nice day for most. good morning, sal. good morning. traffic on 80 is moving along okay, right after university. there's police activity on the shoulder. you can see for yourself that traffic is getting better right after that activity as you drive out to the macarthur maze. let's go back to the desk. >> we begin this hour with developing news in san jose, where police say charges will be filed against the driver accused of plowing into several parked cars killing a passenger. ktvu's janine de la vega has been at the scene since 4:30. are we getting a since of what caused this crash? >> reporter: yes. speed and it looks like alcohol. that's what police are telling me. i want to tell you the speed limit on foxworthy avenue is 35 miles an hour. this is near hillsdale just around the corner from all of the car dealerships on capitol

expressway. we don't know how fast the car was traveling there with the roof torn off. but the police say the driver was definitely speeding. you can see this pile of mangled cars. the passenger is dead. his body is still on the sidewalk. they believe the driver of the toyota avalon, lost control, plowed into a row of three parked cars. three of them were totaled. 40-year-old passenger was trapped inside. firefighters had to extricate him. once they removed the roof, he was already dead. the driver was rushed to the hospital with non-life- threatening injuries. police found beer cans in the car. neighbors rushed to the scene to try to help before firefighters got there. >> i could hear him say, don't move him. just leave him alone. i figured those people are already helping him. the police came shortly after. >> reporter: police say they are going to arrest that

driver. they've identified him as martin acosta, an 18-year-old from san jose. they are going to book him for driving under the influence and for vehicular manslaughter with gross negligence. he's still at the hospital. they say all he suffered was some facial injuries. now, police also tell me that they believe the two men in this accident, the driver and the passenger, were coworkers at a restaurant. what leads them to believe that, they were wearing the same uniform. so they think they were getting off work when this happened. this intersection, we're told, will probably be blocked off for an hour, hour and a half. so police are asking people to avoid this area, right around foxworthy, where it turns into pearl' and hillsdale. that intersection. janine de la vega, ktvu channel 2 news. we're closely watching the u.s. supreme court this morning to see if the court will hand down their ruling on california's proposition 8, the ban on same-sex marriage. the court is right now

announcing rulings. we're monitoring a live blog coming out of the courtroom. we'll let you know the very minute we find out if the justices are gonna issue a ruling on proposition 8 this morning. the court is scheduled to make the decision before the end of the month. but they still have 19 cases to rule on and we don't know which day the prop 8 ruling will be coming down. other closely-watched cases in this supreme court session include whether the doma act defining marriage between a man and a woman is constitutional. an affirmative action case out of texas, whether it's constitutional in austin, texas to consider race in their administration. the university of austin filed a friend of the court brief in this case.

ktvu will bring you the decision on proposition 8 as soon as it comes down. we'll have continuing coverage here on the air and on line. when the decision comes down, we'll go in-depth with an extra coverage on that decision. police say a man in pacifica tried to kidnap a 10- year-old girl but he ran off when the child punched him. this happened yesterday afternoon on beach boulevard near the pier. alex savidge is live near pacifica with important information on the suspect in this case. >> reporter: good morning. this little girl physically unhurt. but likely shaken up after what happened yesterday afternoon. she fought off the man who police say was trying to kidnap her. police -- police really want you to take a look at this

sketch. the attempted abduction happened yesterday afternoon near beach and santa rosa avenue. police say the man from the sketch approached the 10-year- old girl, told her to come with him, and grabbed her. she punched the man and managed to run off. police are still searching for him. he's described as white, wearing a checkered shirt and jeans. i have a call in to police. i'm still waiting to hear back with an update to the investigation. alex savidge, account kut -- ktvu channel 2 news. the trial of a gain rape case at richmond high school continues today. we're learning the victim could take the stand. she was a 16-year-old sophomore at the time of the 2009 attack. police say she was beaten, raped and sexually abused after leaving the school's homecoming dance.

if convicted, jose montona and peter marcelas could get life in prison. and the trial of joseph naso is expected to begin this morning. ess a suspected of killing -- he's suspected of killing four women. he's acting his own attorney and will deliver his opening statement this morning. if convicted, he could face the death penalty. ktvu will have a camera at the courthouse and we'll have more on this coming up at noon. apple says the government asked apple for information about its users and is joining other tech companies that they received similar requests. apple says 5,000 requests were made for information from federal, state and local authorities since last september. some requests were related to national security, but apple says most were made by police investigating crimes or trying

the sisters of the missing man say her brother vanished when taking off his life jacket to swim 75 feet to shore. >> once he got into the water, he tried to get the life jacket back and she witnessed him submerging into the water. >> divers from the alameda county sheriff's office searched the waters for hours before the sun sent down. they are back this morning with what is now believed to be a recovery effort. 64-year-old james moten walked out of his care home near 51st and foothill about 6:30 saturday morning. police say he's considered at risk because of his mental condition. he's an african-american man with a bald head and he has a beard. you see the photo. he's about 5'2" weighing about 140 pounds. president obama is in northern ireland this morning

for the g8 summit, the crisis in syria and worldwide economic fears take center stage. as kyla campbell reports from our washington, d.c. newsroom, the president is expected to speak at the g8 summit this hour. good morning, kyla. >> reporter: president obama is running behind schedule. he's supposed to talk to reporters any minute. president obama joins leaders from eight of the world's most powerful economic countries. the summit was intended to focus on interspark trade and economy. but because some of these countries disagree how to handle the blood shed in syria, that situation is expected to be a top priority. sadly puten is very outspoken -- vladimir puten is very outspoken about president obama's plan. the two are expected to talk privately. a new cnn poll shows that president obama's approval

rating has taken a dive. last month, 58% supported president obama. now just 45% of the job he's doing. that's an 18-month low. we'll take a closer look at president obama's schedule for the remainder of the g8 summit when i see you next. kyla campbell, ktvu channel 2 news. david cameron is among those attending the summit. this morning he refused to comment hon a hacking scandal -- on a hackle scandal involving the government. the newspaper there reported that britain's spy agency hacked into e-mails. this morning, the white house is also defending the nsa's secret surveillance program of phone and internet records. white house chief of staff denis mcdonough says the program is constitutional and carefully monitored. he also says the u.s. government does not know the exact location of the man

accused of leaking the existens of the program. this man, edward snowden. snowden is believed to be in hong kong. that has former vice president dick cheney concerned he could be cooperating with china. >> i'm very, very worried that he still has additional information that he hanot released yet. that the chinese would real -- welcome the opportunity and probably provide immunity to him. >> the justice department is preparing criminal charges against snowden but have not announced what the charges may be. happening now -- fbi agents are searching this field, north of detroit. they are looking for the remains of mob boss jimmy hoffa. who disappeared in 199 a. this is happening in -- 19195. this is happening in -- 1919 -- 1995.

95-year-old alice brown is alive and well even though the government has declared her twice and she says her benefits have been cut. it happened after the government put her on the dead master list. the list is almost impossible to get your name taken off of. she said the first shame she died she was in the hospital and medicare said it would not pay for it. >> and then social security wrote me a letter saying my date of death was 10-31-11. >> she says each time this happens, she loses her benefits, which are her only source of income. 7:24. there have been cracked wells, broken bolts and a host of our problems. growing safety concerns over

the new bay bridge has many people calling for a delay in the scheduled labor day o'ing. project -- day opening. project managers are doing everything possible to reach the deadline. ktvu recently got a close look at the massive construction project. we have breaking news right now. 7:24. breaking news from the united states supreme court. the court did not, did not, issue a ruling on california's proposition 8 banning same-sex marriage during the session this morning. what that means, the earliest the court could -- a ruling could come down on same-sex marriage would be thursday morning. this morning, the supreme court issued five rulings on other cases but again, nothing on proposition 8. the court is expected to make a decision on prop 8 before their current session ends at the end of this

we're following developing news from berkeley. two sheriff squad cars caught fire after a high-speed chase. ktvu's tara moriarty joining us live now to tell us what happened and how that fire started. >> reporter: well, the high- speed chase started in el sobrante and then the suspect made a sharp turn coming off this offramp on university avenue. he made this turn through this foliage, went about 80 yards through all of this ice plant. the sheriff's deputies followed him. you can see where it's all torn up here. that's where the cars got

stuck. but then, the suspect ended up getting right back on 80 and got away. two flat bed tow trucks just hauled away both squad cars. one of them -- one of them a total loss. two contra costa sheriff deputies noticed a black lexus with no plates in el sobrante out on castro ranch road. when they tried to pull over the driver, he sped off an led deputies on an 11-minute chase into berkeley. the deputies got stuck in ice plants. >> it appears to me that the exhaust systems of the patrol cars cut this foliage on fire which then caught the patrol cars on fire. >> reporter: the exhaust systems appear to have ignited the brush. the one car sustained a lot of fire damage and will have to be destroyed. that's worth about $30,000. the other car will be salvaged. no one was hurt luckily. back here live if we take a look at traffic on i-80 you can see pretty much everything is

back to normal. it had been pretty slow going, but it just started to pick up once the scene it clear. typically there's traffic along 80 yeah way at this hour. but this -- anyway at this hour. but this traffic definitely impacted things. a driver facing drunk driving charges after a freeway crash in hayward that injured four little kids. two of those victims were the driver's own steppe children. it happened -- stepchildren. it happened near the a street onramp. the chp says the driver lost control of his car, hit a pickup truck and veered off the freeway and smashed into a large pole. >> the vehicle suffered significant damage. there were four children in the vehicle. two were ejected. those two children suffered major injuries. >> two other children suffered minor injuries. one adult passenger was not hurt. police did arrest the driver on suspicion of drunk driving right there at the accident

scene. a mentally ill man is dead. two fremont police officers are on leave after a very deadly shooting yesterday morning. police were called to help a woman who said her 53-year-old son had a knife and was out of control. police say as two police officers went into the family's home, they were confronted by the suspect and shot him. we have no details on how the man threatened the officers. there's a nasty sewage problem at the oakland coliseum. sewage pipes backed up during the game yesterday. pools of water in the lower levels forced both teams to move from their locker rooms to higher ground. officials say six straight home games attracting 170,000 fans overloaded the plumbing. the as want the new stadium but have not received a green light

from the league. today the oakland police headquarters is set to reopen after being closed for plumbing problems. the building on 7th street has been closed for repairs off and on for two weeks. the problem started earlier this month after a third floor toilet broke and flooded several floors. the cleanup cost is estimated between $150,000 to $270,000. a gas leak near the moscone center tied up traffic and forced several hundred people to evacuate. this happened around noon yesterday when construction workers accidentally hit a pg&e line at 4th and folsom street. a convention at the moscone center was evacuated along with the museum, the yerba buena guardens and nearby apartments. seniors were moved to a nobody church. no one was hurt. a woman is recovering after jumping ten feet into a storm drain. witnesses saw her lift off the

drain before jumping in. this happened in concord. a contra costa county sheriff's deputy said he was leaning in the train and was talking to her when she ran down a sewage ton. that's when a firefighter was lowered down to help her. the woman was hoisted up and taken to the hospital for evaluation. santa clara county supervisors will try to close a $67 million deficit over the next fewer days. they will debate recommendations before they make a final vote on friday. one includes a sales tax hike approved by voters in november and another $21 million in concessions from unions. people who live in san francisco may soon have a say about how san francisco money is spent. san francisco is considering anyone 16 and older to decide how a million dollars in tax money will be spent.

a debate over gun dealers expected to top the agenda at a los gatos city council meeting tonight. council members are due to talk about an ordinance that would require a public hearing before a gun store could open. this comes after a gun store was able to open last november without a public hearing. later this morning, california lawmakers will consider limo safety bills from two bay area state senators. this is in response to last night's fiery limo crash on the san mateo bridge where five nurses heading to a wedding celebration were killed. a bill from ellen corbett would require two doors and two emergency window exits in the back of all windows. a separate bill from jerry hill of san mateo would require all limos to carry five extinguishers. -- fire extinguishers.

pam cook is in our newsroom to tell us what area is being affected by the b.a.r.t -- by the b.a.r.t. closures. >> this is between kato road and mills falls court. it's not far off the 880 in fremont. that stretch of road will be closed for one year for a b.a.r.t. project. the road will be colored and lash -- lowered an three new bridges will be -- and three new bridges will be built. in the long run, it sounds like it will be a very nice addition for the area. but in the short-term this could affect drivers. i want to check in with sal with more. >> a lot of people use this road to get through kind of a little bit of a shortcut. you won't be able to mention it

for another year. and then they will open it back up again. it won't affect 880 directly but people may not be getting off that ramp anymore. it's close to 880. speaking of the freeways. right now we're looking pretty good. it's a little bit heavy between walnut creek and oakland on 24 westbound. nothing you can't handle but this is the peak commute there. bay bridge toll plaza, the traffic has been getting a little bit better. it's backed up for a ten-minute delay at the toll. no problems getting on the upper deck of the bay bridge. if you are driving on the nimitz freeway, we had a couple of earlier issues. southbound 880 between 238 and fremont is moderately busy. let's go to rosemary. a weather day similar to what we had yesterday. we're off to a similar start this morning. we to have low clouds floating into the bay. isn't that a beautiful shot there. partly cloudy skies in and around areas like oakland, hayward, san leandro, reporting

immigration reform. last week, the senate voted to prevent a republican filibuster of the bill by an overwhelming margin of 82-15. the bill is supported by a bipartisan group of eight senators. and two of the republican senators from the group of 8 arworning that if the gop blocks this measure, the party will have a difficult time trying to retake the white house in the 2016 election. a full vote in the senate is expected for before july 4th. a group of nuns pushing for immigration reform traveling around the country will stop in bay area. they marched in bakersfield yesterday. they are nuns on the -- their nuns on. bus tour began in new york last month. this afternoon, the nuns have a meeting scheduled with silicon valley technology leaders in santa clara. some colorado fire evacuees are heading home today as arson investigators look for the cause of the deadly fire. now, the one near colorado springs has burned 16,000

you can see they are examining the body about to collect it. quite a few neighbors heard the crash that caused this accident and woke them up from sleep. one witness says they saw the driver of the car that you see to the left with the roof ripped off of it, they saw the driver stumble out. they asked what happened and who was driving. they didn't realize what he did according to neighbors. investigating and collecting evidence. this accident happened at 2:00 a.m. police say it appears the driver of that toyota avalon was driving at a high rate of speed, lost control and crashed into five parked cars. the 18-year-old driver survived but was rushed to the hospital. the passenger a 40-year-old man was trapped and the fire department had to use the jaws of life to free him but it was too late. he died at the scene. >> officers found a victim trapped on the passenger side of the vehicle. they had to call fire to come in and extract the victim.

avoid this area. now we're getting a look at the police sketch of the man that police say tried to kidnap a 10-year-old girl near the pacifica pier. alex savidge joining us live in pacifica to tell us more about the sketch of this suspect. good morning, alex. >> reporter: good morning. several neighbors say they are concerned about what happened to this little girl yesterday here in pacifica. she was forced to fight back against the man who police say was trying to kidnap her. ultimately, she was able to escape. now, this morning, pacifica police want you to take a close look at this sketch we're gonna show you here. the man they are searching for, described as white, likely in his 30s and last seen wearing jeans and a red checkered shirt. this attempted abduction happened about 4:30 yesterday afternoon near the pier at beach boulevard and santa rosa avenue. police say this man approached the 10-year-old girl and told her to come with him. and then he grabbed her. that's when this little girl punched the man and she was

early this morning, two sheriff squad cars caught fire after a brief chase in the east bay. investigators say a driver led the deputies on an 11-minute chase that ended on 880 near the university avenue exit right there. the patrol cars got tangled up in ice plants. then the engines caught fire. those deputies were not hurt. that driver they were chasing got away. another driver is facing drunk driving charges after a freeway crash in hayward, a horrible one, that injured four children. two of those victims were the driver's sewn stepchildren. this happened last night near the a street onramp. the church says the driver lost control of his car, hit a pickup truck and then cleared off the freeway and smashed into a large pole. >> the vehicles suffered significant damage, almost split in half. there were four children in the vehicle, at least two were ejected. those two children suffered

a mentally ill man dead and put two fremont officers on leave. the shooting happened yesterday morning. officers were called to help a woman who said her 53-year-old son was armed with a knife and was out of control. police say as two officers entered the family's home. , they were confronted by the suspect and shot him. there are no details on how the man threatened the officers. new this morning, as we avenue been telling you, the u.s. supreme court did not issue a ruling this morning on california's proposition 8. however, the court did rule against an arizona law that requires would-be voters to prove their citizenship. the court said that federal regulations trump state laws when it comes to voter registration. the federal law allows voters to register by filling out a form that asks if they are citizens of the united states.
