charges. >> reporter: tori, the district unjunior is -- junior is responsible for a flier and has the dna to prove it. this involves a political flier in 2010 that shows a photograph of a candidate next to a vietnamese flag. and it is considered offensive. the flier says it was sent from her camp. two years later, they received a dna swab from george

shirakawa convicted of charges and the d.a. says shirakawa's dna was found on that flier in 2010 and he's being charged with false impersonation. >> the dna matched. this lead broke the case open. on may 10th, mr. shirakawa voluntarily provided another dna sample which confirmed the initial dna hit. we also found strong evidence that mr. shirakawa's dna was on the stamp of another flier. >> reporter: and here is video of the other flier that was sent out against karasko which the district attorney's office says shirakawa was behind. why would shirakawa do this? the district attorney said he had a motive. his aid was running against her and he ran the race. the district attorney's office says the investigation is still

open and would not answer whether or not campos has been interviewed and would provide dna regarding this case. i want to show you a booking photo that -- that we just received of shirakawa. he will appear in court on friday. he will be sentenced for the corruption charges that he pled guilty to. he's expected to get a sentence of a year in county jail. the d.a.'s office says this new charge won't affect that sentencing but they are asking for jail time on this new charge. we will have much more on our newscast at 5:00 and 6:00. reporting live from janine de la vega, ktvu channel 2 news. >> all right. thank you, janine. it looks like there will be a runoff race, meanwhile, to fill shirakawa's vacant seat. more than 50% of the vote was needed in the special election. cindy chavez has 41% of the

vote. teresa alvarado of the share water district received 31 -- santa clara water district received 31%. this is estimated to cost another $1 million. new at noon, san jose police are investigating the discovery what they are calling a suspicious dead body. someone reported finding a man's body about 9:00 this morning in the 200 block of north 4th street. police say the body was inside a shopping cart and the man may have been homeless. his death has not yet been ruled a homicide. but homicide detectives and the coroner are investigating. a man who was knocked unconscious on a san jose street over the weekend has now died. investigators say the man was injured during a fight on saturday morning. he was hospitalized and then died of his injuries yesterday. his death is under investigation. but no suspects have been identified. police say this was san jose's 22nd homicide of 2013. an investigation is underway after a vacant oakland

victorian caught fire this morning for the second time this year. the fire began just after 7:00 a.m. at a three-story building at 7th and harrison. that sent flames 20 feet into the air. we brought this to you live during "mornings on 2." this is video -- actually, it was video from our roof cam but the fire created a spectacular scene on 880. firefighters launched an exterior attack and had the flames under control in about 35 minutes. they are now looking for the cause. >> i know that the fire that burnt here back in january, there were people seen leaving that were presumably homeless people living in the structure. that very possibly's happening now. but we have no report yet. >> the house had been boarded up. fire crews do not believe anyone was inside. but they are inspecting the burned interior today. they will be looking for signs that people may have listen biv -- may have been living there.

katie utehs is live in val with more about the man shot an -- in vallejo with more about the man shot and killed by police. good afternoon, katie. >> reporter: good afternoon. this is a popular walkway around the marina. if you take a look behind me, the c-dock, that's where the shooting occurred on a yacht that's moored at this dock. some tell me the man shot and killed last night was kind and friendly. another said he battled with mental health issues. >> it's quiet and a nice place to come and walk. >> reporter: what sounded like loud arguing, someone called 911. an officer responded within minutes. shots were fired. >> i was walking on the other side of the causeway here. i heard a high-caliber gun go off. i thought it was maybe a shot

gun and i heard the officer clearly yell, hands up! hands up! and then it was five to seven shots. >> reporter: police say a man living on a yacht moored at the dock pulled out a weapon and the officer fired in self- defense, killing the man. >> the white with the blue one there. >> reporter: the man in his 40s, they say, lived here for a year or so. >> the guy was friendly. >> reporter: another boat owner said the man had mental health issues and made statements in the past about disliking police. >> nobody deserves to get shot. >> reporter: despites report of an argument. vallejo police say the officer only encountered the one man on the boat and the officer's backup was underway when the shooting started. the boat remains at the dock here this afternoon. i'm tone nobody is allowed on

>> rice is a phi beta graduate and served on the national council during the clinton administration and replaces tom donilon. president obama is heading back to the bay area tomorrow and there's been a last-minute addition to his schedule. he will arrive at moffett field tomorrow evening. he will attend two fund-raisers in the south bay. then friday morning he will make a statement about the affordable care act. that addition reportedly came after some high-profile democrats complained that president obama only comes to the bay area for fund-raisers. and michelle obama is getting attention for the way she handled a heckler. the protester repeatedly interrupted her speech, demanding the president sign an order on gay rights. michelle obama walked over to the protester and said "listen to me or you can take the mic.

san francisco college. the school was sanctioned after numerous violations were found. the 19 members will decide whether city college has made enough changes to continue operating. the board will meet for three days. a report on the panel's recommendation is expected to be released in early july. oakland police headquarters have closed, once again, because of problems related to yesterday's flooding. cleanup crews continue to mop up at the building on 7th street. they did reopen it at 8:00 a.m. but the building closed again at 10:00 after complainting of a lingering odor and eye irritation. it's not known when the police headquarters will reopen. the tsa drops a controversial plan. why it will not let airline passengers bring small knives, that and other sporting equipment on planes. and your bay area forecast is coming up. and then cooling off but meteorologist mark tamayo will let us know when -- let us know

afghans pleaded guilty. he told the judge a short time ago that there's not a good reason in this world for why he did the killings. he was serving his fourth combat deployment with an otherwise good record. his attorney said he suffered from post traumatic stress and a brain injury and had been drinking iliz the night of the killing. sentencing is set for september. senators had strong comments before a house panel on how the military deals with sexual assaults. the panel is moving ahead with stripping commanders of the ability to overturn convictions in rape and assault cases. the legislation is part of a sweeping defense policy bill that the house armed services committee put together. the pentagon estimates as many as 26,000 military members have been sexually assaulted last year. that's up from an estimated 19,000 assaults in 2011. the double jury richmond gang rape trial continues today with more witness testimony. the paramedic who treated the

16-year-old victim took the stand. richmond police officers are also expected to testify today. yesterday, the victim's father testified that the suspects called him to brag about the assault in 2009 and that his daughter was near death when he found her. after an overnight fire, the red cross is helping seniors at vallejo retirement home find a place to stay. firefighters say close to 100 senior citizens at the senior home were evacuated just before 1:00 this morning when a pot on a stove triggered the fire alarm and sprinklers. at least eight units were damaged. >> the on-site manager is here. there's open units they can be placed into. also the red cross has been called. a restoration company has been called. >> fortunately, nobody was hurt. a fire at the same complex five years ago killed five people and badly damaged the building. a controversial plan to allow airline passengers to carry pocketknives and other items on board has been

area. a few lingering patches heading out to the east bay neighborhoods. as far as current numbers they will warm up inland. antioch 76 degrees. livermore at 71 and downtown san francisco still needs a sweater. in the upper 50s. wind speeds, s out of the west at 20 miles an hour. oakland out of the north. northwest i should say. and san jose not too much of a factor. sfo out of 15 miles an hour. forecast headlines for today -- we'll go with this, the patchy fog out there for the coast. right around the bay. but clearing back to the shoreline. our next warming trend begins and friday and saturday the two hottest days of the week. we could be talking about a few upper 90s. we still have the onshore breeze kicking in. cool to mild. wind speeds to around 10, 20, maybe around 25 miles an hour. high pressure will continue to build in. that will signal our warming trend for thursday, up a good 5 to 10 degrees for tomorrow. by friday, warmest locations

around 95 to 96 degrees. we're scaling back a little bit on the heat. it will still be hot inland. at least the mid-90s. as far as forecast highs this afternoon. yesterday and today, the coolest day, this week, a few low 80s inland. san francisco, 61. pacifica, 58. some more neighborhoods, san jose, mid-70s. gilroy, 79. bring the sweater and the jacket. those reads in the upper 50s -- readings in the upper 50s. today we talked about the cool to mild conditions. tomorrow, thursday, we warm things up. inland is on track to reach the upper 80s. there's the heat i was talking about for friday and saturday. locations in the upper 90s. we're scaling back a little bit and will fine tune this forecast over the next few days. for day five on sunday, we cool things off. that will be the cooling relief you can expect for the second half of the weekend. >> thank you mark. >> sure. in marin county more ballots need to be counted to

a series of weak economic reports, companies like minors, banks and chemicalmakers fell the most. that's a sign investors are becoming less confident in the u.s. economy. take a look at the big board, the dow is down 191. the nasdaq is down 40. s&p down 19. some big changes for an annual three-day event in san francisco that raises money for breast cancer. the event is organized by susan g. komen for the cure. it's drawn thousands of women who raised $2300 to participate. there's also men in the walk.
