i want you guys to look at this video and tell me if you think this is excessive force or justified behavior. this video was shot during oktoberfest in philadelphia, pennsylvania. this happened on september 29th. now, pay close attention to the guy in the t-shirt, who looks like he's being held back by his girlfriend. his name is john scravano. according to reports, police intervened because this guy was intoxicated. he was allegedly spitting on people, throwing beer and even trying to start a fight. but this police officer in the blue shirt comes in to try to get him to calm down. >> ah! [ bleep ]. >> oh -- nope. going down. >> yep. >> the officer takes out his stick. a struggle ensues. they both end up down on the concrete. >> [ bleep ].

>> the officer has taken a few swings at scravano. >> but he stops taking swings when he stops resisting. you can't hit a cop. >> keep watching the video. after the officer gets up, scravano stays on the ground. his girlfriend comes to help him. according to her, he suffered a fractured orbital bone during this incident. the officer in this video has been identified as officer william gret. the reason this video is getting so much attention, according to reports, the officer has been sued a number of times for different offenses ranging from excessive force to unlawful arrest. now, internal affairs are investigating this incident of whether or not they think that officer gres used excessive force. but right now officer gres is still on active duty. >> it's not excessive force. the officer had to do what he

had to do to get the guy under control, and once he was, he stopped. at the east alabama medical center, history was made when this little girl, lexi marie, was born. >> there she is. cuddled in her mom sarah's arms. but you notice, daddy was not there. at least not in person. a national guard specialist serving in afghanistan. his wife was expecting. so the doctor said they requested that he come home. they were denied. so they thought, hmm. what do we do? what doll we do? let's skype. and the baby was born and her hubby got to see it while his mother-in-law was holding up the computer. he could watch. >> wish i could have been there, but the way it works out -- >> and mom, she was happy about it. >> it makes me happy that he got to see her. >> the birth of your child is kind of a humongous deal and for him to be able to be part of it

patch of slick road and you see there, trooper porter had only seconds to get out of the way. he said he thought, run and don't slip. you can see he just narrowly missed getting crushed by this second vehicle. >> he seemed to be doing the right thing by staying way off the side of the road, and -- >> that's the worst place he could have been. here comes the story of his bad luck, because back in june of 2011 on trooper porter's birthday, nearly the exact same thing happened. he was arresting a drunk driver on i-405 when another car slammed into his patrol vehicle sending the drunk driver's car into him and the suspect. it seems trooper michael porter has bad luck, we spoke to the washington state patrol, they said all the troopers is experienced some sort of scenario like this. she's the famous dog who's done it all. >> she does uso tours. she visit schools.
