instead they are here keeping vigil by her hospital bed side. >> hoping she will be okay. >> reporter: the crossing guard is in serious condition at the hospital. she has broken legs and ribs, kidney damage and a fractured neck. her family called her a hero for what she did though this morning. >> she saved her son's life. to prevent him from getting hit and she was hit. >> reporter: today on his birthday, gilbert has gone to work with his mom. he was next to her when it happened. >> i just heard the noise and then looked up and the car was coming and my mom ran over to me and pushed me out of the way. >> reporter: the suv ran a red light, hit another car and hit them. burton just had minor injuries, another partner had serious injuries to her face and shoulders. >> that's -- like a speedway. >> reporter: police believe the suv was trying to go around school traffic at the time. they think alcohol may have

been a factor in the crash. two men were in the car, one of them remains at large. >> you just hit someone and you just leave the scene. that's really wrong. i'm praying for them to. >> reporter: both victims have been in and out of surgery and the family said while the outlook is good it'll be a long road ahead. >> the doctor said it's serious but it'll be a long call and we are in for the long haul and i know that god is good. >> reporter: police are still looking for the second person in that suv. they haven't released his name but say he is from oakland and they believe he has an outstanding warrant for his arrest. >> ktvu channel 2news. >> the crash restarted concerns about pedestrian safety particularly in contra costa. we tell you about the stat that reveal who is most at risk on the road. >> reporter: this morning's

injury crash in antioch that sent three to the hospital isn't as rare as you may think. stats show in a county of a million people more than 250 pedestrians were killed or injured by vehicles in 2010. that number is down since 2006, that still is about four people hit or killed a week on average. those numbers seem to surprise some we spoke to including daisuke an a. >> you have to watch all the time. always the one running the red light. >> reporter: safety experts say sometimes painted lines, stopsigns, even enforcement isn't enough to keep you safe when cross the street. today in downtown concord we saw an area with plenty of vehicle, pedestrian interaction. experts say improvements in driver awareness, better signs and more enforcement help to a point but walkers need to take responsibility for their own safety. they say areas near on-ramps are especially dangerous as cars ramp up the freeway speed.

a decision is unlikely until late tonight and here is why. take a live look. dozens of people waiting to speak their mind tonight to the supervisors about the vote. many of them are supporters of the suspended sheriff who say they are angry about efforts to remove him. the ethics commission agreed the mayor that he committed official misconduct but hundreds of the supporters rallied him on the steps of city hall this afternoon. anti domestic activists insist he can't do his job. his supporters say removing him is not democratic. >> the elected official in me said that -- most of all, most of all this case is about unprecedented, mayoral power, claiming the ability to charge any elected official in this city with official misconduct

bart station. it happened shortly before midnight last thursday in the parking lot of the coliseum bart station. police have found two juvenile suspects and a gun but a third suspect is still at large. >> the city of oakland revealed a five point plan to try to stop home foreclosures. it would set aside $1.2 million to help homeowners reset their mortgages, establish new responsibility measures for banks and provide counseling legal services as well as outreach and referral help. they want to use california settlement with big banks and a new homeowner bill of rights. >> we have the ability to use measure of prevention to save homes and use the experience of the local partners to protect homeowners. >> reporter: oakland lost 10,000 homes to foreclosures 2007 to 2011. the city council is expected to vote on this new plan next tuesday. >> chevron cut it's financial

outlook in part because of that large fire at its refinery in richmond. it told investors the refining unit that caught fire in august will remain off line until the end of the year. production is also down in the gulf coast because of isaac. chevron stock took a hit after it's financial reporting, shares closed down act a quarter of a point. >> inphysical said its planning layoffs at its security division. they said that -- they will layoff a small number of its workers. no reason was given. the security software company laidoff 150 employees last december. >> cloud workday is increasing the price for lieutenants ipo. in a securities and exchange commission filing today the company said it'll now price it's ipo at 24-$26 a share up

the 68-year-old still denied the allegations and said that he was the victim of a conspiracy. he said that he plans to appeal his conviction. the judge sentenced him to a minimum of 30 years in jail. three of the eight victims that he was convicted of abusing also spoke, some crying. >> a tina ceus of a drive by shooting, stealing a car and breaking out of jail appeared in court today. they say that max wade was the motorcycle rider behind the april drive by that targeted a girl and young man from mill valley. he is a accused of stealing a car. authorities say wade tried to break out of juvenile hall where he was being held. >> police and deputies stepping up patrols in a community that is on alert for possible serial arsonist. robert honda is in san jose with the big approximater threat that the small fires

pose. robert. >> reporter: we are at the apartment complex in san jose whereas you can see many of the fires have been set. starting tomorrow morning firefighter also go door to do with these flyers warning people about the arson fires and asking them for help. >> setting fire to a tree and bushing in san jose turned out to be just the start with in the past two weeks, investigators say there have been at least two arson fires, center around an apartment complex. they say a possible serial arsonist set fire to vegetation, discarded furniture, trash bins and dumpsters. the latest fire last night around 8:30. >> pretty close to the homes. you can see -- the cars in the garages and everything. the garages go up and cars inside them can go up and it'll be like a chain reaction. >> pretty quickly it starts in the building it can catch to other houses. i'm very concerned. i don't know why it's happening. >> reporter: officials aren't sure either but say whoever is responsible is getting bolder.

>> our concern is this person or persons appear to be getting more blatant. most of the fires were happening at night, over the weekend we actually had three with in an hour apart during the daytime. >> reporter: residents worried, they say there is no such thing as a small harmless fire. >> you never know what a fire will do. weather, as far as wind. it can blow, the fire from over here on to the building. no -- no controlled fires here. nothing that we -- unpredictable. >> reporter: and gena long with passing out flyers, they plan to step up patrols in the neighborhood. live in san jose. robert honda. >> the san francisco food bank is facing more problems tonight for a second year in a row they have been denied funding for its food give away program and that has the bank now rushing to make up for the 161,000- dollar loss. the money would provide 483,000

meals to people in need. the pain at pump may be letting up but in someplaces gas prices were at a new record high. aaa said the average cost for a gallon of regular is $4.74 up just a fraction from yesterday. in san jose it's $4.67 down a little from yesterday and prices in oakland also fell slightly to $4.68 a gallon. >> bill clinton campaigned for two congressmen today. >> the president was at davis endorsing four candidates including two incumbents. he is the one with the hat there. is he also backing two new candidates trying to unseat incumbents. >> we don't need lectures on beingself reliant. we need a road map to a

what we don't need. we will stay on it. this doesn't look like a big deal in terms of aerial coverage but if we got a thunderstorm in the santa cruz mountains that would be bad. we will watch again tonight at ten. the latest model and dial it in for you again. this center tracks off tomorrow and things start to clear out. the forecast highs tomorrow, just like today right. 75 in fairfield. a really nice day. it starts off cold in the morning. 40s and even in the north bay upper 30s. 72 in morgan hill. forecast high 71 wood side and then the five day forecast, linger around. friday a few more clouds but a nice looking week ahead. we will watch that, concerned about the red returns on the computer model because that would indicate chance of a storm, that's late tomorrow afternoon. we will watch it. right now looks like this. >> thank you. coming up on bay area news at
