mu-- freeway shut down after a marine is shot at and a preschool locked down, hear what it was like inside for school and staff while a police staff was going on outside. >> complete bay area news coverage starts right now, this is ktvu channel 2 news at 6:00 p.m. >> good evening. hello. i am frank somerville. >> and i am julie haener. >> in cupertino the search for a burglar has been called off and a lock down brought a neighborhood to a stand still has been lifted. ktvu's rob roth joins us live with what it was like inside that preschool and if police found who they were looking for. >> reporter: police searched this neighborhood for most of the day but didn't find the man they were looking for. earler i with all the -- earlier with all the police activity a preschool went into lock down. >> reporter: while police searched this neighborhood for

a burglar, authorities called a preschool and ordered them to go on cold blue lock down. >> keep the kids inside. we don't feel that they are in danger. >> reporter: they have 60 children. >> we brought our children in and we asked them to sit on the floor away from windows and we had the doors locked and the lights out because we didn't know what the situation. >> reporter: the lock down happened close to nap time, when it was lifted parents came to pick up their children. >> you just know that your kid is safe in the school, locked in but it is hard because you want to hold them and hug them and you meant to know that -- you want to know that it is okay. >> reporter: police and sheriff's sheriff's deputies searched the neighborhood. police tried to pull over this car for speeding. it drove into a shopping center

and three men jumped out. two were arrested. >> we feel they may be involved in recent burglaries in the neighborhood so we are following up on that. >> reporter: police have two of the three men in custody and they don't believe any of the suspects were armed. reporting live in cupertino, rob roth, ktvu channel 2 news. an update to a story we brought you live throughout this newscast last night, classes resume at san jose city college after a lock down. police responded to a call from someone saying they saw a man with a gun on campus. but after a search a gunman was never found and there were no reports of shots fired. >> we weigh them out but this call appeared to have quite a bit of credibility to it when it came in. >> he said this is still an active investigation and police are still trying to figure out

who made that call. president obama said today he will use his power to try to prevent more tragedies like the shooting in newton, connecticut. >> if there is one thing we can do to prevent any of these events, we have a obligation to try. >> the president said vice president joe biden will head the effort and come up with a list of proposals by january. president obama called on congress to reinstate a assault weapons ban. reaction to president obama's pledge today was quick and mixed. ktvu's mike mibach is in oakland with the push by the state to keep guns away from certain people. >> reporter: getting guns out of the hands of the mentally disabled has been a big issue.

>> reporter: side by side with agents last month we were there as they confiscated guns from those deemed to have a mental disability. 2,000 fire arms have been seized by prohibited persons in california. today we met a first time gun buyer. >> responsibility of the owners and their mental health is a huge concern. >> reporter: do you have a gun? >> no. >> reporter: she says she supports the president wanting to improve mental health resources and create stricter gun laws. >> it is scary out there. >> they are hot right now. >> reporter: on the president

[ singing ] more than 200 people gathered to pray and pay tribute today. today's mass was dedicated to the sandy hook elementary school shooting victims. choir students sang before and after the services and the archbishop placed a wreath for those killed. a u.s. marine is spending his days on guard. he is volunteering to stand outside a elementary school. the principal is happy to have him there.

he is in the reserves after his last tour in afghanistan. very tense moments after a u.s. marine was shot at after driving on highway 85. the highway closed about 2:00 p.m. this afternoon. and traffic as you see there was backed up for miles. the freeway was reopened before 3:00 p.m. this afternoon. ktvu's ken pritchett is live near the scene with more on what happened. >> reporter: that intersection is where it meets highway 85, the marine took that off ramp about 1:00 p.m. to find out why his window shatters and now investigators want to know who shot at that car and why. >> reporter: he was driving this car.

on one side a window is shatted and you can see on the other side -- shatted and you can see on the other side -- shattered and you can see on the other side, bullet holes. he didn't realize there was shots. >> it was the shattering of glass. there was a loud pop. he gets alerted. pulls over to figure out what is going on and he realized there was several gun shots on the driver's side. >> reporter: highway 85 was shut down for an hour at 2:00 p.m. as they searched for bullet casings. it is unclear where the shots came from, off the highway or from another car, driving in the same or opposite direction. the car with the u.s. government plates was towed to seek answers. >> they will try to get an angle of the bullet holes, see

what direction it came in and match it up with evidence they find. >> reporter: the sherriff's department does not believe the driver was targeted because he is a u.s. marine. when he was driving he was wearing a jacket that covered up his uniform so no one would know he was a marine or is a marine. ken pritchett, ktvu channel 2 news. crews shut down a post office this morning after several workers got sickened by a chemical. it turns out it was pepper spray. investigators say it came from a canister. two people were treated. san francisco woman who was arrested in connection with the death of her daughter has been released from jail. the girl was found lying on a sidewalk and died at the hospital. the mother, 46-year-old heidi heidelberg was arrested on suspicion of felony child

endangerment. the district attorney said he she was released and faces no charges pending further investigation. authorities are working to identify the body of a man found in a storage area following a fire. firefighters were called at 1:15 a.m. this morning. crews found the body in the storage area after they put out the fire. police say the death does not appear suspicious. in oakland crews attacked flames from a burning truck. it was reported after midnight. the flames spread to a building causing significant damage. a security guard was taken to a hospital for smoke inhalation. the truck was reported stolen. jerry hill is proposing a lot to limit the way the public utilities commission spends money. he wants a law that would prohibit the cpuc from giving

out rate payer dollars to foundations unless they are reviewed through the energy commission. a legal battle is heating up. the state rejected a settlement that would have split the money. they filed suit. a judge in sacramento will take up the issue. facebook ceo mark zuckerberg announced his largest gift to charity. mark zuckerberg is donating 18 million shares of facebook stock to the silicon valley community foundation. they work on health and education projects. it is his second donation since joining the group. the group encourages wealthy individuals to donate money. facebook is set to premier

today calling on one of the owners to stop serving veal. they say congresswoman nancy pelosi has an interest in the restaurant chain. they are calling on her to stop the restaurant from serving veal that is raised inhumanely. we have some amazing new video of when two san francisco police officers rushed rushed an abandon baby to the hospital. they say they didn't have time to wait so they took the newborn in their cruiser. one officer performed cpr and because of their efforts the baby survived. the mother pleaded not guilty to child cruelty charges. nurses picked in california today. >> we are the nurses.

we are the nurses. >> the california nurses association organized today's picket to protest inadequate nurse staffing and patient care. a spokesperson said staffing complies with requirements. hospitals operated normally during this protest. some resident are hoping to halt eviction proceedings at this hall. the building went into foreclosure two years ago and now the bank put it up for sale. they have to leave in february. supporters hope the bank might donate the building. >> they want eto have the building in the community -- want to have the building in the community name to continue with the services they provide. >> our calls were not immediately returned. they gave out thousands of bags of food today for those in
