move to the south bay. robert handa has a copy of the lawsuit. >> reporter: good afternoon, tori. this is the actual lawsuit filed a little more than an hour ago by the city of san jose against major league baseball for blocking the as move to san jose. you can see the filing stamp on there. again, san jose says it just got tired of waiting. so they filed the lawsuit today in federal court to try to bring the as to san jose. it's something they've started since about 2004 and even with the blue mlb looking into it, they feel nothing has happened and now they feel they have a good and strong case. >> we have laws that allow people like the city of san jose to go challenge bud selig and his "blue ribbon commission." >> reporter: what about the anti-trust issues? >> well, those go back to the 1920s when baseball was given

wanted to speak publicly but we've seen some family members express cone dole lenses on facebook. this is a picture of the boy from a family facebook page. he's identified as 6-year-old they have selu -- nephi selu. he's from dixon but he was here when the dog bite happened. police say yesterday morning before 11:30, they received a call about the dog bite. when officers arrived, they saw paramedics treating a child for the wound to the head inflicted by one of the family dogs described as a pit bull mix. >> it sounds like they were engaged in some type of horse play with the dog, certainly the boy that was bitten. we think he may have been trying to ride it like a little horse. and for whatever reason, the dog decided to bite him. >> reporter: police say the dog was very quickly pried off by the family members but unfortunately, the boy suffered

major injuries. police say the boy was airlifted to lucile packard hospital where he was pronounced dead. neighbors say the family had been good neighbors. there's never been any trouble at the house before. many said they were aware of the presence of a pit bull as a pet but never saw the dogs being aggressive. >> it's just heartbreaking. i've talked to a couple neighbors. we're all heartbroken it had to go to this extent, you know, and the little boy had to lose his life. >> reporter: now, we just did see someone go into the house but again they are not talking to us. that's understandable they wouldn't want to talk or say anything publicly. >> public -- publicly. as for the dog, there were two of them. both are at the animal shelter in fremont where they will be under quarantine for ten days as the investigation continues. sal castanedo, ktvu channel 2 news. >> thank you, sal. b.a.r.t. police are investigating the death of a person struck by a

train at the colma b.a.r.t. station this morning. b.a.r.t. says it was reported just after 9:00. police would not speculate about how the person came to be on the tracks. we don't know the person's name or even weather the victim was male or female. but the accident did cause delays for a couple of hours. >> the trains are being held out of the colma station until we investigate what happened. there will be a delay for at least 15 minutes. >> we've now learned that the person's body has been removed and trains are running on time. the man who went on a naked rampage at a san francisco b.a.r.t. station is set to make his first court appearance just over an hour from now. 24-year-old yener perez was arrested yesterday and is charged with felony false imprisonment and sexual battery. this is video of perez at the 16th street b.a.r.t. station last month where he harassed passenger and b.a.r.t. workers. perez is being held on $100,000 bail. the former acrobat is facing

deportation to his native colombia. in marin county, a patrol officer gave what could be damaging testimony against joseph naso. naso is defending himself against murder charges that he murdered four women. naso's parole officer testified that he found a list of women and he says he believes this was a list of murder victims. a one-alarm fire was reported this morning at a construction site at san francisco general hospital. ktvu's alex savidge joins us live to explain what happened and if any patients were in danger. >> reporter: good afternoon. no patients were put in danger. i got an update from the spokesperson for the fire department. she said as for the cause, she's not sure what happened. she said it was either electrical work or welding work

happening inside an elevator shaft in this new san francisco building under construction right next to the current hospital. this fire forced 300 workers to evacuate the job site. you can see some light smoke coming from the 9th floor of this -- again, this building under construction right now. fire started about 9:30 this morning. seven construction workers were treated for smoke inhalation. some of them taken away by paramedics to be checked out. two of them went to the emergency room at san francisco general right next door. there was one firefighter treated for a shoulder injury as well. some of the smoke did drift into the existing hospital but a spokeswoman said the fire did not impact hospital operations. >> we also know that the hospital is not on fire. there's no risk of the hospital catching fire and there's no interruption to patient care. that's a completely separate area. this was contained on the construction site. >> reporter: that new san

francisco general hospital building is set to open in 2015. the hospital spokesperson said she was unsure if the fire would delay construction. we did see a lot of construction workers leaving this area, but we're told they will be -- they will be back on the job later today. alex savidge, ktvu channel 2 news. >> thank you, alex. a motorcyclist involved in a crash with a bus on a busy san francisco freeway this morning has died. the make was hit by a small -- the motorcycle was hit by a small bus on the silver avenue exit. no passengers were on the private bus. the driver was not injured. the motorcyclist was rushed to san francisco general hadn't where he died. the chp closed at least two lanes of 101 for about two hours while crews were at the scene. the cause of the crash is under investigation. san jose police are asking for the public's help as they investigate a hit-and-run crash that killed a bicyclist. police found the victim on

taylor street near highway 87 at about 3:25 yesterday afternoon after several people called 911. police say the driver left the scene but did leave behind what appears to be a white bumper. today we talked to a bicyclist who says the area is not safe right now. >> normally, i cross at heading. but right now heading is being repaved. yeah, this 100 yards or so between here and the red light is not super safe. >> so far, there's still no word on the identity of the bicyclist killed. new street lights are going up all across oakland with a goal to help prevent crime. the city is installing 30,000 new l.e.d. lights. they are designed to provide better lighting with less glare and fewer dark spots between light poles. the crime-fighting tactic also has financial benefits. >> we'll save money in the long run. it won't cost the citizens anything and that the most important thing is it will be a

safer environment for crime and traffic. >> we know that in places in oakland that there's insufficient street lighting, that in other places where there's street lighting, it isn't bright enough. >> these lights will change that. >> this is part of a nearly $15 million project. it's expected to be completed in december. smoking may soon be banned in one bay area city. tonight, walnut creek officials are scheduled to consider a citywide ban. if approved, smoking would not be allowed in the downtown shopping area, city parks and even on the patios and condo areas of apartment complexes. meanwhile, fewer people in the u.s. are smoking. only about $18 -- only about 18% of adults consider themselves smokers. that's down 3% from the year before. health officials are still trying to figure out the reason behind the decline. but they note that the agency

crystal geyser. then we deliver it directly to you. an investigation is happening this hour in sunnyvale after police discovered a body inside a burned home from a fire. janine de la vega has more. janine, what's happening? >> reporter: they've been looking through debris. they want to know how this fire started and who died. the body is still inside. the coroner has just arrived to examine the body and remove it. neighbors want to know if it's the woman who lives here. this is cell phone video of the house taken shortly after 6:00 a.m. neighbors say it looked like a fireball. >> massive orange flames shooting all the way to the

sidewalk almost. the whole house was completely engulfed. >> reporter: hume plumes of black smoke billowed above the neighborhood. firefighters say when they arrived, they could not enter because it was too dangerous. the flames traveled fast throughout the house which was about 800 square feet. it threatened the two adjacent houses but firefighters were able to contain the fire. >> made an aggressive attack on the fire. extinguished the fire and at which time we discovered a body that was deceased in the kitchen. >> reporter: neighbors were in disbelief. they say a woman in her mid-50s lived in the house. she's well liked and hold as prayer group once a week there. >> it's really sad to hear that she was -- it was possibly her in there. i can't imagine it being anybody else. she lives alone. the sweetest -- the sweetest person. >> reporter: investigators with the department of public safety have not identified the body. authorities say it's likely that the victim died from the

padres at 7:15. there's new controversy surrounding the america's cup yacht race. the head of new zealand's team is accusing the swedish team as using the death of one of the members as a competitive gain. the team will likely miss the first race and the captain says that gives them an advantage. the ceo of the swedish team issued a formal response saying the public insults are out of line and unsportsmanlike. the derogatory anallygies -- an algaes should be left on -- an algaes should be left on the dock. several organizations are pushing richmond city council to file a lawsuit against chevron. today, the county is expected to -- the council is expected to file a suit over damages

caused from. he refinery fire that sent 15,000 people to hospitals. the city had given chevron time to cup up with its own compensation package but so far, no agreement has been reached. richmond has not set how much compensation would be enough. a wildfire in the sierra continues to burn. it's burned 1600 acres. this is on the main route to yosemite park. it remains opened. an evacuation has now been expanded to about 350 homes that are threatened in mariposa county. fire officials say so far no structures have been damaged or destroyed. hundreds of additional firefighters were called in overnight to help battle the fire which is still 15% contained. a cooler day is underway. for many of us, it's more about

the winds. quite breezy in some areas. the winds have picked up in the last couple of hours. have been blowing strong over mt. diablo and in our hills. mount debe a clocking -- mt. diablo clocking 50 miles an hour. there's a system off the coast of oregon but sliding to the east. this will take a day before it moves inland and pushes off. in the meanwhile, we'll continue with the onshore breeze, the cooler weather and temperatures are expected to be anywhere from five to 10 degrees below what we fell to yesterday. i want to zoom in a little bit closer. you can see a few high clouds passing over the last couple of hours. you may have noticed those from up above. you may have noticed we cleared out. a lot sooner in locations. because the low clouds were disrupted by the system bringing us the breezy condition and cooler temperatures. fairfield, 21 miles per hour with the winds.

stocks are up sharply at the end of trading due to a pick up in home building and low inflation. investors are remaining optimistic that the fed will keep its stimulus program in place. we should get a hint about that after the meeting ends. right now the dow is up 151. the nasdaq is up 33. s&p up 13. well, chrysler ended a showdown with government regulators late this morning and issued a huge gas tank

recall for older jeeps. the automaker had previously balked at the recall for two and a half million jeeps. 51 people have died in accidents involving jeep cherokees and liberties because of gas tank fires. but chrysler said the vehicles met safety standards when they were built and called the recall unfair. todd speaker joined other silicon valley leaders to pledge millions of dollars to help bring the international swimming hall of fame to santa clara. currently, the hall of fame is located in fort lauderdale, florida. but its lease expires in 2015 and the nonprofit that operating -- that operates the hall of fame is looking for a new home. they have signed a stenttive deal -- tentative deal. they must raise $12 million for the project. today at 5:00, continuing coverage on the lawsuit just
