released the photo of a second suspect they believe is responsible for the shooting. 26 matthew john capones is wanted by police for the shooting death of uleses cajaha. >> we felt angry when we saw the photo of the suspect. we've never seen this man around the neighborhood ever. >> reporter: police say they are not sure if the motive in this case however jacob stevens who was arrested and capones have gang ties. >> he has been set back into the community because his last charges did not fit the criteria to stand in state prison. >> they shouldn't be out on the streets if they have a criminal record like that. this could have been prevented if they have a criminal record

like that. >> reporter: as the family honors their son's life, they just want justice. police say he's considered armed and dangerous. if you know anything about this case you're asked to call police. paul chambers, ktvu news. chevron has apologized from that fire that erupted from its refinery and tonight it's gathering the community together to talk about what happened. we have live team coverage tonight. ken pretty chit -- pritchett is live where he got some answers on what caused that fire. >> we have some of the answers but not all of them. chevron says this started as a

small leak that rapidly expanded. two hours before flames erupted sending thick black smoke into the air, emergency crews knew there was a problem. >> at 4:30 is when they noticed that the leak was occurring and this was a small maybe 20 drips per minute type of a leak in this line. >> reporter: chevron fire chief mark ire says the leak was coming from an 8-inch pipe at refinery four. ire says emergency response teams were called in to assess the leak about 6:30 the leak rapidly expanded and crewed evacuated. >> as they backed away and started to pull cooling water that's when it set off. >> reporter: it's not known what igniteed the vapor or what caused the leak to begin. within 10 minutes evacuations were put in place. >> there's an emergency at chevron refineries. >> reporter: county health fishes say air monitoring did not show a health hazard.

>> yes we felt like it worked as designed last night. >> today chevron repeatedly apologized for the incident. >> we're very sorry it occurred and we're trying to do whatever we can to prevent it in the future. >> as for the 10 minutes between the time of the ignition of the fire and when chevron officials triggered the community alert system, county officials considered that, they said today they consider that response time quick. in richmond, ken pritchett. the smoke has cleared but many residents who work and live near the chevron refinery are still concerned about their health and safety. cara liu is live where chevron is joining the community to address those concerns. >> reporter: this community meeting is about to begin but if you look around you can see there's at least 400 people inside. many more are still outside

trickling in. a lot of these folks looking for answers. we heard from chevron they plan to give folks this letter and then share to some of these folks that they plan to take responsibility for that refinery fire and that includes emergency response and health claims. the thick black smoke could be seen for miles. >> i came up here because i have respiratory problems and my eyes were running early this morning. >> reporter: the hospital emergency room was so crowded with folks concerned about effects from the fire that she left with plans to return later today. she says she got worried as soon as she saw the fire and all the smoke coming from the chevron refinery yesterday afternoon. >> i felt like jittery. i don't know if it was because i was nervous. then my eyes started watering. so i went in the house and closed the windows. you know nauseated lake. >> richmond medical center

treated more than 350 people for fire related issues. most patients complained of respiratory problems. doctors medical center in san pablo has seen more than 300. the air quality management district says thanks to favorable weather patterns, early reports show pollution levels well below federal health standards. >> reporter: the air district has tested air quality samples they do plan to announce those results here tonight. now back here live at this meeting, chevron just announced that they are still working on the microphone system. they're going to need about another five minutes to get it started. but take a look at how many people are out here. more than 400 people so far. chevron says they have announced a claim hot line to reimburse any medical claims and first responders. that number for the claim is 866-260-7881. now we do have multiple crews attending this meeting we will bring you many more details on that claims process as well as

some of the other issues brought up in this meeting. right now we're in richmond, cara liu. caltrans says it will send out bills to drivers who crossed the bridge last night without paying the toll. news chopper two caught this imagine of a sign that said do not pay toll, free. bridge toll takers were sent to an office to shelter in place as smoke from the fire drifted over richmond. ktvu.com has complete coverage of the refinery fire including unedited video of the fire and what officials are saying about the incident today. investigators are trying to figure out what caused the fire that held up the commute along interstate 580. it started around 9:30 this morning at the north flynn exit east of liver mother. the fire burned 13 acres before

firefighters put it out. three lanes were shut down backing up traffic for miles. the chp reopened the lanes just before 2:00 p.m. a construction worker is recovering tonight after getting trapped. our camera was the only one at cesar chavez and cap street this morning as firefighters lifted the man to safety. they stabilized his back and neck for possible injuries. he was taken to the hospital in stable condition. the worker apparently slipped off of a cat walk. pg & e is working to repair a 6-inch gas line hit by a construction crew in santa cruz yesterday. it happened at about 10 10:00 this morning. emergency crews from santa cruz county fire sealed off a 4- mile square area. the shelter in place was lifted about three o -- about 3:00 this morning.

a vacaville teenager is dead tonight after a jet ski accident. she died yesterday at the hospital. the man in the other water craft is in serious condition. a san jose man killed in a crime spree nearly a year ago pled guilty to murder and other charges. paul ray castillo entered a plea to the charges against him. prosecutors say castillo shot a gas station attendant in san jose before killing cindy gwien. she is scheduled to be sentenced august 30th to life in prison without parol. the drunk driving trial of a state assemblyman who was arrested in concord is said to begin tomorrow in martinez. assemblyman roger hernandez was arrested on suspicion of dui. hernandez has pleaded not guilty and is challenging the

analysis of the blood test. voters in santa clara county will get their chance to side on at least one sales tax. it would raise the sales tax by 1/8 of a cent to 8.5%. that would make it the third highest tax rate in the state. bay area health fishes are encouraging people -- officials are encouraging people to avoid eating two types of candy when high levels of lead were found. it tests uncovered dangerous amounts of lead in plum and ginger candy. one type had 100 times the amount of lead allowed by law. >> consider a child or pregnant woman who eat this is candy. a single serving of this candy puts them at nearly 100 times over the safety standard for lead exposure. >> reporter: the center is

taking actions against three distributors and five retailers over alleged violations of california law. for complete list of candy brands tests and the stores sold you can go to ktvu.com and click on web links. two companies are competing for patents owned by kodak. the wall street journal reports the bids range between 150 and $250 million. kodak has said the patents could be worth more than 2-1/2 billion dollars. >> wells fargo warned about potential losses due to lawsuits and troubled mortgages. in an fcc filing the bank said it could spend more than $2.6 billion buying back mortgages from investors an increase of 13% from the previous quarter. the filing said it reserved $1.2 billion for losses due to litigation. a 30% jump. san francisco's metrion is

hosting a job fair to hire workers for the target store set to open in october. the hiring event runs thursday through saturday at the mall on fourth and mission streets. the company is asking job seekers to apply online before attending the fair. >> i prefer to cut in another thing. but have my kids safe. >> fewer police officers on the streets and now decent among the ranks. what some are calling risky trade offs being made in san jose while trying to keep communities safe. >> walnut creek schools are leaning on developers to help close their budget gaps the money they'll have to pitch in and why it still might not be enough. >> our bay area heat up continues, i'll have the numbers expected for tomorrow and talk about how long this pattern is expected to last. must be nice, cheering on team usa from the shallow end.

san francisco mayor ed lee pulled the plug on the policing plan known as stop and frisk. the policy allowing officers to pat down suspicious persons has set off criticism and lawsuits in new york. >> and i know that we've had these very sensitive discussions about these programs called stop and frisk. that's been done in other parts of the country and i have a chance to review them. >> today ktvu obtained a letter to lee from new york city comptroller john lu. it advises lee not to introduce stop and frisk. communities are coming together to take a public stand against crime. new at 6:00, anne ruben is live in san jose where this national night out is being held in a shadow of a city hall battle

over the city's top cop, anne. >> reporter: people are here to eat, to mingle but most of all they're here to meet the police. right now officers in san jose say there just aren't enough of them to go around. they say they need the chief to fight for them so they have the resources they need to fight crime. >> reporter: on national night out officers are here in the neighborhoods but on a typical night guadalupe gonzalez says she's seeing fewer of them. >> we need more police out there. >> with an exdouse of officers because of pay. >> if the citizens of san jose knew how few officers are patrolling a beat, they would lock themselves in a bathroom. it's that bad. >> reporter: while they ultimately decided against it they hope they got their message out. >> we're telling them it's time to get off the bench. >> whenever your troops say

a lawsuit involving five afghan employees. after they reported the incident the sales men said they were subjected to more verbal insults. an afghan american manager said he was fired for speaking up for the sales men. workers at two popular museums have voted to authorize a strike. employees of the de young museum say they are going to -- maximum amount allowed by the statement district officials tell us they will no longer charge a commercial building fee saying it's not

cooldown for livermore. most of us warmed up 6 degrees over yesterday's high. upper 80s fairfield, napa still 90 degrees in santa rosa. low 90s is where we saw fairfield hit earlier today. so again that on shore breeze now beginning to cool us off. 67 in hayward, 80 degrees still redwood city. the ridge of high pressure bringing us the warm up today is going to continue to strengthen our way. the sinking air will continue to bring us patchy fog a the bay. you probably woke up with more sunshine than what we had seen in recent days that will be the day again for tomorrow. by tomorrow our hottest spots will be well into the upper 90s. 53 for vallejo, upper 50s fairfield, antioch. the warmer you are right now the warmer you will be tomorrow

morning. we have a nice summer like evening in store for many of our inland spots. 9:00 tonight, areas near antioch perhaps still right about 70 degrees. 90degrees expected for tomorrow afternoon in santa rosa. 85 for novato. 86 san rafael, 75 in oakland for tomorrow. mid-90s in pleasanton so it's glowing hotter number two morgan hill. 92 for gilroy. 82 redwood city, 72 san bruno. 70degrees in the city. mid-60s along the coast with a localized on shore breeze. that's the good news there we're not losing it all together. the marine layer so shallow and high pressure over head not really seeing a good recovery. thursday, friday the best bet is to hit that several -- that century spot. >> that means increased fire

the rover curiosity sent its first color photo from the surface of mars. the pictures are a bit blurry because the rover has a protective cover on it. rover also sent still images of its landing. it'll be a couple of weeks before rover goes exploring. in sacramento experts perts lobbied the governor's office to keep the aero space in
