crash that killed a father and daughter. with continuing coverage we have been following since april alex savage is live with why the victim's family members are disappointed with prosecutors. good afternoon, alex. >> reporter: good afternoon. they are upset the district attorney's office is not pursuing adult charges against him but prosecutors said this morning the law limits them. that teen appeared in juvenile court here and pleaded not guilty to charges he ran over and killed two people. the teen, who we are not identifying, heard the charges against him. they include two felony counts of vehicular manslaughter with gross negligence. prosecutors are not pushing for adult charges. something that is disappointing for her, who is husband and daughter were killed in this crash in april. >> -- i just want justice.

>> he and his daughter went for a bike ride when they were hit and killed. >> i lost two loved ones, it is not going to bring any of them back. and all i want is just justice, that is it. >> prosecutors say he was speeding when he lost control and jumped the curb. still the senior deputy district attorney said today this particular manslaughter charge must be filed in juvenile court. he said he has no immediate plans to petition a judge to bump the case up to adult court because the circumstances just don't call for it. >> you have to look at the individual's prior criminal history, look at whether or not they are sophisticated. >> whether or not they have been on probation before, a lot of things. >> the attorney for the victim's family said he asked them to push for adult charges but they refused. >> we asked the district attorney's office to ask the court to certify this to adult court and they don't want to do

that and that is very disappointing to us. >> also in court today prosecutors talked about two previous run ins the boy had with police before the crash. in one case police found a switchblade knife in his car and he was cited. he will be back in court for another hearing in two weeks. in the meantime he remains free. if he is found guilty in connection with this crash he would likely serve time in a juvenile facility until the age of 21. while the victim's relatives want him to face a stiffer punishment the prosecutor we talked with said his hands are tied. live this afternoon in martinez, alex savage, ktvu channel 2 news. >> thank you. it was a chaotic scene there after two people were shot to death and 9 others wounded there. the shots rang out around 9:00 a.m. at 5th avenue and 34th street in a busy part of manhattan. the gunman, identified as 53-

year-old geoffrey johnson was laid off from his job a year ago. police say he returned to the office and shot and killed a former co-worker. he then walked away from the building, followed by a construction worker who flagged down police. police confronted him a few blocks away. >> he killed one person and at least nine other people were shot and some may have been shot accidentally by police officers who responded immediately and while confronting the suspect and fatally shooting him -- >> the nine other people who were shot suffered non-life- threatening wounds. the motive is not yet known. san jose city officials held an urgent news conference in the past few hours after the city recorded its 33rd homicide of the year last night. ktvu's tara moriarty was there and tells us what they say they are doing. >> reporter: it has been a bloody two weeks for the city

of san jose. last night a gang related shooting. an 18-year-old killed on his scooter there. >> the gang members in the city are feeling emboldment. the chief of police says there have been 33 homicides so far. 13 gang related. >> the message today is we will be there all the time 24 hours a day. we will stop you. if you have a weapon you will be arrested. >> this morning the chief, the mayor, the city council and the attorney made a show of force. >> you will be prosecuted to the fullest extent of the law. you will be removed from this community and sent to prison. >> the chief says the city is allocating $800,000 from its general fund so specialized officers can tackle gang infested areas but officers we spoke to said they already pull 15 hour shifts and overworked. >> it provides a source of income for them so we have not had a problem with that.

>> in the fall of 2010 the team which specialized in gang prevention was axed the homicide rate in 2011 almost doubled. they did merge with another unit but the number of officers was cut by more than half. >> yes, the fact that we have fewer people in special operations has made a difference. it has, but not in a good way. i will say this, those that are still there working are doing a great job and we need to supplement them with that that does that. >> many say it is a band-aid solution and it will be right back where it was. >> later this morning they released more information on the shooting death of a man there yesterday afternoon. responding to a 911 call there they found the victim there.

investigators have not released the man's name or many other details about how he died. they hope witnesses will come forward and help them find the killer. there are new developments in a story we have been following. some critical federal assistance is coming to the east contra costa fire district. they are receiving a grant from fema for their staffing for adequate fire and emergency response program, also known as safer. it was created to help fire departments increase staffing in their communities. east contra costa cut 16 jobs and closed three stations in june in brentwood, nightson and bethel island after voters rejected a partial tax measure. >> -- the grant -- morning -- and -- be able to -- back up -- that -- >> there is no word yet on which fire stations may re-

open. and some of those east contra costa firefighters were busy this morning. coming up in nine minutes the story of a house fire and how a family pet played a role in getting a neighbor to safety. an alarming discovery in one community. a growing number of dead bats with rabies. we have this report live from there to explain what is being done about it. good afternoon. hi. the city is putting out these warnings here telling people they live among bats and some of them are rabid. the last one was found here in the middle of the street. the call of nature draws people to san francisco's neighborhood but sometimes nature gets too close. >> we are on the lookout for anything -- >> they posted warning signs about rabid bats. 5 have been found here in the last another months. the most recent was last week.

threat. >> yes, it was a misunderstanding but you have to understand whip you see sections of pipe capped off the first thing that comes to mind is the potential that it is an explosive device and that is why we did that. >> police are still trying to determine that. the red cross provided shelter for them overnight. they were allowed back in around 6:00 a.m. thousands of people in shasta and those counties who had to evacuate because of the ponderosa wildfire are now being allowed to return home. the fire is 61% contained with full containment expected next week. more than 900 homes are still threatened, 64 homes and 20 other buildings have already been destroyed by the flames. a 4 alarm grass fire along internety there last night is under investigation. it started around 8:00 there. it burned 50 acres but firefighters managed to keep it from homes. multiple fire agencies were called to help. it took firefighters two and a half hours to put it out.

the firefighters are investigating the cause of a house fire in brentwood. this happened in the 500 block of second street. we are told no one was inside the home when the fire started after 5:00 this morning. a neighbor credits her dog with waking her up and alerting her to the fire. >> she pullinged my -- she -- my -- you know my blanket and my face and i said what happened, what, and i -- i follow her and then i -- my window, my living room, the fire, the next door and then we get up on the house. she say our lives. >> 1 firefighter was treated for heat exhaust fighting the fire. the latest polls show the race for the white house narrowing in the past week with mitt romney leading slightly in two of the three most recent polls and a tie in the third. barack obama does not have campaign events scheduled today. the washington post reports the obama campaign will intensify

its efforts to solidify its support among women. mitt romney held what they called a victory rally there. he made a joke about no one ever having asked to see his birth certificate, a reference to the controversy over weather mr. obama was born in the united states. the obama campaign immediately accused him of joining the birther movement. concerns about isaac and possible protests in florida are affecting plans for the republican convention in tampa. forecasters say isaac will probably head toward alabama, but tampa could still be hit by heavy rains. the former presidential nomination process at the republican convention will start early because of the weather. delegates will begin the roll call vote to officially nominate mitt romney on monday there instead of wednesday. they are starting early because of the concerns about disruptions from protesters and isaac. starting sunday night on

the 10:00 news we begin live coverage of the republican national convention in tampa. our coverage will continue through thursday when gop candidate mitt romney speaks to the delegates. ken will be there live when it begins. the former navy seal who wrote a book about the osama bin laden raid is no longer anonymous. the book was written under a different name and purports to be a first hand account of the killing of the leader in may of last year. fox news and other organizations are identifying the author as a 36-year-old man from alaska. he could face prosecution if the book contains classified information. petalooma's little league team is celebrating a win that secured them a place there. they beat the texas team last night 11-1, the slaughter rule in 5 innings. it puts them in the
