yourself a little bit of extra time, especially on southbound 101 as you drive out of sonoma county. people still kind of slowing down. now, ktvu's alex savidge has been on the scene early morning. coming up at 7:30, he will have more on the fatal accident that knocked over a power pole, including how long pg&e says it will repair. back to the desk. san jose police are investigating the city's 29th homicide. it was the fifth homicide in san jose in the past eight days. tara moriarty is live at police headquarters with more whoop makes this case see disturb -- with more about what makes this case even more disturbing. tara? >> reporter: well, the gang has been lashing out. shots rang out near poko way and police say a 17-year-old

way was shot and killed. he was rushed to the hospital by friends. the shooter then took off in a car and had still not been caught. our source says the city of san jose is in the middle of a gang war and -- and it's only going to get worse. within an hour of the shooting, more gunfire erupted. police are trying to find out if the two are connected. this was at north jackson avenue, the shooting, that person is expected to survive. the shooting brings the total number of homicides to 29 so far this year. compare that to last year when there was only 27 kill-- killings. we're waiting for san jose police to arrive here and hopefully speak to them about the two cases that happened last night, toe soo if we -- to

see if we can get any more information to you. i'm tara moriarty, ktvu channel 2 news. coming up at 7:15, what president obama is saying about a new bold attack and he's declaring the threat of chemical war far in syria, a redline for the united states. this comes as hundreds of syrian refugees protest against the country's president and the ongoing violence. yesterday's protest was held in turkey after 150 more refugees arrived there severely wounded in syria. anti-regime activities say 20,000 people have been killed since the revolt against president bashar assad began last year. ed lee says he hopes the

commission will uphold the ruling found in the ross mirkarimi case. it will take nine out of the 11 supervisors to remove mirkarimi with office. they are expected to deal with this issue next month. the "chronicle" is reporting that he may sue if he's voted out. well, some people have been living illegal in foreclosed and short sale houses in antioch. so now, new tenants or listing agents representing the home have to complete a water service application. they have to certify that they are authorized to have water service and they have to do it in person or with a notarized signature. some have been sending in fake documents to start water service. a jury in san jose will soon decide if one of the

biggest technology disputes in history is over. closing arguments are scheduled today in the apple/samsung dispute. after apple is demanding that samsung pay $2.5 billion claiming that samsung stole its iphone and ipad technology. samsung says apple used its technology. if apple wins, it would represent the largest patent verdict in the u.s. checking apple's stock, it's increasing in value. right now it's selling for just over $674, up $5. the increase made and the most value -- made apple the most valuable company in history. it looks like it will keep raising the bar as trading continues today. 7:06. well, the catamarans will be off the bay practicing off

marina green ahead of the america's cup world series, which by the way starts tomorrow. ktvu's allie rasmus is live with the details of an exciting week ahead. >> reporter: that's right, dave. 11 boats representing eight different countries, the flip practice runs start today at 2:00. but from wednesday to sunday you'll see boats just like the one behind me out on the bay. this is a 45-foot long multi- hull catamaran. it's hard to visualize this out in the water. but just imagine 11 of these out on the bay, some at at same time, going 35 miles per hour. the boats have been practicing since last week even though today is their official practice day. dress rehearsal ahead of tomorrow. we've already seen them capsize. this is video of the korean boat tipping over during one of the practices on saturday. we talked to one.

event hosts who has -- one of the event hosts who has sailed before -- >> the san francisco bay is gonna be one of the trickiest place to race. there's very strong wind, there's fog which makes it difficult to see sometimes. there's a lot of current. >> reporter: now, today is the official start of practice, then wednesday through sunday, there will be multiple races out on the water for the america's cup world series. in some cases will be doing matchoff races where it's one against the other but at least twice a day every day, they will have what's called fleet races and that's when all 11 boats will be racing each other on the bay at the same time. of the village opens at 10:00. practice runs start at 2:00 and then at 4:00, people will be able to meet some of the skippers and sailors. if you want to come out today, it's completely free. there's no charge but starting wednesday through sunday, if you want to sit in the bleacher

some slow traffic -- pinole and richmond, you will see some slow traffic there. let's go to some live pictures now. bay bridge backed up for about a 10 to 15-minute delay. nothing out of the ordinary. there's a backup. metering lights are on. in san jose, out of downtown san jose, all of a sudden, we have slow traffic. that appeared in the last 10, 15 minutes. it was good. now we're getting some slowing around the corner. 7:10, let's go to rosemary. >> good morning to you. we have a trough nearing the coast. that will bring us a cooling trend. the fog and the low clouds back with us. you can see -- you cannot see the city. so shrouded in fog. late morning, early afternoon burnoff. the marine layer is slightly deeper. a look at the winds blowing through the delta. anywhere from 20 to 26 miles per hour reported with a gust, even stronger than that. areas near concord reporting 15 miles per hour and areas in mt.

diablo, 35 miles an hour. we'll see the marine layer and we'll continue with cooler conditions for the afternoon. the temperatures are expected to slide back anywhere from 3 to 6 degrees below what we felt yesterday afternoon. low 50s in areas near napa as well as santa rosa. we're looking at mid-50s for concord/livermore. this low cloud and fog area is all the way down in the south bay over parts of the north bay. 57 in san jose. for the afternoon, the marine layer will be deepening, the onshore breeze is going to continue throughout the afternoon, giving you a sweeping view of all of that gray sky. the breeze and winds are expected to kick up to about 35 miles per hour. if you are going to out to watch the world cup, the -- actually, we're gonna see the winds continuing to about 25, 30 miles an hour. it will be a brisk day and a coomb -- and a cool day. we'll see a bit of a cooling

responsible. a deal to avoid deep cuts to military spending is unlikely before the november elections. that's according to barack obama. he made the announcement yesterday. the president says he's making sure that service members don't lose pay for benefits. without some sort of deal, the pentagon faces $500 billion in cuts over ten years. 7:17. new information this morning about california's state park scandal. the buildup of leave time by parks employees, that's what led to a bigger investigation that revealed that the state park's department was hiding millions of dollars. auditors reportedly found that the former director lopez spent some of his budget cashing out leave through a program that side-steps state protocols. lopez himself received more

than $28,000 by crashing -- by cashing in more than 13 weeks of leave time. silicon valley taxpayers are suing over a sales tax proposal for the november ballot. they are claiming the county is violenting a -- violating a proposal on the ballot. the county supervisors' races were decided in the june primary. there's also a renewed threat to sue the water county district over another tax measure. 7:18. new this morning, we're learning some state senators accepted gifts after voting to ban the practice. the bay citizen reports anthony kanaha voted to ban gifts to businesses that lobby the states. but it was reported that he

received golf tickets to the at&t this past june and alex padilla voted for the ban also and then accepted tickets to disney world. the bill passed the state senate but died at the assembly. california may soon become the latest state to put an end to an offensive term. lawmakers would -- passed a bill that would end the use of the word "mentally retarded." 42 other states have stopped using the term. the bill has been sent to the governor's desk for approval. 7:19. new this morning, the city of oakland investigating accusations. the oakland tribune says the city is investigating allegations that robert warshaw made inappropriate remarks to city leaders. they asked a judge to keep the details of the allegations secret. warshaw was hired to make sure

the city complies with terms. lawsuit settlement that stems from the 2003 riders case. the city of oakland says the problem with their police radios have been solved. coming up at 7:37, pam cook will be here and she will tell us more about the company that's been causing interference with those radios and how this could impact cell phone users. 7:19. more whams are making their way to the -- whams are making their way to the -- whiles are making their way to the california coast. it's actually causing a problem. there's been a sharp increase in blue and hump back whale sitings this year, especially in the monterey bay. this is where the whales come to feed before heading to mexico and central america, where they breed. but more whales mean more collisions with cargo ships heeding in and out the area -- heading in and out of the area. and we're following

there's claims that african- americans in san francisco are being arrested at a much higher rate than whites. the bay citizen is reporting that, saying african-americans -- african-americans are seven times more likely to be arrested. that's reportedly above state and national average. the difference may be even higher because police department records often misclassified latino suspects as whites. now, police reportedly blame an out of date computer system for that error. new research suggests that breast cancer patients with dense breasts do not appear to be at increased risks for death. that's according to a you this study -- to a new study. but researchers say there was an increased risk of death for

obese patients. the autopsy results for former nfl star junior seau have been released. he committed suicide at his home in may. the san diego county coroner says no alcohol or illegal drugs were found in his system. the autopsy showed no underlying hemorrhaging or contusions on his brain. his family has donated some of his brain tissue for research. all right, tori. 7:25. let's go back to sal. i know we have some fog. do we have any problems out there. we don't have a lot, dave. we do have slow traffic, though, dave and tori. let's start off with a look at highway 4. it's been pretty slow in the last -- i don't know, 45 minutes or so coming up over the bay point area. if you are driving over to concord, it will be slow. it's also slow in antioch, there is a break in pittsburg.

two accidents tied off traffic on highway 101 in novato. the first accident happened in the northbound lane in the atherton offramp. alex savidge is live with more on how all of this started. >> reporter: good morning. this started with a deadly accident here along northbound 101. that's when a truck veered off the roadway and slammed into that power pole where you can see pg&e crews where you are still working. this scene may have caused a distraction and triggered a separate accident on the opposite side of the highway. both accidents have been cleared. the original crash happened just before 4:00 this morning. a chp sergeant says it looks like a driver fell asleep behind the wheel. the man who was driving died

from his injuries. he hit the power pole. >> the impact, the -- the power pole is leaning to the left now. pg&e is here now to stabilize it. >> reporter: in the meantime, that original accident may have triggered this second crash in the southbound lanes of highway 101. this is all just north of the atherton avenue exit. in that second crash a couple of cars were involved. there were injuries. but at this point, all lanes are open. you can see pg&e crews are working on this power pole that's lean offer to the side. it's actually only being held up by the power line itself. the plan is to replace this power pole. we're told all of the work will happen off the roadway. traffic will not be affected this morning. live this moving in novato, alex savidge, ktvu channel 2 news -- this morning in novato, alex savidge, ktvu channel 2

news. >> thank you, alex. a car crashed into the bank of america on lone tree just before it was with to close yesterday. police say the driver was an 89- year-old woman. she was not hurt. but a customer inside received minor injuries from the shattered glass. 7:32. newly released photos show the viper clouds over the chevron refinery in richmond moments before it caught fire three weeks ago. investigators are the u.s. chemical safety board released the chemicals showing the progression of the disaster over a three-month period. now, look at this. investigators say these photos will help them re-create the events that led them to the fire. >> this size of clouds, people working in a refinery, this should not be happening. >> now, at least 20 employees were close to a leaking pipe. some of them escaped seconds before the car started. a clean air advocacy group

they don't know where they came -- where that came from. >> that was the los angeles county coroner. he's planning more tests after performing a series of tests. scott died on sunday after jumping off a bridge in san peep -- san pedro. the san onofre plant will have major layoffs. 730 jobs will be eliminated. that will cut the total work force down to 1500. however, the owners are still deciding which jobs will be cut. that nuclear power plant was shut down in january after a radioactive steam leak. the layoffs would indicate it will never return to full operations. well. p.u.c. will decide if -- well, the p.u.c. will decide if pg&e can raise its rates. the p. >> c. ordered them to test and replace most of its pipeline

in about 90 minutes, a san jose family is set to enter a plea on the charge that they abused mentally disabled adults. police say they were starved beaten and baked only once a month. police say the family was also collecting the social security checks of the disabled adults. they were arrested in july after relatives of the victims cliented they were not allowed to visit the home. three daycare workers in delaware are facing assault and child endangerment charges over what police call a toddler
