p.m. >> good evening. i am ken wayne. >> i am maureen naylor. >> in an hour a church is set to hold its first services since a shooting on christmas eve. a mother attending the service was wounded shielding her children. ktvu's eric rasmussen talked to her today about what doctors are saying. >> reporter: it was a close call but she is expected to make a full recovery. this woman felt no pain when she was shot. we talked to her in the hospital. she was among 100 people who were at that christmas eve service when several butts came through the -- bullets came through the walls. her first instinct was to

protect her children. [ speaking foreign language ] >> reporter: in spanish she said when i saw the bullet i threw myself over them so it might hit me and not them. she showed us where she was shot. doctors told her the doctors narrowly missed her heart. after three surgeries she is doing well and thanks god she is alive. police say a 17-year-old was also shot outside the church. he is expected to make a full recovery. police are still looking for the shooters and the church does not appear to be the target. she still has another 3-4 days at the hospital before she can go home. tonight in 90 minutes the church will have its first service since the shooting. we will be there and we will have much more from our interview with this very brave mom. live in oakland, eric rasmussen, ktvu channel 2 news.

we know the identity of the man shot and killed bypolice this morning. ktvu's ann rubin is live where many questions remain surrounding today's shooting. his friends said he worked at a hair salon and they have many questions about how this happened. >> reporter: what began with a 911 call ended with gunfire. police say they responded here to the apartments and were met by an armed man. >> they were concerned. >> reporter: officers were forced to shoot. the man died at the scene. happened at 3:15 a.m. >> i was asleep. i heard 8-10 shots. quite a bit. >> saw 6-10 officers with a lot of gunfire and screaming.

>> reporter: neighbors were terrified and took cover. >> we stayed inside and hit the ground and stayed down. we were scared. >> reporter: investigators say this was not a domestic dispute. friends of the man say he was a hair dresser who was hard working, kind and known to meditate. they are shocked. neighbors say they are shocked too. >> we are human being. we have to think first before we act because the consequence is this. >> reporter: the investigation could take several more days. the officers involved have been placed on administrative leave. ann rubin, ktvu channel 2 news. police identified the man killed in a crash last week. he was driving a truck when it was broad sided by a car arm

930 -- around 9:30 p.m. the cause of the crash is still under investigation. in union city a tow truck triggered a multi car crash. the drive lost control, hit two other cars and crashed into the center divide. traffic was slow going for a while. two people hospitalized after a crash this morning. it happened about 9:00 a.m. this morning. a classic car collided with a why sedan. officials say two people injured were taken to the hospital. one person was seriously injured. the cause of the accident is under investigation. california law enforcement is reporting an uptick in drunk driving arrests. 1,170 people were arrested for

dui statewide compared to 980 in 2011. and 39 people died compared to 14 last year. in the bay area, 165 people people were arrest -- people were arrested. last year 188 arrests were made and no fatalities. they will beef up patrols again friday through tuesday. the man who commanded -- general norman schwarzkopf has died. he commanded the u.s.-led international coalition that drove saddam hussein's forces out of kuwait in 1991. he retired in 1992. he rejected calls to run for office. he was 78 years old. president obama cut his hawaii vacation short and returned to washington, d.c. today to try to avoid the so- called it can it can.

the perez -- so-called fiscal cliff. the president is expected to meet with leaders tomorrow and congress will conseen a special sunday -- convene a special sunday session. ktvu's consumer editor tom vacar is here with a look at the building angwer washington, especially -- anger with washington especially among californians. >> reporter: it could bring another recession and higher unemployment. >> reporter: californians voted for prop 30. every californian will pay a quarter percent higher sales. the fiscal cliff will hit all americans with higher taxes. and that could lead to a u.s. economic down turn. and that could derail many of the benefit prop 30 could have meant for the state. >> i don't know if there is a

word to describe how mad the public will be. nobody will be happy to see that happen. >> if taxes go up it is not going to be a happy time. i think that is what is going to happen. >> reporter: the lowest income folks will see their pay shrink by 3.5%. average earners 4%. top earners 6%. that says nothing about other unknowns. >> we will be very angry. it will hit the people -- if you are on top you are on top but the middle and the working class are going to be effected. >> very angry. this life, i mean, we have to succeed. >> reporter: add to that 2,100,000 more americans on unemployment benefits who will be cut off january 1.

>> our political parties hurt the american people. >> reporter: no one, no one will be exempt. consumer editor tom vacar, ktvu channel 2 news. americans bought new homes last month at the fastest pace in 2-1/2 years. sales of new homes road 4.5% to $377,000. that is the fastest pace since april 2010. stable job gains and low mortgage rates are reasons for the rebound. new laws are set to take effect january 1. one limits lawsuits over violations over the americans with disabilities acts. bans attorneys from demanding money to businesses that are

violating. it gives businesses more time to correct them. >> plaintiffs had hundreds or thousands of lawsuits going at one time and it was viewed as a shake down. >> other laws include the right of employees to obtain copies of their personnel files and a ban on employees requesting social media passwords. a christmas baby born. delivered in the ambulance on the side of the road on the way to the hospitals. when the mother went into labor they pulled over and stepped into action delivering a healthy baby girl. >> mom started crying, dad started crying. it was great. wonderful gift. >> the father was following behind in his car and was able to be with the mom when the baby arrived. several fire districts in

contra costa county received life saving equipment. 70 defibrillators were delivered. fire department policies could be changing following a crash this month that sent several firefighters to the hospital. three firefighters on december 1 were struck by a out of control car by highway 24. they want to review policies to prevent a similar accident in the future. the district has implemented some new procedures. a local playground destroyed, who is repairing it? >> not one, not two, a half dozen classrooms vandalized. >> in 4 minutes a $4.3 million pay day. the check lender called out for

bringing in a new team of experts in hopes of reducing violent crime. ktvu's mike mibach joins us now. >> reporter: 5 days away from the new year and a new plan of attack underway. that plan announced here outside city hall. includes splitting the city up into five districts and dropping a quarter million dollars on a consultant. >> reporter: downtown oakland midafternoon, a robbery investigation underway, same time two blocks away at city hall. >> crime is too high. >> i take ownership as the

chief that this is happening. >> press conference to announce a strategy to reduce violent crime. neighborhood policing. splitting the city into five districts. each district to be run by a captain. >> we strengthen our relationship with the community. build trust. and we hold the captains and his officers responsible for knowing about crime, addressing crime. >> reporter: part two, a $250,000 contract with consultants. he says the group hired commissioner and los angeles police chief bill bratton to come up with a road map in oakland. >> he will do whatever he needs to do to get a feel of oakland. i will be meeting with him. >> reporter: the city avoided being taken over by the government after a judge agreed to have a court appointed

director over see the department. >> we have to try something different and we have to try with what we have. this gives thus best opportunity to do that. >> reporter: and officials say $250,000 to be used will come out of the general fund. mike mibach, ktvu channel 2 news. a three month ouch reach effort launched in san francisco aimed at customers borrowed. the program is part of an agreement to settle a lawsuit against the company. >> we will do what we need to do to make sure the people who are entitled a refund will get one. >> check and go acknowledged no wrong doing but agreed to pay more than $4 million. refunds will range from $20 to

$4,500. there may be fewer classrooms when students return. police say copper thieves disabled the wiring for a half dozen classrooms. >> ken wayne is live now. >> reporter: what the thieves did was go to the back of this campus. in the dark to do their work out of sight. that was the plan. >> reporter: not one. not two. but this act of vandalism was repeated on a half dozen classrooms. >> we first received reports on the night of christmas from security guards indicating they had buildings that were tampered with. >> reporter: he says again last night security was on patrol and this time they caught

someone. police say he was taken into custody. >> he had tools consistent with the break ins. he was also determined to be in possession of illegal drugs and he was arrested. >> reporter: what is not clear is if the same man was responsible for the christmas night copper theft. a worker says there is a danger because he wasn't sure if the wires were still live. as with most thieves they usually get away with less than it will cost someone to repair the damage. it is not clear how much it will cost to fix the classrooms. he says incidents like this spike at random. >> it is hard to pinpoint what is causing that. all we can do is investigate on a case by case basis. >> reporter: a year ago a law went into effect that increased the penalties for copper theft

and required those convicted to compensate the victims for damages. ken pritchett, ktvu channel 2 news. officials in contra costa county are looking at a proposal it will connect trails. they be enjoyed walking and biking on the iron horse trail. but the only things that connects them is unmarked streets and path. the hope is they will connect. a community group is making progress on their request to rebuild a city park thanks to a generous donation. they presented them with a $16,000 donation this morning. earlier this year vandals destroyed the taught lot. that is when they stepped in and started raising money to repair the park. they hope to reopen by spring.
