burglaries, robberies and leading deputies on a chase in a stolen suv. the man allegedly stole the seb in windsor this morning. deputies spotted him in petaluma and he took off on petaluma point raised road and ended up in the community of what acre in marion county. deputies used the stolen suv onstar system to track the seb to what acre at one point the deputies fired tasters at the man but missed. >> prior to fleeing the area he made an attempt to harm law enforcement. >> >> the search of the call that because authorities say the wooded area, the suspected hiding in, is to dent to go in after him. for the second time in less than 48 hours there has been an officer involved shooting in oakland. ktvu eric rasmussen joins us live at the scene of west oakland with what he has learned eric? reporter: julie, please say it turns out the suspect was holding what they say is a very realistic looking replica gun. they get taken down most of the crime scene tape out here but

some police are on the scene and in the last hour, the suspect brother showed up demanding answers. our camera was recording as the man had a heated conversation with police near the scene on 43rd street ear and chess that. he just wanted to know the hospital where his brother, 31 -year-old sean cherry was being treated. he did not dispute cherry could have been involved in the burglary at a nearby home. police say an officer shot him once in the shoulder when he pulled a gun, it turned out to be a replica. two nights ago a veteran oakland police officer, shot an unarmed 16 -year-old in the face while investigating a robbery. turns out rainer had nothing to do with it and today his family hired high-profile civil rights attorney john burris who says they will likely sue both officer and police department. >> .-dot officer misconstrued the facts or was trigger-happy, in any event there wasn't any basis to pull the weapon and certainly not any basis to shoot the

weapon. reporter: oakland police say they've launched a full investigation in that case. as for the shooting today police say they arrested the man and a second suspect who was found with the knife again back here live police finishing up their investigation the sergeant we talked to today said this has been a difficult week in fact we are told a chp officer was actually shot at while patrolling oakland last night. five in oakland eric rasmussen ktvu channel two news. >> police in san jose say a mistaken identity may be behind the shooting is set a disabled man to hospital early this morning authorities say at 7:30 this morning they received a report that the 34 -year-old victim had been shot near his home between south white road and mountain vista drive. police say three men in a blue four-door honda approached the man asked him if he belonged to again he said no but someone in the car shot him anyway, twice in the stomach. >> there has been evidence found, some blood located we are

2 the father of the santa clara county paramedic who was shot in the head in the oakland hills spoke with us today about the family's heartbreak one day after his son's death. roger boyer says his 34 -year-old son, quinn boyer married a fellow paramedic last year and just last week was accepted into stanford's program for physicians assistants. that was all lost when a gunman shot boyer in the head at the intersection of keller and hanson on tuesday. >> i have had two joys in my life. one was my daughter and one was my son. i have lost my joy for my son. >> please continue to search for boyer's killer his family has decided to donate his organs. >> state regulators today cleared the way for chevron to resume operation of its crude oil processing unit that was damaged during a huge fire at the richmond refinery last year. the announcement comes eight months after the massive fire

reporter: at children's hospital oakland today in a special floorboard 24 -year-old luis robbie showed me some of the painful and aggressive tumors killing him. the cancer is rhabdomyosarcoma, it is rare, current medicines don't work well especially for his internal and external tumors tumors. >> they didn't have a way to treat both at the same time. but, there was a clinical trial at ucsf. reporter: doctors recommended he take part in the drug file in fact ucsf is holding a spot for him in the trial specifically for rhabdomyosarcoma. his health insurance is through his father's work at sutter health. third-party administrator called u mr sent a letter saying since ucsf is outside the health plan network, only emergencies are covered and nothing experimental. luis says he was referred to
