behind it and whether there could have been other special circumstances. >> there was a lot of traffic going southbound on 680 and as it happened there were a number of eyewitnesses who remained on scene who we have interviewed. so they were all part of the investigation. >> investigators won't say how many shots were exchanged in the gun battle but a key part of the investigation will likely be video of the shooting taken by a chp dashboard camera. time now is 4:31. a san jose firefighter who suffered a heart attack while fighting a church fire is out of a coma. frank ryan has been in a medically indeuced coma since thursday. he regained consciousness for the first time yesterday. his friends say he was able to recognize friends and family and even asked for one friend by name. ryan is still listed as critical but stable and will remain in the hospital. turning to election news now. tonight democrats will name president obama their candidate after a highly anticipated

speech by former president bill clinton. last night president obama and his daughters watched the first lady address the convention from the white house. earlier in the day the president continued his campaigning in virginia. he told the crowd that whatever he said would be a distant second to what they would hear from his wife later this night. >> i am going to be at home watching it with our girls and i am going to try not to let them see their daddy cry, because when michelle starts talking i start getting all misty. >> when it came time to deliver her speech she entered to cheers a standing ovation and a little stevie wonder. ♪ [ music ] >> the first lady told the crowd the past four years has not changed her husband. she talked about his efforts for students, women and healthcare and reminded people that real change will take time and she talked about one of the best parts of her job as first lady.

opened fire during a victory rally for quebec's new premier. it happened last night in montreal. guards rushed the new premier offstage and she was not hurt. the gunman managed to start a fire near a door before being arrested. while the motive is not known, she strongly favors separation of french speaking quebec from candy da canada and is also the first female premier. they will gather there to take part in the search for sierra lamar. they will do that as they do every time. the disappeared on her way there. he has been charged with that. he says he hopes it will renew public interest in the case. there is also a fund-raising vigil to mark that.

supporters will place led candles in front of the city hall at 7:00 and the contactels will be on sale for $5 dollars, all proceeds will go to the fund to keep the search center running. happening now, firefighters in ka ka lose a county are working working to do that there is a map of it. the fires have burned that much. they are 10% contained and a third fire burning there is 90% contained. firefighters also making progress on that wildfire burning in the angeles national forest there. that fire is now 25% contained, seven firefighters suffered

actually. and now a lot of this is high based but certainly a possibility of that. 50s in temperatures, antioch 60. low 50s, mid-50s. the cloud cover along with low clouds and high clouds. a descent sea breeze there. as a stronger component of that the combination will give as cooler pattern. tough to see that, there is a low doing that today and tomorrow. so we will have to deal with that. again there could be showers and maybe inland could pop up. but low and high clouds, cooler. partly cloudy that should say or partly clouds. forecast high 60 to 90, most temperatures starting to come down, 60s, 70s, 80s and 80s to near 90 but that will do that but we will throw in a possibility of that. most of it would be east and south of us i believe but it is close. then things start to clear out a little bit on friday. the weekend looks nice, just calm, night morning fog then

choice early sunday morning when they fired into a white thunderbird killing him. the chief shows us a picture of the replica gun he says he was carrying. >> i have to stand by in regards to their actions to protect themselves in a case where they were confronted by an individual that had a handgun in the waistband. anything about these weapons is that -- >> he said it is difficult to distinguish a real gun from a replica. romero was a known gang member on probation for firearms violations. witnesses in his family dispute the account and the need for officers to fire more than 30 rounds. they call the shooting unjustified. his brother-in-law was also shot by officers. he is in the hospital with a hip injury. san francisco police have arrested a man in connection with the killing of a hairstylist in the city's diamond heights neighborhood. police say witnesses hipped identify 45-year-old james

ricklives as the man who killed him. they met in a bar and took a cab to his amount. the next day he was found bound and gagged and several items missing from his home. he was arrested on sunday and is held on murder, burglary and a probation violation. time now is 4:43. san francisco is trying to clean up the city's homeless possiblelation population by targeting drunks. they would have to do that every time they miss a court date. it could take place there and could start within a month. san francisco police released video showing an elderly asian woman being scanned out of thousands of dollars. this is from sunday morning, take a look, near chinatown, a group of women convince a woman to turn over her valuables in a bag, saying her money and jewelry needed to be blessed because the victim had stepped in blood. using a bait and switch took

tactic they stole from her. >> the noticed it wasn't right and noticed it was gone. >> police say it happened also there possibly carried out by them. that victim lost $35,000, her entire life savings. the university of california has reached a seblghts settlement with almost two dozen protesters pepper sprayed there. 19 students and two teachers filed the lawsuit after the police used pepper spray to break up a protest over rising tuition last november. terms of the proposed settlement have not been closed. they must sign of on that settlement. the president's campaign office in oakland has moved to a new location. the previous headquarters had been targeted several times by vandals. the most recent incident

happened two weeks ago. when six activists walked in and refused to leave. weeks earlier someone threw a rock and smashed out the front window. >> they were feeling unsafe and for the most part it was because because of the window and lately it was very very public. >> campaign officials don't want to reveal the location for safety reasons but say it is also in downtown oakland. they have not decided yet if they will have a viewing party tomorrow night when president obama speaks at the dnc. well this year there is a record turn out from the gay community at the democratic convention. in total 468 delegates are either gay, lesbian, by sexual and transgender and for the first time come from all 50 states. gay rights activists say his endorsement and the repeal of don't ask-don't tell is leading the movement and for the first time they are appropriately represented.

keep an eye on their stock. shares have hit their lowest level ever. 17.55. closed lower than 18 dollars for the first time. that is down 53% from its ipo in may. in premarket trading facebook stock is up a little bit. almost 2%. back above that 18 dollar mark. we will keep an eye on that. a u.s. judge has ruled a lawsuit against the parent companies of american airlines and united over the 9/11 attacks can move forward. world trade center properties is asking for more than 8.4 billion dollars in damage from the airlines. that is the estimated cost of replacing the twin towers. the lawsuit alleges the airline's negligence allowed terrorists to hijack the planes that flew into the world trade center. attorneys for the airlines argued the lawsuit should not move forward because world trade center properties has already received more than 4 billion dollars from insurance

companies. 4:47 is the time. flying coach on united airlines is about to get a little more cramped, the company announced plans to install slimmer seats on 150 of its planes to fit more passengers. the seats will be reduced from 18 to 17 inches. that will allow for six extra seats in the cabin, the changes will be made sometime next year. all right. time now is 4:47 and we want to take a look at traffic for you this morning. so far on this wednesday morning. let's take a look at the maps here. 680 and walnut creek area. you can see there is a little bit of a caution there, the freeway shut down yesterday of course, we followed that all morning after that officer was shot. right now three lanes are still closed because of construction between there and diablo road. other than that everything is back open there this morning. in east bay 880 and oakland near the coliseum moving actually slowly there for this

time of day, not even 5:00. there is some construction in the area so that is probably what is slowing things down. no major problems there though. further down, 680 not a lot of traffic on the sunol grade. you can see cars heading to san jose and 280. right now we are lucky to have steve paulson back. hi. >> hello, pam. well, a little change in our weather pattern, low clouds, they have been there but held in check but a low has formed off the coast drawing up moisture. now could be showers here. keep an eye on this. tomorrow is a better bet. tomorrow we see high clouds and maybe get some light sprinkles or showers out of that. more likely clouds. 50s temperatures to 60s, 50 santa rosa, 60 antioch, west- southwest 18, stronger sea breeze, more fog here making a push inland, a combination low above the coast and drawing up that moisture means we are partly cloudy today pattern again today and also tomorrow.

again the lower layers are very very dry but we need a trigger mechanism in the atmosphere, something to give this umphf and there is a possibility of that but more likely tomorrow, partly cloudy today, cooler possible showers but anything would be probably pretty light. temperatures 60s to near 90 degrees so maybe a little muggy, humidity in the mix due to these. 60s, 70s and 80s on the temperatures. looks like another day on thursday. so that is why we put in that symbol for a possible shower activity but more likely high based stuff, clears out then night fog and a quiet pattern as we go into your weekend pamela. >> thank you very much, stephen. changes are coming to cable service, the reason you may need to switch out your cable box or lose some local channels. preparations for the final trip of endeavour are underway. the reason it is making some people in southern california, especially environmentalists unhappy.

have that yet. they say they still have not decided if they will take steps against them. cab companies complain that lift and side car are actually illegal taxi services. now the mta has approved 200 now taxi permits it hopes will improve cab service around san francisco. the bay area feeling the pain at the pump, gas prices have soared 9% since the refinery fire. according to the gas buddy website unleaded gas averaged 4.19 in the bay area yesterday, 34 cents higher, 8.7% than the 3.82 average price the night of the fire. the average price of gas was 4.16 in the east bay, 4.18 in the south bay and 4.23 in san francisco. right now it is 4:53, in our 5:00 hour want to get a look at traffic this morning. take you to the 24 in lafayette towards the tunnel and you can

see no problems there. it does seem like there are month cars out on the road though now that it is not even 5:00, maybe people heading in early today. the east shore freeway toward the toll plaza also more people out and heading to work. moving along though. still all clear there though. it seems like it is spreading out as people are heading into the city. speaking of the city, what is the weather going to be like? steve has the answer. >> it is going to be cooler today, high clouds along with these lower clouds so temperatures today held in check, coming down a little bit, maybe higher humidity as we get these in here. 60s, 70s, 80s, 90s, starting off with 50s to 60 degrees. also these higher clouds with us not only today but tomorrow. breeze there so nothing outrageous but there and the clouds will give in an interesting forecast here today. there is returns showing up on radar. i think it is all high based and won't do much but still
