california transplant donor network to help others. >> the family of officer kenyon youngstrom released this statement through the california transplant donor network. quote, kenyon was always giving to others and serving others as a chp officer and in his life with us. our grief is overwhelming but in a special way, kenyon carries on in helping others. bay point schools went into lockdown this afternoon because of a fatal shooting nearby. it happened just before 2:00 this afternoon, right in front of some homes near inlet drive and marina road. it was also near two schools and a day care center. what you're looking at is video from news chopper 2 where you can see the parents lined up to pick up their kids at one of those schools. authorities also issued a shelter in place advisory for residents. we're waiting for an update from authorities on that search and also the identity of the person who was killed. a third person has died

from hantavirus after visiting yosemite national park. the victim was from west virginia. officials say that eight people who stayed in the park between june 10 and late last month all came down with the virus and three have since died. seven of the victims had stayed in the tent cabins at curry village. the eighth stayed in the high sierra camps. park officials say up to 10,000 people may have been exposed to the hantavirus. the democratic national convention wraps up tonight with the doubleheader of much anticipated speeches. first, vice president joe biden and then president obama will accept the nominations and try to convince the country why he should be reelected. ken joins us live from charlotte. >> reporter: the california delegates that we talked to said they do not expect president obama to spend much

live look inside temple nightclub. it is a free event being attended by anyone who wants to come in. it's a free event. attendees are being encouraged to contribute to the campaign if they come here, though. some of us tell us the president will have a hard time topping speeches made by the first lady and former president clinton. but they tell us they look forward to hearing him outline his plan if he is reelected. former republican candidate for california governor meg wittman says she's been too busy to watch the democratic national convention. we caught up with wittman today at the children's hospital. wittman went to the republican national convention in tampa, florida, last week. today we asked her if she thought republican presidential candidate mitt romney got a boost from that convention. >> it's really hard to know, because i think you have to look at what happened after the republican national convention, what happens after, you know,

the democratic national convention. and then frankly, there's 60- some odd days so it will be a race to the finish and a lot can happen. >> wittman lost to jerry brown in the 2010 california governor's race. san francisco is looking for hundreds of people to work on election day. they plan to hire more than 2500 people to staff the polling sites on november 6. applicants must be at least 18 years old, a u.s. citizen and registered to vote in california. those who are hired must also complete a training course before the election. pay for the one-day assignment is between $125 and $170. just about an hour ago, the oakland a's announced that pitcher brandon mccarthy is recovering from surgery after being hit in the head with a ball. the team say the 29-year-old pitcher is now awake and alert, after that hit. mccarthy was hit by a line drive from erick aybar yesterday. a ct scan showed he suffered a

skull fracture, hemorrhaging and an confusion. doctors performed surgery last night and they say he is improving. sheriff's deputies and probation agents carried out a periodic check as people on probation this morning in san jose. the terms of the probation allow authorities to enter their homes at any time. deputies this morning for looking for guns, drugs and other gang members. >> our goal today is to enforce the laws, to deter people from committing crimes and being gang affiliated. educate parents who may not know their children have gang affiliations and show them what to look for. >> our crews saw two arrests, one for drugs and one for a firearms possession. an early morning fire in san francisco chased more than two dozen people from their homes. it broke out in an apartment building near 22nd and fair oaks. everyone was able to make it out safely and firefighters were able to get the flames

under control. but they say there was extensive fire damage on all of the floors. the red cross is helping about 26 people find temporary places to stay. two fires in colusa county have now grown to 7200 acres. they're four miles apart along highway 16. highway 16 has been closed along an 18-mile stretch from highway 20 to the town of rumsey. 1300 firefighters are on the ground there at the two fires. the fires are 10% contained. firefighters say the containment is at 44% on the fire burning in the san gabriel mountains north of los angeles. the williams fire is now at just under 4200 acres. dozens of people were able to return home after they were evacuated four days ago. a trace of rain yesterday helped firefighters make progress. search crews had to luck today looking for a young bay area man who disappeared near chico. 20-year-old brett michael olson

attends cal-poly. he was last seen on a well- known beach. today search teams combed the river and the surrounding area. parents have also gone to chico to help with the search and they're handing out flyers at chico state. the labor department says new applications for unemployment benefits dropped 12,000 last week from the week before for a seasonally adjusted figure of 365,000. a survey indicates an increase in hiring in august with companies adding 201,000 jobs, the most since march. the job news combined with the report that european central banks plan a bond buying program pushed stocks to their highest level in four and a half years. the dow closed at 13,292. nasdaq was up 66.

the s&p added 28. authorities say they are going to come down hard if they find the person behind a hoax phone call that said a passenger on a u.s. airways flight was a terrorist. the pilot was ordered to return to philadelphia today and the very surprised passenger was taken off the plane in handcuffs. authorities say they found no explosives on the plane and they're calling it a nasty trick. the victim of the hoax was heading home to fort worth to celebrate his 29th birthday. happening now, we want to take you life to sacramento to the chp police academy where we understand they have been ringing a bell there in honor of officer kenyon youngstrom, who was killed earlier this week while making a stop on highway 680 in alamo. once that is over -- well, we understand it just wrapped up here. but what is also going to happen up in sacramento, there is a memorial up there honoring all of the chp officers who have been killed in the line of

duty. kenyon youngstrom's name is now going to be added to that memorial. it took 90 minutes to free a man trapped between two buildings. we'll show you exclusive video of the rescue. cçrrú ññ

a bizarre rescue today in san jose after a man was trapped for hours inside a very tiny space in between two buildings. it happened at the orchard supply store on east capital expressway. ann ruben is there now with video of that rescue. >> reporter: the sewing machine is on the other side. authorities believe the man was trying to jump from one building to the other when he fell into the crevice. it was all captured on camera. the tricky rescue that hoisted

a man from between two buildings. 32-year-old arturo corona had been stuck for hours. >> no way to survive. >> reporter: the only way out was up. the rescuers lowered ropes, instructing corona to hold on tight. authorities believe he'd been jumping from rooftop to rooftop when he slipped. >> he landed on his feet, but he was unable to come out of the buildings because of the abutments. >> reporter: the gap between the buildings is about 18 inches at its widest although you can see it's much narrower on either end. while corona wasn't able to move, authorities say he was able to reach his cell phone. >> we received a phone call from a victim who said he was being chased by several people with knives. >> reporter: san jose officers quickly realized the story didn't add up. they now realize he wasn't running from criminals.

he was running from police. they think he'd been involved in a pursuit hours before. >> he said he was involved in an accident and just trying to get away. >> reporter: he didn't get far. he was trapped just blocks from the accident scene. once he was lifted from the crevice, he was taken to the hospital with minor injuries. from there, he'll be booked into the jail, facing charges of felony hit and run and driving on a suspended license and he also has a warrant for a previous unrelated criminal matter. live in san jose, ann ruben, ktvu channel 2 news. a deadly shooting just after 2 a.m. on mccarthy boulevard and market streets. police say someone shot a man multiple times. police say they did not have a description of the shooter and a motive is not yet known. the victim is identified as 24-

year-old miandrey rachal. >> this boy had no reason to get shot. he's not out there selling drugs. he's just a person that's trying to help everybody do right. >> his death is oakland's 81st homicide of the year. by this time last year, the city had seen 73 homicides. a new report finds that billions of dollars are being wasted on health care here in the u.s. the institute of medicine and the california health foundation looked at 2009. they calculated that 30% of those costs, about $750 billion, was wasted. researchers blamed unnecessary services is, excessive administrative costs and fraud. the authors recommend the u.s. health system improve by constantly learning from new technology, engaging patients and linking pay and bonuses to

outcomes of care. california officials announced a recall of raw milk products because of a possible bacterial contamination. the research covers raw milk from the organic pastures dairy located in fresno county. all of the products have a code date of september 13. routine testing found traces of a bacterial strain. the bacteria can cause bacteria, abdominal cramps and fever. federal officials unveil a detailed plan for the recovery of california's salmon. coho salmon were plentiful in the past. now they are only found in two rivers. yesterday, the national oceanic and atmospheric administration issued detailed recommendations that included everything from legislative and regulatory changes to pollution control and habitat restation.

a final vote will be taken on november 7. in hopes of preventing accidents on deer valley road, it was shut down for a week while work is being done. the closure will be from brentwood and marsh creek road from september 17 through the 23rd. they will realign the two-lane road in hopes of making it safer. we're getting word of a brushfire near fairfield. >> live news chopper just got to the scene. this is developing news. a brushfire. this is the time of year we worry about them. you'll see some of the terrain here, looks pretty steep. conditions out here aren't that nasty for firefighters. this is out by cordelia. these are the hills behind that housing division. i think if you were to come with a camera and look straight down, you'd see a housing development in that area. so this is burning up in the

hills behind it. i was wrong. that's -- i don't have a great fix on this fire. anyway, this is near cordelia, we're told anyway. we have a ton of smoke in this area and a lot of rough terrain. it's definitely not an easy one to fight. there's the smoke. you can see it there. here's the conditions there, 79 degrees in the fire zone. and this is good, because look at the humidity. 34%. i'm kind of looking over my shoulder at the fire and we've got a lot of smoke. developing story. we're watching it for you, and the thing to take heart of is just note -- it doesn't look like there's homes out there. the wins aren't howling. the humidity is about double what you'd expect for this time of year. so that's good. so we'll be following the story closely for you. the temperature outside right now, we've got lots of numbers in the 70's and 80's. we had the showers move through. we had a few thunderstorms earlier in the south bay.

most of the rain activity is sort of to the south around point conception. so that subtropical moisture that gave us fits, the red flag warning is pretty much out of here. the red flag warning has been dropped. there's tropical moisture, the blue skies are gone. and you've got plenty of sunshine out there. the fog should try to come back to the coast late tonight. tomorrow morning, i think you wake up at ocean beach and out in pacifica with a little sunshine. there will be a few patches of puffy clouds. here's the story. this low pressure center to the north of us is just going to kind of linger there and let this high pressure build in. so the low is not going to impact us as much as it has until the high pressure builds in. five degrees around the bay and two degrees along the coast, so warmer tomorrow, but it's a subtle change. so i'm back here at 5:45. we'll look directly at that

business. the programs recently started at mi pueblo supermarkets today. mi pueblo means my people. but some people are upset at the grocery store chain's recent implementation of e- verify, checking immigration status on employees. >> people that sound, look different. we believe this is anti- immigrant. >> reporter: there are more than 387,000 employers using e- verify across the nation. they say although the grocery store chain is not required to use e-verify, it made the changes because of pressure from homeland security. >> we're simply complying with what's being asked of us. the irs came and asked us to do

certain things. >> reporter: current employees are being asked by management to recheck their work eligibility. but mi pueblo says e-verify will only be used for new hires. they are planning a boycott of the grocery chain. shoppers seem conflicted on the issue. >> i think it's racial. it's not fair. people need to work. >> are we going to boycott target, albertson's because they're going to do e-verify also? personally, i just think it's a waste of time. >> reporter: mi pueblo food center has about 3100 employees, mainly in california. a spokesperson says they are planning on going public and expanding and some states require e-verify. reporting live in san jose, matt keller, ktvu channel 2 news. the private equity funds for solyndra, the company's net

operating loss is estimated at almost $1 billion. when solyndra comes out of bankruptcy, the equity funds can apply the credits against future profits instead of paying the taxes. the federal judge who oversaw oracle's successful lawsuit against google has dropped the inquiry into bloggers who might be on the payroll. the judge had ordered the company to provide lists of bloggers and other journalists they were paying. he expressed concerns those payments might influence what they wrote about the case, but now he says he's not taking any further action. a jury ruled in may that google did not violate oracle's patents in its android software. a woman was arraigned in michigan after allegedly being caught with a gun in her purse at city hall in detroit. elmira sutton is charged with

carrying a concealed weapon. a gun in her purse was caught on x-rays. sutton is currently being held on $5,000 bond and is set to return to court next thursday. two men who applied to a job at in-n-out burger are suing the chain for race and age discrimination. paul chambers did his own unscientific poll today and tell us us what he observed when it comes to the diversity of in-n-out burger. >> reporter: in-n-out burger is known for its fries and other items but it's not known for diversity, they say. >> this is a clear-cut case of age and race discrimination. >> reporter: the two men are both african-american, over the age of 40, and suing in-n-out burger. both men say they were passed up for positions in oakland and san francisco. >> every organization has the ability to turn people down. but when you start to see

systemic discrimination, that's where the problem lies. >> reporter: they released this statement. in-n-out burger does not discriminate in our hiring policies or practices. we hire from our local communities and our restaurants reflect the demographics of that community. with that in mind, we decided to randomly pick three bay area in-n-out burgers to see how true that statement is. this is the store that the two plaintiffs who appeared. two employees appeared to be african-american. half were latino and half caucasian. no one appeared to be in their 40's. >> i see only young people, like teens, twenties, you know. i never see old people. >> reporter: in-n-out burger says they will aggressively fight these allegations. in mill valley, paul chambers, ktvu channel 2 news. let's go back to that fire.

now. neil armstrong will be buried at sea. that's the word from the family of the first man to walk on the moon. armstrong was a navy pilot before he joined the space program. a public funeral is set for a week from today at the national cathedral in washington, d.c. armstrong died at the age of 82. tom brokaw says he's okay after being taken to the hospital today following a television appearance. brokaw is in charlotte, north carolina, for the democratic national convention. he says he mistakenly took a dose of a sleeping pill and felt light-headed. a spokesperson says brokaw was discharged from the hospital and pronounced in great health. it is a massive project. the big expansion getting underway on the peninsula. now we're learning how valuable the bay area's two

big drop in land value. it was valued at $125 million back in 2008. when neighbors began their fight against plans for 370 homes on that sight. new plans call for a park, trail and a link to the bay area ridge trail. the town council has cleared the way to start over on an approval process for an expansion project. a group of citizens won a lawsuit to require an environmental impact report. airline ticket prices are going up across the country, but not at san francisco international airport. the latest statistics show that san francisco passengers actually paid 2% less in the first quarter of this year compared to the same time last year. some experts say higher fuel costs and less airline competition have caused ticket prices to go up across the

country, but an airline trade group says when you factor in inflation, prices are actually down. >> the bottom line, in absolute terms, they remain a great bargain. they're half of what they were before the industry was deregulated. >> at oakland international airport, the average ticket price rose .7% in the first quarter to about $277. and at san jose international airport, ticket prices rose 2.8% to about $308. federal aviation officials are considering a request for collision avoidance technology on all large planes because of a high number of close calls. the national transportation safety board is the one making the recommendation to the faa after about a thousand runway incursions last year. that's when planes are closer than the minimum distance allowed for safety on runways.

>> anytime you encroach upon a runway that another airplane is taking off or landing on, it creates a potential safety issue. >> officials say in each of the cases, the planes were actually far enough apart to avoid a collision. the federal aviation administration is promising to review this recommendation. they say things are bigger in texas, and apparently they're also faster. texas will soon open a stretch of highway with the highest speed limit in the country. they have approved an 85-mile- an-hour speed limit on a new toll road. it runs between austin and san antonio. the officials say that drivers can safely travel on the highway at those speeds. right now the top speed is a mere 80 miles an hour. >> wow. 85. all right. let's talk about our weather now. the weekend is just around the corner here. looks like it's heating up. >> i was just going back to the 70's where we were going 55. >> that's nothing now. >> things are starting to warm
