the boy is right now, good afternoon, alex. >> reporter: well, that boy is actually being held in a juvenile facility and i spoke with prosecutors who are reviewing evidence in this case and they have yesterday to charge this boy with the murder of leila fowler. a short time ago, i was told by a sergeant that leila fowler's parents want to make a public statement following the arrest of the brother and that could happen in the next couple of days. the brother seen at a vigil is now accused of stabbing her to death. the superintendent tells me the boy is a 7th grader at the middle school and teachers never saw any behavior that could cause concern. >> clearly there was nothing in

the past that i would see or think to see any behavior like this. >> reporter: parents are in disbelief after hearing leila fowler's own brother was arrested for the crime. >> i was asking him, did you know him and he was like yeah i knew him and he had friends but it's just -- it is just a shock. it is crazy. >> reporter: nobody was home this morning at leila fowler's house and only a large rental truck was parked outside. the little girl was killed here more than two weeks -- only two weeks ago, the only one home at the time. initially he said he saw a man running from the house and found leila fowler dead and that prompted a manhunt but just this weekend, leila fowler's brother had been arrested for the crime. a sergeant would not tell me if the boy had confessed to the crime and he also would not talk about the possible motive

ireland. a weekend of planning came -- planting came to an abrupt end after a controversial piece of land was talked about. here is new video of what has been happening since we first brought you this story on mornings on 2, good afternoon brian. >> reporter: there were 30uc berkeley police officers and many activists, and they left about 45 minutes ago and the activists want this area for urban farming even though it is already slated for development. uc berkeley police this morning arrested four people for trespassing on a piece of land known as the guilt trap. they were the only ones who were later identified as friends of brook moran.

>> it is really -- the university should be looking at it as an opportunity to do something transformative and i am upset about how they are destroying a beautiful public project right now. >> reporter: uc berkeley police told the activists they had to leave because the land is owned by the campus. one was arrested for not leaving and just after 9:00, they brought in a tractor to mow the plants that were grown. one activist tried to jump on the tractor to try to stop it. >> they are doing illegal acts on our property. >> reporter: the piece of land is already slated for development. they are expected to break ground early next year. this is the last piece of

a fair trial. simpson is scheduled to testify thursday. they filed a last minute appeal allowing the sale of the morning after pill to girls of any age and a brooklyn judge made that because the age limit was politically motivated. a brooklyn judge agreed to postpone the enforcement of his order and the morning after pill will allow pregnancy if taken within 72 hours of unprotected sex. they are looking to allow a morning run in larkspur. they are suggesting adding a boat on the san francisco run to relieve over crowding. it also relieves the possibility of charging for, aing and at least one -- for charging for parking and at
