we're live in san francisco where two dozen people are evacuated from some apartments in the bayview because of a fire. why neighbors say it can be traced to an ongoing dispute with a landlord and garbage chute. day two of the same-sex marriage hearings are getting underway right now. right now, the critical case the supreme court will review this morning. a problem on the bay bridge. find out if that will affect

the scheduled opening on labor day. >> reporter: and we're live on the bridge where there are no more humane toll takers. we'll tell you what you can expect as you drive across it. well, good morning. i'm dave clark. >> i'm tori campbell. it's wednesday, march 27th. we're following developing news in san francisco that we first told you about at 4:30. firefighters are still cleaning up after an early-morning fire on third and mckinnon in the bayview district. tara moriarty is there. and tara, some residents say this fire was intentionally set? >> reporter: that's what they believe. they say the landlord had an ongoing dispute with one of the tenants. you can see there's a huge chunk of it missing over there which is right above a bar. the witnesses describe how a

burned kitchen mat somehow got into a garbage chute between these two buildings which is where the fire appeared to have started. firefighters are still here manning hot spots from a fire that broke out six hours ago. part of the challenge in tackling the flames was a gas line that needed to be turned off. it took pg&e an hour and 15 minutes to get the valves switched. about two dozen people were able to escape. they evacuated these blildings with flats, one on mckinnon, the other on third and a bar that was just renovated also burned down. everyone got out safely. it was a close call. victims say they heard alarms and people pounding on each other's doors. >> i listened for a little bit more and then i heard people hollering and screaming like fire! oh, wow. something this on fire. the whole back of the house

caught on fire and the fire truck, it's not like they were spraying water on it. they took a water hose trying to put out a forest fire it was like. >> reporter: the fire appears to have started in the grar birnl chute. two firefighters received minor injuries. one hurt his knee and elbow. another suffered smoke inhalation but minor. the evacuees are at a house nearby where the red cross is able to place them in temporary housing. we understand that one man has been detained but we don't know if he will be arrested for arson. we did speak with the owner of the two buildings. he side he's not gonna be able to afford to rebuild. his insurance only covers $1.5 million and he says it will take more than that to rebuild. so right now, the residents' lives are up in the air. they have no idea where they will be living for the next week, month and year.

tara moriarty, ktvu channel 2 news. happening right now, round two for the u.s. supreme court on the issue of same-sex marriage. this morning, the court takes up the federal defense of marriage act known as doma. kyla campbell is outside of the supreme court building right now to tell us what this case is all about. kyla? >> reporter: dave, those oral arguments get underway. they are scheduled to last for two hours. while the justices hear those arguments inside the supreme court, take a look at the crowd growing outside of the supreme court. we're seeing plenty of protesters on both sides of the defense of marriage t issue. now, the defense of marriage act is receiving them from receiving 11 benefits. the justices could determine that doma is unconstitution am and that means same-sex chums

in states that -- couples in states that recognize this could start to receive benefits. the second, married couples could continue to keep being denied benefits. the arguments are getting underway inside the supreme court. they are scheduled to last for two hours. we don't get a decision probably until late june. reporting live in washington, kyla campbell, ktvu channel 2 news. >> thank you, kyla. supporters of same-sex marriage are being encouraged to wear the color red or use red in their social media. the group human rights campaign changed its logo for this week. it's usually a yellow background but it's been changed to pink.

slult vodka post -- absolute vodka put red around their bottles. for more information, go to ktvu.com and click the same-sex tab. well, this morning, big changes on the golden gate bridge. for the first time in 76 years, there are no toll collectors out there. ktvu's brian flores is there in san francisco to show us how drivers are adjusting to the -- there you are -- the all- electric toll system. how is it? any problems so far? >> reporter: so far so good. this marks a new era for the golden gate bridge. cars moving through at about 25 miles per hour. but technology has definitely taken over the iconic structure as tolls will no longer be collected physically here at the bridge. around midnight, the last human

toll taker left her booth from a small group of people. for the first time, tolls across the bridge will be taken through prepaying, transponders or scanners that will gather your license plate and you will get a bill later in the mail. the golden gate bring authority says the move stream lines costs and traffic at the time, thus eliminating the need for a human toll taker. before they left, they were given gifts and thank yous as well. we talked to a few of them who say this is emotional. in terms of today, there's issues that the chp is noticing on this first day of this. here's what they had to say -- >> the problem that we're addressing right now is speed coming through the toll plaza. obviously with this new system we have less of a backup during the commute time. typically lighter traffic can lead to higher speeds which is something we're noticing at the moment. we want to remind everybody, 25 through the toll plaza. please watch your speeds as you are coming through.

>> so far so good. the main thing is keep going but slow down a little. >> reporter: now, signs are posted before you hit the bay bridge about the change. the golden gate bridge authority says they expect a bit of confusion this week. that's why they will be out here this week taking a look at the traffic patterns and answering any questions commuters have. as we take it back out here live, not only is speed a problem, they also have a loudspeaker. another issue that they are having, people are just so used to paying the tolls that they are stopping and that could be a problem as well. the speed going through here again is 25 miles an hour. but so far, so good. for the rest of the traffic, let's go to the eyes and the ears of the bay bridge, sal. >> good morning, brian. there's not been any problems yet on the golden gate bridge. let's take a look at the bay

bridge toll plaza. this commute looks pretty good. remember, this is spring break week for some. some schools have time off. other schools have time off approach, the easter holiday. so you might see better-than- usual commutes. we're already beginning to see a little bit of improvement at the toll plaza. kind of early for wednesday. we'll take it. westbound, about a 10-minute delay. this is a look at 880 northbound and southbound. as it goes, after doing this for a long time, thursday and friday before easter, friday is good friday. a lot of people will observe that. also the morning commute in livermore hoos been slow. it's very slow coming in off the altamont pass. no major problems on the way. but it will be better by the time you reach dublin. let's go to steve. for those of you puttering around the house, there's your day. take a look at the screen. you can see a couple of breaks in the clouds. it's been a little bit of drizzle. very mild lows unless you are right on the coast. it might be foggy and cold.

what they call a guerrilla art campaign. the group has been painting offer and writing their own political messages. the ads by a group include inflammatory quotations by osama bin laden and others. critics say they are hateful and antimuslim. 7:14. california may soon play a key role in testing drones. 50 states from 50 teams from 39 states are bidding to test the drones for the federal government. two front-runners reportedly are aerospace companies from the san diego area. the drones have been used overseas for military operations but now there is a push to fly droebs domestically for things like fighting wildfires and for law enforcement operations. the city of oakland wants to limit the way pay of a -- pay of a man hired to oversee the reforms of the police department. thomas frazier was appointed by

a federal judge this month. he's in charge of executing court-mandated reforms from the riders police corruption scandal. his base salary, $270,000. he can also convert $18,000 in medical care and executive leave to cash. the dispute, though, is over retirement benefits. the city says he should get another $10,000 a year as a part-time worker but frazier reportedly wants almost $70,000 in pension. a bit of a surprise in the south bay. the home of the sharks has been called the hp pavilion and janine de la vega is here to explain why that name could soon be a thing of the past. good morning, janine. >> reporter: good morning, tori. there are reports that hp may be taking the hp off the arena. the naming rights deal is scheduled to end in 2016. with that said, the mayor spokeswoman said in the coming year they plan on exploring

alternatives. the tech blog all things digital is reporting that meg whitman wants to get out of the deal as early as this summer. hp's personal computer sales are reportedly declining and insiders say hp is re- evaluating how it markets itself and what it chooses to sponsor. right now, hp pays roughly 3.1 million a year for the naming rights to the arena. s.a.p., it's reported, is taking over the rights. thousands of hockey fans fill the arena during the nhl season. it's also the main venue for concerts. workers chimed in about this latest news. >> i've seen names of the arenas all around the bay area come and go, and i don't know. it's her prerogative. she has a lot of money. she can do what she wants. but hp is pretty easy to pronounce. i like that. it's not hard to say and that's what everybody has come to know it as. >> reporter: the city council

would have to approve a change in the arena's naming rights. the city manager is responsible for those negotiations. we are still waiting to hear back from that department. the mayor spokesperson told me that the city is optimistic that it will end up in a position that is mutually beneficial for everybody but she also told me that to her  knowledge the mayor's office has not been contacted by hp or s.a.p. on this issue. again, we're still waiting to see if we get any more response from the city manager's office as if they could confirm anything about this report. reporting live from san jose, janine de la vega, ktvu channel 2 news. 7:18. the sacramento city council has approved an arena deal aimed at convincing the sacramento kings to cancel plans to move to seattle. our reporter brian hickey live in sacramento now to tell us about that vote last night and what is next in the battle over the kings. >> reporter: it's not over yet. this is a major step forward

but not done, with the city council voting 7-2. this is the downtown plaza in downtown sacramento. la nightthe council voting 7-2 to join in on the deal and let out a cheer at the same time. >> let's do it! [ cheers ] >> reporter: the 7th and final vote coming from the former nba all-star and mayor of sacramento, kevin jon, agreeing to this deal to build the arena here. the city would be responsible for $258 million from that. the rest would come from investors. all pitching in to put together a counteroffer to keep the sacramento kings here in sacramento after the maloofs joined into a deal with investors out of seattle to sell the team and relocate there. but sacramento not going down without a fight. now, this deal will have to go before the nba board of

governors. they will decide who gets the team. and this will all happen on april 3rd and then april 18th and 19th is when the nba board of governors is expected to vote on this deal and again decide whether or not the team will go to seattle or stay right here. but at this point, the city of sacramento feeling very confident they've offered up everything that the nba wants to see, an arena and then coming up with deep-pocket investors to make sure they have the backing. brian hickey, ktvu channel 2 news. >> thank you. california lieutenant- governor gavin newsom is a sought-after interview as the supreme court hears arguments on same-sex marriage. newson, a supporter predicts how he believes the supreme court will rule on proposition 8. >> i think they will uphole the 9th sir -- uphold the 9th circuit appeal court and i

happening right now -- the u.s. supreme court is hearing oral arguments on another same- sex marriage marriage case. rene marsh is there live. this morning's case really has to do with denial of federal rights or federal benefits for homosexual couples, right? >> reporter: absolutely, toeshry. good morning. second day, second case is involving same-sex marriage and it's underway right now, those oral arguments. they are looking at the federal definition of marnl and how that im-- marriage and how that impacts benefits they get like social security benefits and

other spousal benefits [chanting] >> reporter: the crowd outside the supreme court is large, passionate and they have a message. >> my family like everyone else's denies full fundamental right the! >> right -- rights! >> reporter: the opponents, not as vocal. they converged outside of the supreme court as the nine justices heard oral arguments on the constitutionality on proposition 8. the justices' decision could impact families nationwide. >> there's some 40,000 children in california, according to the brief, that live with same-sex parents. the voice of those children is important in this case, don't you think? >> you want us to step in and render a decision based on an assessment of the facts of this institution which is newer than

california's ban on same-sex marriage. but many justices seem to even question whether or not the court should take up the issue. >> i think it was important and interesting that so many of the justices asked a lot of questions about whether the sponsors to prop 8 have standing which suggests to me there's a real possibility the court will end up not issuing some broad ruling. >> if the court decides not to rule on prop 8 that would likely mean lower court rulings declaring the measure unconstitutional would stand and that would mean that same- sex marriages could resume in california. we're not expecting to hear the decision until june. for more on the legal battle over same-sex marriage, go to ktvu.com. we posted the full transcript of the prop 8 oral arguments. click the same-sex marriage tab. and 8-year-old girl shot in the leg with an arrow yesterday in berkeley is recovering this

morning. it happened during a field trip to berkeley's lawrence hall of science. it happened around 10:00 a.m. while she was playing outside on a whale replica at the center. investigators don't know if it was an accident or intentional. they are trying to determiner where the arrow came from. the -- determine where the arrow came from. the arrow was removed from her leg. richmond leaders say a new partnership could lead to better community health in the future. the city is teaming up with contra costa county, the west contra costa county unified school district and the california endowment. the richmond health equity partnership wants to improve open space. they want to put more local health services in schools that serve lower income communities. they think all of these efforts could reduce violence. bay area transit leaders will hold a special meeting to discuss the latest construction problem on the new bay bridge. it is rather alarming.

claudine wong joins us live from treasure island. this problem involves bolts. >> reporter: that's right, bolts that snapped when they tried to tighten them. that's how they discovered the problem. this meeting at 9:30 this morning to give the board members of the metropolitan transportation commission, trying to give a real idea of the type of problems they are dealing with. take a look behind me, you can see the suspension cables coming from the tower, just to give you a reference point. and you follow those cables all the way down as it approaches oakland, that's the area in question. we have newschopper2 out here to give you a different view of the situation. it gives au look from above just where we're talking about. again we're talking about where the bolts connect the cable to the road deck and then down below and as we can -- as we pull out of this area where

they were tightened. the crews were in the process of getting everything together when they discovered this problem. we talked to the mtc this morning about what the bolts were supposed to do. >> the job of the bolts, if you will, is part of many systems that tie down the -- the road deck to the -- to the supporting pier below, which is known as pier e2. >> reporter: okay. here's a graphic to help you look at pier e2. to the right you can see where the pier is identified. this is just a connecting point that kind of brings everything together. there are 30 bolts in question right now. but 288 of these same kinds of bolts throughout the bridge, so the question is, are any of those other bolts compromised? they plan to do materials testing. they've kind of narrowed down the problem to hydrogen that might have gotten into the materials that's causing this to be more brittle and so they

want to make sure there's no high trojan in any of -- hydrogen in any of the other bolts. these bolts are huge. they play a big role. the commission said they see thises is a problem and a cost to fix, anywhere from $1 to $5 are estimates right now. claudine wong, ktvu channel 2 news. >> all right. in overnight news, a contra costa county sheriff's deputy crashed a patrol car while rushing to a call. it happened on san pablo avenue and richmond parkway. the patrol car flip on the side when the deputy swerved to avoid an oncoming car. the officer was treat for minor cuts and bruises. we want to check in with sal. >> we have slow traffic crossing milpitas getting out to interstate 880.

you can see it's busier than it was a few moments ago. so this is the heart of the morning commute. montague expressway is also slow. and 880 nearby is slow as well. speaking of 880 between hayward and fremont, you will see slow traffic. it's increased. it's almost doubled from the first time we checked. 35 minutes from 2238 to mowry avenue. if you are driving in contra costa county, it has not been all that bad. 680 on the freeways. 80 this morning, moderate traffic from pinole to richmond. at the bay bridge toll plaza, we have about a 15-minute delay. it has not become any worse and i think as we get closer to easter, some people will start to take time off and you will see lighter conditions. let's go to steve. thank you. pretty good fog bank in place. it's up around 1500, 3,000 feet. we have reports of drizzle mainly in marin county north and light rain to the extreme northern part of the state. a little system picking up fog bank and increasing it.

not over yet. >> it was unanimous. the council voted to ban outdoor cultivation of marijuana and any marijuana you can see through openings suched a windows. the majority of the people who showed up to the meeting last night were against the ban. one man showed us video of indoor plants he says he grows with pashens and he says this will hurt people. >> it will increase the price, increase the scarcity. >> the ban includes plants grown for medicinal reasons. 50 other cities and counties in california have implemented ordinances limiting or banning outdoor marijuana growth. coming up next hour, we hear from an attorney who says the ban on growing pot will help keep families safe from crime.

dave? >> thank you, pam more trouble for popstar justin bieber this morning. now he's being vecketted for at -- investigated for battery allegations with a neighbor. he says he was confronted by a neighbor because he was driving his ferrari erratically through the neighborhood. that allegedly led to punches being thrown. but bieber's spokespeople deny that. no arrests have been made. the investigation continues. the city of san leandro is offering a $10,000 reward to catch two people who killed a mother-in-law. investigators say the mother-in- law was unloading her car when two robbers attacked her. they shot and killed the man when he came out of the house to help her. in one hour, four people suspected of killing a

suspected pimp are expected to be formally charged with the shooting of calvin sneed last summer. prosecutors say the paumpts of a 17-year-old girl and two others killed sneed because he forced the girl into a life of prostitution. the d.a.'s office calls this a case of vigilante justice. lawyers for the defendants say they are convinced their clients will be acquitted. 7:47. a follower of charles manson accused of trying to help the cult leader. 63-year-old craig hammond was arrested sunday. the charges include conspiracy and possession of an illegal communication device. now, investigators say hammond tried to sneak a cell phone into charles manson at corcoran state prison. man son has been caught -- manson has been caught twice with cell phones in prison. hammond fabses up to six -- faces up to six months in jail and a $5,000 fine.

on a pedestrian bridge over highway 29. firefighters put the flames out but the man died at scene. investigators say because of all of the burns he suffered, they still don't know his age or ethnicity. they have to wait for the results of an autopsy. san jose police now have a sketch of a woman who stole a jeep that had an 11-month-old baby inside. take a look. she's described as latina, about 5'5", weighing 160 pounds. she's said to be in her late 30s or early 40s. this is a case that we covered extensively monday morning. police say this woman stole the jeep from a home on amador drive monday with the baby inside. the vehicle and the baby girl were recovered a few hours later and the baby was not harmed. santa rosa police are investigating a bank robbery that could be part of a string of crimes. yesterday afternoon, the u.s. bank inside the safeway on mendocino avenue was robbed. police say the robber demanded

cash and left. they say no one was injured and no weapon was ever seen. police say this is similar to other bank robberies in the area but have not confirmed whether they are related. 7:53. sal, come on back. a lot to talk about for the morning commute. >> i just looked at the chp commute. i just got report of an accident at 101 at the yerba buena offramp. that's new. 880, southbound, you can see traffic is a little bit slow from 238 to mowry avenue. it's getting a little et berbut not -- a little bit better but not much. as we move the maps over to contra costa county, slow in antioch and slow in concord on highway 4. out to the bay bridge toll plaza, that's improved quite a bit. this is a little early for the improvement. we'll take it, thank you very much. as we get closer to easter sunday, some schools have a break this week and some have it next week. moving to the 280 commute

early-morning fire that happened in san francisco. this one started about 1:00 a.m. at third and mckinnon in the bayview. ktvu's tara moriarty has been there since 4:30. it was really flaming and, tara, there are barricades up now. >> reporter: that's right. one of the buildings has actually been yellow tagged. there are three buildings according to firefighters. technically, there were two but it looks like one had an add-on so they are counting it as three. this pink building looks like it is falling in the street. that's where firefighters put up the barricades because it's in danger of collapsing. crews are still monitoring hot spots out here. arson investigator the should be arriving any minute -- investigators should be arriving any minute, this six hours after the fire began. >> where is this coming from! >> reporter: part of the challenge in tackling the flames was a gas line that needed to be turned off. it took pg&e an hour and 15 minutes to get the valves

switched. about two dozen people were able to escape. they evacuated from these two buildings. a bar had been renovated downstairs. that also burned. flames broke out just before 1:00 this morning and everyone got out safely. but it was a close call. there was knocking on doors, people said that they grabbed all of their stuff and just tried to get out. there was another resident who said the flames were so hot that he had to stand back and they kept getting hotter and hotter. a lot of crackle be and electrical wires sparking. the fire appears to have started in a garbage chute. two firefighters received minor injuries, one hurt his knee and elbow. another suffered smoke inhalation, but both with doing fine. the evacuees are at a house nearby where the red cross is trying to find them temporary housing. investigators have not released the official cause of this fire. we understand one man has been detained. we don't know if he will be

arrested for arson. he arnt paintly had -- he apparently had a dispute with the landlord. the owner says he will not be able to rebuild right now. these residents, at heat two of them -- at least two of them children that we met, really don't know where they will be living. tara moriarty, ktvu channel 2 news. the u.s. supreme court is, once again, hearing oral arguments on same-sex marriage. this morning, the case is the federal defense of marriage act. kyla campbell is joining us now outside of the supreme court building and has more on an 83- year-old widow at the heart of this case, kyla? >> reporter: yeah, dave. right now, the supreme court justices are hearing the arguments on both sides of the defense of marriage act. as you can see we're outside where the action is happening. we've seen protesters on both sides of the doma debate.

right now, traditional couples are only recognized. the fight now for these people out here today who support same- sex marriage want those benefits to be extended to same- sex couples. all of this is based on a woman, edith windsor, whose partner of more than 40 years died and she had to pay more than $360,000 in taxes because of doma and the language of doma in inorder to inher hit her -- in order to inherit her partner's eskate. we spoke to a man and he said these couples should be given the same benefits as traditional couples. >> how are you supposed to run your affairs? it's blatantly unfair. >> reporter: those oral arguments right now, we're about halfway through them.

neighborhood. construction is scheduled to be completed in 2016. oakland police say they are looking for a man who they say could be a child predator. this surveillance video shows the man on a cell phone. he's facing the sidewalk at 94th avenue and b street. police say the man walked into the front yard of a nearby home and tried to abduct a 9-year- old girl. when she screamed, family and neighbors came outside. police say the man left in a silver honda. 8:04. police increasing patrols at the richmond b.a.r.t. station, that's after the deadly shooting outside of the station earlier this month. there will be one b.a.r.t. police officer during the peak of the morning and afternoon commutes. richmond police officers will also patrol the b.a.r.t. station and will be riding the trains. all of these patrols being increased come after the fatal shooting of a man on march 14th. police are still searching for that killer. well, drivers of the golden gate bridge can no longer use cash to pay the tolls.

this morning, the bridge switched. it's all electronic at the toll plaza. brian flores has been out there in san francisco for some hours now. how is it going, any problems? >> reporter: no problems that we've seen so far. there is a little bit of issue with speed, dave. we'll get talking about that in a few moments. this marks a new era not only for the golden gate bridge but for the commuters and the visitors that will be visiting this iconic structure as well. traffic moving very nicely through here. first time i've seen this before as well as many residents as tolls will no longer be collected physically here at the bridge. >> have a good night vice president ! >> reporter: around midnight the last toll taker arrest. tolls will be taken through prepaying, fastrack or through scanners that will gather your license plate information and you will get a bill in the mail lateert. they say the move stream lines

cost and transportation thus eliminating the need for a human toll taker at the booth. before they left, some commuters gave them gifts and said thank you. we talked with a few as they left their post for the last time and they say it's very emotional. >> we're all very close. it's sad. it's sad but happy. we're onto a new chapter. >> people made this job what it is, yeah. a lot of kind people autopsy and i have my -- a lot of kind people, you know, and i have my memories and no one can take that a -- take that away from here. >> reporter: the authority says they expect a little bit of confusion this week. they will be out here as well as dhp. we've seen several chp patrol officers here. they will be -- they say there's issues with the tolls but also the increased speed limit going from 5 miles an hour to 25 miles an hour.

one chp officer says the other people are so used to paying the tolls so at least five or six cars have stopped thinking they still have to pay the toll. the other issue is increased speed. some cars, the chp says, have been going through the tollbooth at 60 miles an hour. be aware as you go through this morning. we're live here at the golden gate bridge. brian flores, ktvu channel 2 news. breaking news right now in san francisco. we've learned three pedestrians have been hit by a truck, sal? >> that's right. a garbage truck. our newschopper2 is overhead. it looks like the truck may have been on broadway making that turn onto embarcadero. three people were hit by this garbage truck, a woman, her child, another person. fortunately we've been told by police that this is the -- the injuries are not serious. nevertheless the people were taken to san francisco general hospital and that truck is still there blocking one lane on embarcadero and one lane on

because it burns less fuel on those trips. the cost of an airline ticket should be based on a passenger's weight according to one another weeken economist. he says that could discourage heavier people from flying. he adds a two-pound reduction in the total weight of a plane carrying results in fuel savings of about $3,000 a year. critics say paying by the pound would be discriminatory. but southwest airlines already requires some overweight -- overweight passengers to buy two seats. what do you do? step on the scale? >> i may never get on a plane. scene at broadway and embarcadero, the truck we're talking about is now pulled over to the side of the street. they just moved that from this intersection within the last couple of minutes. i did talk to san francisco police and here's what we know happened -- it happened about a half-hour ago or 45 minute the ago, the struck was -- minutes ago. the truck was coming down broadway was taking a right turn on the embarcadero. the grandmother and the child were in the crosswalk when they were hit and then multiple calls went out for help. again, we do not know their condition right now. if you take a look at the area from newschopper2, you can see a lot of traffic here. this was backed up pretty far a short time ago as they were trying to clear up the scene and really take care of things out here. we know that san francisco police have talked to the driver. they've taken a recorded statement from the driver. as far as we know, we're not clear if there will be charges filed or where the situation stand right now.

marriage tab. 8:33. bay area transit leaders will hold a special meeting today to discuss a big bolt problem on the bay bridge. caltrans tells ktvu news that 31 giant bolts on the new east bay span have snapped and it may need to replace nearly 300 bolts once the entire repair project is completed. despite the iron, caltrans says the bridge is still safe and the bolt problem will not delay the scheduled opening of the bay bridge on labor day weekend. in overnight news, a contra costa county sheriff's deputy crashed a patrol car while rushing to a call near san pablo. it happened around 1:00 at san pablo avenue and richmond. the car nipped on its side when the deputy swerved to avoid a car. the deputy was treated for minor cuts and bruises. we want to update you now on our breaking news from san francisco. two people hurt this morning, an accident involving a garbage

truck. ktvu's claudine wong is right near the scene, right near broadway and embarcadero. what do you know now, claudine? >> reporter: well, we just checked in on the status of the two victim, a grandmother and 7- year-old child. we don't know exactly how they are doing but we're told they are responsive. witnesses said they were responsive so that's good news. we're hoping the injuries are not serious. we want to give you a look at the situation here. you can see the police cars are still parked along the side of the road because this investigation is still getting underway. in front of the police cars is the garbage truck in question. it's been pulled over to the side and the commercial investigators are coming out here from sfpd. if we want to the sidewalk, you can see some folks wearing some fluorescent-colored vests. there's a gentleman wearing a hat. that's the driver of the vehicle. it all happened around 7:30 this morning. the grandmother and 7-year-old child were walking in the crosswalk, walking across the

street when this garbage truck took a right turn. that's when they were struck. we did just talk to an officer with sfpd about what happened? as far as charges, usually there's no charges. this would be civil. we still have to give the comergal vehicle -- commercial vehicle a level one inspection to make sure there's no mechanical defects. i still have to speak to several witnesses before any fault determination is made. >> reporter: at this point, it appears that we're dealing with just an accident. they say the driver has been very cooperative. they are coming out to talk to him right now. you are taking a look at newschopper2 as it flew over the area earlier when cars were backing up. san francisco police have reopened this intersection now so we have seen traffic moving at least through where we're standing at this point. if we come back out here live, we expect some activity through here for at least the next little bit here as the investigation continues. an interview still needs to get

underway. they still need to deal with the truck. as far as getting this area back hope, that's already happened. that's good news. we know sal castanedo has been watching the traffic moving in and out of here keeping an eye for drivers how to best get around. sal? >> you can use battery street instead of the embarcadero to get to that general area. as claudine said the lanes have been reopened. the police are there, it could be causing a backup as police see what's going on. if you want to go through and you don't want to be in that area, you want to go through that slowdown, you might want to think about using battery street. let's go out to san francisco freeways, that looks pretty good approach, the 80 split coming into san francisco. also this morning, we're looking at the bay bridge. that's cleared out early, westbound, some spring break action may be to blame -- to help our commute. and if you are driving on 80 westbound we've been watching that commute. it's been moderately heavy.

we've been watching hayward and fremont. that's heavy. we have a 30-minute backup from 238 to mowry avenue. let's go to steve. multiple layers of the clouds here. a lot of low clouds this morning. had some drizzle. i think that will be back tonight, tomorrow morning as well. and then we'll focus our attention for the weekend. had some drizzle. parts of the bay. still an onshore bush. everyone is coming in from west to east. that's giving us a low cloud deck. a little system to the north kind of helping push that in. 40s and 50s, it's already very mild. oakland airport 55. i think this is a sign of things to come. 40 in rena, 52 monterey. 50s, 60s down in southern california. one little system here kind of rotating around. a little cloud cover has to work its way in tonight and tomorrow. that's the low that will play into our weekend forecast. i think we're all right friday and saturday. sunday looks iffy. today, partly sunny, partly

killed near stern grove earlier this month. investigators say karen brewer was -- kieren brewer was under the influence of alcohol when he hit the teen. he pleaded not guilty to felony charges in connection with the death. the debate over what to do with polk street in san francisco continues. last night another community meeting was held on what to do when the street is repaved in 2015. proposals include adding bike lanes and small grass areas. critics say this could reduce the number of available parking spaces. supporters say it would bring in more business. 8:41. a royal battle over the kings. >> let's do it! after the dow jones had its biggest gain in three weeks. investors are watching to see if cyprus can restore confidence in the banking system. they are also keeping an eye on italy where political parties are struggling to form a new government. the dow is down 37. the nasdaq, down 7. s&p, down 4. 8:44. let's bring you up to date on some of the other top stories we're following for you right now. right now, the u.s. supreme court is hearing oral arguments on the defense of marriage act. it's a federal law that denies federal benefits to even legally married same-sex couples. now, legal arguments should be wrapping up any minute now. if those parties involved hold a news conference before the end of the newscast, we'll broadcast it and bring it to you live. also, the golden gate bridge now is on an all- electric toll system. at misdemeanor night, the toll collectors left their booths for the very last time. you drivers can pay your toll

through fast track or have your license plate scanned and get a bill in the mail. in san francisco, two dozen people are now homeless after an early-morning fire in the bayview district. it started before 1:00 a.m. at third and mckinnon. tara moriarty has been out there since 4:30 this morning. you are back now. an arson investigation is underway, tara. >> reporter: that's right. the building that caught fire are now yellow tagged. this pink one behind me has a facade that you can see is almost looking like it will drop there so they've actually barricaded that part of the street off. crews are still here monitoring hot spots. arson investigators are expected to arrive very shortly. trying to figure out exactly what sparked the fire. >> where is this coming from? >> back room. >> reporter: it took crews two and a half hours to contain the

flames that broke out just before 1:00 this morning. the deputy chief says part of the challenge, a gas line that took pg&e and hour and 15 minutes to shut off. about two dozen people were able to escape. they evacuated the two apartment buildings with flats one on mick conditionen and one on third. a bar that had just been renovated was also burned down. >> the alarm was going off. all i did, i -- i have been in a fire before. i was up on the roof. i mean, i just -- i just grabbed whatever i could and i just flew up and everybody else was flying behind me. >> it got hotter and hotter, you know, and the flames started to shoot up. we were across the street and you could feel the heat from the flames. >> reporter: the fire appears to have started in a garbage chute sandwiched between the two buildings. two firefighters received minor injuries. one was hurt in his knee and

elbow. the other suffered minor smoke inhalation. both are doing just fine. the evacuees are being placed in temporary housing by the red cross. they've not released the official cause. we understand that one man has been detained. we don't know if he will be arrested for arson. but neighbors say he had an ongoing dispute with the landlord. the opener says he cannot afford to rebuild. we saw him walk in a few minutes ago. he said his insurance only recovers $1.5 and that won't be enough to cover the cost of the three buildings. so now the people who have been evacuated really have to think about where they will live next. tara moriarty, ktvu channel 2 news. >> thank you. 8:48. not in my backyard. that was the message in concord over marijuana. kight's pam cook is in the studio now -- ktvu's pam cook is in the studio with more. >> it was unanimous at the city council coup meeting in concord in the -- council meeting in

concord in the fight over marijuana. the council voted to ban outdoor cultivation and ban any plants you can see through a window. one man showed us video of plants grows with patience. critics were vocal saying growing pot leads to crime. >> if there isn't some restriction put on it, this becomes a magnet for other people to come into the area from the surrounding communities. >> visible ploonts are an invitation to break-ins and robs -- robberies. >> 50 other counties limit or ban outdoor marijuana growth. unless there are any legal challenges, that ban is expected to be in place in about two months, violaters will be cited for public nuisance and fined. 8:49. rohnert park thanks to a new

casino is getting a $40 million shot in the arm. yesterday, the city council approve an agreement with the fed rated indians of rancho rio. it's intended to address concerns over the casino the tribe is building. if the casino earns as much as expected, it will pay $251 million to the city over 20 years. the casino's due to open late this year. ten minutes before 9:00. an environmental group wants yosemite national parknd the golden gate national recreation area to stop setting bottled water. they want to encourage people to use tap water instead. 14 national parks have banned the sale of bottled water. later the group will hold a meeting at crissy field and try to get support from the park's superintendents. google's street view is getting a rare look into japan's nuclear zone. this is the city of nami.

his spleen was ruptured. but he did safely stop that bus and believe it or not, none of the 26 passengers on board were hurt. back here at home, sonoma county, close to adopting some new rules for taxicabs. reported supervisors unanimously approved this ordy naps. a second meeting is scheduled next month. it will take effect 90 minutes later. the sheriff's office would start to enforce this in october to allow time for public outreach and public education. the new ordydy naps deals with safety issues -- ordinance deals with safety issues for permits on those drivers. the supreme court is still hearing oral arguments on doma. people inside the courtroom are tweeting and blogging about what's going on as we're looking at a live picture outside the court. here is some of what we're hearing. apparently, just like with proposition 8 argument the
