very obvious case of drinking and driving. when richmond police stopped this driver it wasn't a question of whether he'd been drinking, only how much. officer found an open beer between his legs and his id revealed he's under 21. >> the legal limit would be a zero for the zero tolerance rule. any measurable amount it would be a violation of dui law. >> could he will going to jail tonight? >> potentially. >> this is a check point. >> reporter: it's all part of the statewide crack down on drunk driving. tonight alone there are at least eight check points. yet dui arrests are down from the same period last year and police say it's a good sign. >> i think the public is realizing that the ramifications and penalties are

robbed at gunpoint. then just today a potential car buyer was robbed near 62nd avenue. police suggest these safety tips. insist on meeting in a public place. consider having a friend accompany you and use a cashier's check or money order. never cash. >> oakland police are investigating a gunfight. it started on the 3600 block of brown avenue at about 11:00. shots were fired back and forth until it finally ended at the end of the block. two people were take tonight hospital. one with critical injuries. two other people were detained but police will not say if there are any suspects or motive. >> a woman is behind bars after ramming a sheriff's vehicle. 26-year-old erin was taken into custody last night. detectives followed her down a dead end street where she deliberately ran into their vehicle. after a brief chase she was arrested. detectives say she had heroin

and meth along with stolen driver's licenses. >> we're learning a sailboat has sunk. yesterday around 4:00 p.m. coast guard crews rescued a 16- year-old girl and 51-year-old man after their boat capsized. while trying to recover the boat today it broke into pieces and sank. >> fans took their seats inside uc berkeley's newly renovated stadium. >> reporter: with the roar and rip the ribbon for the stadium was cut. and then it was game time. the california golden bears took on their first opponent the nevada wolf pack.

inside was destroyed. >> the san jose firefighter who collapsed while responding to a fire earlier this week is in critical but stable condition tonight. frank ryan is in the intensive care unit in a medically induced coma. fire officials say ryan collapsed after suffering a heart attack on thursday. last night ktvu was there as members of the church held a vigil. >> with 80 homicides so far this year in oakland some religious leaders held a prayer walk hoping to end the violence. the group walked down international boulevard. the marchers say the community must come together to bring peace to the city. >> we all have the same purpose and the same goals. that's to bring our city back to where it is today. >> the walk ended with a community festival where the play your and city council president smoke to the crowd.

>> lawyers are asking for a judge's order to force oakland mayor to testify about the future of the police department. the bay area news group reports that she canceled thursday's scheduled deposition. the attorneys face an october 4th deadline to submit court documents. they say the department has failed to carry out reform following the police corruption scandal. >> advocates of a failed measure to rewrite state teacher evaluation guidelines say they're not giving up the fight. the proposed system included more performance reviews, classroom observations and public input. critics said it would require long negotiations with each teacher's union on every element. the chief of staff for i.c.e. submitted her resignation

an air show in davenport, iowa turned tragic this afternoon. training jets were flying in formation when one of them failed to complete a banking maneuver. authorities say the pilot was killed when the plane hit the ground sending a huge fire ball. no one on the ground was injured. organizers say that air show will go on tomorrow as scheduled. >> flood waters are starting to recede, but more than 600,000 people are still without power after hurricane isaac. you can see some people carried

their belongings up to the roof to wait out the flood. >> we have two children under two. it's miserable. i have a generator now, which is better. but it's still miserable. >> what's left of isaac is bringing heavy rain to missouri and illinois. two tornadoes touched down, no damage has been reported. forecasters are keeping an eye on another storm. leslie is not expected to pose a threat to the u.s. but strong waves could affect puerto rico. >> in afghanistan two suicide attacks near a u.s. base kills at least 12 people. nato officials say no american or coalition troops were killed. afghan officials say a suicide bomber detonated an explosive vest then just across from the compound a second bomber driving a fuel tanker detonated a bomb. eight civilians and four afghan police are among the dead.

the taliban claimed responsibility for the attack. a lake county soldier killed was laid to rest today. 23-year-old army sergeant roy essex was one of three killed. >> in other news of the world, a u.s. drone attack killed at least five suspected militants in a tribal area. the strike comes days after two top members of the network were killed in a drone attack. also today in the southwestern part of the country, gunmen pulled seven shiite muslims off a bus and killed them. no one has claimed responsibility. in syria rebel fighters.
