a man is shot and killed at a b.a.r.t. station during the busy evening commute. we've been talking to witnesses about what happened. good evening i'm julie haener. >> and i'm frank somerville. a frightening scene tonight at an east bay b.a.r.t. station where a man was shot

and killed right in front of stunned commuters. the victim may have been followed right off of the plane. amber lee questioned witnesses and police to find out what happened. >> reporter: the shooting happened at 6:07 tonight but as you can see this is still a very active crime scene. the victim's body found near the front of the b.a.r.t. station has not yet been removed. b.a.r.t. police officers armed with flashlights gathered evidence after a shooting. a witness told me she had just gotten off the b.a.r.t. train when she heard shots. >> people were gathered, people were scared they didn't know what was going on. >> reporter: the victim, an african american man close to his 30s had been walking down

marin county now where a car crashed into a church in san anselmo narrowly missing a church: no one was hurt but the church sustained damage. it appears the driver may have pushed the wrong pedal. a search is under way in santa cruz county for a missing man who may be disoriented from a head injury a few days ago. volunteers have joined sheriff deputy for their search of matthew anderson. his mother told us he was mountain biking when he fell off a train trestle and suffered a concussion. he may have left home to look for his missing backpack. >> they saw him last night before he went to bed. they don't think he left until

sometime this morning. >> reporter: his parents say he had become fixated on finding that backpack. administrators are set to deliver a report tomorrow that outlines how they plan to remedy the school's deep financial troubles and keep it afloat. ktvu' patty lee is live at one of the campuses that's on the chopping block. >> reporter: the lights are still on at that galt street location, but closing it is one of the options to convince the

anonymous. he worked for ktxl which is owned by tribune the same company that own it is tribune times. keys had left the tv job when he helped anonymous. it appears the state furlough days designed to save money may end up costing colorado in the long run -- costing california in the long run. more people ended up using less vacation days because they were forced to take so many furlough days. the dow did it again. it closed up again and closed at a record high. it has now closed higher for 10 consecutive trading sessions. the nasdaq was also up to day up 13. as ktvu's anne rubin tells us the markets haven't seen a streak like this in years. >> reporter: traders are feeling the optimism. the dow jones is up for the

attacks. they say they launched a pilot program last fall to reduce the estimated 3,000 inmates living in these units. new at 10:00, boeing says it's 787 dream liner will soon be flying their passengers again. commercial flights should resume within weeks not months. boeing says 1/3 of their safety test on ion batteries are now complete. you will recall dream liners have been grounded since january even though the exact reason why one battery caught fire and a second started smoking is still not known. there is word that president obama will visit california next month. the events will take place in san francisco and silican valley. the president is trying to help his fellow democrats recapture control of the house in the 2014 midterm elections.

leandro for residents who have run a foul of the law keeping bees and chickens in their yards. deborah villalon with more on how the city is trying to catch up with its neighbors. >> reporter: julie this is a forbidden chicken coop. most bay area cities have rules, san leandro a ban. so backyard poultry and bee keeping are illegal. >> i've been breaking the law for two weeks, i'm an illegal chicken keeper and beekeeper. >> reporter: san leandro residents spoke tonight in favor of urban agriculture. >> why do we need to keep any ordnance. >> reporter: some argued for lifting the ban but the city is drafting a permit process. >> we need to set guidelines especially it's really intended for those who can't meet the minimum qualification. >> reporter: qualifications such as how many chickens in how big a yard and requirements for their coop and their care

too noisy. live in san leandro. deborah villalon, ktvu news. more information on goulet. many have wondered why they dropped charges in hawaii. now they say he wasn't prosecuted because of a lack of evidence. they say in one case fingerprints did not match and in the other case, the victim could not identify him. a lab technician will plead guilty to a drug charge. the attorney for debra madden says a plea deal has been reached. this is set to happen tomorrow morning in front of a federal judge in san francisco. the plea deal follows two mistrials and hung juries. madden was accused of stealing cocaine from a police lab.

as a result hundreds of criminal cases had to be thrown out. only on( 2, a woman accused of kicking a toddler at a park made her appearance in court. >> this is so [ bleep ], this is ridiculous >> reporter: sabrina bell was supposed to be arraigned on federal assault and child charges, bell could be heard yelling from her holding cell. bell kicked an almost 2-year- old girl in the chest on monday. the little girl and her family were in town for a wedding. >> i have to say that this is the first time that i've seen a case where we've had a toddler being assaulted with the level of violence by a stranger right in front of the participants. >> bell never made it into the courtroom today. her case was continued until next week. a bay area substitute

teacher is facing child pornography tonight. some of the pictures they found include children as young as four years old. >> reporter: tracing the steps of a substitute teacher has the alan rock school district busy tonight. nathan forstell was arrested for producing and distributing pornographic pictures online. >> some were four, five to seven year old range. these are sexual acts. >> reporter: there's no evidence forstell produced his own fornothing -- pornography or that any students were involved. he was arrested yesterday while teaching at a monterey county school. >> so we're determining at what schools he substituted. how many days in what grade levels. >> reporter: the superintendent held this emergency meeting

overdose. now he is being observed. this is illegal. this is a public access easement. >> reporter: pete mcclosckin led the group as they walked over. the surf rider foundation filed a lawsuit saying that the gate violates the coastal act. san francisco police oversaw the protest but did not make any arrests. a man from alaska was arrested for bui or boating under the influence. he was taken to san m ateo jail. the boat the serenade 2 was just purchased last month during a lien sale. governor brown's delta water plan was unveiled. the plan aims to bring millions

of gallons to farms and communities in the southern part of the state. the plan calls for two 35-mile under ground tunnels to transport alof that water. critics say this will hurt the ecosystem but the governor disagrees saying after years and years of study it's time to finally get this done. if approved construction could begin in 2017. temperatures today dropped off a couple of degrees but it's still warm. above the average in many places, 77 in antioch. that was one of the warm spots most of us in the mid-70s away from the bay. around the bay it was upper 60s and low 70s. temperatures today cooler there was a lot of fog this morning. look for possible dense fog. i don't think it is going to be as intensive but it'll be nasty out there. mostly just high clouds. as we go into the day tomorrow, temperatures are going to increase. current temperatures outside, 57 in hayward.

in southern california, one construction worker died but another was rescued when a trench collapsed in pacific palisades. the two were working in a 15- foot deep trench at a water project. peta is outraged after the death of a shark. peta says it was flown from new york to l.a. for that tv commercial and died after showing signs of stress. k mart issued a statement saying it is saddened by the incident. k mart also says professional animal handlers were on hand for that shoot. more rough waters tonight for carnival cruise line after a carnival cruise line stranded

another of it ships. >> reporter: it's been just a month since a fire aboard the cruise ship triumph stranded passengers for days. now carnival my may have another pr problem on their hands. passengers say the power was turned off as crews tried to fix it. >> it was down for about three hours. during that time the toilets and everything started overflowing down in the main general lobby areas where people were frequenting the path room. >> reporter: a malfunction occurred during the regular testing of the ship's original diesel generator and only one public restroom was taken offline. >> when they did the systems check they noticed there were some errors. thought it was an easy fix. as it progressed through the night they found out it was more difficult. then they determined it is

san francisco police hope newly released surveillance video of an attempted robbery on a nummi bus will lead to an arrest. the video shows a well orchestrated plan by three men to try to steal a woman's cell phone. one suspect grabbed a woman's phone while the second suspect held the bus door open. a third suspect stayed on the train possibly to keep any good samaritans from stepping in. >> these are three people that are working together and if

pocket knife will not create any dangerous situation on an airplane. clayton garzan was arrested in charges including committing a hate crime. grarzan is accused of beating michael partida early sunday morning. partida had just left a house party. witnesses heard anti gay slurs directed at partida before and after the attack. state treasurer bill locklear says he and his estranged wife are trying to reconcile and he is calling off the divorce. she recently completed a rehab program for meth. she was involved in an extramarital affair. a spokesperson for bill locklear said the two are looking forward not back ward. they have a 9-year-old son. in news of the world

tonight in baghdad, coordinated attacks killed at least 24 people and injured 67 others. first three car bombs exploded outside government offices right in the heart of the city. the then gunman dressed as police began shooting. none of the attackers survived. the attack came less than a week before the u.s. led invasion of iraq. >> the legislature has elected ping as the new president during the country's once in a decade power change. china's slowing economic growth, rampant corruption and pollution are some of the issues he'll have to face. spectators in moscow were

we're not picking up much fog. right now i'm seeing just partly cloudy skies in the north bay you're clear. the current conditions outside right now are mostly in the upper 40s, low 50s. tonight we end up with some patchy fog at the coast but again it's not as extensive as last month. their going to start off a little bit more warmer with a few high clouds. the extended forecast keeps the upper 60s, low 70s going up here over the weekend. last night it came up a little, we cooled off. tonight it's compressing a little and we get the highs. temperatures overnight mid-40s so mild really. for this time of year 45 degrees in concord, 43 in livermore. it's chilly but it's not cold.
