themon a deadly pursuit slamming into two cars and he did it all the way with a child with him and that child is safe. this is where the chase ended near contra loma boulevard and police opened fire at him killing him. he opened fire on the officers and this started at a domestic violence call at the man's house. he led police on a pursuit and eventually bailed out a few blocks away. he had a car seat inside of it, left the child in the car and began running through yards and eventually he was spotted by a chp helicopter heighting on the roof of a -- hiding on the roof of a house. the man woke up to the sound of gunfire. >> i heard gunshots and everything. it sounded like clapping noises

like, boom, boom, boom, boom. >> reporter: a sergeant tell he is me he did have to leave as the investigation took place and they were being assisted by the red cross. investigators will be at this scene throughout the area for several hours and we are hoping to speak to somebody to find out more information about this man again who was shot to death overnight by antioch police. live this morning in antioch, all level savage ktvu channel 2 morning news. and a south bay gang group is being charged with graffiti and prosecutors are hoping it will bring a tagging spree to an end, lorraine? >> reporter: prosecutors are now using a gang enhancement for the first time and you can see the graffiti here. this could get a non violent

tagger prison time. they will be seen in court to make a plea deal. san jose police say they are responsible for more than $60,000 worth of damage. the county said they are tired of this graffiti so from now on they will charge nonviolent tagging crews. it is any group of 3 or more people doing that. and they will serve 6 to 8 months, do community service, pay fines and get probation but even with this, their convictions will get a strike on their record and if they violate that probation they will face 3:00 to 11:00 years in prison. they did speak off camera with us and this plumbing business says they have been hit several times and it is costly for

on that charge. the bishop apologized for drunk driving over the weekend. he was one of 11 people caught by a dui check point and he as he was driving his mother home after the arrest. >> i blame myself for that. i blame myself. he was driving well, until we went through that checkpoint. >> and he is serving as the bishop of oakland and he will be installed on october 4th, that is five-days before he is due in court. right now 6:07 we will check in on the commute, sal? pam, so far so good, we have not had a lot going on and we hope to keep it that way, sometimes i am very optimistic, let's go out and take a look at what we have with highway 4 and it is still a little bit slow

here on antioch but it is okay as you get to bay point and this is a little section we are looking at and you will see crowded conditions as you drive on by, you can see it is getting more crowded. pretty and to they do it about 6:15 and we'll see when that happens. we talked about contra costa but if i move the maps over to the right we do have some slowing on 580 coming west out of the tracy area into livermore, let's go to steve. skies are clear, except for some patchy fog, that is not the case today so it will not take long to warm up. especially inland to near 90

degrees, it is very similar and yes still a tropical storm just inches towards new orleans and all signs point towards it 100 miles per hour south and storm surge will be big and heavy rain about a foot of rain, northwest 12, let's hope it does not stall or slow down but the main impact will be tonight into tomorrow it looks like. upper 60s for some and upper 50s for others, hardly any breeze, yesterday it collapsed and they went from 16 to calm and that's why temperatures are skyrocketing up there and about 15 degrees. this low will make a move, lots of sun warm to hot, patchy fog, only light breeze, strong to the dealt tax 60s and 70s, 80

. it happened last night in the eastern part of afghanistan, officials are saying nobody was hurt, however the taliban released a statement claiming they shot down the helicopter killing everybody on board. the first report said the helicopter did not appear to have been hit by enemy fire. a disturbing plot, soldiers accused of the exhibiting murder in order to keep their

militia a secret. they are accused of killing another soldier and his girlfriend because they were afraid of being betrayed. they are members of a group called fear which stands for ever enduring always ready. he took a plea deal to prosecute cute the other three. they tested i.q.s twice. they found a drop in the i.q. before they were at the age of 18. they are more likely to have attention and memory problems later in life. they are investigating a fire that burned two buildings. that fire started just after 2:30 yesterday afternoon. the flames spread to a second building and it took firefighters nearly an hour to put out that fire but nobody was hurt. contra costa counties are on the move trying to keep the mosquito population under control. crews say they will be fogging an area and the fogging is surrounded by perimeter island road. the fogging takes place between 745 and 11:00 tonight. now the control district says the large number of mosquitoes

carrying the west nile virus have been found in that area. it happened last night in montana, 44-year-old randy lee was standing in the right hand lane apparently trying to scare drivers when he was hit by two cars. he was wearing a military style suit like the one shown on the screen and he was hoping people would call in a as watch see -- a sighting. don't worry, you can still get a decent commute and let's look at the toll plaza, it is not all that bad coming into san francisco, and i do want to mention traffic is moving along nicely once on the bridge and it really is not that bad. we are getting closer to the holiday and some people are

trying to take some time off during the week and also during next week. this is a look at the san mateo bridge and one thing we look at, many days we look across and can't see the hills and today it's clear. that means the flights at fso will not have any real problems getting into and out of the fso airport. this is a look at highway 4, it is a little bit slow, but 680 still looks good. it didn't last long, patchy at best, i mean temperatures, they warmed up yesterday and there is a low which stays offshore and starts to move in. it is not really that cool where you get a few upper 40s and 50s and yesterday we jumped up a good 10 to 15 degrees and we will start a cool down

tomorrow. upper 50s for some, lower 50s for others, also down towards parts of coast and the coast is clear, west southwest went from 16 to calm and that was assure sign it was warming up, there is still a component and it looks like high pressure wins out and it begins tomorrow and will usher in a cooler pattern and today lots of sun. warmer temperatures, 60s and 70s and a few low 90s, it looks cooler, friday could be a slight warmup, nothing great but with your weekend always in view, it sets up shop on the california coast. alyssa meyers is making changes, she hired her new marketing director and they will start working at yahoo by the middle of next month.

. developing news coming out of walnut creek, they were evacuated less than an hour ago after a fire broke out. officials say it started 530

this morning. no injuries have been reported and the fire is still under investigation. also this morning, the fire of a 15-year-old boy accused of opening fire on another student, he says his son was bullied before the shooting. it happened in baltimore maryland. the student who was shot is in critical condition. the condition could have been worse had guidance counselors not intervened. they pinned him against something to keep him from shooting anybody else. and they will collect data about radiation levels. local leaders have information for comparison in the event of a disaster. the helicopter is flying just three feet above young. >> my mom said it flew over

five or six times. we thought they were looking for somebody and i was a little bit nervous. >> and they mapped radiation levels in washington d.c. seattle and los vegas. 6:26, one neighborhood is keeping their pets inside. three dead cats were found in recent weeks. wildlife officials say it appears to be the work of coyotes and as an mall owners, you should take precautions. >> this is harming domestic animals and are we going to wait for a toddler to be harmed? >> they are recommending you bring pet food inside and don't leave garbage out overnight. coyotes cannot be trapped or relocated unless they are either sick injured or

orphaned. and i want to update a fire on calistoga at myrtle. this is 1250 along the main drag and although they have opened up the road this was a fire at the calistoga and it was blocking the main road here. people inside the hotel were evacuated but now we have found out nobody was seriously injured although the fire department is still very much on the scene. we have information from the call fire, i assume they had gotten into the area but not much. the sunole grade looks good, let's go to steve. at best patchy fog, temperatures begin to warm up and we have cool to mild for

the dutch bank opening this weekend so they are there and a lot of business news coming up, we will tell you why there is a big drop overnight and going on in europe this morning that could affect us. we will smile and thank you for joining us, it is a tuesday august it 8th, -- 28th, i am dave clark. investigators at the scene of antioch, alex savage has been on this since 4:30 telling us why this incident was so dangerous, alex? >> well, good morning,. >> reporter: antioch police were chasing a man who had a young child with him and that toddler is safe this morning. and in contra boulevard in antioch, this is where antioch police officers opened fire on

that man. he died here at the scene. he was actually on the roof of somebody's house and pointing a gun at officers. it happened with a domestic violence call at a nearby home which led police on this pursuit. he eventually -- he eventually bailed and that's where we saw the child in the car seat and he began to run through yards in this area. officer found him with the use of a helicopter and he was hiding on a rooftop and that's when they heard gunfire. >> shots -- i heard shots go out and it sounded like firecrackers but i knew it wasn't. it was like, yeah bang, bang, bang several shots. >> and a sergeant out here told me the family who lives in that house where the shooting took place had to leave while the

investigation continues and investigators do plan to be out here and they have not released anymore information the name or the age of man who was shot dead. but the child who was involved in this early morning pursuit was checked out at the hospital and is doing well this morning. alex savage, ktvu channel 2 morning news. firefighters are looking into the cause of a fire that forced guests to have to evacuate. that fire started 3:15 and here is a live picture at the calistoga inn. we understand they were blocked off for hours due to the response of the fire and they are scheduled to reopen at this hour. we will continue to have more information on that as well. a shooting in west oakland has killed one man, police say

he was shot in the chest at 9:00 at 8th and add line streets, he died at the hospital. police have not released any information and the victim's identity has not yet been released. >> let's get you moving, sal you are watching the san mateo bridge, right? >> yes, i want to remind you over the weekend coming up, it seems like it is far away but yet, you have to start planning not to use the dumbarton it will be closed until tuesday i should say, so from friday evening, until ties tuesday morning, it is a nice drive barring any major problems. also looking at the bay bridge, we have the metering lights on, and we have a backup passing 880. if you are driving on highway 4, we have slowed traffic

through antioch but it gets better in bay point and pittsburgh. skies are clear, and temperatures are cool to mild but some locations are in the 60-degree range and it will be another warm day inland, nice breezy by the coast, mild to warm, inland warm to hot, temperatures to upper near 90 degrees and the low sitting there stays offshore for one more day and mainly clear, could be a little bit of patchy fog but not too much. upper 80s for some, it looks like cooler weather will kick in and still a tropical storm, we need to get to 74 but it is inching closer, all signs moving northwest at 12, let's hope it keeps moving and tonight slow down.

it continues to track up towards new orleans and once it moves inland we will start the weekend but it will start a strong storm surge. 60s for some and 50s for others, overnight lows are definitely warmer and some of the temperatures in the upper 2000 feet are very warm compared to yesterday, so it looks like patchy fog, maybe stronger, and going to the delta overall, 80s in between 60s and 70s closer to coast and bay. antioch and caster valley 78, 83 san jose, santa cruz near 0 there -- near 80 there. and it looks cooler wednesday and thursday, another cooling trend looks good with your

weekend always in few. tropical storm isaac is expected to cause problems. joining us george what is the biggest danger where you are? >> reporter: well, pam we are in what will be the northeast quadrant so we could see the potential of the strong storm surge and flooding and wind gusts, they are picking up as the storm moves in closer. we are expecting wind gusts as the storm makes landfall and at this point, we are expecting it to be a category 1 hurricane. >> and george, tell us where with your, give us an idea, there are a lot of houses in that area, i know sometimes it is along that area, they are

already physically prepared for a strong storm surge, what is it like where you are? >> well, right here, there are some homes when the storm surge comes up, these homes are in danger and there were several in several counties, you will find some seeking higher ground and as you mentioned some people have left town all together and i saw a few people jogging. a few people who the storm out, people i spoke with, they have been watching the storm closely and they have been taking it seriously whether they stay here or leave town, they seem to have a plan ready as it comes in. >> i know we saw some people sort of wake boarding as well so it is interesting, the ditch reaction. live there in mississippi, thank are for that update we will continue to watch isaac as

it comes into the coast. and the price of gassing up your car is going up. tara moriarty will shows us where gas prices are now and how high they are go, tara? >> reporter: in the castro district, where if you take a look behind me, you can see it is $4.39 for a gallon of regular unled and it could be even higher. here is what is happening in anticipation of tropical storm isaac. nearly 350 oil and gas platforms have been evacuated and that has halted production typically coming out of there. they produce nearly half of the nation's oil supply and a refinery explosion is also taking its toll and the chevron refinery fire is creating what some are calling a triple threat. and today's average price

is $3.75 per gallon. it is the highest we have ever seen in history. >> it is the highest during labor day weekend weekend and here in california, the average price is $4.13 per gallon and here in san francisco, 421 and expert say it could jump which could be devastating to the economy. it is $4.15 in the wake of katrina just to give you an idea. and higher gas prices, smog producing hydrocarbons in the refinery fire but today that leak could finally be stopped. that was one of many reports and chevron could face fines up to $25,000 each day if pollution standards are violated. the exact size of the leak has

. here is a quick look, a man is dead after being shot and kill by police in antioch overnight. police say it started as a

domestic dispute call involving a gun. a suspect drove off with a child in his car. during that chase, the suspect rammed two police cars and the man was shot and killed while hiding on the roof of a house. they have been on this and will bring you the latest coming up at 7:00. firefighters are investigating the cause that forced residents to be evacuated at calistoga hotel. we are told the fire started at about 3:15 this morning. now both directions in calistoga were blocked off as firefighters rushed to the scene. now tropical storm isaac is close to becoming a hurricane as it closes in on the gulf

coast. we are expecting to hear from president barack obama in just about 15 minutes and a briefing is set for 7:00 this morning. they declared a state of emergency freeing up federal help. and santa clara prosecutors are hoping the prospect will stop a san jose street crew from tagging, lorraine blanco would like to explain how long members of the that crew could spend behind bars, pam? >> reporter: we spoke with them and they say, it is a challenge keeping up with taggers and it is very costly to businesses here and will now cost taggers their freedom. they will be in court and they are responsible for more than 60,000 for businesses and they say they are tired of this graffiti and for now they will

is clear, can you believe it? >> yes, i do believe it today. in fact i just put that in there and so far it is clear and it will be a warm day for many. yesterday we warmed up fast, a good 17 degrees and temperatures have jumped up and warm to hot inland compared to sunday. the low that gives us a big cool down and it's retrograded, it looks like it will make a move tomorrow. skies start off clear, high pressure says i am in charge today and temperatures inland warm up and they are about the same, i think they will start that cool down. tropical storm isaac continues to make its move and it is only a tropical storm, it might reach hurricane strength moving northwest at about 12 miles per hour let's hope it doesn't stall out because it is a big,
