under way. alex joins us live to let us know what was said during opening statements. good afternoon. >>reporter: good afternoon. in court, prosecutors are painting joseph naso as a sexual predator with a history of violence towards women. today, jurors were shown a key piece of evidence. >>reporter: the murder trial of accused serial killer joseph naso began today with an opening statement from district attorney rosemary slote. she slowed pictures of the women naso is accused of killing and dumping and also showed a note found inside naso's home in 2010. i was a list of locations that correspond to places where victims were found. police say that note helped link

naso to killings as far back as 1977. prosecutors say naso net women during his work as a self-employed photographer. the district attorney told juries about naso's past convictions for rains, showing diary entries about the assault. >>reporter: naso could be put to death if convicted. the 79-year-old is representing himself at this trial, also he does have a public defender advising him. naso is expected to give an opening statement this afternoon. christian is in court right now and will have a full report tonight at 5:00 and 6:00. >> all right. thank you, alex. meanwhile, the victim in the rich hand high school gang rain trial says she has no recollection of the attack. the victim, being identified only as jane doe, was a

16-year-old sophomore at the time of the 2009 incident. today, she said she only remembers waking up with a severe headache and aching body. she spoke in a soft voice and did not make eye contact with her alleged attackers. police say she was beaten, raped, and sexually abuse affidavit leaving the school's homecoming dance. if convicted, the two men could face life in prison. a girl fought her way out of an alleged kidnapping yesterday, by a man looking like this sketch. investigators say the man approached the 10-year-old girl around 4:30. he reportedly tried to grab her and told her she was coming with him, but he punched him and ran away. understandably, kidnapping attempt has some parents on edge. >> surprising. shocking. you have to look o

kid. you have to look out for your family. >> the suspect is described as a white man in his 30s about 6 feet tall with a stocky build. a teenagerer is behind bars after being involved in a deadly car accident. police say he is responsibility for his coworker's death. janine, you've learned the driver may have been involved in another crime before the crash? >>reporter: that's right. police believe there's a connection between the two men who were reportedly stealing beer from a convenience store about a mile from here. alcohol was involved, and they think there's a connection. you can see all lanes here are back open after being shut down. >>reporter: police are trying to figure out how fast the driver of this mangled toyota avalon was traveling when he crashed into a row of cars on foxworthy

drive at 2:00 this morning. a witness said the 18-year-old driver stumbled out of the car. a passenger, a 40-year-old man was trapped inside. >> when officers responded on the scene, they found a victim trapped in the passenger side of the vehicle. they had to call the fire in to extract the victim. he was pronounced dead. >>reporter: police say the driver had injuries to his face and will survive. officers on the scene found several beers inside the vehicle. they have arrested him. investigators are trying to determine if he is connected to a crime that occurred a mile away at the 7-eleven. managers here say two men stole a case of beer just before the accident occurred. officers were collecting surveillance video. neighbors say it's hard to believe that one car did all the damage. they say it makes them think twice about drinking and driving. >> that's pretty surprising, you

know. i was hoping nobody had gotten really, you know, hurt. it's really sad. >> it makes me not want to drink. >>reporter: police tell us the driver and passenger were coworkers at a local rest flaunt san jose. we went to that restaurant. the manager confirmed his workers are involved. he says they're in shock. you can see one of the coworkers stopped by here in the last five minutes and dropped off those flowers. he was pretty shaken up. even though it was his day off, he said he was going to be in and wanted to be around his grieving who coworkers. the coroner has not released the identity yet. >> thank you, janine. in the east bay, a driver is facing drunk driving charges after a freeway crash that injured four children and two of

those victims were the driver's step children. the accident happened at 10:00 last night near the a street onramp in heyward. the chp says the driver lost control of the car, hit a pickup truck and veered off the freeway and smashed into a large pole. >> the vehicle suffered significant damage, almost split in half. there were four children in th vehicle. two were ejected. they suffered major injuries. >> two other children suffered minor injuries. an adult passenger was not hurt. officers arrested the driver on suspicious of drunk driving. two sheriff's squad cars caught fire after a brief chase this morning. investigators say the driver led the deputies on an 11-minute chase that ended on interstate 80 in berkeley. the patrol cars caught fire. the deputies were not hurt.

the driver got away. in just about an hour, california law makers are set to consider limo safety bills from two state law makers. the legislation comes in response top last month's fiery limo tragedy that killed five nurses. a bill would require two doors and two emergency window exits in the back of all limos. a separate bill from democrat jerry hill would require all limos to carry all extinguishers. the supreme court did not issue a ruling on california's proposition 8 during its session this morning. it is likely that a ruling won't come down on california's ban on same sex marriage until next monday. the court issues five rulings on other cases but not prop 8. they're expected to rule before the session ends this month. an east bay lawmaker today

firefighter are battling a wildfire this amp, afternoon. the fire is burning near mariposa near highway 140.

it started yesterday afternoon and is being fuelled by high wind. about 150 homes are threatened, and people in the area have been ordered to evacuate. we just checked, and 900 acres have burned. in colorado, firefighters are still bat tailgate black forest fire, but they're getting promises news from the front lines. some help from the weather gave firefighters the edge they needed to start making major progress on this blaze. >> i'm pleased to report because of the activity, both of the day crews, we're going to bump containment up to 65. >>reporter: the commander got a round of applause when he announced the progress. >> they have work sod hard. >> the firefighters in the field are doing a good job of hitting

ways to help way for the nearly half a billion dollar debt incurred from the stadium renovation. officials had planned to special seats to help pay off the debt. but the latest figures show so far sales have fallen far short of the 2900. the chronicle reports some people have actually backed out of their ownership deal. the oakland police department's lobby is open for business again. it's been closed for most of the past two weeks after a toilet broke on the third floor and caused damage on that floor and the two floors below. the building opened briefly, but it was closed down again until the repairs could be finished. the san francisco mayor is

stocks pay gains, after rising more than 1% today. the federal reserve will reenforce this week it's excitement to supporting the economic recovery. that two-day meeting begins tomorrow. the dow is currently up 61. rising interest rates on moment mortgages could be good news. right now mortgage rates are hovering near the 4 % mark. that's up a half percent in the last month. some analysts say that could enforce some investors to step aside. currently many families are being outbid by investors. netflix is announcing plan to run original series from
