case before the court. janet is in san francisco but we start with david stevenson who satin side the court to here the arguments in washington dc. >> reporter: that's right. the arguments inside the court were at times intense as the justices took on this historic case. as same sex sporters and opponents rallied this morning lawyers for both sides faced tough questions from the justices. the hearing in large part centered on in the supporters had the standing to present the case at all after california's highest court ruled the ban unconstitutional. >> the states said because we think that the focus of marriage really should be on

procreation, we aren't going to give licenses anymore to any couple where both people are over the age of 55. would that be constitutional? >> reporter: the attorney for same sex marriage advocates clashed over the history of marriage. >> i want to know how long it has been unconstitutional. >> it seems to me. >> it seems you would be able to tell me when. >> i submit you never have required that before. >> we look forward to a positive decision from the court that will up hold the will of the people. >> reporter: a ruling on the case is expected in june. >> i look forward to the day where i can be married to the person i love and start a family. >> reporter: coming up at six more audio from inside the court and reaction from two bay area city leaders.

for now reporting live. david stevenson. >> bus loads of supporters arrived in the capitol today and made their feelings known. one group came from north carolina. one of the reverands with the group based his objection to same sex marriage on religious views. >> we believe that the bible is right. god ordained the institution of marriage from the beginning of time when he created adam and eve. >> reporter: the demonstrations outside were peaceful. there were no reports of injuries or arts. a victim ill is under consider -- a vigil is underway at the state capitol. how that group views what happened in washington today. >> reporter: there is a lot of optimism. let me take a step back so you

can seat group here-- see the group here. i counted 30 and it continues to grow. this just started at four and they plan to go until eight tonight. they expect most people will be arriving in the next hour once the workday ends at five. organizers say they had about 300 people signed up for this vigil on the event's website and san francisco is where all of this started. the state court legalized same sex marriage in 2008 but then proposition 8 was passed there have been many protests and rallies on this these steps in san francisco. gay marriage supporters are back again today. >> i'm happy that it's happening right now. to me it means there will be a change, a positive change coming out of this. this decision is actually made. >> fighting for my rights, for the lights of the community and i'm showing i care and that i

want equal treatment under the law. >> while we may disagree with other clergy who feel differently we still stand with the couples and the families that are waiting for this day of justice to happen. >> reporter: as you can see people have been bringing rainbow flags, signs, wearing t- shirts, all in support of a reinstatement of gay marriage in the state of california. if not nationwide. i have been looking around the crowd in the area and i haven't seen anybody who is in support of proposition eight. of course that is the gay marriage ban but this is going to last until eight tonight. we will be here and we will bring you more live pictures coming up in the 6:00 news. reporting live. channel 2news. >> some cities in california are showing support for gays and lesbians during the two days of arguments. in long beach the gay flag is hanging at city hall. the mayor there said there is

huge support for same sex marriage in his city because many live there and all residents see the human side. it'll fly again tomorrow as the court hears arguments on the national defense of marriage act. coming up at 5:30 the polls show a shift in people's attitudes toward same sex marriage. see the changes since california's ban was passed by voters in 2008. >> police in morgan hill resolved the standoff just a few minutes ago involving a woman and man barricaded inside a motel room. it started about ten this morning at the morgan hill inn on monterey street. police haven't said if there were weapons inside the room or why the people were inside but investigators did say it was not a hostage situation and the man and woman are in custody. >> a horrible find on a napa highway over crossing has led to a homicide investigation. police and fire departments received several calls before four about a burning object on a highway 29 pedestrian

overpass near industrial way. when they arrived they found a man's body on fire. the unidentified man was pronounced dead at the scene. police are treating the case as a homicide. san jose police have released a sketch of the woman wanted in yesterday's child kidnapping. the woman drove away with the 11-month-old girl in a stolen jeep liberty after the mother went in to the house for a moment. the little girl was found sava long with that vehicle about five miles away. the kidnapper is described as latino, about 160-pounds, about 38 to 45. >> san jose police are investigating a deadly traffic accident involving a single vehicle. it happened about two on monterey highway. investigators say an initial investigation shows the vehicle was traveling southbound on monterey highway at a high rate of speed when the driver lost control and smashed into a building. the identity of the driver has not yet been released. he was declared dead at the

scene. in san jose an early morning accident left hundreds in the dark. it happened about five at the intersection of coleman avenue just thought of taylor. the outaga was caused when a street sweeper hit a power pole. pg&e said power has been restored to all but 23 customers. >> north dakota governor signed a controversial anti portion billt. will ban abortions if a fetal heartbeat can be detected that can happen six weeks into pregnancy. it would also ban it based on genetic defects. north dakota is now the most restrictive state when it comes to abortion. italy's highest criminal court is ordering a new trial for amanda knox for the death of her former roommate. the court today overturned the acquittals of knox and her former boyfriend. both were accused of killing

knox's british roommate in 2007. a man was eventually convicted of murder. it's not clear what prompted knox's acquittal to be overturned. she called the court's decision painful. her attorney said he is shocked and frustrated with the decision. >> went through this already. we don't know what else can be discussed knox is now a student at the university of washington. she isn't required to return for the retrial and she has no plans to do so. >> the number of new homes in february fell across the nation according to new figures released today. the commerce department reports the sales of new homes dropped to a rate of 411,000 in february. that's a 4.6% drop from january which had been the strongest month for sames since september of 2008. now in terms of prices the medium price was $246,000, that's up 2.9% from one year

victim it's a repeat because it was almost five-years ago to the date she lost her son in the same exact spot. kimberly celebrated her birthday two weeks ago. >> a really happy person. she really didn't fool with nobody. >> reporter: she was -- she was gunned down this morning in west oakland. >> when officers arrived they found a female. she was laying in the street and had died of fatal gun shot wounds. . >> reporter: the suspect walked up, fired and left the area in a car. police will review video taken by cameras in the area to help find the shooter. >> scary when i got there. i was like same spot my brother was in. that's where her brother got killed. >> reporter: harvey's mother said it was to familiar. back in march of 2008 her son,

hunter was also gunned down almost in the exact same area his sister was killed today. her son's killer was never found leaving her doubtful that police will find the man who killed her daughter. >> i don't have no faith in them finding out who killed my son and my child now. >> reporter: the suspect is an african american male in his 20s. he is wearing a blackjackest and beanie and a gray pair of pants. he was seen leaving in a 90s toyota that was silver or gold. if you know anything about this situation you are asked to call the police. live in oakland. >> police are searching for whoever shot an 8-year-old girl with an arrow. we are live in berkeley after talking to someone who saw the little girl immediately after she was hit. >> reporter: if you look behind me right now you can see a bunch of kids playing at that whale replica. that's about where a 8-year-old

was playing when she was suddenly struck by an arrow. the lieutenant said that investigators believe that the arrow came from this hill just north of the center but this point they don't know for sure. this happened outside the hall of science around ten. the whale was roped off with yellow tape most of the rest of the day. police say the girl was here on a field trip. they aren't sure if it was a random attack or targeted. they say she went into surgery to have the arrow removed. patty was here this morning and saw the little girl before she was rushed to the hospital. >> reporter: it was an arrow, a regular arrow. not a toy, it was stuck in her leg. it wasn't poking out one side. it just was in and it was stuck in there. pretty crazy. >> reporter: investigators searched the neighborhood as well as the area trails but no luck so far in finding the person responsible. this accident as you can imagine was upsetting for parents and grandparents

bringing their children to the area today. >> i really am concerned. i come here every week with the kids at least once a week and i'm concerned there is somebody shooting arrows. >> reporter: police are asking folks in the area to be on the look out for anybody with a bow and arrow or cross bow. if you see anything or have information you are asked to call the police department. ktvu channel 2news. >> the cause of an early morning apartment fire is still under investigation tonight. it broke out around 2:30 at a six unit building on park street. according to a fire captain the fire is believed to have started in a university on the third floor. it caused a million dollars in damage. two businesses on the ground floor were also damaged. >> it's hard considering i have only owned it eight and a half months. it's my dream job. i got out of corporate and this is my dream job.

i always say things happen for a reason. i'm not going to get down on this. >> reporter: it took about two hours to knock down the fire. there were no injuries. california is on the edge of making a major environmental change. dropping the requirement that furniture makers put flame retardant in their products. after decades environmentists feel they are about to win that fight. >> reporter: here is how california tests furniture now using an open flame, much bigger than this. if the foam inside this chair can with stand an open flame for 12 seconds it passes the test but flame retardants needed to pass that test. the new test would use a smoldering source like a cigar, it's a much easier test that wouldn't require the chemicals. one mattress treated flame retardant. 9 other not. the chemicals have been used in california since the 70s.

firefighters are among those who want their use stopped. tony is a retired san francisco fire captain who has cancer. >> i was told by my doctor that it's a rare form that's normally found in people that are exposed to chemicals. >> reporter: he and others testified before a department of consumer affairs board looking into changing how furniture is tested using not a flame but smoldering fire. >> what the upshot of that means is that manufacturers will not have to use chemicals in the foam in furniture if they don't want too. >> reporter: representatives of the chemistry council wouldn't go on camera with us but denied chemicals are toxic. they said the elements are critical and must gain approval from the epa. legislative efforts fought by chemical companies to eliminate the use have failed several times. >> i live we have a governor now that understands both sides of the issue and i believe that

he is prepared to do the right thing and it looks like it'll happen. >> reporter: look at the tag on this chair. it says technical bulletin 117. that means its passed the re flame retardant stand art. if the new rules passed you will see it on new furniture that won't have the chemicals and it's expected the rules will go into effect by early fall. in sacramento. >> another community meeting is underway in san francisco regarding a controversial plan to take away parking spaces on polk street. it calls for the removal of street park agriculture long the stretch of road from city hall to union street. >> going to have to about some dialogue around balancing everything and making sure people understand there is a reason to change what that reason is.

>> reporter: the transportation agency also wants to add bike lanes between market. a group of business owners is concerned that would hurt business. >> a new study finds working while pregnant doesn't increase a woman's risk of having a preterm or low birth weight baby. researchers looked at 1500 women who gave birth in 2005. some worked full or part time while pregnant, others didn't work. no difference was found in the rates of premature birth or low birth weight babies between those who worked those who didn't. >> we are inching toward that chance of rain. bill martin told us yesterday and we are getting a little closer. >> it's interesting because the numbers in and they are saying february, january and now march are turning out to be probably -- probably the dryest periods we have seen in san francisco. those records go back to 1850. at least that we have seen in recorded time. very dry around here.

we have showers coming but nothing major. stuff we need not on the way. on the east coast take a look. they have winter out there big time. it's cold, freeze warnings, snow and ice and for us we have just got another beautiful day. the radar is sweeping looking for rain. there were a couple sprinkles last nightu. you may have seen them around 10:30, 11:00. those showers kind of like these up here around -- you can see them. just widely scattered. that's what we are up against the next few days, a chance of a sprinkle tomorrow, maybe sort of a drizzle event as we go into the morning hours. the main dynamic i talked about yesterday, of this weather system, stays off shore and what it does is just throws moisture and weak impulses in our direction so we get a chance for sprinkles, starting tomorrow. that lasts through friday and then changes around on the weekend with a better shot of rain. these are the current temperatures, you see how warm it is.

new highway tunnels opened to traffic early this morning. john fowler talked to drivers about what the new addition means to them and joins us live from san mateo county near the entrance of the new devil slide tunnel. john? >> reporter: a steady stream of commute traffic here. coast siders say this tunnel promises them two things. cash and civility. open today and busy. the new tunnel at devils slide got differing reviews, one driver said that he is disappointed. >> i'm a little disappointed because of the view. there is no view anymore. it was nice. it was nice to look out at the ocean. >> reporter: after decades of rock slides closing the road regulars are thrilled. >> i go back and forth all the time. i couldn't be more excited. >> reporter: a graphic designer said the closures would add two hours to her drive. >> it was a nightmare. we are looking forward to this.

. bay area news coverage continues. this is ktvu channel 2news at five. >> it's a historic hearing but even before the issue today the court is questioning whether or not it should be taking up the case. we continue our coverage now as the court hearing on same sex hearing wraps up it's first day. scott mcfarland was in the courtroom and explains why some of the exchanges suggest the justices may not make a decision on the case. >> reporter: still no cameras allowed but from where we were you could hear it in the voices and words. they were questioning why they were even hearing the case. the front of the court was a wall of people. a loud crowd. walled off from the noise and just seconded after arguments started the justices questions if the case should even be heard. in part because the people

the nation's leading group of financial risk analysts said medical claims costs will jump 32% under obama care. claims costs are the biggest driver of insurance premiums. the -- a few states will see costs go down but the majority would see double digit increases. the group said california may see a 62% hike by the year 2017. the obama administration said that the report ignores other measures that off set price increases. >> wal-mart today announced plans to test the use of lockers in its stores to hold goods ordered online. the company spokesman said it's a way to link online sales to brick and mortar sales and avoid the cost of shipping. wal-mart said two thirds of people in the united states live with in five miles of a wal-mart. this move after amazon started installing lockers at various locations where customers can

. family members and friends of a 9-year-old are credited with saving her from a stranger who tried to kidnap her. we are live there with surveillance video of the suspect. >> reporter: oakland police want to you take a close look at the video we are about to show you to help identity a suspected child predator. the surveillance video shows a man on a cell phone pacing the

sidewalk on 94th avenue and b street in oakland just after six yesterday evening this man walked in to the front yard of a home and tried to kidnap a 9- year-old. >> he picked her up in a bear hug style and as he was holding her off the ground he touched her inappropriately. that's molestation. >> reporter: the girl screamed and her family and neighbors stepped in. >> they were able to scare him. he released her. he set her back down and then fled from the front yard on foot. >> reporter: police say the man ran down the street and took off in his car. this 1990 silver honda civic. several neighbors told us they heard the noise but nobody felt comfortable talking about it on camera. police praised the neighbors. >> everybody recognized that something wasn't right and they acted ronde it and because of that saved a little girl from being kidnapped. >> reporter: police believe this attempted kidnapping may be connected to a similar incident on november 5th. a 14-year-old was walking on

first tried to stop them because it matched the description of a vehicle linked to a haywood shooting. a charles manson follower has been arrested for allegedly trying to smuggle a cell phone into prison for the cult leader. the department of corrections officials say charles manson didn't ever get the phone. a 63-year-old was arrested sunday after he was caught with the phone in a prohibited area. manson is serving a life sentence and has been caught with a smuggled phone twice in the past four years. >> the irs is warning taxpayers about a series of tax related scams. the irs said that people should watch out for phishing attacks an e-mail pretending to be from the government asking for personal information including social security numbers. the irs said it doesn't use e- mail to request personal or financial information. the agency also warned ads or flyer was claims of free money
