rise to their phone, which gave rise to their tablet, which was pretty much a knockoff or a very close copy of what was being made by apple. now, believe it or not, this is still going on. we're still waiting for people to come down. the jury actually had to decide on two noninfringement issues and has raised the penalty now from $10 million to $1 billion and 50. the idea being here is that samsung now is going to have to appeal this, because they have to put that money in escrow or put it someplace where it is safe so that if they should lose, they're going to have to provide that money to apple. in the meantime, we're still waiting for the lawyers, for the jury members, anybody who wants to talk to us on this very, very long case that has been going on. but suffice it to say that apple has sent a shot over the bow of anyone thinking about taking any of its ideas, that that's a very bad idea to do.

in fact, steve jobs was so livid about this he said he would spend every penny of apple's money to make sure they were vindicated in court. they didn't have to spend much. in fact, they got $1 billion back. more at 10 p.m. right now we do have more details on that ruling as well. again, the major patent violations were found with mobile phones and several devices that came up again and again in the jury verdict. here's a list of some of those, including samsung's big sellers. the jury createdly found that those mobile phones were in violation of apple technology patents. jury deliberations begin in contra costa against a drunk driving case against a southern california law enforcement. prosecutors say hernandez had a blood-alcohol level of .08, the minimum level for drunk driving. the defense says the blood test

was administered and handled poorly. the d.a.'s office says if he's convicted, hernandez could face two days in county jail, probation, and life suspension. authorities in san jose identified a man shot to death last night in the city's 33rd killing so far this year. police say 18-year-old mando herrera was gunned down on south king road just before 11:00 last night. he was taken to the hospital where he later died. detectives believe the shooting was gang-related. he is the ninth person to be killed in san jose so far this month. today the arraignment was postponed for a man accused of killing a 17-month-old boy. police say back in april, the man killed the toddler who was in the care of his girlfriend. police in santa rosa are warning parents and students

about a man who tried to lure a girl inside his truck. investigators are looking for the driver of this white pickup truck, seen around noon yesterday. they say he tried to convince a 15-year-old girl to get in the vehicle. the suspect is described as a latino man between 25 and 35 years old, dark hair, a thin build, wearing a baseball cap backwards. an eleven-year-old boy from fremont who hid along with his sister in a closet while robbers broke into their home yesterday is talking tonight about his frightening ordeal. >> we just stayed inside the closet. then for a while, we were trying to call our mom, twice. and then we finally called the cops. >> the police arrived at the house and made sure that the kids were okay. the three robbers ran off but were caught a short time later. they have been booked now in alameda county and fremont jails. coming up at 7, we'll hear more

higher gpa in high school. >> 1,000 students took part in the summer jobs program this year. that is double the number from last year. senator joe smideon wrote a bill that would require landlords to provide warning in writing to prospective tenants when the apartment they're looking to rent is subject to foreclosure. a city council election will be held in los gatos. marcia jenson is running for a seat on the town council. they say the election is needed to restore confidence in the city's democratic process after allegations of potential candidates being bullied out of running. ken will be live in tampa bay, florida.

for a bicycle ride. mike spoke to the widow in this case, and that woman made an emotional plea today outside the contra costa county courthouse. >> reporter: today, outside the county courthouse in martinez, mrs. nuri walked slowly. on her mind, her husband and nine-year-old daughter, both struck and killed by a white suv back on april 7 in concord. >> you try your best, day by day. it's never going to be the same. >> reporter: police arrested a 17-year-old driver but then 48 hours later, they let him go. and today, more than four months later, the same teenager was charged. >> i don't know what to say. i'm just -- i just want justice. >> reporter: a 17-year-old, who we will not notify because he's a minor, pleaded not guilty to two counts of vehicular manslaugher. the deputy d.a. says the charges do not fall in the category of juvenile crimes

arrested wednesday afternoon at a wendy's restaurant on main street. he was booked into the martinez jail on suspension of having a stolen weapon. officers closed part of main street while they investigated. a bill on abortion rights is now headed to the governor's desk. during a fierce debate over who can perform first trimester abortions, an assembly woman blasted her colleague's ignorance of women's bodies. she said as a woman she would not be shut down. >> what happened yesterday is a true testimony of what happens to women and how women are treated, not only in the business world but in politics. >> what ms. torres was saying was important but it wasn't related to this -- the issues presented in this particular bill. so it was strictly a -- a rule enforcement. >> assemblyman calderon did

vote in favor of the bill. a warning tonight after five rabid bats. health officials say since bats are nocturnal, if you see one during the day, it most likely means they are weak or sick. anyone who comes in contact with a sick bat should immediately receive treatment. crews are gaining ground on a wildfire burning in tehama county. the ponderosa fire is burning about 30 miles southeast of redding. cal fire officials say it is now almost 70% contained with full containment expected on monday. the flames consumed more than 28,000 acres in tehama and shasta countyings. 64 home versus been destroyed. the fire was sparked by lightning almost a week ago. an $8 million federal grant is coming to the rescue of the contra costa county fire district.

it will make way for the rehiring of 15 laid off firefighters as well as 12 new ones. the grant must be officially accepted by the district's board before hiring can start and it expires in two years. we have good news for electric car drivers looking to charge up in santa clara county. there are new charges stations at the county civic center in san jose. despite being an employee parking lot, the 12 new charging stations are open to the public. and welcome back. we've got a little bit of fog out there. that fog is going to push its way inland late tonight and early tomorrow morning. as you go into tonight, the fog pushes inland. it does a lot of what it did yesterday and today. there's going to be in most bay areas in the morning fog. highs tomorrow, they cool just a little bit. then they cool a little bit more on sunday. so temperatures are trending down for the weekend.

it's not a washout. there will just be more fog. the forecast as you go into tonight, the fog comes back. the weekend, a little cooler. next week, things start to warm up a little. but no big heat wave coming our way. we're not going to see red flag warnings or spare the air days. the annual best cancer walk is going to be tomorrow at oakland's lake merritt. it starts at 9 a.m. you can still participate. take a jacket if you're going out there. it's for a very good cause. again, about 9 a.m. tomorrow morning. go a little early if you want to sign up. the forecast for august, it has been kind of cool. but as we go into the last week in august, temperatures are going to remain cool because of 24 low pressure center. so with a cool week or cool few days coming up, we're not anticipating increased fire damage or bad air quality. we're into this kind of mild weather pattern to stay for a while. so what we're getting today, what we're going to get this

weekend, is kind of what we'll see for the rest of the month. fog even tries to show up in vacaville. tomorrow, you'll probably notice it being cooler in most bay area locations. there's a little bit of heat north and south. but in sacramento, those are 80's, not 90's. we're in august. you'd expect 90's. warm-up in clear lake, because you're up above the inversion. 80 in fairfield. 70 in vallejo. 84 in antioch. along the coast, it's foggy. i think the sun came out today. it will probably come out saturday and sunday a little bit as well. you might see it out there about 2, 3 in the afternoon. five-day forecast shapes out like this. when i come back tonight at 10:00, we'll take a look at that tropical storm which could easily become a category 1
