here. there are evidence markers still on the ground, as well as "shattered glass." two men were parked here and one man got out with what appeared to be a gun but witnesses say that never happened. >> small memorial at the scene of the officer involved shooting. officers encounter two men in a car and one men got out of the car with a pellet gun. police made clear yesterday the officers opened fire after seeing the driver step out of the car with what they thought was a gun. >> somebody's decision is to get out of the car and reach for a gun is not the appropriate thing to do. you have to suspect officers will protect themselves. >> reporter: officers fired 30 rounds. family say he is recovering and he was killed.

his sister says she was less than 20 feet from the shooting. >> he never left the car. >> reporter: she says after the car she heard one officer ask a crucial question. >> he asked his partner should we open the doors. why would you ask should you open the doors if he was already getting out of the car? >> reporter: today she says no one was the police or the district attorney asked her anything about the shooting. >> they came to my door and got my name but never interviewed me. the police department, whoever posted interview -- whoever is supposed to interview people, they never interviewed me. >> reporter: both officers are on pate administrative leave -- paid administrative leave. p live, crist -- leave. leave, christien kafton, ktvu channel 2 news.

>> police arrested a 17-year- old in connection with a stabbing this morning. it happened during a fight about 3:20 a.m. this morning at a home where the male victim lived. he was stabbed several times and they say the teenager admitted to the stabbing. at this point no word on what prompted the fight. police released a picture of a man who is wanted in a shooting death. a arrest warrant has been issued for him on manslaughter charges. the charges stem from a shooting on july 22. he is 5'7", 130 pounds. investigators say he is armed and dangerous. in san jose police called off a search for a third suspect in a pot club robbery about 11:00 a.m. this morning. police chased three men in san jose. officers arrested two men but

the third escaped on foot and at this point is still at large. a taxi driver was taken into custody after lowing into a pg&e gas -- lowing into a pg&e gas meter. leaking gas forces 10 people from an apartment building. firefighters had to use special tools to turn off the leak. demonstrators matched today calling for more government over sight of chevron and other companies. >> they made their way to the chevron refinery. speakers said energy companies should have stricter safety standards to prevent incidents like last month's chevron refinery fire. >> the equipment is old, not

maintained. they made $26 billion in profit last year. their equipment should be better maintained and safer for the workers. >> chevron said the company is working to prevent such incidents and they haven't found out what caused the fire. gas prices are the highest they have ever been over a labor day weekend. and that is do in part to the chevron refinery fire. ktvu's tom vacar joins us with more on the situation. tom? >> reporter: have a look over here. in a usual year these prices would head down but because of the chevron refinery fire it is anything but usual. >> reporter: they made a road trip round trip because airplane tickets also spiked by fuel cost were also too high.

>> cheaper to drive here even though gas prices are so high. >> reporter: bay area wide, the average price of a gallon of regular is $4.20. that is up 2 cents from a week ago. up 35 cents from a months ago before the chevron refinery fire and up a quarter from labor day a year ago. >> i got back from a trip from the mid-west, it is amazing i am paying a dollar more here. >> reporter: many blame speculators as much as they do chevron. >> the speculation drives up fuel prices. >> out of our control. up to them. i think, you know, they panic, they say we are going down, they raise the price. >> we have to always pay big,

rich people. not fair to us. >> reporter: that is why dianne feinstein called for a special investigation into gas prices in the wake of the chevron refinery fire. consumer editor tom vacar ktvu channel 2 news. the dumbarton bridge closure is in its final hours. the bridge is expected to open before midnight. that is 5 hours ahead of schedule. it has been closed since friday so workers could install a seismic joint. the repairs will be done after this weekend but final adjustments will need to be made. the project should be cleated by -- completed by 2013. here is a look at the alternate routes. the northern detour route takes you to the hayward, and across the bridge. the southern detour takes you tasan jose and across high -- to san jose and across highway

head injuries and the girl suffered a leg injury. the father was not hurt. concerns over the hantavirus outbreak resulted in a lot of cancellations at yosemite national park during the holiday weekend. 20% of the reservations were canceled. typically this type of year everything is sold out. officials announced last week 10,000 people were at risk for contracting hantavirus after staying at yosemite national park this summer. so far two people died. researchers are trying to find out if eating organic food is better for you. scientists say studies show it can lower exposure to pesticides but the amount of pesticides they measured in non- organic foods were in safety limits. both are equally nutritious but bacteria in non-organic meats

festival. the three day event featured music, wine and a lot of art. today was the last day. 270 artists displayed a variety of art. 25,000 pieces were on display. the festival is produced by the art festival foundation, proceeds go towards student scholarships, arts organizations and community service programs. and folks who love wine came out for the harvest wine celebration. it kicked off yesterday and featured 40 wines from the valley area. tickets included entrance, wine tasting and discount on wine -- discounts on wine. there was fog that beach this morning. you see the fog here. there is a shallow inversion.

the fog is there right now. it will be there again tomorrow morning. this morning there was a dense fog advisory because it is hard to see through. it will be dense again tomorrow morning and that means a warm day the nland. -- day inland. it doesn't allow inland to cool much. they will cool a little tomorrow, couple degrees. temperatures around the bay, same, maybe cooler and major cooling or more cooler wednesday and thursday. that is the weather trend. slightly cooler weather through the week. tomorrow, like today, slightly cooler, you may not notice tomorrow, might notice more fog. not as warm. the fog forecast shows the fog along the coast. burns back quickly. few breaks tomorrow and then you see the heat. 90s. i don't think we will see mid- 90s. we will see low 90s.
