identify because he is a minor, made his first court appearance in martinez. >> it has destroyed my family, taken two of my loved ones away from me. >> reporter: the teenager pleaded not guilty to two counts of vehicular manslaughter. the attorney says the 17-year- old will be tried as a minor, despite a plea from the nuri family that he be tried as an adult. >> they have asked them to do that but they're telling us they're not going to do that, that it will remain in juvenile court. >> you look beyond the circumstances of the crimes. you have to look at the individual's prior criminal history, you have to look at whether or not they have been on probation before. >> reporter: the nuris attorney says the 17-year-old's family, which declined to comment, has

not shown any remorse or reached out to the family, a family that is sickened with sadness. >> i don't know what to say. i'm just... i just want justice. >> reporter: the defendant's attorney declined comment and his family did not address the media outside the courthouse today. a pretrial hearing is scheduled for september 17 at juvenile court. mike mibach, ktvu channel 2 news. in hayward, police are looking for whoever shot and killed a jewish store owner yesterday. police got a call when officers found the 53-year-old man inside espinoza's jewelry boutique. at this point, authorities aren't sure whether robbery was the motive, although there has been a rash of jewelry store robberies in the east bay in resent months. a man who attacked a horse, the horse has been ordered to

put down. police gave him official notice today. charlie attacked a horse on patrol earlier this month, leaving the horse badly injured. the owner says he plans to appeal the order. police are trying to figure out who left ammunition and suspicious looking devices at an apartment building. 75 people were evacuated on jones street. the bomb squad removed 15 pieces of pipe from the building. police say several bullets were found near the pipes. the bomb squad detonated the pipes and determined they were not a threat. >> it was a misunderstanding, but you have to understand when you see sections of the pipe capped off, we think this is an explosive device. that's why we took precautions. >> they were allowed back into their homes around 6 this morning. fire crews have made more progress against the so-called ponderosa fire and more people

were allowed back into their homes today. that fire has been burning for almost a week in shasta and tehama counties. it has burned more than 28,000 acres and also destroyed 64 homes and 20 outbuildings. tonight those flames are still threatening hundreds of buildings. however, evacuation warnings had been lifted for thousands who had fled their homes near the town of mineral. cal fire has been fighting the fire from the air and ground and now has it 60% contained. two people are dead and several other injuries today. new york's mayor called for calm after the frightening scene at the empire state building. karen reports on what police believed triggered the shooting. >> reporter: ayos and confusion on the streets -- chaos and confusion on the streets of new york. it was 9 a.m. when a man police identify as jeffrey johnson approached the empire state building. johnson had worked as a women's

accessories designer but was laid off last year. >> in a dispute with one of the former employees of haza. in front of the building, johnson produced a pistol and fired at close range, striking his victim in the head. >> reporter: johnson left the scene and stashed the gun in a black bag but was spotted by a construction worker. the worker followed johnson and tipped off nearby police. >> as the two officers approached johnson, he pulled his 45 caliber semiautomatic pistol from his bag and fired on the officers, who returned fire, killing him. >> reporter: other people were wounded or grazed during the gun battle between police and johnson. >> and some may have been shot accidentally by police officers who responded immediately. >> reporter: rebecca fox was nearby and was at the scene before police arrived. >> when i walked off the street, i saw women had been [

infringement claims. it found that samsung intentionally and knowingly copied apple's smartphone and tablet designs. that alone will cost samsung $1 billion in damages. without doubt, my many years of reporting in law school, tell me that samsung is already planning an appeal, some of which may, may allege unfairness and jury prejudice because the case was tried on apple's home turf. but for now, apple has fired a major shot over the bow of anyone looking to its intellectual property, which it clearly will not allow. we will have more as the attorneys come out and as the jurors come out, coming up later in the news cost. for now, tom vacar, ktvu channel 2 news. a san jose man accused of killing a toddler made an appearance today in a santa clara county courtroom.

alejandro benitez was arrested. authorities say he killed a 17- month-old boy back in april. he was set to be arraigned today, but officials pushed the arraignment to next friday. a teenager suspected in the armed robbery of a man he met on craigslist. a warrant has now been issued for him. hill pulled out a gun, took the victim's computer and took off. if you have any information on hill's whereabouts, you're asked to contact the alameda county sheriff's department. the u.s. anti-doping agency today issued a lifetime ban against bicycle racer lance armstrong and stripped him of his seven tour de france titles. this came after armstrong announced he would no longer fight the charges that he used performance-enhancing drugs. he called it a witch hunt and

said, quote, enough is enough. what he says the cyclist should do, now that armstrong is being stripped of his tour de france title. federal prosecutors in san diego say if armstrong fails to repay, he could face up to 20 years in prison. he won the tour de france in 2006 but has been since stripped of that title. he claims doping was widespread on the team, which included lance armstrong. two san francisco 49 fans are suing the team along with candlestick park officials and the nfl. daniel long and gabriel lanerette, their lawsuit is seeking unspecified damages, claiming that the league did not create a safe environment

for fans. navarette was beaten unconscious by a group of men in the parking lot and long was shot four times while attempting to help him. at this point, no suspects have been charged. tropical storm isaac is causing concerns for the upcoming republican convention in tampa, florida. people are preparing for that big storm. our chief meteorologist bill martin says that isaac will likely head toward alabama but that tampa could see heavy rain. today, florida's governor says he has assured romney the state is prepared. >> and did he feel comfortable that -- he felt comfortable that we have the right plans. we're a state that has dealt with hurricanes. we're going to make sure that all the delegates are happy also. >> governor scott said the gop delegates will receive regular updates on tropical storm

taking place on san francisco bay. cal trans says many of its trains will be packed. the last cal train will leave san francisco saturday at midnight and the last train on sunday is at 9:15 p.m. more than a dozen people are facing hundreds in fines for poaching crab in san mateo county. a sheriff's deputy spotted a group of men fishing for grab. he brought in a game warden who cited 14 men for catching crab out of season. the warden confiscated 83 crabs and released them back into the ocean. the men are facing fines ranging from $400 to 1400. mitt romney has raised more campaign money than barack obama during the past three months. now there's word of a technique that may be helping him to do that. the associated press says a marketing company is helping

>> reporter: well, they are taking steps to make streets safer. it's a vow they took just hours after the city's latest homicide. friends of san jose's 43rd victim, known as mando, set up where the police say the 18- year-old was shot last night. >> he was just a nice guy, always hanging around with him. he was an excellent guy. >> the investigation is still ongoing. i can say that the detectives have some information that leads them to believe this case is definitely gang-related. >> reporter: today city leaders vowed to crack down on gang violence. the chief says he does not plan to ask other agencies for assistance. instead, its special metro unit will focus solely on gangs. the city will earmark 800,000 for overtime. >> the message today is we will be there all the time, 24 hours a day. we will stop you.

are looking for a woman wanted in connection with a violent robbery. police identify her as bryce o'roark. her boyfriend was arrested on wednesday following the robbery attempt at the salvation army store on mission road. witnesses say they punched and choked a worker who caught them trying to steal clothes and household items. o'roark got away. a final order has been issued in the case of two motels accused of being centers for prostitution. the economy inn and national were ordered to be closed. they were ordered to pay the city's legal costs in the case. the judge set a hearing for august 31 to appoint a receiver to make sure the motels remain closed. in marin county, a man's fashion sense could get him in

jail. the marin journal reports 31- year-old eugene anderson pleaded guilty to assault. police say he tried to run down two men because he found their plaid jackets offensive. his sentencing is set for september 20. recapping our top news story, apple scored a big legal win today against samsung. just about an hour ago, a federal jury ruled in apple's favor in a massive smartphone patent infringement case. samsung must pay more than $1 billion in damages to apple. that's about 1.5 billion less than apple had demanded. this is a complicated verdict. tom vacar is working right now to go through the entire decision. tom will be back here in less than half an hour to show us what he's learned. in contra costa county, three fire stations recently closed could soon be reopened. allie is in brentwood and tells

us how -- >> reporter: outside the building, there's a notice letting people know the station has been closed since july 1. but that could soon change. in the next couple of months, this station and two others in east contra costa could be back open again. at 5:00 this morning, east contra costa firefighters rushed to a house fire on second street in brentwood. >> the engine was coming from all the way across town. >> reporter: he says they would have gotten there sooner if station 54 was still open. 15 firefighters lost their jobs after county voters rejected a partial tax measure in june. it's been a long summer for firefighters, but today, the district got some good news. >> they got good news in an e- mail this morning. >> reporter: the federal government awarded east contra costa fire with an $8 million

multiculturalism in norway. in a defiant statement, he said he's sorry he wasn't able to execute more people. we learn some startling new information today about the suspect in last month's movie theater massacre in colorado. newly filed court records allege that james holmes actually told a classmate four months before the shooting that he wanted to kill people. prosecutors made that claim in a motion today. they're seeking access to holmes' records at the university of colorado. prosecutors say he left the neuroscience program there in june after also making unspecified threats to a professor there. mexican police today shot and wounded two police instructors on a highway south of mexico city. the mexican governments says the officers mistook the u.s. embassy vehicle they were in because they suspected it was carrying kidnappers. the americans went to the hospital and are expected to be okay. both governments say they are investigating. a santa clara appeals court decided not to hear a lawsuit
