teacher molested students. matt keller is live in san jose where the family of an alleged victim is seeking restitution. >> reporter: this is the first if you are full week of classes. school officials dealing a lawsuit as the molestation trial is set to start. students are hoping for a fresh start as the new school year starts. the past year is hard to forget after a third grade teacher was arrested in january and charged with abusing five students. today a lawsuit has been filed against the principal and the district. chandler had yard supervisors or other children bring in students in to his classroom one or two at a time for lessons on helen keller. >> she was told she needed to act like helen keller and not be able so see things and be

able to feel with her mouth or feet. she didn't understand she was being assaulted. >> reporter: last month the da charged the principal at the time of the alleged molestation with a charge for failing to report after a child came forward. officials say nobody, believed abuse. the district released this statement. they say they take seriously any action of misconduct. >> you need to supervisor and if you don't, you are going to be held responsible or in this case civilly responsible for your actions because in the end it's the child who pays. >> i learned today the a new principal is in charge.

all employees district wide have undergone new training on mandatory reporting. >> we are foal following news where we learned it wasn't one but two waterline that broke flooding the streets and creating a giant sink hole. want to you show pictures of the 20 by 30-foot hole on sunny dale avenue in the visitation valley neighborhood. the two water mains ruptured about 11:30 sending water into the streets flooding nearby homes and a school. >> we have the regional transmission as well as the direction system and -- complicated by the amount of pg&e in the area and able and phone. > crews turned off the water and are digging to check for

potential gas leaks in the sink hole. we are live in the city to look at the damage to homes and a church and school. >> reporter: because the water and power has been turned off if parts of the neighborhood there are ten to 12 people who had to be evacuated they can't go home now. they left, they were told to leave earlier and just in the last half hour we have seen a few of them come back. you can see them talking to some -- among each other and talking to some of the authorities to find if and when they will be able to go back home this sun yeah dale and this sink hole is just beyond this pg&e truck and there is a massive equipment behind it. we do see water gushing in to this gutter over here. next to this is the church of the valley visitation school

and church. tunes were in class and they watched a wave of brown water gush in to the classroom. they tried to clean up the mess, it obviously didn't work. the water rushed downhill to the nearby homes and emergency crews knocked on the resident's doors, 14 homes, telling them to evacuate. >> we are all surprised, the neighborhood is surprised. the water, all of a sudden just -- you know, splattered -- i don't know where it come from. >> reporter: now there were a total of 250 students at the visitation church who had to evacuate. police escorted them overo to a nearby park where their parents picked them up. the school is likely going to be closed until september 10th before another two weeks. back out here the city has hired a private clean up crew that's out here to clean up some of the mess. those are the vehicles you see in front of the church. they have started their work and the damage assessment, is

miles from new orleans. we are live in the weather center. >> the good news is it has made landfallt. will start to fall apart. here is the story. a slow moving peak hurricane but very moist. a lot of water. it moves forward, look at that, from friday still in the lower valley. you will see a lot of runoff over the next few days. the storm surge six to 12 feet and it's about the rain. you could see 18, 20 inches of rain. they will have real issues, it's slow too so it'll last over the next 24 hours in the new orleans area is a cause for concern. when i calm back we will -- updates but we will look at

what you can expect, i will see you back here. >> there was a brief scare this morning for residents near the chevron refinery as another flair was ordered. we flew overhead just minutes after that flare. it's a common technique used to relieve pressure upside the refinery. this as many many still on edge after the fire made thousands of people feel they felt six. john fowler is live with new evidence about what makes this refinery especially at risk. >> i learned that the federal investigators are looking at the idea that i -- first told you about. i have obtained the latest documents showing crude was

100% from saudi arabia high in sulfur. i was told that pipe corrosion is more likely with this higher sulfur. it combines with water forming ions. some are did signed to cope with that. federal documents reveal chevron used low sulfur crude until the late 90s. the content varied but continued to rise. they say that it caused a unit fire in 2007. there was another unit in november of last year and a third three weeks ago. chevron didn't comment. industry spokesman points out the refineries have been using dirtier crude that all the clean is use up. we found other refineries use

cleaner crude. martinez about 1.03%, shell martinez, about 1.18, chevron topped the list at 1.55, that's 56% higher than the average. federal officials also have this information and though still early say it's a key point in their probe. >> a landmark deal too reform public pensions in california. the governor said the agreement with democratic lawmakers would put a cap on individual pension payments. new employee who have to contribute at least half of their pension costs and it would raise the retirement age for many. >> this is not easy. we have been negotiating for months, up in sacramento but people have come together in the legislature to bite the bullet and clean up a big mess.

>> today labor groups called the deal outrageous. the state senate is set to vote on friday. >> tonight romney is officially the presidential nominee of the republican party. delegates from new jersey put the former governor over the top of the gop convention. he watched the roll call with this wife. >> about an hour from now ann romney could give the speech of her life before the delegates. this morning she checked out the podium where she will address the convention. the former massachusetts governor said he will be in the audience while she speaks. some say it'll be aimed at women with a goal of warming up her image. its being streamed live online

one man inside that home said he heard gun fire from all directions. >> when i heard the gun shots i dove on the ground. >> the suspect died at the scene. the child wasn't hurt. >> there is a new warning tonight about an outbreak of a disease at yosemite. the park is warning 1700 visitors who stayed at currie village that four people who stayed there got the honta virus, two of them died. one of the victim was a 37-year- old man. the virus is spread by infected mice. the park said the village has been cleaned. >> the city of menlo park could cash in from facebook. they say that it's working on a development agreement with facebook for the company's new 22-acre west campus. in a similar agreement menlo park made more than $14.5

new ones just a couple feet away? >> reporter: the city isn't following it's own urban policy he says which requires mature trees to be kept when possible. he said even the mayor who happens to be his wife can't do anything to stop the trees coming down. the mayor was not allowed to vote on the issue because as a neighboring property owner it would be a conflict of interest. if she could she said she would force developers to work around existing trees. >> in terms of the future i want to see emoryville considering design that include protecting mature tree trees rather than saying it's in the wrong place. >> reporter: the planning director said the parking lot includes a number of privately owned spaces. he said the only way to make the park, the parking the development work is to get rid of the existing trees and plant new ones. >> we have to include a small parking lot but it'll be a big improvement and when it's done

there will be probably more trees than now. >> reporter: some say this plan could be a call to action. >> when they see the trees being cut down people can get very motivated i think. >> reporter: fences started going up. there is no word on when the trees will be cut down. hundreds rallied at the state capitol in support of a new bill. this say they want the governor to sign what they call the trust act. the measure would let counties to opt out of a federal program requiring local law enforcement to hold jailed undocumented immigrants after they are eligible for release. >> chilling effect about this just being undocumented doesn't mean are you a criminal. >> reporter: opponents say the
