here at the santa teresa library has been planned for weeks. tonight people are sure to be demanding answers about why crime is on pace to be possibly even worse than last year. today people were back at the scene where two teen boys were shot and killed on sunday in east san jose. no one wanted to talk to us on camera, but police now identified the victims as 15- year-old christian comilang and 16-year-old johnson comilang. both were students at nearby independence high school. just hours after their deaths on sunday, police say 20-year- old justin watkins was shot death on hayes avenue in south san jose. there have been no arrests in either case. this afternoon, the city councilman says he expects to hear a lot of questions about why san jose doesn't seem to have nearly enough officers. >> the reality is that the residents are feeling it, not just in one neighborhood or the other but throughout the city. burglaries are through the roof. if your home is burglarized, an

officer is most likely not going to show up. we don't have a burglary unit anymore. >> it just keeps increasing. >> reporter: there are currently about 900 officers working the entire city of nearly one million people. the police union says officers are in droves for cities offering better pay and benefits. now, the city and police have gone to arbitration over a new contract. we'll have that part of the story and, of course, what people have to say here at tonight's meeting tonight at 10. we're live in san jose, eric rasmussen, ktvu channel 2 news. now to developing news out of oakland where police shot and killed a man this afternoon. ken pritchett is in oakland. ken? >> reporter: well, frank, just a few minutes ago, we received a update from oakland police. they said they found a handgun that belonged to the suspect at the scene. the new information is police say that handgun was loaded and stolen out of georgia.

here is how all of this started this afternoon when police spotted a car with three men inside about a mile from here. they believe one of the men was armed. they tried to pull the car over. then a chase ensued here on bancroft, went back and forth, and ended about two blocks north of here, when the man got out of the car and ran. one of those men ran about two blocks back in our direction. here's what police say happened here, where we are, at richie and bancroft. >> one of our officers encountered the subject, who was armed at the time. the officer at that time discharged his firearm, his service firearm, striking the subject. >> reporter: police say officers attempted first aid at the scene. this is newschopper 2. you should be seeing here a video of the ambulance as it took the suspect to the hospital, where he died. his name and age has not been released. it is up clear if the suspect

fired any shots at officers. but investigators say they did find a gun at the scene, a gun they say was loaded and stolen. the two other men in the car, who also ran according to police, were arrested nearby. many people in this east oakland neighborhood immediately showed their anger at police. they say there are too many officer-involved shootings in oakland. >> they just pulled up to them, boom, boom, boom, boom, boom. six times. you had to shoot at six times? for real? >> reporter: they were telling each other that they did not believe the man was armed. of course, that is contrary to what police are saying. police are saying they found a loaded gun. the question of how this all started, why police thought that car initially, the car with three men inside, why one of them was armed, that remains unclear at this point. and police are still not offering a description of that suspect vehicle involved in that chase. in oakland, ken pritchett, ktvu channel 2 news.

the 12-year-old boy accused of fatally stabbing his sister in their calaveras county home pleaded not guilty today to second-degree murder. investigators say the boy killed his sister, eight-year- old leila fowler on april 27. he originally told investigators he found leila's body and saw an intruder inside their home. that triggered an intense manhunt. according to the boy's attorney, he did agree to waive his right to a speedy trial. the boy is due back in court on july 31. the highway patrol has a helmet probably saved the life of a motorcyclist who plunged off an overpass in novato this morning. he was headed to eastbound highway 137 when he lost control and hit a barrier. 36-year-old tony henderson of fairfield was thrown from his motorcycle and fell about 40 feet onto highway 101. the chp says he is hospitalized tonight with major industries.

should a father who fell asleep while driving and then crashed, killing his two daughters, be charged, or is having to live with what he did punish enough? that's what prosecutors have to decide. 48-year-old arvind tandel crashed his car in palo alto after falling asleep at the wheel on november 23. today the chp recommended that he face vehicular manslaugher for the death of his two daughters, one of whom was 20. the other was 24. we have learned a lawsuit can proceed against the san francisco sheriff's office in an alleged beating of a man who was being held in jail. we were the first to get this video of the incident which happened back in 2010. darrell hunter says he was surrounded by as many as nine deputies when one reportedly came over and began punching him. hunter's attorney says he hopes to take the case to court in august. today, the california state senate passed a series of seven gun-control bills that backers say could save a lot of lives.

the bills would ban semiautomatic rifles with detachable ammunition magazines. they also require permits and a fee to buy ammunition. and the bills would expand the list of people who are prohibited from owning guns. the measures now go to the state assembly. caltrans faces a state review as a result of the problems with the eastern span of the bay bridge. transportation departments will conduct the review. the studies is expected to cost $270,000. today we were supposed to learn if the labor day opening of the eastern span of the bay bridge would be delayed. tom vacar learned there is now a new drop-dead date to make that key decision. >> reporter: and the beat goes on. officials are hedging their words. as we reported yesterday, they are going for labor day. here's why.

the bay area toll did not get what it was expecting today. a date certain to open the bridge. nonetheless, the current schedule, labor day opening, remains in effect. >> we think that is entirely possible. but it requires a lot of information to be assembled, a lot of work to be complete. >> reporter: many tests are well along, especially on the unbroken bolts and on more than 2,000 other questionable bolts, implicated by the broken ones. >> the remaining bolts continue to perform as designed. no other observed problems or failures. >> reporter: but the results of a 30-day rapid aging test of the most critical bolts won't be completed until late june. >> it's equally plausible that it would make sense to replace some of the other bolts after we open the bridge. >> reporter: the other crystal

determinate depends on how soon contractors can complete two braces that will wrap around the columns to bypass the broken bolts. they say a go or no-go decision must be made by july 10, 42 days from now, for a bridge opening now just over 90 days away. >> labor day is still the goal. >> reporter: bridge officials warn an opening date after labor day can be complicated by many things, including deteriorating weather. and at least then there's the potential for negative economic impact on the holiday shopping season. i'm tom vacar, ktvu channel 2 news. and more details now about another bolt problem. this time on the bicycle path next to the new span. today we learned that numerous bolts used to anchor the railing were improperly welded. but during today's update on the bridge, a bridge spokesperson said that problem has now been fixed.

some starting the new numbers show that some latino students in silicon valley are falling way behind in math. the group, innovate public schools, looked at statistics from santa clara and san mateo schools. in one example, just 10% of latino students in a sunnyvale district are proficient in algebra by the time they reach high sc, to 82% for asian students. >> we know there's more work to be done. >> the study says the schools where latino schools do best tend to be smaller schools that offer a lot of preparation and mentoring. recent studies show that mom, not dad, is the primary wage earner. in 1960, only 4% of married

homeowner rick was getting his house move-in ready. >> all of a sudden, i heard this unbelievable noise. it just started cracking. i just looked up and the tree was on top of me. >> reporter: this tree, a 60- foot pine, big enough to cover most of the backyard, heavy enough to pin him beneath it. >> so i was down, underneath the branches, and i couldn't get free for a while. >> reporter: that 60-foot tree was originally over there, where there's a big gape in the fence. when it fell, it landed on this barbecue, which rick thinks saved his life and probably his home from further damage. the tree took out the roofline, crushed patio furniture, and that barbecue. >> that's metal. what would that have done to your body? >> oh, yeah. i know. >> trees in an urban setting, there's always going to be risk involved. >> reporter: they cleared the pine. to the untrained eye, it looked healthy. >> but really, it had root

problems last year. nasdaq officials made a series of ill-fated decisions, they say. the penalty is the largest ever imposed against an exchange. meantime, facebook is now admitting that hate speech against women is a problem on its site. last night, the social media giant posted a statement about its ramped up efforts to identify and remove the inappropriate content. it said, in part, as we've grown to become a global service with more than one billion people, we're constantly reevaluating our processes and policies. californians could get a 60- second warning before the next big earthquake hits, that is, if state lawmakers approve a bill to create an early warning system. it would cost about $80 million. the senate has approved the bill, which is now headed back to the assembly.

morning, there it is, right along the coast. then it's there when you get up. then it goes away pretty quickly. that's an indication that the high pressure is building. i suspect the fog is going to be around most of the midmorning hours. forecast highs, 80's, so it's a warmer day for you tomorrow. yellows are 70's. all the heat is coming this way. when i show you this map tomorrow night, there's going to be all oranges over here. so high temperatures staying with us right through saturday and into sunday. these numbers a good five degrees warmer than they were today. 84 in pittsburg, 82 in walnut creek. air quality gets a little worse but tomorrow is not that big a deal. but as we get into friday and saturday, fire danger is going to jump up pretty rapidly, especially on saturday, and air
