again. an early morning fire in the county. the fast moving flames created a very dangerous situation for one family. we're live in san jose where 100 people camped out overnight in a drive-thru. what they wanted from a certain fast food chain. plus, the fbi warning for both the republican and democratic conventions. mornings on 2 begins right now. well, good morning to you, welcome, good morning to on 2. i'm dave clark. >> and i'm tori campbell. it is thursday, august 23rd. developing news, the muni line is delayed due to a broken water main. we are live at the scene of the rupture. it's in san francisco's sunset district to explain what happened and how it's impacting the commute. good morning lorraine. >> reporter: good morning, well, the commute is now back to normal. you can see the muni line down the road there. it's actually not experiencing

any delays at this point. a crew member with the san francisco water department just told me that he thinks there's some kind of an electrical problem between the muni line and the water pipes on the street. he said crews have been working on leaks here the past couple of years and you can see where they opened the ground to turn off the main and then sealed it back up. the problem started this morning with a two inch copper pipe springing a leak. it never affects water service here but did cause some delays as trains moved slowly through here while a crew was working on the pipe. now service is back to normal with no delays on muni. as for the water main a crew will come back later on in the day to repair it. traffic and the muni service is now running smoothly out here. live in the sunset district in san francisco, lorraine plan co, ktvu channel 2 news. 7:02. in election news republican presidential candidate mitt romney will campaign in new mexico later today. he'll be promoting a new energy

plan. at 7:15. how romney's running mate is helping to attract votes in one swing state and who's starring in new ads from president obama's campaign. new this morning, the fbi warns that anarchists may target the upcoming political conventions. this is video showing self- declared anarchists clashing with police in portland two years ago. fbi bulletin suggests the groups could plant improvised explosive devices or ieds at next week's republican convention in tampa. possible targets indelude bridges, streets, and public transportation. federal agents learns of similar plots before the 2008 republican convention in minneapolis. police have arrested a lark spur man for allegedly threatening to kill the city's major. investigators say glen allen march also made threats against the fire chief and public works

director. an investigation began this month when officials learned march had reportedly talked about killing the officials because he was told he could not make renovations to his house. march also reportedly admitted to following the mayor in his car. time now 7:03. happening right now food lovers in san jose are enjoying an early chicken breakfast at the brand new chick-fil-a restaurant. about a half hour ago the doors opened at the headquarters drive location. ktvu's tara moriarty has been out there all morning and i know people camped out and some of them came from miles away to be there for the grand opening. >> reporter: one man we spoke to had traveled 3,000 miles coast to coast in order to make this grand opening. and he's inside the restaurant actually right now. fans of the atlanta based chain camped out overnight in the drive-thru and an hour ago they got what they were waiting for. [ people chanting ] [ cheering and applause ] at 6:00 this morning, 100 people traded their wristband

for coupons for free chicken meals once a week for an entire year. now these chicken sandwich lovers are not deterred by chick-fil-a's recent controversy. one month ago you'll remember the company's president spoke out in support of traditional marriage sparking furor. chick-fil-a fans say that everyone has a right to free speech and they come for the food. >> i'm here exclusively for the chick-fil-a opening, it's my 79th grand opening, that's 79 openings in 20 different states. over a seven year period. >> but we're nuts for chick-fil- a! [ laughter ] >> reporter: now this is only the second chick-fil-a to open in the bay area. the other one is in fairfield. two more are expected to crop up in walnut creek soon. this month supporters flooded the area in fairfield for customer appreciation day. a few days later protestors same sex couples kissed in front of the restaurants nationwide. now later today the lbgt community is planning is

protest here and they plan to educate folks about supporting equal rights, live in san jose, i'm tara moriarty, ktvu channel 2 news. >> all right,. time is now 7:# 5. with the new attention to build the new arena for the golden state warriors in san francisco now there's a new advisory panel. 16 people are on the panel. they include jack bayer senior vice president for the giants, he will be the -- they'll be the warriors' neighbors. the former planning commission president, ron mcgill is also a part of that special team. as is sean patton the owner of reds java house on piers 30 and 32. that's where the arena is going to be built. the several residents are also on this special advisory panel. they'll offer their input and guidance about the plans. it is 7:06. later today thousands of people are expected to watch the america's couple world series races in san francisco. 11 boats will be racing on the bay today.

but not all the teams will return for the america's cup next summer. that event is being scaled back a bit. in fact, only three or four teams have raised enough money to race the 72-foot catamarans in the finals. oracle's larry ellison have predicted there would be many more and his team of course is the defending champion. >> yeah. all right, our time now 7:06. sal is back and you're watching highway 24 and everything else. >> that's right. we're starting in contra costa county dave and tori. westbound 24 is a good place to start. moderately heavy and it seems lighter than it was yesterday and so is 680. it's back to school but some people may have seen the commutes yesterday and said you know to heck with it. i might take b.a.r.t. and b.a.r.t. is a good option right now. trains are moving on time. we see the traffic though pretty heavy at the toll plaza. but it's not as bad as it was -- well, i don't know. now i say it wasn't as bad as yesterday but now looking at it. mmm. it's about the same. so sorry for that false optimism there. it is backed up for about a 20

minute delay. we're looking at the bridge to make sure there's nothing on the bridge that's making it extra slow. also this morning's commute on the peninsula looks pretty good if you are driving on 101. i want to move the maps over, we mentioned contra costa county. highway 4 i want to make sure thaw know that highway 4 is very slow out of about i don't care. now to mark tamayo. basically the same deal with the weather pattern as well. clouds are back with us near the coast and near the bay. and a little bit of a breeze out there. as far as the current fog pattern we can show you right now hugging the coast also some drizzle out there as well. santa rosa, napa some overcost. oakland, heyward, fremont and mountain view as well. current numbers in the 50s to the lower 60s. oakland 58 degrees. and downtown san francisco right about 55. here's our forecast model showing you this and the clouds this morning in the short-term still a big factor out there.

clearing near the coastline. into the afternoon hours this tour links up with the 80- degree range so warmest locations in the mid- to upper 80s and maybe a few spots arnold 90-degrees. the qualifying races in the bay today of course a very active day for san francisco. for the bay waters. you'll notice wind speeds do crank up once again and as a result a small craft advisory kicks in at 1:00 this afternoon. all in response to an increase in those wind speeds throughout the afternoon hours easily topping 25 miles per hour. bundle up if you are going to the coast this afternoon. the readings only in the upper 50s to lower 60s. fog and drizzle around the bay at 8:00 and a bit of a breeze around the bay this afternoon and then the inland neighborhoods partly cloudy this morning and for sunshine and temperatures on track to reach that range 83 to 88. these numbers about the same as yesterday could be a little bit cooler in a few spots. a look ahead your five day forecast if your weekend always in view. same deal for your fridays. some minor cooling for both saturday and into sunday. coming up in about seven minutes we'll look at the giants' forecast as they return

home tonight. all right, thank you mark. governor brown has declared a state of emergency in three northern california counties after the ponderosa wildfire destroyed dozens of buildings. the lightning sparked wildfire has burned more than 27,000 acres in the counties. cal fire reports this morning the fire is 57% contained. be the flames -- but the flames still threatening 900 homes and 3,000 people have been evacuated. a state of emergency is also been declared in lieu miscounty due to a wildfire in the national forth. we'll have a live report later in the newscast. fires across the west are stretching the budgets of many states, washington state projects it will spends $19.8 million on wildfire costs this fiscal year. that far surpasses the $11.2 million the state already allotted. wildfires in colorado, montana and idaho are also expected to

strain tight state budgets. will a colorado judge will decide if the college records of accused colorado theater gunman james holmes should be released. prosecutors want to show that a notebook should be allowed into evidence. now holmes said that notebook to a university psychiatrist reportedly it contained violent descriptions of an attack. the defense lawyers say the records are subject to privacy laws. well, the nine jurors who will decide the legal battle between apple and samsung. they're not expected to come to a quick decision. the jury received the case yesterday after more than two hours of instructions from the judge. now one jury expert says this may take more than a day for the jurors just to figure out how they're going to handle all of the charges and counter charges involved in this very complex case. all right, it is 7:11. a mystery aids-like disease, where it's occurring and how it impacts patients and the one bit of good news from doctors. >> also, what has military

good thursday morning, all week long we've been talking about a cooling trend. that cooling trend continues for this afternoon. some fog this morning. clears back to near the shoreline later on today. highs in the low 60s to the upper 80s. it is 7:14 this morning. emergency crews in scottsdale, arizona rescued two people from a van that got stranded in flood waters. this was the scene about an hour ago. one of the victims was in a wheelchair so firefighters used an extension ladder to get to the van. and they pulled the victims out through a passenger window. both victims appear to be uninjured. arizona has been experiencing severe flooding from a series of rainstorms this week. and right now three counties

are under flash flood warnings. no one was hurt in a fiery collision between a freight train and a tanker truck overnight in east texas. the accident happened around 1:30 this morning in wills point. that's about 45 miles east of dallas. authorities say it appears the collision happened after the big rig got stung on the tracks -- stuck on the tracks. the driver of the tanker truck jumped out of the vehicle just moments before the train hit. time now 7:15. the united states says it does not plan to extradite wikileaks founder julian assange despite what he's claiming. he says he asked for asylum in ecuador because he believes the united states wants to execute him. for publishing classified documents. assange is hiding now in london. he's fighting extradition to sweden for questioning about sex crime accusations. the state department says assange is just trying to deflect attention away from the allegations against him. well, coming soon, a first person account of the raid that killed osama bin laden.

one of the members of the u.s. navy s.e.a.l. team 6 has written a book about that raid under a fake name. a military official says they don't believe the book has been read or even cleared by the defense department. and they're concerned about the possible release of classified information. in fact, if classified details are included, whoever wrote that book could be prosecuted. the book is due to be released september 11th. the 11th anniversary of the terror attacks. it is 7:16. questions this morning about a campaign donation for president obama. $52,000 reportedly was donated by herbert m. allison jr. to help re-elect the president. allison is a veteran wall street executive who conducts an independent review that exonerated the obama administration's loan program to energy companies. alson says he -- allison says he donated after he completed the review. in other news republican

presidential candidate mitt romney is trying to refocus his campaign on the economy today. ktvu's allison burns is live in the washington, d.c. newsroom with the issue romney will be promoting and how he says it will create jobs. allison? >> reporter: romney will be in new mexico today, tori, promoting his new energy policies. he wants to open up more oil drilling off the east coast and says his strategy will create three million jobs. a poll out this morning shows romney's selection of paul ryan as the running mate has boosted his popularity in the swing state of wisconsin where obama now leads by just two points. >> we are on a path that the president has placed us upon where we will turn out just like europe if we stick with these european policies. >> reporter: the president has no public events today during stops in nevada yesterday, he warned voters they'd be seeing more ads from the gop that he says are not true. >> and you know these aren't like positive ads where they're

putting out their plan. because they don't really have a plan. >> reporter: now the obama campaign has a you new ad of its own out today featuring former president clinton for the first time solo in an obama campaign ad promoting the president's economic policies. we'll have more on that during my next update in about an hour. reporting live in washington, d.c., allison burns, ktvu channel 2 news. it is coming up on 7:18. today bay area antinuclear activists plan to speak out against keeping a california nuclear power plant in operation. the plant in northern san diego county was shut down temporarily in january when radioactive water leaked. this morning, the state public utilities commission will hold a meeting at the state building in san francisco. that's when activists will demand it be shut down permanently. time now 7:18. medical researchers say they've discovered a mystery disease with symptoms similar to aids.

reportedly it's affected people from if united states all the way to asia. now although the victims aren't infected this hiv with new disease attacks the immune system and leaves the patients unable to fight off germs. the doctors say the disease doesn't appear to be contagious but they don't know what triggers it. the victims normally are around 50 years olds and researchers say some people have died from it but the exact numbers are still not known. residents of vallejo want more to be done about prostitution there. this year the police department installed these cameras trying to deter the illegal activity but some say it's not working. the cameras aren't monitored properly according to them. residents also complained that stay away orders issued to prostitutes they're not being enforced. city officials promise they will investigate those complaints. 7:19. later this morning, the senate is expected to pass a bill regarding alimony and spousal abuse. the bill is designed to protect

people from having to pay alimony to spouses convicted of sexual felonies. after the senate votes the bill heads back to the assembly for a final vote. it is expected to pass both houses. then the governor has until september 30th to either sign or veto it. suspended sheriff ross merkermie is responding to a poll that found that most san francisco people want him out of office. >> a poll like that and the questions that are on that poll. there's no way to answer that poll and not be negative about the removal of him. >> yesterday, he cited a different poll from sf gate that shows more support for him. he also said city supervisors should ignore both polls and remain open-minded. the supervisors could vote on permanently removing him from office as soon as next month. this comes after he pled guilty to false imprison imcharges in a de-- imprisonment charges in a case involving his wife this

year. breaking news this just happened. the man who was convicted of murdering exbeatle john lennon was just denied parole. for the seventh time. 57-year-old mark david chapman shot and killed john lennon in december 1990. chapman was sentenced to 20 years to life in prison. a three member parole board held a hearing about this in new york jed and again they denied the request for a seventh time. 7:20. the coastline received a big dose of fog overnight. and that means most bay area neighborhoods are starting to cool off this morning. up next our meteorologist will tell us where we can to end up later today -- expect to end up later today. >> the very latest fallout for a central valley meat company accused of animal cruelty. >> good morning, 280 is a mess getting into the valley now. what's going on there and also one of the bay area bridges is also very slow, coming up.

7:23. new developments involving a fresno county slaughter house accused of animal cruelty. mcdonald's and the federal government will no longer buy meat from central valley meat company. that's after undercover video showed sick cows being beaten and kicked at the hanford facility. records show the federal government bought 21 million pounds of beef from central valley last year for school lunches and other programs. the slaughter house was shut down on monday and says it's working to address concerns. the food and drug administration issued an official recall for cantaloupe that may be linked to salmonella. for the first time, health officials also released the name of the producer. indiana based chamberlain farms. two people have died from the outbreak and almost 180 people got sick. including two people here in california. time now 7:24. and san diego county, three squirrels that have the plague have been found.

they were at the cedar grove campground and donna campground. the health director there says it's not unusual for animals to test positive for plague and just stay away from all squirrels, so far no human cases of the plague have been reported. all right, 7:24 and check in again with sal. what's happening at the bay bridge? >> this morning we had slow traffic there tori and dave. it really has been slow for the last half hour or so. now it's still moving through. it's not like when there's an accident. so at least you have that to as the bright spot here. but it's backed up for about a 20 to 25 minute delay and once you make it across into the san francisco it looks good. a little overcost and not affecting bridge traffic. 580 is slow coming in through live mother. not too bad castro valley. 880 heyward slowing actually near 238 down todown john city.

and then across the bay 101 and 280 looking good. there are some airport theys that are going to be -- delays that are going to be -- well, they are forecast by the faa and expect delays after 8:00 for at least an hour on some flights. northbound 101. near candlestick there's an injury crash on the shoulder. it may be causing slow traffic anyway on northbound 101 between roster point and candle stick point. a look at 280 and san jose downtown. that traffic is busy coming around the corner. now at 7:26 to mark. hi there sal. good morning to you. the marine layer deepened to around 2,000 feet and the net result some cooling across the bay area. we have some more low clouds and fog to deal with for the morning. looking out to the oakland cam doctor and we have some overcost here and also some potty drizzle and wet roadways driving highway 101 this morning. temperatures this afternoon a touch cooler than yesterday's highs. warmest locations inland on track to reach the mid- to upper 80s and the giants are back home this evening.

time is coming you up on 7:30 and overnight news investigators are expected to arrive shortly at the scene of an early morning house fire in san rafael. flames and smoke poured out of the garage just before 2:00 this morning. alex savage as the up close look at the damage. good morning. >> reporter: good morning tori. this fire started in the garage early this morning and it destroyed a car and two jeeps that were parked there. but the family managed to escape unhurt. they actually ran into their backyard to escape the flames. but they got stuck there for a

short time because this fire was burning right along the sidewalkway. it broke out just before 2:00 this morning at this house. the family sleeping inside at the time when the smoke alarms went off. mom, dad, and daughter all woke up and they got out along with their dogs and ats. everyone -- cats, everyone ran back to the backyard for safety as the firefighters battled the flames and we just talked with a neighbor from two doors down who described the intense fire. >> when we came over basically you know the garage was part of the garage here just you know was up in flames. and we were really concerned about where the family was because they were nowhere to be seen. and my sister said that he had gone back inside to try to get his family out. >> reporter: this fire does in the aid peer to be suspicious -- not appear to be suspicious but investigators will try to pinpoint the exact cause. as we come out here live you can see there's a hose on the roof of the hose. the homeowner was actually

using it to try and spray down the flames before fire crews arrived. the fire luckily didn't burn into the house itself but there is smoke and water damage inside so the family for the time being will be staying with some friends. we're live the morning in san rafael. alex savage, ktvu channel 2 news. the suspicious fire left a small oakland business in ruins. the fire started around 1:00 a.m. at an appliance repair shop on 64th avenue and international boulevard. smoke could be seen pouring from the eaves of budget appliances. a building full of used washers, dryers and refrigerators. firefighters believe the fire started in the front of the building. >> the units were able to quickly extinguish the fire. no one was hurt. there was minimal damage to the building. >> the man who runs the business fixes up old appliances and sells them. but firefighters say he'll be out of business for a while. the cause of the fire is still under investigation. a water main break that affected the commute in san

francisco earlier this morning is no longer a problem. the rupture had been causing trains to move slowly on the l. muni line from 5:15 until arnold 6:40 this morning. the break happened at the sunset district near 32nd and 33rd avenues. crews have fixed the problem and the trains are now running normally. our time now 7:32 and anarchist group is claiming responsibility for vandalism in san francisco's mission district. the "san francisco examiner" reports anarchist symbols were found on at least one building and a car in the 700 and 200 blocks of the street early yesterday. more graffiti was in the 500 block of guerrero street. a group later posted a message they said the vandalism was a response to rising rents. well, oakland police say a homicide suspect is off the streets now. our ktvu news crew was there last night as police took a man into custody. this was at 18th and brush

streets in west oakland. police haven't said yet which homicide investigation he's being questioned about. new this morning the top commandser in afghanistan says the u.s. needs to strengthen themselves against insider attacks. general john allen made the remarks the morning from afghanistan where at least 40 nato service members have been killed by afghan troops or security forces this year. general allen also said it has been a busy summer but the main objective is making sure insurgents do not succeed in control is turned over to the afghan government. a tropical storm that could become a hurricane soon is leaving the military to postpone hearings for detainees at guantanamo bay. tropical storm isaac is forecast to make landfall near guantanamo bay on saturday morning. the latest hearings to be

postponed involve five detainees charged in the 9/11 attacks. and the storm has already brought rain and wind to the eastern caribbean islands. u.s. virgin islands and puerto rico. it could be a hurricane when it's expected later today or early tomorrow. that's when it's expected to pass over the dominican republic. haiti and cuba. and isaac could then head toward tampa where the republican national convention will kickoff on monday and "wall street journal" is reporting that tampa mayor says that they are aptly prepared to call the convention off if the tropical storm grows stronger. bowl. that's big. some by area republicans are getting ready to head to florida for next week's republican national congress individual. last night was the grand opening for marin's republican campaign headquarters in downtown san rafael. we talked to a 17-year-old student body president of the catholic high school on her way to the tampa convention. she says she'll get some hands-

on work experience while also attending events including breakfast with the keynote speaker, new jersey governor chris christie. >> the youth of the next generation, we're going to be the change and if we're not proper lighted and getting involved now how are we ever going to be the proper leaders of the nation? >> despite the controversy now surrounding todd akin people we talked to say their focus is on jobs. fixing the economy, and getting mitt romney and paul ryan elected into the white house. meantime the democratic national convention will kickoff on label in charlotte -- labor day in charlotte, north carolina with a big festival open to the public. that's one way organizers are trying to get more people involved. also invited to hear president obama accept the democratic nomination on september the 6th. and that may be right there, california attorney general pamela harris will be one of several women due to speak at the convention. well, a developer wants to

build a new intertanment hub in northern california that will be four times bigger than disneyland. it will be called the spirit of california. it would cover more than 6700 acres just north of tracy. the $1.2 billion center would feature an amusement park, a castro and we're told a lot more. -- casino and we're told a lot more. he just received exclusive negotiation rights for the property and the everything goes to plan, we're told it could open by 2024. the oakland a's and its fans are dealing with a stunning suspension of star pitcher bartolo colon. as we first reported on ktvu channel 2 news at noon yesterday, major league baseball suspended the 39-year- old for 50 games after he tested positive for elevated levels of testosterone. in a statement colon apologized for taking the performance- enhancing drug. his teammates say in order to focus on the playoff run, it's time to move on. >> i don't feel anger because

i'm not emotionally tied in that sense. it is disappointing there's no question about that. >> the suspension came just a week after giants' outfielder melky cabrera was suspended for the same violation. the future of sports in oakland meanwhile not really clear. the a's may move to san jose. the raiders may be eyeing los angeles or sanest clara and the warriors plan on moving to san francisco. but, there are a number of things planned to keep those teams in oakland. we'll have more on is that coming up at 7:47. >> very interesting. time now 7:38. well, two bay area sisters who are olympic gold medalists will be honored in danville their hometown this weekend. here's video of 19-year-old maggie statham showing off the gold medal. this is at a local fitness club last week. now she and her 25-year-old sister jessica helped lead the u.s. water polo team to victory in the london olympic games. the sisters will be honored in a ceremony at oak hill park, 5:00 this saturday. and there will also with taking

lot of slow traffic here and it's beginning to get slow here in pleasant hill as well as you drive to walnut creek. nothing major. if you're driving on the 80 freeway interstate 80 between richmond that traffic has been slow. and also looking at the commute on interstate 880 between 238 and union city. it gets better though if you're getting only the freeway in fremont. not all that bad. let's go to some live pictures again or another live picture of the bay bridge. westbound that's backed up for about a 20 minute delay. still moving through. not all that bad. but it's definitely slower than it has been. this week has been slower than the other weeks when we had summer vacations going. and 237. some stop and go traffic here as your westbound as you cross 880. but it gets better after the road. at 7:40. let's go to mark. ly there sal. good morning -- hi there sal. good morning to you. gradual cooling and that's going to be today all because of this, the fog, in fact the

marine layer has deepened to 2,000 feet. the fog you can see widespread near the coasts and also some drizzle showing up near half- moon bay and pacifica. some cloud cover out to santa rosa and napa and even down to oakland and heyward. but to fremont and san jose. we're tracking the heavy rain and thunderstorms moving out to the east of phoenix so this will continue to move to the east in a short-term. over the next two to three hours. and primarily the overnight rain event but some pretty significant flooding just outside of phoenix to the east. as far as current numbers here in the bay area. we have this. 50s and 60s and mountain view right now 60 degrees. fairfield 55 degrees. a bit of a breeze out toward the delta. this area of low pressure has been the culprit of the cooldown. it's not going to move too much for today. so as a result, a little bit cooler temperatures about the same or cooler across most of the region. the fog this morning, focused coast side and right around the bay and you'll see temperatures range approaching the mid possibly the upper 80s this afternoon. here's our forecast model

are still in danger. our reporter dan springer is live in red bluff right now. he's back here to tell us about the progress firefighters are making. good morning dan. >> reporter: yeah, good morning dave. this is proven to be a really stubborn fire you mentioned 57% containment but the acreage burned is now also up to 28,000 acres. and just when we had a whole bunch of people allowed back into their homes yesterday? flames jumped the containment line and now new homes are being threatened and more people are being evacuated. they were lapping up the highway 36 yesterday. the resources on this fire are really unbelievable. 2500 firefighters. 278 engines and 11 helicopters and yet because of the conditions are so hot and dry. there's still plenty of fuel to burn and this thing continues to spread. 84 structures have now been destroyed. 900 homes are threatened. remember yesterday, we were talking to you and they were

down to 200 homes threatened but because it jumped containment more homes are now in the path. this is shaping up to be the worst fire season in u.s. history. based on the acreage that's burned so far nearly seven million acres charred across the country and still about two months more to go in the fire season. in the last week four states have been under a state of emergency, california as you mentioned is one. oregon, washington and idaho. but while the acreage is high, the numbers of fires in homes destroyed are nowhere near close to record territory. which is the good news. credit that to good fire fighting and also some luck. but still we have more than 1800 homes across the u.s. that have been destroyed by wildfire this year. remember back in texas last year, 3,000 homes plus burned. so we haven't had the numbers of homes but these megafires are chewing up you know millions and millions of acres across the country and of course still burning here in california. dave?

now ktvu's alex savage has been in san rafael all morning and we know investigators are still trying to figure out what happened. good morning alex. >> reporter: good morning to you dave. this fire bunked right through the family's garage just destroying a car and two jeeps they had parked there. but the folks who live inside, they managed to get out unhurt. they smelled smoke early this morning and what they did, is they ran to their backyard but they were actually stuck back there for a short time because there were flames burning along the sidewalkway you're looking at. fire broke out at 2:00 in the morning at the house. the family was sleeping inside when their smoke alarms went off. mom, dad and daughter all woke up and managed to get outside. their dogs and their cats also made it out safely. everyone ran to the backyard for safety as crews worked to knock down these flames. and for the most part firefighters were able to keep the fire contained to the garage. and i talked this morning with a neighbor who lives in this area who actually works for a company that does clean-up and restoration after fires. >> this is exactly what we do.

alarm fire at a church. this one started yesterday about 11:45 at the east backare i can't believe church of the nazarene on miramar avenue. firefighters haven't found out where the fire started but it caused a lot of damage in the 45 minutes it took before they put the flames out. well, police have arrested a man from lark spur for allegedly threatening to kill the city's mayor. investigators say glen allen march threatened the fire clear and public works director. officials len it had march had reportedly talked about killing the officials because he was told he couldn't make renovations on his house. march also reportedly admitted to following the mayor in his car. a colorado judge will soon decide if the college records of accused colorado theater gunman james holmes should be released prosecutors hoped to show that a notebook should be allowed into evidence.

holmes sent the notebook to a university psychiatrist and it reportedly has violent descriptions of an attack. the records are subject to privacy laws defense attorneys say. the nine jurors who will decide the legal battle between apple and samsung are are not expected to reach a quick decision. the jury received the case yesterday after more than two hours of instructions from the judge. one jury expert says it could take more than a day to figure out how to handle the charges and countercharges in the case, the state senate will vote on the bill that deals with domestic violence. now the bill is designed to protect people from having to pay alimony to spouses who are convicted of sexual felonies. after the senate takes its vote the bill goes back to the assembly for a final vote. then it's expected to pass in both houses and then the governor has until september 30th to either sign it or veto

it. well, suspended sheriff ross mirkarimi is responding to a poll that says that 76% of the people in san francisco want him out of office. >> a poll like that and the questions that are on that poll, there's no way to answer that poll and not be negative about the removal of ross mirkarimi. >> now yesterday, mirkarimi creteed a different poll that showed more support for him. it also said that city supervisors should ignore both of the surveys and be open mined. the board of supervisors could vote on removing him from office as soon as next month. this comes after he pled guilty to false imprisonment charges in a demostic violence case involving his wife earlier this year. it is 8:33. people in vallejo want more to be done about prostitution in their city. this year, police department installed cameras to deter the illegal activity. but some say the approach is

not effective because the cameras are not monitored properly. residents also complained that stay away orders issued to prostitutes are not enforested. the officials are promising to look into the program. they have discovered a mystery disease with symptoms similar to aids and has affectioned people from the united states to asia. although victims are not infected with hiv, this new disease attacks the immune system. so it leaves patient unable to fight off germs. doctors say the disease does not appear to be contagious but they still don't know what triggers it. victims are normally around 50 years old and researchers say some people have died from the disease. some new developments involving that central valley slaughter house. now both mcdonald's and the federal government will no longer buy meat from central value legal meat company. that's after undercover video

overnight news as a suspicious fire in oakland leaves a small business owner picking up the pieces this

morning. the fire started about 1:00 a.m. at the appliance repair shop 64th avenue and international boulevard. it happened at the budget appliances. now the building was full of used washers and dryers and refrigerators. firefighters think the fire started in front of the building. >> the units were ableist quickly extinguish the fire. no one was hurt. there was minimal damage to the building. >> the man who runs the businesses resells the old appliances and firefighters say he's going to be out of the business for a while now. happening now, santa clara county is conducting an aerial assault on nexts, a helicopter -- mosquitoes, a helicopter is spraying 400 acres of the palo alto bay land's nature preserve. these are live pictures of the spraying. the county is trying to get rid of summer salt marsh mosquitoes, they do not carry the west nile virus. but they have a vicious bite ask they have been swarming the area lots of complaints.
