resurgence this season. colon has twice been named an all-star. the san francisco giants have cancelled on order for 20,000 t-shirts features melky cabrera that were supposed to be part of an upcoming giveaway. the team says it halted the order shortly before melky cabrera was suspended. instead, they'll receive a shirt with angel pagan's name on it. six killings in just more than a week in what used to be known as the safest big city in the country. robert is live in san jose where some people are calling it scary. >> reporter: the string of homicides is easily the most talked about issue. people have said they wonder if the murders can be stopped. the homicide rate in san jose

went up today, even without an actual murder on this day. police announced a young child's death here on mendota way back in april has now been classified as a homicide. 38-year-old alejandro benitez has been arrested. it is now the city's 32nd homicide. the 31st took place just last night here at this safeway store when a young man was stabbed to death inside. in just over a week, san jose has had six murders and ten shootings. most people we talked to say they believe it's because of the police officers shortage. >> it's not just this one area. it's all over town. that's, again, the layoffs and it's maybe just a coincidence but yeah, it's happening everywhere. >> reporter: and so fast. harry clark was killed on june 29 in this parking lot on winchester boulevard. >> my brother was no. 20. here there already at 32. and in less than two months.

it's gotta stop. >> reporter: the director for a victims assistance program says she's never seen it so bad. >> i've been a victim advocate for 25 years working very closely with families of murder. it's unusual. it's very scary as well. >> reporter: as we've been reporting, the police chief is considering whether to ask other agencies for help. coming up at 6, we talk with the sheriff about her discussions with the chief and what might happen next. live in san jose, robert honda, ktvu channel 2 news. a san mateo county judge has ruled that a man is now mentally competent to stand trial on charges that he murdered east palo alto community activist david lewis. prosecutors say gregory leon elarms gunned down lewis in san mateo in june of 2010. the two men had been childhood friends. last year, elarms was ruled incompetent to stand trial. he's been in a state mental health facility ever since then. uk berkeley identified a

man who slammed inside a dorm. the crash happened just before 3 a.m. at the corner of college avenue and channing way. students were evacuated from all eight floors of the building. police say the driver left the scene but that his father, who is the registered owner of the car, came to the crash site and said his son would be returning son. >> when the son came back, the officers brought him into the station. we did some field sobriety testing and also interviewed him and subsequently arrested him for suspicion of drunk driving and also for hit-and- run. >> police have identified the driver as 22-year-old douglas perez. students were allowed back into dorms. the first day of school is tomorrow. the san mateo coroner has released the name of a 20-year- old man killed in an accident. william clayton la belle died when his toit veered off interstate 80. a blown tire likely led to this

crash. officers they la belle was alone in the car. contra costa county supervisors say there were delays of up to two hours alerting people about the richmond refinery fire earlier this month. the head of the county's community warning system says those calls should have been taken about 20 minutes. investigators are trying to figure out what caused a two- alarm fire at the church of the nazarene. the fire broke out this morning inside the church. when fire crews arrived, they say flames were coming out the side of the building. so far, no word on the estimate of damage. but an alameda county fire department spokesperson said there was structural damage and the inside of that church was badly burned. for the fourth time since june, lafayette police made an arrest for prostitution at a

massage parlor, at la touch massage parlor. they made three similar arrests in june. the sweep led to a new ordinance that requires state certification for all massage therapistst. a central valley slaughterhouse under investigation for alleged cruelty and possible health issues had the federal government as one of its customers. records show the central valley meat company sold beef to the u.s. government last year. the meat was for school and other nutritional programs. the company was shut down monday while an investigation is underway. federal officials say there's no indication that meat from sick cows made it into the food supply. tonight, the ponderosa has grown to more than 24,000 acres and the governor has declared a state of emergency. >> reporter: frank, good evening.

this is the paynes creek area. it is seven miles west of the town of mineral. it has been one of the most challenging spots for firefighters of the ponderosa fire. you're looking at some pickup behind me of both water and flame retardant. it was in this area that firefighters struggled to get away from flames themselves. firefighterring scrambled, rushing to save their own engine within seconds of flames. it was with hoses that they kept fire from jumping across highway 36. minutes earlier, a cal fire spokesman had been giving a briefing of fire conditions. >> as you can see behind us, we're starting to get some fire activity, so i'd kind of like us to back up, guys.

>> reporter: three minutes later, the same spot was engulfed. one after another, hillsides here have burned quickly. >> the problem is that the terrain is extremely steep. the wind is traveling out of the southwest. so if the wind increases, it gets warmer out here and it pushes these fires very rapidly. >> reporter: and back out here live, evacuation orders have been lifted in the town of shingletown, about 20 miles from here. it is on the northern edge of this fire. they are still in effect in the town of minton. in the town of mineral, the town that firefighters are working so hard to save tonight, there are right now no evacuation orders in effect, but because there have been warnings that there might be later tonight, a lot of people, including campers at campgrounds near the lassen national forest have decided to evacuate voluntarily t. in spite of more calls from

republican leaders to drop out of the senate race, todd akin continues to insist he's staying in. he became the subject of a controversy after using the term "legitimate rape." >> it makes me uncomfortable to think that the party bosses are going to dictate who runs as opposed to the election process. >> he should drop out of the race. but he's not. he's gonna run his campaign. >> republican presidential candidate mitt romney also told akin he should drop out of the race. u.n. observers pulled out of syria as the violence continues there between government forces and rebels. activists are publishing video showing president assad's troops driving tanks through neighborhoods.

federal health officials say this year is on track to possibly be the worst outbreak of west nile virus ever in the united states. the cdc says so far this year, 41 people have died and more than a thousand cases have been reported in 38 states. the extreme heat most of the

country experienced this summer could be contributing to the rise of west nile virus. here in the bay area, there was a lot of concern about west nile in contra costa. and now there are plans for more mosquito spraying in brentwood. john is there tonight and tells us why there is so much concern. >> reporter: we're at a housing development. officials have just announced two and a half scare miles here are going to be sprayed tomorrow evening. till now, west nile mosquitoes have been the kind that only fly a few yards. but the latest positive test was a dangerous wide-ranging mosquito. >> they can fly up to five to 15 miles from the breeding source, so obviously there's more opportunity for them to spread and infect more people. >> reporter: scientists today have now confirmed at least 20 birds with west nile, well ahead of last year. but more worrisome, chickens were reported infected in the

mosquitoes do not carry the west nile virus but vector control officials say they are aggressive day-biting mosquitos that have attacked children's soccer teams, golfers and others in the area. weather permitting, the fog will start at 7:00 tomorrow morning. a san francisco man's eviction was delayed. the protesters had hoped to convince them not to evict lucas from his san francisco home. he says he filed for a loan modificationback. nation star says it is reviewing lucas's case. americans bought more homes in july than in june. analysts say this is the latest evidence of a slow but steady improvement in the housing market.

there is a 2.3% increase in sales compared to june. experts say the housing comeback remains sluggish because the july rate was lower than the growth in political and may. however, sales are up more than 10% when you compare it to last year. it's called the fiscal cliff and that's where the congressional budget office says this country is headed if congress doesn't act to cancel tax hikes and spending cuts scheduled for next year. they say going over that cliff could mean a new recession and unemployment rate back over 9%. on wall street today, stocks bounced back from early losses. the dow closed down 30 but the nasdaq gained 6 and the s&p 500 rose 3/10 of a point. hewlett packer posted the biggest quarterly loss in that company's history. hp reported a loss of 8.9

billion, in large part because of the shrinking value of electronic data systems. the stock dropped 5% and has now lost more than half of it value in the past two years. three people in pittsburg are facing a possible ten-year jail term for allegedly filing false claims for a home buyers' tax credit. irs agents raided a home. just last week, a grand jury filed conspiracy charges against tanya giller, edrick harvey. they allegedly made fraudulent claims. two of the defendants are out on bail. the third is due in court tomorrow. police are investigating a $1500 grape heist from a vineyard that used to make wine

by alameda-based sellers. they reported seeing at least two people fleeing from the property monday night and taking off in a car. oakland police say despite determining that the car was stolen from antioch, they really don't believe the two incidents are related. let's talk about our weather, because it sounds like fog is the word this evening. a lot of it out there already. >> yes. did it feel warmer or cooler today. >> some places were a little warmer. some places were a little cooler. that's the weather pattern. some of you have been slightly warmer, some slightly cooler and there's been plenty of fog to go around. currently, we pick out the fog in san francisco. you've got fog out on the avenues. you've got fog over in the headlines and up towards -- not quite toward -- the fog is really going to push inland tonight.

it was extensive when you woke up. i put the satellite loop here because i wanted to show you all the tropical moisture. all the way south from mammoth lakes. this is big deal stuff. we're very fortunate that this subtropical moisture is going east. there's a low pressure center to the north. that is what has cooled our temperatures or kept us on the cool side. if you're out in san francisco, you're wearing a jacket all day. the fog has really been there and not just at the coach, but because it's stretched out, it's in the valleys. it was in concord this morning, in san rafael this morning. tomorrow morning it will be back, right where it was this morning. subtle, subtle changes. i think tomorrow we'll see a little more cooling, a degree or two in some places, but subtle cooling. this is thursday at 7 a.m.

the fog footprint basically touching on all nine bay area counties. that's the most extensive fog we've seen. by virtue of that, i dropped temperatures a couple degrees. the fog was there and that cool air persists. you don't have to see the fog to have that marine layer of influence, the cooler, moister air. the air quality district loves this pattern because it's much better upon the bay area. there's still heat north, east and south. but we're in a nice cool weather pattern that sticks around. i'm coming back at 5:45. i've got to latest computer model loaded and i've also got the forecast with your weekend in view and we'll be looking for a warm-up. i'll be back here at about 5:45 with all the details. a passionate pitch. the governor comes to a san francisco school. the plea he is making to some of the wealthiest people in california. up and up they go. the encouraging signs coming

california continues to improve its scores on high school exit exams. this year's past rate rose more than one percentage point.

it's the sixth straight year the school has gone up. the biggest gains were made by minority students. 93.1% of latinos passed the exam. the test, covering english and math, is required to receive a high school diploma. it's back to school week in san francisco and today governor jerry brown showed up at one middle school to make a passionate pitch for his tax initiative. >> no campaign is a cake walk. this is a challenge. this is a tall hill. but i didn't come back to be governor at my age just to try easy stuff. >> governor brown rallied a crowd of students and teachers. he's pushing for prop 30, the november tax hike measure. prop 30 would raise taxes temporarily on those who earn 250,000 or more per year. it would also boost the state's sales tax by a quarter percent. >> i believe that all students can meet the expectations that

we set for them, but we have to provide them with the resources. >> i'm just saying, please, give back one or two or three percent over the next seven years and the kids of california will be much better for it. >> the governor warned that if prop 30 fails, a new round of budget cuts will kick in. governor brown's plan is also competing with a rival tax initiative on the november ballot. that proposition would raise taxes on all but the poorest californians. a bill is headed to governor brown's death that would restrict what health plans would charge patients for oral chemotherapy. it would prohibit health plans and insurance companies for charging more for oral chemotherapy than they do for

5. a new poll released today in san francisco is not good news for suspended sheriff mirkarimi. that poll found a large majority of people in san francisco think mirkarimi should lose his job as a result of that incident with his wife where he bruised her arm. david stevenson talked with both mirkarimi and his wife today. let's hear what they told him. >> reporter: lopez is inside city hall, as that new poll says the majority of san francisco residents want the sheriff to lose his job. a coalition of anti-domestic violence advocates released a poll. 62% said someone who pleaded guilty to a crime and is on probation shouldn't serve as sheriff. mirkarimi pleaded guilty to false imprisonment after bruising his wife's arm in december. >> the people of san francisco

feel that domestic violence is wrong and that our sheriff cannot continue to hold office. >> reporter: the poll also finds that 51% surveyed would be less likely to reelect a supervisor who votes to keep the sheriff. five of san franciscos eleven supervisors are currently running to hold on to their seats. >> i feel like the board of supervisors will respond to this and that they will be grateful for this information. >> this is political. a poll like that, there is no way to answer that poll and not be negative. >> reporter: mirkarimi says supervisors should disregard surveys and try to be open- minded. >> a sheriff who gains this level of perspective in the criminal justice system is really somebody that can be a real asset in making the system work well and better. >> they are trying to destroy him. that is wrong.

>> reporter: and that was the sentiment lopez shared just under an hour ago with the city's commission on the status of women. we'll have her complete comments coming up later tonight on the 10:00 news. reporting live, ktvu channel 2 news. nissan is recalling hundreds of new suv's because of a faulty gas gauge. the recall involves 7800 2013 infinity suv's. the company says a tube inside the gas tank could be in the wrong place. the fuel gauge could show there is gas in the tank when it's actually empty and cause the suv to run out of gas unexpectedly. owners will be notified about free repairs. the diocese of the catholic church is olding a mass to mark its 50th anniversary.

daners performed for parishners outside the cathedral. the oakland diocese was established in 1962 to serve catholics in the east boy. a bay area developer wants to build an entertainment center in tracy that would be four times the size of disneyland. the city of tracy has given james rogers and spirit of california, llc, exclusive rights to develop the site. the company is talking about a $1.2 billion complex built on 620 acres. it would include an amusement park, hotel, convention center, wine-tasting center and marina. the goal would be to have it operating about 12 years from now. it's a fresh start for a building that housed a company with a now infamous name. the building that used to house solyndra is in the process of being sold. how this could be a good deal

for the whole city. >> reporter: we were able to confirm late this afternoon that an agreement to buy this building here behind me has been reached. tb the deal goes through, you can expect more jobs here in the city of fremont. as the mayor of the city told me, it is time to wipe that name off that building. the former home of solyndra, a 31,000 square foot state of the art facility. >> there's no asking price. >> reporter: it's been on the market for months but not more much longer. >> reporter: roger is talking about sea gate technology. the bay area company makes hard drives and storage devices and it's now looking to buy the former headquarters of abrupt solyndra. seagate employees are starting to hear now, a company employee sent me this statement, saying

seagate has entered into an agreement to purchase the build. if and when the purchase is complete, we will provide our plans for use of the building. >> we know seagate. we like them. >> reporter: fremont mayor says in the company expands, he's looking forward to the jobs it could create. >> there's not a whole lot of revenue other than payroll taxes. it's just good for us to have these buildings built and have people working. >> reporter: and papers connected to the sale of the building expected to be filed tomorrow morning with the u.s. bankruptcy court. it is up to the court to approve the actual sale. the amount of the offer is not yet known. in election news tonight, president obama continued a back-to-school push for education during a stop in nevada. he spoke inside a high school gym in lass vegas about the

need to hire more teachers and he blasted mitt romney for describing educators as nameless bureaucrats. mitt romney flew into iowa today to talk about the economy at an aluminum testing plant. he criticized the president for the nation's debt and deficit. he says president obama needs to go beyond the talk and make sure schools are getting better. he moved on to a private fund- raiser in arkansas this afternoon. a new gallup poll shows romney leading mr. obama. other polls showed the president still ahead of romney. an ap poll shows a narrow 1% margin. there is now an easy way, if you want to fact-check political ads.

all you have to do is download a free iphone app. here's how it works. it listens to political ads on tv and then matches the ad's audio wave against the database. it will then tell users who paid for the ad and how much was spent on the campaign as well as identify nonpartisan sources to verify the ad's claim. it's called the super pac app. today a virginia man accused of shooting at the offices of a christian lobbying group, floyd was scheduled for arraignment this afternoon. authorities say he shot a guard in the arm at the family research council headquarters last week. he was volunteering at a gay community center in washington, d.c. at the time of the shooting. he also had 15 chick-fil-a sandwiches in his backpack. going for a spin. the major step by nasa on the

he is serving a sentence of 20 years to life. he has been denied parole six times before. each time, lennon's widow has written a letter opposing his release. the curiosity took its first test drive on the red planet. curiosity rolled forward, rotated to a right angle, and then reversed. the short spin lasted about 16 minutes and covered 15 feet in all. curiosity's travel plans eventually include a trip to what's known as mount sharp, all in the search for signs that mars once supported life. in the south bay, more than 200,000 is going to fund safe summer activities for at-risk youth. the probation department invited all cities within the county that have gang task forces to participate in the summer activities program. so far, six city versus

cooler as we go into tomorrow. 85 inland. you get the picture. 75 around the bay. 60 at the coast, on the high end. so temperatures come down. winds are breezy. the weather systems to the east of us are basically just going out of here. the race day winds are still going to remain in the southwest, about 20 miles an hour. you might have seen that story, and if you looked a t the texture of the bay, it's kind of bumpy. southwest winds are not the ideal wind conditions. the forecast highs tomorrow, 80 in sonoma. tomorrow, just like today, but just about that much cooler. i'll bet you don't even notice it. most people wouldn't notice the cooling or slight warming today. 86 in livermore, 85 in morganhill. san jose, you're at 78.

76 in sunnyvale. 73 in san mateo and 61 in san francisco. so the five-day forecast checks out like this. you can see we've got just the upper tier numbers. temperatures kind of trickle down over the weekend. the upshot to all this is, you know, it's late august. it's the height of fire danger season and that five-day forecast is not -- if you're a firefighter, you're going, oh, not too bad. typically this time of year you get the big heat and we're not seeing it this entire week. >> i guess it's kind of typically back-to-school weather. >> it does feel a little bit like fall, yes. an update on a bay area natural foods company that's been under federal investigation. the reason u.s. marshals paid it a visit. and it's moving day. the huge project on the peninsula that needed this crane.

a critter turned up in san jose, he's about to get a trip home. a yellow-belly little guy. they believe he was stowed away in the engine compartment of a man who owns a bed and breakfast in yosemite. wildlife rescuers said they track it and plan to return him
