yesterday he was deemed legally well enough to defend himself but his attorney says gardener remains delusional. he's due back in court on june 27th. there appears to have been a second workplace death in santa clara county this week. a workers at the stevens creek quarry reportedly died while working with heavy inn. we are waiting for the santa clara county sheriff's office to update us on this developing story. the quarry is scheduled to open for business right now. back on tuesday, an elevator mechanic was hit and killed by a counter weight at the new 49er stadium in santa clara. 7:04. new this morning, oakland firefighters are reporting double trouble at one home. investigators want to know if an overnight fire is connected to graffiti found there earlier. he has more on this continuing

investigation. what's going on brian. >> reporter: fire investigators and police investigators have not officially come out and said both of these incidents are connected but again, at the very least, it is suspicious that one home was tagged with graffiti yesterday afternoon and a short time later a fire broke out. it's on the 1400 block of 73rd 73rd avenue. it was tagged with with graffiti yesterday afternoon. we are not showing much of the graffiti, it contains a homophobic slur and phrase stop snitching. firefighters tell us it appears it started from the outside and damaged a portion of the back porch. firefighters were also able too contain the fire quickly from spreading. we're adding more to the suspicious nature the fact that nobody was home. if there were, it might have been an accident, but we also

san jose's fire chief after three years on the job. the veteran bay area firefighter hired to become the new fire chief of las vegas. mcdonald admits it's been a rough few years for san jose firefighters but budget cuts, pay cuts and other problems and insists that is not why he's leaving. >> incredibly hard, in fact,ers i really wrestled with it for quite a while because i really love the city of san jose, really my time in san jose b has been excellent and i really will miss it. so, mo, it it's really more -- so no, it's more about an opportunity there. >> mcdonald will take quite a pay cut. right now he makes $200,000 a year as san jose's a fire chief. he'll make 150,000 a year in las vegas. mcdonald becomes the second public safety leader to step down this year. in january chris moore retired as san jose police chief. police in pittsburgh released a photo of a man

a counter weight at the 49ers stadium. it is 8:03. new this morning, 3 people were injured when a car collided with a forklift at a san francisco produce market. this happened at 4:00 a.m. on gerald avenue at the wholesale produce market. the driver of the forklift was thrown from that vehicle, two people in the car were also injured. the cause of the collision is being investigated. witnesses say it's a dangerous area because a city street goes right through that market. new this morning, police and fire officials in oakland are are investigating two incidents at one house involving graffiti and a small fire. brian flores is live in oakland with more on whether the incidents are related. good morning brian. >> reporter: good morning. fire investigators and police investigators have not come out and said the incidents are related. but they are continuing to investigate this. at the very least, though, it is suspicious that there was graffiti early on yesterday afternoon and there was a fire

he got a call from her mother. time is 8:06. a major contractor is in line for a big bonus if the bay bridge opens on time. the contractor building the signature suspension span will get $20 million if the bridge opens as planned this labor day weekend. now, three government agencies overseeing the bridge project agreed to the incentives three years ago. it was part of a plan to get that long overdue bridge back on track. now, many state lawmakers are are worried the bonus could lead to a risky rush to get it completed. a group of california lawmakers introducing a bill that would name the western span of the bay bridge after former san francisco mayor willie brown. the official name would be the willie brown junior bridge. the western span connects it to san francisco. it is not part of the current construction project. 8:07. if you are planning on going to the san francisco marathon this

negatively affect the store's existence, even though they comply with the laws and regulations, it faces backlash from community members who were shocked and upset that a gun store opened last september. over the past several months, town officials have brainstormed if and how it should regulate gun owners and dealers follow state and federal laws. a preliminary draft of the ordinance includes a provision that templar will not be grandfathered in and will be required to renew the permit each year with public meetings. town officials are looking to possibly change proposed land use and zoning templar says that could zone itself out of existence. some people who live in los gatos have mixed feels about it. >> i think it's fair because we have a right to explore anything. i don't have strong feelings against or for the guns. i don't personally own a gun, and i don't, you know, it's not something that i would really want. but i don't think that i should

prevent anyone else from doing what they want to do. >> reporter: and templar does have a group are of supporters. it's asking people on its facebook page to come to a town meeting scheduled for this coming monday at 7:00 to voice their opposition to the ordinance. as i mentioned, a draft of the ordinance was released about a week ago, but a newer one supposed to be released at noon. reporting live los gatos,. the oakland headquarters building is closed to the public. the building was damaged by a plumbing leak earlier this month. crews are still working there, fixing the damage. the building is due to reopen monday morning. but in the meantime, you can go to the eastmont police substation between 8 in the morning and noon to to -- to get most anything you might need. we want to check in with sal see what's happening on the roads.

on top stories. early this morning in san francisco three people were hurt when a car ran into a forklift. the forklift operator was knocked out of his seat. two people in that car were also hurt. right now we're not sure the extent of their injuries. overnight fire in east oakland is under investigation. it happened at a house near 73 73rd avenue and international boulevard. police were at that same house yesterday investigating graffiti that included a homophobic slur and the words stop snitching. still no word on whether the fire and that graffiti are connected. and people in richmond want a boat that crashed into the marina a couple weeks ago removed from the shore of the marina park. that boat is registered to an alleged sex offender. explain why parents are so concerned about this tara. >> reporter: you know many neighbors are upset. they're just learning about the
