and bail was $2,500. >> in a statement released before 5:00 p.m. tonight reverend salvatore cordileone said he was ashamed of what he called a error in judgment and plans to pay his debt to society. he is scheduled to be installed as the archbishop on october 4, 5 days before his first court date. a jury today acquitted a man on dui charges. he was arrested on suspicion of drunk driving in march. the jury did not reach a verdict on a second count of driving with a blood alcohol of .08 which is the minimal level. he maintained throughout the trial he was not drunk. judge modified the sentence of a police officer who pled guilty to embezzling scholarship funds. he pleaded guilty in may to

stealing from the association. the district attorney says he converted his service to 350 hours of community service. >> investigators are looking into a suspicious fire outside of a daycare center, it happened before 7:00 a.m. this morning in the year of the facility on tennessee street. a spokeswoman said the flames burned part of a handy camp ramp and it appeared someone tried to put a fuel through a vent under the building but that did not catch on fire. students at six schools were locked down after a bank robbery about 1 again p.m. this afternoon when they held -- 1:15 p.m. this afternoon when they held up a wells fargo. police say they arrested one suspect in the area and the second suspect was arrested 2:30 p.m. in a car on highway 880.

a single cell phone theft led police to five suspects today. ktvu's david stevenson is in the city where he spoke to a witness who heard and saw a police officer open fire on a suspect during the confrontation. david? >> reporter: that's right. the shooting happened down this alley way. we spoke to neighbors and a witness shaken. >> reporter: police swarmed the neighborhood surrounding st. paul's catholic church after a officer fired on a suspect. it began with a cell phone robbery. the victim used a special app to help police track the phone and two suspects. one witness described seeing and hearing a officer chase a suspect. stop or i will shoot. >> she fired at whoever was

running. did that happen? >> one of the suspects while jumping over a wall over there jumped up, hands in, she fired one round, it did not strike the suspect. >> reporter: the suspect escaped. but police say they managed to track down and detain five men, including one found in this car with the stolen phone. >> nice neighborhood. very quiet. and seldom anything goes on. >> reporter: police lifted the lock down. >> got an e-mail and said not to bring the kids to school because they were in lock down. another e-mail at 9:00 saying it was lifted. >> reporter: police held cold shows to let witnesses view the suspects in the street. in addition to the cell phones

reporting live, rob roth, ktvu channel 2 news. the securities and exchange commission chair woman is reviewing the rules that ban remarks about the company's prospects around the time of facebook's ipo. many sued that they obscured the weakened growth forecast ahead of the listing. facebook stock lost half of its value. bart shut down a main entrance to the powell street station. a closure that will last three years. it is by the apple store. it is part of the subway construction project. passengers will have to go to the fourth and market street entrance. signs will be posted during the closure.

while forecasters are busy tracking tropical storm isaac, the red cross says more bay area volunteers are heading there. the american red cross says 11 more volunteers are leaving for alabama, louisiana and mississippi to set up shelters. people who live around new orleans spent today getting ready for the storms. the tropical storm isaac is in the center of the gulf of mexico and our chief meteorologist bill martin says tropical storm isaac will strengthen before it comes ashore as early as tomorrow. >> most likely strengthen to a category one or two but that is nothing like katrina. that was huge. this is not on the same scale but same concerns. we will track that for you at 10:00 p.m., i will have the latest updates on tropical storm isaac, which will soon be
