keller is there where police are working to piece together what happened. >> let me set the scene for you. just over this embankment about 30 feet is highway 9. as i turn my photographer down, you can see we are standing on a ledge here about 125 feet down this hillside is where the car ended up. you can see the blackened brush. that's where the fire started. this is video of firefighters this morning making sure there are no more flare-ups. when they arrived last night around 11:00, they found the car and badly burned body lying next to the vehicle. investigators said the victim is female but will have to test dental records. chp officers say this section of highway 9 is dangerous. >> the curbs jump out at you. no tell telling how fast the curb might be -- curves might be. extremely dangerous driving up here. >> chp told me the vehicle was

still hot when it was pulled up to the tow truck. investigators say there was no foul play involved. the victim appeared to have died from the fire or smoke inhalation. as we come back out here live we can see the pink tape where the firefighters were. three firefighters were down there making sure no more hot spots flared up. they had a hose on the ground earlier today. again to make sure the ground is nice and wet. because of the dry bus here in saratoga. real concern about the high fire danger and hot temperatures today. ktvu channel 2 news. 8:34. lawyers for former kidnapping victim jaycee dugard accused the justice department of tampering with the key witness. dugard's lawyer alleged that federal officials convinced a parole expert to quit dugard's case against the government. that expert was one of dugard's key witnesses according to the "san francisco chronicle." jaycee dugard wants to hole the government responsible for her 1991 abduction by convicted rapist phillip garrido.

she claims federal agents could have put garrido back in prison before he kidnapped her. the search is on for a missing pregnant woman out of modesto. lisa costello is considered at risk. police say she may have been taken against her will by her ex-boyfriend eric davis. she left a note saying she was going to meet up with davis who came over during the night. and said to call police if she wasn't back in five minutes. davis is believed to be the father of her unborn baby. police are now looking for blue 1999 chevy tahoe with the louisiana license plate that reads, tgu274. anyone with information is asked to call crime stoppers. time is now 835:67:89 we have breaking news -- 8:35. a big rig has crashed and is blocking traffic. want to show you some pictures we just got in. a semi truck filled with 200 gallons of vanilla extract. it has crashed along interstate

80 in placer county and look, it's stuck between a guard rail and a bridge support near sysco greive. this is about 20 miles west of truckee. crews out there are trying to take off all of the vanilla extract and get that truck back on its wheel but a major mess on interstate 80 and placer county. back here at home, more people are riding muni these days. some are saying there are fewer drivers and buses capable of taking them around. san francisco examiner reports ridership is up more than 2% over last year. however, muni has been missing hundreds of trips daily. part of the reason, due to money saving crackdowns and overtime for drivers and there are fewer drivers. muni also -- too many old buses and they are breaking down a lot. muni says it's trying to attract more competent drivers and they hope to have new buses coming next year. 8:36. want to check with sal to see

mid-90s. tomorrow is warmer inland and continue that thursday into friday and about the same saturday it's cooler pattern starts sunday and takes us into next week. >> time is 8:38. we were finding out about the man suspected in the deadly shooting rampage at that sikh temple. 40-year-old wade michael page was an army veteran. he had connections to white prem ss groups even playing in heavy metal bands with names like definite hate and end apathy. social media profile show those pictures of page with banners that have swastikas. authorities say page killed six people, wounded four others and the sunday morning shooting rampage. he was then killed by a police officer. one of the injured is 51-year-old police officer brian murphy. he is in critical condition. he was shot nine times but is expected to survive. murphy was the first police officer on the scene and police say he was ambushed as he tried to help one of the victims. one of the six people killed

was the president of the sikh temple. his son says he saved lives by trying to stop that gunman with a knife. >> i was told by several fbi agents that the blood trail and evidence that are inside is blood evidence that shows a battle had ensued and then a knife next to his body that had blood on it. >> in the wake of the sikh temple shooting, president obama ordered american flags at all public buildings and military posts to be flown at half staff until friday. three of the people who were killed had ties to the bay area. in san jose, sikhs gathered yesterday to pray and to mourn. planning to hold a candlelight vigil tomorrow. and temple leaders say despite the violence, they will continue to keep an open door policy. 20 minutes before 9:00. the search continues for the san joaquin county man suspected of kidnapping his one-year-old daughter triggering an amber alert. the child was found safe here in the bay area.

authorities are still looking for this man, 30-year-old jonathan martinez. he is six feet tall, 170 pounds. martinez was last seen wearing jeans, a white t-shirt and as baseball cap. his suv was found yesterday evening in a parking lot near stoneridge mall in pleasantitant. martinez' daughter was found unharmed in a relative's home. investigators say she will be reunited with her mother. at 10:00 this morning, a new casino opens in san jose. casino matrix with its eight story tower overlooks main thea san jose international airport. replacing the older smaller garden city casino that colonialsed its doors at 2:00 this morning. all 440 employees from garden city will have jobs at casino matrix along with 300 new employees. time now is 8:41. the suspect in the tucson arizona mass shooting will be in court this morning. what he needs to do today in

stronger earnings reports from u.s. companies helping the marks this morning. energy companies especially rising broadly after chesapeake energy reported its income doubled in the second quarter. taking a live look from the big board, the dow is up 86. the nasdaq is up 24 and the standard and poors 500 index is passed 1400 for the first time in three months right now up 9 at 1403. new this morning, 20,000 workers for the nation' largest phone company are now on strike following a midnight walkout. the at&t employees are represented by the communication workers of america. they are on strike on both the east and west coast. the west coast contract covers more than 17,000 phone workers here in california and also nevada. the east coast contract covers more than 3,000 workers mostly in new england. it's not clear how the strike is affecting service. our time is now 8:45.

bring up the other top stories. two firefighters were hurt this morning that were battling a major fire in san francisco this happened on ocean avenue near capital. the firefighters were hit by a back draft while they were trying to go in several buildings. the firefighters are expected to be okay. luckily, no one else was hurt. one person was hurt in this early morning crash. it happened in oakland. it happened on 45th avenue and international boulevard around 5:00 this morning. that pick up truck you can see was also involved in the crash. a police investigation continues. and just hours ago chevron held a news conference after that huge fire yesterday at the richmond oil refinery was put out. however, a controlled burn is being allowed to help reduce pressure. ktvu is live from richmond with the many questions that still remain to be answered. good morning. reporter: good morning. the main question this morning

is what triggered this refinery fire in the first place. as you mentioned, chevron representatives have been out here this morning making public statements about what happened. they started with their first update at 5:00. making a public apology to the people who live in the area for what happened yesterday. and i checked in with the company representative by phone about 20 minutes ago and he said he would be out here at 9:00 to give us another on camera update. this refinery fire started around 6:30 yesterday. news chopter 2 was overhead showing the flames coming from two of the refinery stack and the massive flume of black smoke. the fire started in refinery unit number four here which refined diesel fuel. investigators are looking into reports that there was a leak in that unit right before the fire started. at this point they still don't know what caused this fire. company representatives told us that the main fire here is extinguished and that main fire that is spewing the black smoke and we aren't seeing that out here this morning. but there is still work going on right now to get the problem

completely resolved. >> our unit is completely shut down. and anything else that is going on is going on because it's safe to do so at our facility at this point. it's a normal day at work. we are expecting folks to be here on site and we will continue to operate. reporter: now there is a controlled burn still going on here at this refinery. that burn chevron says is necessary to continue to release some of the pressure at the refinery. while that control burn is going on in the investigation is taking place as you heard the spokeswoman mentionedded unit four, the diesel refinery remains shut down and spokespersons don't know when that unit will be back online again. chevron says other parts of the refinery that were not affected by the fire are still continuing to go through the norm prole dux facilities this -- normal production facilities this morning. the diesel unit that has been shut down and in the mean time we are waiting to get another update from spokespersons that are supposed to be out here at

9:00 this morning. we will have more on ktvu schanl 2 -- channel 2 news at noon. that investigation in the chevron refinery fire is just beginning. there is already talk of higher prices at the pump. ktvu is in the studio with more on that part of the story. reporter: well, it's crazy but it's basic economics. supply is going to go down so surprises -- prices are going up. one analyst tells the contra costa time that the effect on california fuel prices is likely to be meaningful wre. used to hearing this. california strict environmental and air quality rules mean californians are restricted in the kind of gas that we can use. the specialized fuel created tight supplies in california and even when there aren't any problems. the refinery fire has certainly created some problems. >> i don't know howe we will reconfigure the fire at this stage. something we will work on. with the crude unit down we are not processing our other units. reporter: now the chevron

plant is the largest in the bay area. it can process 10 million gallons of oil products a day. that's equal to 1100 tanker trucks. however, last night fire means that will be cut sharply now that one unit of the refinery is offline. chevron has to now decide it will change how the remaining units will process. there is talk of the supply being affected for months to come and i'm already hearing gas prices are up in the region 25-cents a gallon today. we will keep watching. wow, quite a jump. thank you. chevron will hold a town hall meeting tonight to answer questions from the community. it will be held at the richmond memorial auditorium on civic center plaza starting at 6:00 p.m. and stay with ktvu for continuing coverage on the refinery fire. we have more pictures and video on our channel 2 website, ktvu.com. new this morning, the husband of former arizona congress woman gabrielle giffords says he and his wife

are satisfied with the plea agreement with the suspect of the tucson mass shootings. jared loughner will try to convince a judge he is competent enough to plead guilty. his lawyers have reached a plea deal with the prosecutors that would have loughner spend the rest of his life in prison but avoid the death penalty. loughner will have to admit he shot and killed six people and wounded 13 others including gabrielle giffords. >> ten minutes before 9:00. speaking out against san jose's police chief. the message some members of the police union are hoping to send.

happening right now, san jose police officers are talking about a vote of no confidence against their police chief. the some of the officers blame the chief for their problems but others say he is getting a bad rap. here are the details from both sides. reporter: well, good morning. some san jose union members don't feel their chief is properly representing rank and file officers and is that the reason that they are holding a meeting here. the meeting is going on and this is a critical meeting. i got word that discussion is taking place here inside. essentially a couple hundred people that are deciding whether to continue to support their chief. members of the san jose police officers association deciding whether to ought razz vote of

-- to authorize a vote of no confidence. couple hundred sphears -- officers taking place. some concerned about pay cuts and staffing shortages along with low officer morale and blame the chief for all of this. the president of the union thinks this is the wrong time for a no confidence vote. >> our leader who is chief moore he is held accountable for lote staffing issues that we have going on. the exodus of officers that are leaving the closures of police functions that will affect the community. >> normally when you do an action like this it's meant to pressure the chief to leave or pressure city to fire the chief. that's not going to happen here. that's not the case. symbolic at best. i really don't know what the point is myself. the chief is aware that his officers have not been happy with his silence. >> and the chief does have the support of the mayor and city leadership as all this plays out. police union members who are taking part in this meeting will
