i just got off the phone with vallejo police and have more information regarding the officer involved shooting. hundreds in the dark on both sides of the bay after a pair of power outages. the valuable items thieves targeted. some students used their smart phone to bully other kids but one south bay school district is looking into a new service that would help kids use their smart phones for good. plus apple getting ready to hire thousands of new workers.

ktvu morning news continues. good morning, thank you for joining us i'm pam cook. >> good morning, everybody i'm brian flores. is there any rain in the forecast? >> not here. >> because we have graduations coming up. we are also looking at another live picture. let's do back to the desk. >> we have new information about a fight at the vallejo marina when a police officer was forced to fire his gun.

and as more on the exchange between the suspect an the officer. katie. >> reporter: vallejo police lieutenant tells me it was only a matter of minutes between the officer arriving here at the marina and the shots being fired. it happened here at the sea dock. you can still see the police tape. now what prompted the call for service was a 911 call around 7:00 last night. >> the caller indicated only hearing the sound of a male voice talking about potentially killing someone and again describing it just as being very violent sounding in nature. >> reporter: the shooting happened around 8:00 last night. the man officer encountered on his boat pulled a weapon on the officer and that is whens officer then fired -- that is when the officer then fired. there are reports of multiple gunshots being heard but it's

unclear if that came from the suspects weapon or the officers. we do know the officer fatally shot the man believed to be in his 40s. vallejo police are working to confirm the man's identity with the coroners office. coming up in our next report, i will have more details regarding the officer who was involved in this fatal shooting. live in vallejo katie utehs ktvu channel 2 news. last night's shooting marks the second deadly officer involved shooting. last year they had six deadly officer involved shootings. we are learning more about a car suspected in a hit and run ended up in an estuary. police tell us the incident began in san francisco late last night. the suspect is accused of

smashing a neighbor's door with a hammer. had a run in with a homeless man and rammed his car into a gas station. san francisco police chased the suspect on the bay bridge where they blew out a tire with a spike strip. he told investigators he drove into the estuary to hide out. >> he said he wanted to get away from the police. he pulled up here and made a right turn and ran straight into the estuary. >> the suspect was shivering when loaded on to an ambulance. a fire and power outage in fruitvale overtight and thieves may to be blame. firefighters believe if a copper wire thief sparked the fire. this power pole caught fire at about 11:30 last night. oakland fire and pg&e think someone trying to steal copper cut into live wire. most of fruitvale lost power. at least one crash also happened at a dark intersection because of the power outage. the outage lasted for about an hour. hundreds of people in san francisco is also without power after a tree fell into power

lines. that is on garfield street in merced heights. the outage started before 11:00 last night. now effecting nearly 600 customers. pg&e does expect to have the power back on by noon. antibullying tool is promising students a safe way to get help at their schools. janine de la vega joins us live with what the school district is saying about the texting service. >> reporter: good morning, brian. kids carry their smart phones to school. but it's become a way for students to use their cell phones to bully. this summer they are going to explore how kids can use their phones to combat that. the assistant superintendent for curriculum says they are very interested in looking at a service called tip txt. black board inc. is offering it free to every school across the country from kindergarten to 12th grade.

it's a two-way texting service that allows the student to report bullying without retaliation. the district says it's challenging to get students to open up and come forward in light of what happened to saratoga height student audrey pott. she committed suicide after a sexually explicit picture of her was taken and sharamong students. an employee told us his thoughts on audrey pott. >> some students heard about it and they kind of like don't be referred to as a snitch. that would have been a great tool. if it was around at that time. >> reporter: while the service is being offered for free, each school district would have to pay $125 to set up a dedicated phone line and district officials told me again it sounds very interesting and that is a reasonable price they said. they are also looking at

another tool possibly setting up an anonymous hotline. they are needing to evaluate which service would be the best fit for the school district. reporting live from saratoga janine de la vega ktvu channel 2 news. apple plans to increase the size of its work force by 50% at its cupertino headquarters. that information was included a report as apple submitted to the city. that would mean more than 23,000 people would work at the company's main campus. cupertino has mostly been supportive of apple's expansion. but more city leaders say they need more information about the plan before they can give the the final approval. it looks like a run off race is likely. more than 50% of the vote was needed to take the district 2 seat. the county registrar says labor leader cindy chavez has 41%.

meanwhile theresa alvarado received 31%. meantime in contra costa county it appears voters have -- in the city of hercules for five years. the measure received 70% yes votes and 29% no. hercules city leaders estimate the tax hike would raise $1 million. and in marin county a parcel tax appears to be winning. measuring a received 66% yes votes and 33% no votes. right now it's 6:08. commute has been pretty good actually. let's check in with sal. it does start getting a little busier. >> it does. we've had a couple things pop up. first of all let's go to the toll plaza. i want to check on that. we're just past 6:00. they have turned the metering lights on. and the traffic is going to be backed up now that they have turned the metering lights on. traffic is moving along okay once you get on to the bridge

but you will see some slow traffic. also 880 northbound we got word that there could possibly be a chase going on. i've been watching this camera. i haven't seen anything. but you know in case you ever get into a situation where you see police cars coming up on your wheel fast. just get over to the right as safely as possible. i don't see anything here. west 80 at carlson or central avenue there is an injury accident there. traffic will be slow as you head west. no major problems yet on this commute. but if this crash is there for any length of time we're going to have a big backup stretching all the way to richmond. 6:09 let's go to steve. all right sal, thank you. sunrise over the big city. most observations at 6:00 a.m. say cloudy unless you are far enough inland. then you just have clear skies. a little cool this morning. for this time of year. a pretty good breeze in place. it will probably get chewed up a little sooner today. the barometer is going up.

while samsung scored a victory over apple, the u.s. international trade commission says two ipad models infringe on samsung patterns distributed by at & t. they are assembled in asia and considered imports. president obama has two months to override that decision. time is 6:15. and developing news. a shakeup in president barack obama's foreign policy team. the national security advisor is resigning. as ktvu kyla campbell reports from our washington, d.c. newsroom republicans are not going to be happy with the president's pick to replace him. >> reporter: tom donilon is resigning from his post and susan rice will replace him. the white house said just a few minutes ago the president will be holding a press conference about five hours from now for a personnel announcement. donilon has been in his post since october of 2010 and heavily involved in the raid to kill osama bin laden in 2011.

rice is currently the u.s. ambassador to the united nations. the president's pick is seen as a defiant move top republicans. many in the gop harshly criticized rice for giving a misleading account on the deadly attack on the u.s. con lat in benghazi this past september. but this post does not require senate conformation. i just reached out to california senators barbara boxer and dianne feinstein for their reaction to this news. so far i have not heard back. live in washington kyla campbell ktvu channel 2 news. we have new details on president obama's visit to the bay area this week. there is a last minute edition to the president's schedule. president obama arrives in the bay area tomorrow to have a pair of fundraisers. before leaving on friday he will talk about his affordable care act. an event opened to the media on friday morning. this came after high profile

democrats complained about another fund prisonerring only trip to the bay area. first lay by michelle obama confront -- lady michelle obama confronted a heckler. the protestor repeatedly interrupted the first lady's speech demanding the president sign an executive order on gay rights. michelle obama walked over to the protestor and said quote listen to me or you can take the mic but i'm leaving. you all decide. you have one choice. the crowd shouted for the first lady to continue and the protestor was escorted out of the event. an american soldier will plead guilty to one of the worst atrocities in the afghanistan war. robert bails will recount how he slaughtered 16 afghan civilians. many of them women and children last year. the sentencing phase will be held this summer to determine if he receives life in prison with or without the possibility of parole. two sisters accused of

abusing babies at a livermore day care are supposed to appear in court today. they tightly swad led babies at the universal preschool to force them to sleep. the infants bodies were bound so tightly they had trouble breathing and couldn't move their arms and legs. neither of the babies were permanently injured. this fall a major renovation will under way at dolores park. it will include the installation of new bathrooms, upgraded walkways, new recreational fields, and designated area for dogs who are off the leash. in october the northern half of the park will be closed for the first part of the improvement. the entire project is expected to last a year. time is 6:19. hopefully not too busy out there on the freeways. sal, how is traffic? >> we do have a couple things out there. on 80 westbound that is the biggest problem we have.

a crash west 80 at central avenue. central and carlson there and the traffic is quickly backing up all the way to richmond. if you drive from vallejo to rich and tone down to the berkeley area this is a major problem for you. they are working hard to get it out of the way but the damage is done. this might be effecting the bay bridge as people may not be able to get through. and you might see lighter than usual conditions. let's hope they can get that out of the way soon. we're also looking at interstate 880 we had reports of police activity but never did materialize. happy to say traffic on 880 north and southbound looks good. 6:20 let's go to steve. thank you. the weather looks good. if you like a big fog bank. if you want warmer temps you have to wait until friday and saturday. westerly wind low clouds sunny and breezy. a little bit warmer tomorrow. and friday and saturday sunny skies heating up. how much is in question.

welcome back to the ktvu channel 2 morning news. it's 6:24. county fair competitions usually involve best livestock or the fastest hot dog eater. but the san mateo county fair will have computer whizzes. they include app making and computer programming. it runs from saturday june 8th to sunday the 16th. san francisco is suing a new car sharing service that caters to travelers at sfo. flights cars allows passengers to rent out their cars while out of town. they want it to give sfo part of its profits or shut down. flight car says it should not pay the rental fees because it operates off airport property. it also considers itself a ride sharing service.

suspect's car was pulled out of the water. tara. >> reporter: yeah this is certainly a bizarre chain of events that led up to the suspects being here. if you take a look behind me it started with a hammer attack in san francisco and ended with a car in this estuary. you can see the mud tracks where it went in. divers hope to attach cables to the range rover that was pulled out of the water around 5:00 this morning. the man in the car was able to get out around 11:30 last night. and divers helped him swim to shore. this all started in the castro district in san francisco where police say the suspects smashed a neighbor's door with a hammer and then sources close to the investigation tell me he went to a gas station off sixth and harrison. had a confrontation with a homeless person who slashed one of his tires and the suspect allegedly rammed his car through the front glass windows of that gas station which are now boarded up. the police led -- the suspect led police and the chp on a low chase through the city crashing into a car and with a one flat

tire he escaped across the bridge and eventually hit a police spike where he pulled over in berkeley driving into the estuary. >> he said he just wanted to get away from police. he didn't believe it was as deep as it was and the garrisoning in less than two minutes. >> reporter: now the suspect wasn't hurt but he was taken away in an ambulance for mental evaluation. he does have a history for mental illness. he just bought the car that is why there is no license plates on it. he will be facing multiple charges including a felony for evading an officer. live in berkeley tara moriarty ktvu channel 2 news. cleanup crews are on the scene of a vallejo retirement home where dozens of senior citizens were evacuated overnight where a pot on the stove activated the sprinkler system. about 100 people had to be evacuated when the sprinkler enforcements went off.

>> there is open units they can be placed into. also the red cross has been called. >> fortunately no one was hurt but it was a different story at that same building back in 2008. three people were killed in a fire that badly damaged the complex then. investigators found the buildings fire alarms were not working the day that fire was started by a tenant. smoking in a room. the owners of the building were arrested on manslaughter and elder abuse charges but those charges were later dropped. that building reopened as low income housing for seniors in january. also new a federal raid ends in sacramento with fbi agents removing several boxes from a state senators office. we want to go to video from sacramento where boxes were wheeled out of senator ron calderon's office. the raid is part of a larger

public investigation. calderon is a democrat. the senate is cop riting. >> i have no idea what is in the warrant. it's a sealed warrant by the court. >> ethals served warrants a the latino caucus. the issue of sexual assault in the military will take center stage again today on capitol hill as the house armed services committee considers a sweeping bill. at a hearing yesterday, senators grilled military leaders about an alarming increase in the number of sexual assaults within the armed forces. the military leaders say they do not agree with proposals to strip commanders of their authority over sexual assault cases. cell phones could become the latest tool to help students deal with bullying.

janine de la vega joins us live from saratoga at a high school where bullying may have led to a tragic death. >> reporter: pam, we're here at saratoga high. this is where audrey pott was a student. if you remember she killed herself late last year after revealing pictures of her were taken on a cell phone. and now the los gatos saratoga high school says over the summer it will look into whether it will start using tip txt. that is a free service being offered by black board inc.. students can confidentially send texts about bullying on campus and abuse going to school officials. the service is available to all schools from grades kindergarten to 12th grade. the superintendent says they are very interested in using this antibullying tool like tip

texts and says it sounds like a valuable mechanism. one parent says the tool should be seriously considered. >> i think if it's anonymous it may help quite a bit. i think the reason children may not mention it to adults because they are afraid of retaliation or criticism by other children. >> reporter: the assistant superintendent told me in light of what happened to audrey potts, they nee do be vigilant. they couldn't more because of pending that is why they are going to explore this during the summer. we will try to get in touch with the actual superintendent of los gatossore are toga school. reporting live janine de la vega ktvu channel 2 news. >> thank you. the schedule for the upcoming america's cup is in serious doubt. the mercury news reports

river. many people there already left their homes. you can see others packing up their belongings. they are ready to go at a moments notice. the river is retreating but they really do not expect a big drop in the water levels any time soon. we are learning about a third case of hepatitis a in the bay area linked to tainted frozen berries sold at costco. the 22-year-old santa clara county woman was hospitalized last month after eating the mixed berries. a woman from contra costa county were also sickened. the illness is linked to townsend farms organic antioxidant blend of frozen fruits. workers from jobs to park maintenance to city engineers are scheduled to take a strike vote next week. they haven't had a raise in five years. now they say the city wants

very tenured. very professional minded officer. and very confident. >> reporter: we've learned this morning the 911 caller told dispatchers there was a male voice and what sounded like a loud violent argument coming from a yacht at the c-dock. the officer responded around 8:00 last night. as he approached the yacht investigator say the suspect pulled a gun. that is when the officer fired in self-defense. multiple shoots were fired. the officer involved is okay. he is now on paid administrative leave which is standard procedure. police are still trying to contact the person involved in that original argument. because the officer again was only encountered the man who was shot. again there was only the officer there as the witness. now in my next report i'll have more information about the suspect and also the boat where
