was somebody trying to attack a pg&e substation in san jose this morning? that's what pg&e and authorities want to know. we'll tell you about the suspicious activity that occurred here this morning. a deadly shooting in florida overnight. how the gunfire is tied to the boston marathon bombing. worse than i expected.

tired neighborhoods, leveled. >> a lot of people in moore, oklahoma going back to their homes after a tornaddisaster made history well, good morning. welcome to "mornings on 2." i'm dave clark. >> good morning. i'm tori campbell. it's wednesday, may 22nd. topping our news, new trouble at a south bay plant. early this morning, a suspicious man was spotted near the pg&e substation on metcalf and coyote ranch road. there were apparent acts of sabotage at that same plant last month. ktvu's janine de la vega joins us live with what we've learned about this latest incident. good morning, janine. >> reporter: good morning, tori. well, this suspicious activity raised a red flag because, as

you mentioned, this substation was attacked a month ago. there is a sheriff's deputy car. ever since that attack a month ago, they've had somebody stationed here all of the time. now, pg&e wants to know what was a man doing here at 3:00 a.m. in a field near the sun stakes. this all happened during a routine patrol. a man was shotted next to the substakes on coyote ranch and metcalf. they shined their flashlights on him and he ran away towards monterey highway. sheriff's deputies were called to help to search for the man, and a perimeter was set up but they couldn't locate him. last month, the substakes was fired at, causing oil to leak. they cut the fiberoptic lines which knocked out 911 service to gilroy and parts of the kuck-- of the county. that person was never caught.

a pg&e spokesman i talked to this morning said in light of this they are gonna can't to work with the sheriff's department trying to decide if they will do anything different in light of this happening. i spoke with the sheriff's department and they said once they hear from pg&e and if pg&e feels this was a real serious threat, they will continue to partner with them and investigate. janine de la vega, ktvu channel 2 news. 7:03. continuing coverage of the tornado disaster in moore, oklahoma. that deadly tornado killed 24 people, including nine children. our reporter, craig boswell, is in moore, oklahoma this morning to tell us why the search for more victims, craig, is ending. >> reporter: dave, good morning to you. yeah, this particular area we are in right now, right across from the hospital right here on this block, where you can see just devastation here. this is becoming a very busy area. they are moving heavy equipment in here to begin to remove a

lot of this debris. finally a break in the weather. the reason why they are doing this, yesterday they've gone through all of the structures, three, four, possibly five times. so search and rescue is no longer ongoing. that's transitioned into recovery and cleanup. brierwood school students reached out for loved ones as adults ran to comfort them after the massive tornado struck their building on monday. >> really hard. i thought i was gonna die. >> reporter: all of the kids survived, unlike some at plaza school which took a direct hit from the twister. seven children died there. take a look at these images before and after of the building. once standing tall, now reduced to a pile of rubble. >> unfortunately, there was people that lost their lives, little children that lost their lives. >> reporter: search and rescue efforts are coming to an end as the city's fire frill says he's confident there are no bodies or survivors in the rubble.

the widespread devastation is an overwhelming site for many. >> it's worse than i expected. it's -- you know, entire neighborhoods leveled. looking like sticks. >> reporter: some residents have been allowed to return to their neighborhoods, getting a closer look at the place once called home. they are searching through mounds of debris hoping to salvage what little the storm spared. >> it's just hard to imagine when they walk out of your house, and the next few minutes you come back and it looks like this. >> reporter: we're back out live now. finally, after this ef5 roared through here, it's a clear day. look at those crumpled cars. they are almost a foot pushed into the ground as is a lot of this debris. it's going to take a long time to get this stuff out of here. and knew that we finally have a clear day, families are coming in, beginning to their through this rubble, finding what they can, even the small mow --

the agent was taken to the hospital with non-life- threatening injuries. he said he was not involved in the bombings. >> they were pushing him. don't leave, don't leave. decided to stay. we had a feeling, worse case senator know, something like that -- worst-case scenario, something like that could happen. >> he said he knew tamerlan tsarnaev but he was just an acquaintance. looking into the irs scandal. one of the witnesses scheduled to testify this morning is lois learner. he's in charge of the irs division that handles tax- exempt applications. she's there. but coming up at 7:15 why learner's attorney said she will not be talking this morning. happening now -- back here at home, strong winds in the bay area in case you didn't realize it causing problems out there this morning. ktvu's tara moriarty is on the great highway in san francisco to -- you really have been

showing us some of the wind damage out there, tara. >> reporter: that's right. well, this happens a lot when the winds hit the great highway. right now, it looks more like ocean beach. these drifts, some of them are taller than i am. we can look over here to the right. you can see, this is the parking lot. this is where all of the people park. look all the way up. look how high that drift is over there next to the restrooms, extremely difficult. it's buried. the southbound lane of the great highway is shut down now from lincoln way all the lay to lake merced. generally, we're looking at 20 to 35-mile-an-hour gusts. some cyclists tried to ride through you this ended up walking their bikes. the winds toppled a 75-foot tree last night on northern avenue in mill valley and the tree landed right on top of the car. about 360 people were without power this morning until about

3:30. now, in berkeley, some heavy limbs fell on the 1800 block of sacramento seet, snagging some wires there. the branches hit a white van, damaging the hood and crews obviously busy removing the limbs none's power was affected. a high wind advisory was in affect for several bay area bridges this morning. that was canceled around 4:15. you can rest easy going across the span. just be aware that it is cold and windy, especially out by the ocean. so bundle up. live from san francisco, i'm tara moriarty, ktvu channel 2 news. >> tara, wearing her warm parka. she needs it this morning. let's check in with sal and see what's happening in the south bay this morning. >> we're starting in san jose, tori and dave, good morning to you, once again. northbound 280, we're looking at the traffic kind of grinding to a halt here as you drive through downtown san jose. it's been a tough one getting up to highway 17. no major problems all the way up to the valley. however, it is slow.

if you consider slow a problem, well, there are problems. if you are driving on the nimitz freeway, southbound, we've had slow traffic this morning between hayward and union city. the drive time, about 20 minutes from 238 to mowry avenue. have we mentioned the bay bridge? it's backed up for a 15-minute delay, west of the macarthur maze to the metering lights. let's go to steve. well, clear skies. that's the good news. very, very chilly lows. low to mid-30s. mendocino county, lake county, also in the north bay, even on -- on skyline and woodside, 38 degrees. my goodness. a little chill in the air. the visibility is good. that's nice. there will be sunshine for everybody. not as wind yip as everybody. sfo -- windy as everybody. sfo had a peak gust last night. monday, 80s and 90s. today, upper 60s or very, very low 70s. sunshine, very brisk lows for this time of year. the nights are short.

one report ofwood, 31. breezy to windy. i think it's more of the coast and the hills. 41 napa. they made it to 37 this morning, napa airport. 48 novato. 48 half moon bay with a north wind. cold and windy. cassie jean said it's a cold day on the coast. livermore, 47. there's some brisk readings this morning. temperatures will be -- if you can get a little north wind, slightly warmer. but i think there's too much of a breeze to keep things from warming up. 49 in reno. 45 tahoe. 41 eureka. just looking at seattle, it's 44 degrees with light rain. 30s with snow up in the cascades. amazing, even down to portland. we don't get that yet. there are signs, though, that next week a stronger system may drop into northern california. so this looks like a pattern that is here for a while. sunny and breezy. windy for some, but it stays

today. highs mainly, 60s or low 70s. very cool this morning. looks like this very cool pattern. it will be here for a while. all quiet here. it's way below average on the tein a e oklahoma weather, in fact, i think, i do believe -- there we go. maybe. a break in the oklahoma weather is giving a clear view of the devastation that occurred. it's clear there in the 70s today. so things are much calmer. one elementary school took a direct hit. the before-and-after pictures show the damage. some of the teachers are being called heroes. estimated winds between 200 and 210 miles an hour. the students laided on students to protect them and some of the students had to huddle together in the hallways to safety. we're now hearing about more reporters and even white house staffers. the justice department seizes

phone records of two white house staffers and five fox news reporters. it was part of a case the government was building against a state department contractor charged with violating the espionage act by leaking information to a fox news reporter. happening right now -- the u.s. house oversight committee is questioning top irs officials, including the woman who oversaw the tax-exempt division, that targeted conservative group -- groups. lois learner, though, is pleading the fifth. here's kyla campbell. >> reporter: learner's attorney advised her not to answer any questions from the house oversight committee. lois learner was talking mostly about her history with the irs and the position she's held. but again, she's not expected to answer any questions and one congressman spoke to learner's plan to stay silent. >> i'm disappointed, we will not be able to ask her

questions today. i believe that she could shed much light on what we're trying to find -- the truth. >> reporter: the maryland democrat says he respects learner's constitutional right and encouraged the rest of the committee to do the same. tough questions are expected from darrell issa of northern california. he's furious so many people now about this and did nothing. >> every single person who looked at one of these applications could have and should have been a whistle- blower. >> reporter: we will continue listening in on this hearing. we'll have the very latest testimony for you next hour. live in washington, kyla campbell, ktvu channel 2 news. 7:17. a congressional committee is due to vote on changing military law because of a growing epidemic of sexual assaults. the changes include banning commanding officers from changing or dismissing a court marshal conviction. another part of it requires

that service members found guilty of sexual offenses be dismissed or dishonorably discharged. congress is taking action because they say military leaders have not been successful with changing the culture within the ranks to combat sexual assault. a far-reaching immigration reform bill is now headed to the u.s. senate. with 13 yeses and 5 knows, the measure was passed yesterday. this bill would create a pathway to citizenship. also a new program for lower skilled foreign labor and would allow more high skilled workers in the country. the full senate is expected to take up the legislation after the memorial day recess. los angeles voters have approved new legislation to limit the number of medical marijuana dispensaries in the city. proposition d has received 63% of the votes from yesterday's election. the measure would limit the

number of medical marijuana dispensaries in l.a. to 135. currently, there are an estimated 1,000. in the meantime, in san jose, the city council voted to raise the city's tax on medical marijuana dispensaries. the marijuana tax will go from the current 7% to 10%. it's expected to take effect in july. a ruling earlier this month confirmed the rights of the cities and counties to ban or regulate marijuana dispensaries. santa clara county just agreed to a $5 million settlement in a distracted driving case involving a sheriff's deputy. now, last year, a 78-year-old man was badly hurt in a car crash in san jose. investigators say three things caused that deputy to take his eyes off the road. a mcdonald's hamburger. the officer was eating at the time of the accident. a radio microphone got stuck in the deputy's patrol car and a light switch he was trying to

turn off when he hit the victim's car. two innocent victims were hit in a car chase on willow pass road near highway four yesterday. police say they were chasing a blue suv involved in a burglary when the suv hit another car. two innocent people in that car were hurt. the driver of the suv was not hurt and arrested at the scene. people who live in san carlos will get a look at a revised proposal for a new development near caltrans station. plans include 280 apartment units along with retail and office space. a neighborhood group wants to limit the height of residential buildings to three stories. group also says the development is too dense and will worsen traffic in the area. the meeting is scheduled to begin at 7:00 p.m. at the loriola community center. a stanford professor is

facing parent-child abduction charges. police say she took her three children on a one-way trip to the hawaiian islands. she said it was a break down in communication with the two farce and had every intention of coming back. the children are in the ware of relatives and barron has been ordered to wear a gps device. a 6th grader from hillsborough will compete tonight in the nation's capital as one of the finalists in the national bee. the 12-year-old will be going for the top prize. it's a $25,000 college scholarship. his interests include international affairs, politics and baseball statistics. the contest focuses on history, landmarks and climates. well, the queen of soul, aretha franklin is taking a break for the month of june. after appearing last week on "american idol" she announced she will reschedule next month's show. she says she will resume her

park campus. the mother's been there for about a year. but it wasn't until recently that her three little babies were spotted. the foxes even have their own facebook page, of course. it has 11,000 "likes" so far. the company has met with fish and wildlife. the plan is leave the foxes where they are unless they start to bother employees or vice saw versa -- vice versa. hopefully, people will leave them alone. sal says it's a little slow out there. >> yeah, it is slow. the good news, we don't have a lot of crashes but we have a lot of slow traffic there. we showed you last time in san jose, it was slow through downtown. it has not changed. if you are thinking of using 101 instead, 101 northbound we have a camera near mckee. that's bogging down. it's not stop and go. but you is -- but you can sell it's below the speed limit. we've had slow traffic this

overnight news, san francisco police have arrested one man and are searching for another after a burglary at a private high school. ktvu channel 2 reporter claudine wong is live at the school on ocean avenue. she spoke to the woman who helped police make the arrest. what did she tell you, claudine? >> reporter: well, she talked about what she heard when police brought one of the suspects in custody. certainly, she said it scared her quite a bit. we're out in front of the high school. behind hee you can see -- a this point, the school is getting started as business as usual. it was after 3:00 this morning that neighbors saw apparently two suspects trying to break in. they called police and ktvu got on the scene just a short time later. let me show you what they saw when they got on scene. police making their way in and around the high school. the neighbors spotted those two suspects kind of going in and out of the school and it's all locked up. obviously, they knew something was wrong. they called police, police got on scene and one of the suspects tried to get away by

going in through the backyard of one of the homes in the neighborhood. it's when the neighbor saw that person or heard a rumbling she looked outside her window, apparently one of the fence boards had come down. she talked to us about what she heard. >> i saw they broke the -- broke my fence. >> reporter: wow. kind of scary. >> very scary because i am sound asleep. >> reporter: so what she heard apparently was, again, that arrest taking place right on her porch in the back of her house. that suspect taken into custody. they do not have the other suspect in custody yet but they are hoping to get that person in custody soon. apparently, they were after some computers, 15 or 20 of them, from inside the school. it's unclear how many they were able to recover. but we know we saw one backpack on the scene. our crews did, when they were out here. so certainly, it could have been a morning where the school

showed up and found a lot of their stuff gone. instead, it's the morning where any know neighbors that surround the school helped stop the thieves from getting away. claudine wong, ktvu channel 2 news. in overnight news, richmond police are searching for the gunman in a frightening shooting. it happened late last night on virginia avenue. police tell ktvu news a man with a gun fired more than 20 shots at a parked car. one man inside was wounded. his female passenger was not hurt. the motive is unknown. firefighters put out a big suv fire in oakland overnight. it happened on 86th avenue and e street about 3:30 a.m. there was no one in the vehicle. the fire likely originated in the engine compartment but police are still trying to figure out exactly how it started. back to our coverage of the tornado disaster in moore, oklahoma, now looting is making things worse. last night, two men were arrested, suspected of robbing

tornado-damaged homes. police say they recovered bags filled with stolen items. one homeowner called the police when he saw his belongings stuffed in the suspect's pockets. now, the state of oklahoma will soon issue an i.d. badge to homeowners with their photo on it. only photos with those badges would be allowed into neighborhoods. this tragedy is generating a lot of generosity. architecture for humanity is a san francisco nonprofit. they help communities rebuild from disasters. volunteers spent years rebuilding schools in haiti after the 2010 earthquake. well, the grip's reconstruction experts -- group's reconstruction experts are analyzing how buildings crumble after a tornado, they are hoping to rebuild to withstand tornadoes. salvation army has opened up several shelters. and the fire captain of fremont and others from this area are

there. if you want to help out, go to ktvu.com. in the hot topic section there a link to the relief organizations. she claimed two men tried to rob her and kidnap her son. but now a pleasanton woman is accused of making the whole story up. 23-year-old jennifer flores told police two men stole her purse. but police say she actually left her purse at a domino's pizza the day she reported it stolen. the camera shows her picking up the purse the next day. she was arrested for filing a false police report. a new safety device for guns was created in case they fall into the wrong hands. the company in capitola created a microchip that acts as a controller. it would trigger an alarm on the gun owner's cell phone if someone tries to move the open. the gun owner could punch a

button that automatically disables the firearm. the device costs $50 and $12 a year for a subscription. san francisco is considering adding another surcharge to sporting event tickets. brian flores is live to explain where the proposed fee would go. >> reporter: thousands of people take muni on a daily basis and thousands of people take muni as well as go to giants' games and to concerts. well, the supervisor, scott wiener hopes to bank on that. now, wiener proposes a $1 to $3 suhr charge that would be added to a concert or major entertainment event. the money would go for upgrades, rail cars, or at least upgrade the ones the system has. he also says he's looking at

the way the system is functioning, it's at a breaking point. this has already gotten mixed reaction. >> it seems like gas prices are going up. bridge tolls are always going up. i think to maintain our infrastructure if that's where it's going, i don't have any problem with that. >> reporter: there's even greater concern that public transportation may not meet the need if and when the new warriors' arena is built. the supervisor asked the city to study this. not sure when the assessment will be finalized but early estimates suggest that this surcharge would generate between 3 and $4 million. we're live here in san francisco, brian flores, ktvu channel 2 news. 7:37. tomorrow, the b.a.r.t.

board is expected to vote on allowing bikes on on board all of the time. they were allowed certain hours only. this has some lifting ban during rush hour. but they would like a five- month test period before making the new rule permanent. 7:38. hey, sal, you've been watching the toll plaza. it has not been looking pretty this morning. >> no. you know, it's been kind of a strange morning, dave and tori. we've had not that many crashes but we've had a lot of slow traffic. i would prefer that as opposed to a lot of collisions. but it's slow out there. backed up to the macarthur maze and the metering lights are on. we are expecting that this traffic will start getting better in june as people take summer vacations and schools are going to be out. in fact, a lot of graduation systems are going on this weeked a colleges and high

schools. let's take a look at the commute on the bayshore freeway. it's looking good. there is a little bit of slow traffic in san mateo. nothing out of the ordinary. southbound 280. san jose 101 is backed up from pretty much the capital expressway all the way up to sunnyvale. 85 is slow to 87 -- saratoga. northbound 280 is still very slow. it has not improved at all, really, since the first time we showed it to you this morning. now let's go to steve. >> those are probably leaving hp pavilion from last night. >> yes. having a little fun. >> yes. we have an unbelievably cool pattern maybe through the end of the month. there are signs maybe next week of a stronger low replacing one up in the pacific northwest right now. we're not getting any rain out of this system. we're getting the cool and the wind and below-average temperatures. it's sunny, coast, bay, inland.

you have to worry about blustery conditions and chilly lows. we had a lot of chill. the days will be sunny. not much of a warmup until the weekend. that looks like the mid-70s. so from the 90s on monday to the upper 60s and 70s. quite a difference. the morning lows were very chilly. napa airport, 37. 38 la honda on the peninsula. a lot of 30s up in mendocino county and lake county. in fact, a couple of reads near freezing. it was a -- it was a cold one. 39 reno, 45 tahoe. 46 ukiah. they were only 67 toker a high yesterday. cool air -- 67 for a high yesterday. cool air. raining in seattle and 44. portland, raining and 43. some of the higher elevations they are getting snow. next week we'll see if a stronger low drops in and does

7:44. stocks are opening higher this morning. u.s. home sales rose slightly to 4.97 million in april. that's the highest in three and a half years. inventories are jumping as well. right now, the dow is currently up 75. the nasdaq is up 14. and s&p is up 9. another reason the stocks are up, this man, he's speaking right now to -- this is ben bernanke. investors are listening very closely as he's speaking on capitol hill, updating a joint congressional meeting on the

state of the u.s. economy. heels telling congress that the u.s. job market remains weak and it's too soon for the federal reserve to end the programs. they will maintain efforts and that's good news for efforts. a silicon data storage company plans to eliminate hundreds of jobs. netapp will 9 -- netapp will cut jobs. the announcement came as the sunnyvale-based company reported increased sales. but netapp says higher operating costs outweighed higher revenue. gays in the boy scouts. that hot-button issue issue surfaces again. pam cook is in the studio to tell us about an important evision that should come down tomorrow. >> they are set to vote on whether or not to allow openingly-gay members.

the warmer weather here in the bay area, blamed for a rattlesnake bite. the sonoma county rescue center is getting a lot of calls this time of the year. most of the victims are dogs. they are saying if you are bitten, the best thing to do, wash the area real good with soap and water and head for a hospital quick. 7:54. people who live in vallejo can notify the city about potholes with their smart phones. they are asking users to provide with an app called c-

last month. janine de la vega is there. what have you found out? >> reporter: well, a sheriff's deputy is stationed here in front of the substation. here is normally here because every since the attack, they've contracted to have a patrol person here. but earlier, eight deputies rushed here to the scene after n wamaspotted in the field near the transformers here. at 3:00 security guards at pg&e spotted a white man in his 20s with a goatee wearing all black clothing across from the transformer area. they kinded their lights on i had. he ran a -- shined their lights on him. he ran away towards monterey highway. deputies say i did not appear to be homeless -- he did not appear to be homeless. that's why he stood out as suspicious. deputies already tightened up the substation because someone broke into the substation last month and caused an oil leak. they cut fiberoptic lines that knocked out 911 service. the person responsible for that

today's "chronicle" reports cram caltrans decided to -- reports caltrans decided to install the rods after learning they were approved for the richmond/san rafael bridge in 2001. however, the bolts were tightened too far lower tension levels than the rods installed on the bay bridge. experts say tension is a key factor in causing high-strength steel to snap, something that's already happened on the new bay bridge. the white house is honoring ten gay rights leaders today for harvey milk day, including a former lawmaker from santa cruz. john laird is california's secretary of natural resources. in 1983, laird became one of the first openly gay mayors of the country. he also served in the state legislature before being appointed to his current job. some groups are protesting harvey milk day honor, the first openly gaylamaker. one group is running radio ads,

motivate them to make the decisions they need to make right now to take those first steps to try to get a sense of normalcy back here in moore. >> the cleanup effort is not just to make it look nice but also in case some more strong wind. you could have more projectiles swirling around and doing more damage. >> reporter: that's the thing. that's why they have a curfew, not just to keep lootersers out, although that's-- looters out, although that's part of it. you don't want people in this debris, there's nails, metal. if you get strong winds whipping up, it will pick these things up as projectiles and be a very dangerous situation. >> and craig, you mentioned the 24 fatalities. is that final? we're not expecting anymore? there's no one missing at this point, correct? >> reporter: i've still not been given that word "final." they are 98% to 99% sure they've found everyone. they are just leaving it to the chance that they could run

with a gun fired more than 20 shots at a parked car. one man wounded, his female passenger not hurt. the motive is unknown. firefighters put out a big suv fire in oakland overnight. it happened on 86th avenue and e streets at 3:30 a.m. there was no one in the vehicle. the fire likely started in the engine compartment but police are still trying to figure out exactly how it started. 8:35. well, ticket prices may go up as much as $3 for big events in san francisco like baseball games, music concerts and more. it's a big story. ktvu's brian flores is in san francisco now to tell us about an idea where these extra suffer -- tell us more about these extra surcharges. >> reporter: thousands of people, as you know, take muni and thousands go to events and concerts in the city as well, well, supervisor scott wiener

hopes to bank on that and says his proposal for a surcharge would be a win-win. now, wiener proposes a $1 to $3 that would be added to a ticket from an event. the money generated would go towards muni, things like new rail cars or at least upgrades on the system it already has. wiener says he's looking at the way the system is functioning, it's at a breaking point. it's preliminary. but it's already got mixed reaction this morning. >> it seems like gas prices are always going up, bridge tolls are going up. i think to maintain our infrastructure, if that's where it's going, i don't have any problem with that. >> i agree. they overcharge us already. another $1, $3, it might seem minimal compared to what we pay. we already pay too much so i would not appreciate paying a

strike force underway right now. taking a look at vehicles with high-passenger capacity. that means limos, shuttles, they will bring buses in here. this strike force is basically looking at everything from permits to gas emissions. mechanical to make sure that people are not working too many hours. they actually do this, they say, once a year. but certainly, we asked them in the wake of that limo fire that killed five people if that was the reason for this event today. they said no, they have done this before but it's on the back of everything's mind. if you take a look in front of us, you have motorcycle officers and they go out and bring the vehicles in and then this multiagency strike force goes through their inspections. last year, they say they broughto take a look at, and again, these inspections go from top to bottom, everything from the vehicle itself, to the person behind the wheel to how many people are carrying to make sure they are not

just leaving a hearing that he was speaking to in washington, d.c. he was actually telling congress that the u.s. economy is doing better but he does not want to impede the recovery so the fed will not end his extraordinary program any time soon. that's good for investors. the dow is up 105, 15,492. the nasdaq is up and so is the s&p. home sales increased 9.7% from april of last year. national medium prices soared 11% to $193,000. santa rosa-based medtronic has announced plan to cut 2,000 jobs worldwide. 70 of the job cuts will be here in california. but the company has not said how many of those positions are based in santa rosa but says all affected employees have already been notified. let's bring you up to date

on some of the other top stories we're following for you right now -- the strong winds today in the bay area caused problems in a lot of areas. tara moriarty has been showing you this blowing sand on the great highway that shut down roads. overnight trees toppled down on power lines and wind warning were posted on bridges and roads. the irs at the center of the scandal, lois learner testified she did nothing wrong. lois learner then refused to answer questions invoking her fifth entertainment right against incriminating herself. we're still following overnight news from santa clara county. earlier a suspicious man was seen near a pg&e substation. there is a security guard out there. there were apparent acts of saab bow taj at the same plant next -- sabotage at that same plant next month. janine de la vega is back now with the latest. what do you know now?

>> reporter: well, not too much has changed here. sheriff's deputies still parked out here. pg&e has been playing for a deputy to be out here ever since the attack happened at this same substation last month. there's kit cal -- there's critical infrastructure. that's why security called in more deputies. about eight responded when they spotted an unknown man spotted in the field near the transformers. this happened during a routine patrol of the property around 3:00. a security guard spotted a white man with a goatee. that security guard shined his flashlight on that man, he ran away towards monterey highway and deputies were called in to help and they set up a perimeter but they couldn't locate him. last month, the substation was attacked by a vandal. someone fired a rifle here at a van and that caused leakage.

the person responsible was never caught and that's what definitely put security guards an sheriff's deputies on high alert here when this latest incident happened. a pg&e spokesman said they will continue to work with the sheriff's deputy. it's still unclear. we haven't heard back yet. we haven't gotten an update from pg&e to see if they are going to change any security measures or bring in more people here because of what happened this morning. reporting live from san jose, janine de la vega, ktvu channel 2 news. >> thank you. 8:49. gays and the bye scouts. that -- and the boy scouts, that hot topic is back up. >> the boy scouts are set to vote whether or not to allow openly gay members. scouting leaders from across the country kick off their annual meeting near dallas, texas today. the vote is expected tomorrow. hundreds of people from both sides of the issue are there as

welcome back. 8:54. she claimed that two men robbed her and tried to kidnap her infant son but now a woman in pleasanton is accused of making the whole story up. 23-year-old jennifer flores told police two men stole her purse. but detectives later discovered flores really left her purse at a pizza shop on the day she said it was stolen. then she was seen on surveillance video retrieving the purse the next day. flores was arrested. she was charged with filing a false police report. there's a new clue in the missing man case. a lifeguard found 27-year-old beau rasmussen's shoes and his maroon football jersey near the beach chalet restaurant. that's the sam area where his phone, credit cards and passport were found on sunday. he's not been heard from since he told friends he was going to the beach after finishing the

race. 8:55. a high-tech firm in santa cruz county has created a new safety device for guns in case the wrong person gets it. the company yardarm technologies created a microchip that's a wireless controller. it would trigger an alarm on the gun owner's cell phone if someone tries to move or steal the gun. the gun owner could punch a button that would automatically disable the fire arm. the device would cost $50 at first and then $12 more for an annual subscription. the b.a.r.t. board is expected to vote on allowing bikes on board trains all of the time. passengers had few complaints after a recent test that gave cyclists unlimited hours to use board. that has more b.a.r.t. board directors in favor of a permanent lifting of the ban on bikes during rush hour. but two directors would like a five-month test period before making the new rule permanent. all right. hey, sal, how is 8800 doing?
